COUNCIL RESOLUTION
AGENDA MATTER:
ADOPTION OF RESOLUTION NO. ____-2025 TO DISESTABLISH PUBLIC IMPROVEMENT DISTRICT 83-1
EXECUTIVE SUMMARY:
The City Council established Public Improvement District 83-1 on March 19, 1985, to provide sewerage facilities to areas of West Barstow. Given that the facilities have now been constructed, the District is no longer necessary and should be dissolved. At its July 15, 2025 meeting, the City Council adopted Resolution No. 5219-2025, indicating an intention to disestablish PID 83-1. Now that the public has been notified and informed of the potential dissolution, the City Council may take the final step of adopting a Resolution to Disestablish PID 83-1.
DISCUSSION:
On January 21, 1985, the City Council adopted Resolution No. 2679-85, declaring its intention to form a public improvement district. Thereafter, on March 18, 1985, by adoption of Resolution No. 2689-85, the City Council created Public Improvement District 83-1 (the “District”) pursuant to the Municipal Improvement Act of 1913 and ordered assessments against the approximate 1,376 parcels within the District’s boundaries. The District assessed landowners in West Barstow for related costs of providing the sewerage improvements, appurtenances, and appurtenant work. On April 22, 1985, by Resolution No. 2702-85, the City Council authorized the issuance of bonds to represent and be secured by certain unpaid assessments. Since its inception, staff has diligently used the funds provided by the assessments to construct the anticipated sewer line, identified by three sections: Lenwood Interceptor, Sun ‘N Sky Interceptor, and the Lenwood Road Interceptor. Given the District has constructed the required facilities, has no outstanding debts, and no remaining funds, it is appropriate to dissolve the District.
This matter was originally brought to the City Council on May 20, 2025. Councilmember Hernandez expressed concerns regarding an approximate $750,000 payment that the City made to cover delinquencies in the account and sought additional information. The City Council then pulled the item and staff performed additional research.
Between 1993-2002, the City provided approximately $757,000 from the General Fund to fund PID-83 due to delinquencies. Due to payments from the County, in 2006, the City confirmed that all but approximately $210,000 was paid back. In 2005, the City sent a letter to the County auditor/tax collector asking that the County include the remaining delinquent parcels in the next tax sale. Based on the newest information the City has obtained, it appears that the balance of delinquencies is down to less than two hundred dollars.
At the City Council meeting on July 15, 2025, the City Council adopted Resolution No. 5219-2025, indicating an intention to disestablish PID 83-1. After that step, the City published a notice in the newspaper at least ten days before this hearing and sent notice by mail to affected property owners at least twenty days before this hearing.
Having completed the above steps, the City should open the public hearing, hear any comments and/or objections, and determine whether to adopt the attached resolution to disestablish PID 83-1.
