A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BARSTOW
PROCLAMATION OF EXISTENCE OF A LOCAL EMERGENCY AND CONCLUDE THE
LOCAL EMERGENCY
WHEREAS, Section 2.16.050 of the Barstow Municipal Code empowers the Director of Emergency Services/City Manager to proclaim a local emergency if the City Council is not in session and requires that the City Council shall take action to ratify the proclamation within seven days thereafter;
WHEREAS, conditions of extreme peril to the safety of persons and property arose within the City of Barstow, as a result of a sewer line break on a line serving Barstow High School, a critical public safety and instructional facility, caused by a sudden and unexpected sewer line by another utility,
requiring immediate repair to ensure to ensure safe sewer services are available to the students, faculty, staff, and community members who rely on Barstow Highschool; WHEREAS, the City Council of the City of Barstow was not in session at the time the above-described conditions arose;
WHEREAS, the City Council does hereby find that the above-described conditions of extreme peril did warrant and necessitate the proclamation of the existence of a local emergency in the vicinity of the City of Barstow;
WHEREAS, the City Manager acting as the Director of Emergency Services did proclaim the existence of a local emergency within the City on August 1, 2025; WHEREAS due to the severity of the situation and the immediate need to remedy the sewer line
formal competitive solicitation for bids as the bid process would take several weeks, at minimum, and the repairs needed to be completed immediately to ensure continued public health and safety for students, faculty, staff, and community members at the Barstow High School; WHEREAS, the City Manager acting as Director of Emergency Services, via authority in Barstow Municipal Code section 2.42.020(a) and the Barstow Purchasing Policy, entered into an agreement for emergency sewer line repair services for a total of $ 9587.95;
WHEREAS, the necessary interim emergency repairs were made via a patch as a temporarily repair, as a permanent fix will only be possible after GSW moves its utility line; exempt from review under the California Environmental Quality Act under CEQA Guidelines section 15301 as repairs to existing facilities;

WHEREAS, the City will enter into a formal competitive solicitation for bids to permanently repair the sewer line after GSW moves its utility line; and WHEREAS, the interim repairs have temporarily addressed the sewer line break and therefore the local emergency has concluded.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Barstow:
Section 1. That the Proclamation of Existence of a Local Emergency, as issued by the Director of Emergency Services/City Manager, is hereby ratified and confirmed.
Section 2. The City Council hereby declares the emergency has concluded.
Section 3. The City Council hereby directs the City Manager and City Attorney to pursue full cost recovery for these repairs from Golden State Water Company and any other responsible parties who caused the sewer line break.
Section 4. This Resolution shall take effect immediately upon adoption.
