AMENDMENT NO. 1 TO PARK MAINTENANCE AGREEMENT
(City of Barstow and Barstow Heights Community Service District) This Amendment No. 1 (" Amendment") to the Park Maintenance Agreement (" Agreement") is made on this 22nd day of October 2025 at Barstow, California, by and between the City of Barstow, a municipal corporation ("City") and Barstow Heights Community Service District, a Special District organized and operating under the provisions of Division 3, Title 6 of the Government Code of the State of California (commencing with section 61000) ( "District").
This Amendment modifies Section 1.a. of the Agreement between the City and the District dated October 27, 2020 in the following fashion:
a. The term of this Agreement shall commence at 12:00 a.m. on the October 27, 2020 and shall expire at 11:59 p.m. on October 27, 2025 ("Initial Term"), unless extended by written agreement of the parties. Upon expiration of the Initial Term, this Agreement shall automatically extend for an additional ninety (90) days, expiring at 11:59 p.m. on January 26, 2026, unless extended or terminated in writing sooner. The parties may mutually agree in writing to extend the Agreement for one additional ninety (90) day period beyond the first extension, which would expire at 11:59 p.m. on April 25, 2026.
TO EFFECTUATE THIS AGREEMENT, the parties have caused their duly authorized representatives to execute this Agreement on the dates set forth below. "City"

AMENDMENT NO. 2 TO PARK MAINTENANCE AGREEMENT
(City of Barstow and Barstow Heights Community Service District) This Amendment No. 2 (“Amendment”) to the Park Maintenance Agreement is made on this __ day of January 2026 at Barstow, California, by and between the City of Barstow, a municipal corporation (“City”) and Barstow Heights Community Service District, a Special District organized and operating under the provisions of Division 3, Title 6 of the Government Code of the State of California (commencing with section 61000) ( “District”).
WHEREAS, the parties acknowledge that the Initial Term of the Park Maintenance Agreement (“Agreement”) expired on October 27, 2025; and WHEREAS, at its October 21, 2025 meeting, the City Council approved a ninety (90) day extension of the Agreement via Amendment No. 1, extending the term through January 25, 2026, to allow staff to complete a property tax analysis related to the Agreement, after which staff will return to the City Council with additional information and proposed contract terms for consideration; and
WHEREAS, the parties desire to continue their business relationship while engaging in good faith negotiations to amend the Agreement; and
WHEREAS, the parties mutually agree to extend the Agreement on a month-to-month basis to provide flexibility and continuity of services during negotiations; and WHEREAS, Exhibit A to the Agreement contains an incorrect Assessor’s Parcel Number (“APN”), legal description, and property address for Barstow Heights Park; and WHEREAS, the parties desire to amend the Agreement to correct such APN, legal description, and address by replacing Exhibit A in its entirety with Exhibit A-1 attached to this Amendment.
NOW, THEREFORE, the parties agree that this Amendment No. 2 modifies the Agreement between the City and the District dated October 27, 2020 in the following fashion:
1. Section 1.a. is amended as follows:
a. The term of this Agreement shall commence at 12:00 a.m. on the October 27, 2020 and shall expire at 11:59 p.m. on January 26, 2026 (“Initial Term”), unless extended by written agreement of the parties. Upon expiration of the Initial Term, this Agreement shall automatically renew on a month-to-month basis, with each monthly renewal period commencing on the 27th day of each month at 12:00 a.m. and expiring on the 26th day of the following month at 11:59 p.m., unless earlier terminated or otherwise extended by written agreement of the parties.
2. Exhibit A (Legal Description) is deleted and replaced in its entirety with Exhibit A-1, incorporated herein, for the purpose of correcting the Assessor’s Parcel Number, legal description, and property address for the Barstow Heights. The reference to “34574 H 420721.3 Page 2 of 3
Street” as the address for Barstow Heights Park in the second Recital shall be deleted and replaced in its entirety with “28075 Rimrock Rd.”
3. Except as expressly modified herein, all other terms and conditions of the Agreement remain unchanged and in full force and effect.
