COUNCIL AGENDA ITEM
AGENDA MATTER:

FIRST AMENDMENT TO LEASE AGREEMENT WITH BARSTOW SENIOR CENTER TO AUTHORIZE

THIRD-PARTY EVENTS WITH ALCOHOL SERVICE
EXECUTIVE SUMMARY:

Staff recommends that the City Council authorize the first amendment to the existing lease agreement with the Barstow Senior Center (Senior Center) for the property at 555 Melissa Avenue. This amendment would allow the Senior Center and third-parties to host special events where alcohol is served, subject to enhanced insurance requirements, indemnification provisions, and compliance with the City's temporary use permit ordinance.

DISCUSSION:

The Senior Center currently operates under a lease agreement that does not explicitly authorize events involving alcohol service. The Senior Center has requested permission to serve alcohol at both its own events and third-party events it hosts, to enhance programming opportunities and generate additional revenue. This amendment would allow expanded community programming while incorporating comprehensive risk management measures to protect the City's interests. The proposed amendment:
 Requires $2 million in Commercial General Liability Insurance and adds a requirement for Liquor Liability Insurance
 Requires the Senior Center to indemnify the City for claims, demands, and liabilities for loss for third party events and events where alcohol is served.
 The Senior Center and any third-party hosting an event at the Center must obtain a temporary use permit, without exception.
 The City will pay 57% of the Senior Center's utility costs (sewer, water, gas, and electric) up to a cap of $42,000 per year, which will increase annually by three percent. The Senior Center must submit complete copies of the utility bills to receive payment.  Adds clarifying terms about repairs required by the Senior Center.  Add terms allowing for an annual inspection as well as at any reasonable time.

Because the First Amendment to Lease is amending the 2023 Senior Center Lease Agreement, it only includes sections where terms are being amended (i.e., Sections 3, 7, 8, 9, 10, 12, 18, and 19). All other terms of the lease remain the same. The First Amendment is an addition to the 2023 Senior Center Lease Agreement. Both documents together show the full lease terms. The revised sections in the First Amendment replace the matching sections in the original lease.
