AMENDMENT NO. 2 TO PARK MAINTENANCE AGREEMENT
(CITY OF BARSTOW AND
BARSTOW HEIGHTS COMMUNITY SERVICE DISTRICT)
EXECUTIVE SUMMARY:
The City Council is asked to consider approval of Amendment No. 2 to the Park Maintenance Agreement between the City of Barstow (“City”) and the Barstow Heights Community Service District (“District”). The original agreement, approved on October 27, 2020, expired on October 27, 2025. On October 21, 2025, the City Council approved Amendment No. 1, a 90-day extension of the agreement, establishing a new term end date of 11:59 PM on January 26, 2026, to allow staff to conduct a property tax analysis related to the agreement. Staff requests the City Council approve Amendment No. 2, which extends the agreement with the District on a month-to-month basis to allow negotiations to continue and correct the Assessor’s Parcel Number, legal description, and property address for Barstow Heights Park.
DISCUSSION:
On October 27, 2020, the City and the District entered into a Park Maintenance Agreement governing maintenance responsibilities for park facilities located within the District. The initial term of the agreement expired on October 27, 2025. At the October 21, 2025 City Council meeting, the City Council approved Amendment No. 1, a 90-day extension of the existing service agreement, extending the term through January 25, 2026. This extension was approved to allow staff time to conduct a property tax analysis and evaluate the fiscal impacts associated with the agreement.
Amendment No. 2 formalizes the continuation of the agreement by providing for an automatic month-tomonth extension following the expiration of the initial term and the previously approved 90-day extension.
Each monthly renewal period will commence on the 27th day of the month and expire on the 26th day of the following month, unless earlier terminated or otherwise extended by written agreement of the parties.
In addition, staff identified inaccuracies within Exhibit A of the original agreement, including an incorrect Assessor’s Parcel Number, legal description, and property address for Barstow Heights Park.
Amendment No. 2 deletes Exhibit A in its entirety and replaces it with a corrected Exhibit A-1. The amendment also corrects the park address referenced in the recitals, replacing “34574 H Street” with the correct address of “28075 Rimrock Road.”
Except as expressly modified by this amendment, all other terms and conditions of the original agreement remain unchanged and in full force and effect.

None. The amendment does not modify compensation, scope of services, or funding obligations under the existing agreement.
RECOMMENDED ACTION:
That the City Council approve Amendment No. 2 to the Park Maintenance Agreement between the City of Barstow and the Barstow Heights Community Service District, and authorize the City Manager to execute the amendment on behalf of the City.
