AGENDA MATTER:
REQUEST FOR PUBLIC HEARING - DELINQUENT TRASH AND SEWER ACCOUNTS EXECUTIVE SUMMARY:
Staff requests that the City Council set the date, time, and place for the next delinquent sewer and trash (utility) accounts hearing for Tuesday, January 20, 2026, at 7:00 p.m. in the Council Chambers located at 220 E. Mountain View St., Barstow, CA 92311.
DISCUSSION:
The City of Barstow began billing for sewer and trash (utility) services in November 2020 for customers who receive trash services within the incorporated city limits and/or for those who are connected to the City's sewer system. Barstow Municipal Code (BMC) Sections 6.20.210 and 13.22.060 authorizes the periodic review of delinquent utility accounts. The code sections also authorizes the collection of delinquent amounts through the lien process, as well as constituting the delinquencies as a special assessment that can be assessed onto the property owner's tax bill.
Delinquent utility accounts are defined as those that have an unpaid (past due) balance after the delinquent (due) date. To properly notice those property owners who have a delinquent unpaid balance as of October 31, 2025, on their City of Barstow utility account, and pursuant to the BMC, staff is requesting the City Council establish the regularly scheduled meeting being held on Tuesday, January 20, 2026, at 7:00 p.m. in the City Council Chambers, located at 220 E. Mountain View St., Barstow, CA 92311, as the date, time, and place for hearing any objections or protests pertaining to delinquent trash and sewer accounts. City staff will send the required public hearing notice directly to delinquent property owners.
FISCAL IMPACT:
None.

AGENDA ITEM
AGENDA MATTER:
MODIFICATION TO PLANNING COMMISSION INTERVIEW PANEL REPRESENTATION EXECUTIVE SUMMARY:
At a previous City Council meeting, Council Member Williams and Mayor Pro Tem Rose were appointed to serve on the interview panel for the upcoming Planning Commission recruitment. Upon review of the applicant list, the Council Member notified staff that participation on the panel may give rise to a perception of bias due to prior interactions or relationships with one or more applicants. To maintain the integrity and impartiality of the interview process, staff is requesting that the City Council consider appointing an alternate Council representative.
DISCUSSION:
At the October 21, 2025, City Council meeting, the Council directed the City Clerk’s Office to initiate a recruitment process to fill an upcoming vacancy on the Planning Commission. As outlined in Ordinance No. 1024-2024, the established procedure includes forming an interview panel consisting of two City Council representatives and staff to review applications and conduct interviews.
Council Member Williams and Mayor Pro Tem Rose were selected to serve as the Council representatives on the panel. After receiving and reviewing the names of the applicants, Council Member Williams notified staff of concerns that their participation could create an appearance of conflict or compromise their ability to remain fully impartial.
To uphold the integrity of the interview process, staff is requesting that the City Council appoint another Council Member to serve on the interview panel in place of Council Member Williams. Interviews are currently scheduled for December 4 and December 8.
FISCAL IMPACT:
None.
RECOMMENDED ACTION:
Staff recommends that the City Council:
1. Accept Council Member William’s request to step down from the interview panel for the Planning Commission recruitment; and
2. Appoint an alternate Council Member to serve on the interview panel. 6 Packet Pg. 26
