ORDINANCE NO. 1041-2026
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BARSTOW AMENDING CHAPTER 5.40 OF THE BARSTOW MUNICIPAL CODE
REGARDING OUTDOOR VENDING REGULATION
The City Council of the City of Barstow ordains as follows:
SECTION 1. Findings.
WHEREAS, the City finds that the vending of prepared or pre-packaged foods, beverages, and merchandise outdoors may pose unsafe conditions and special dangers to the public health, safety, and welfare of residents and visitors.
WHEREAS, the City finds that state law, specifically Government Code section 51036 et seq., limits the authority to regulate persons who sell food or merchandise from pushcarts, stands, displays, pedal-driven carts, wagons, showcases, racks, and other nonmotorized conveyances, or from one’s person, upon public sidewalks, pedestrian paths, and parks (“sidewalk vendors”).
WHEREAS, the City finds it necessary to regulate sidewalk and other outdoor food vendors to address objective public health, safety, and welfare concerns associated with outdoor vending, including, without limitation, food safety and sanitation; physical obstructions to pedestrian traffic; inadequate clearance for wheelchairs, walkers, and other mobility devices; obstructed sightlines at intersections, crosswalks, and driveways; congestion and queue formation that impedes building exits, emergency vehicle access, and emergency evacuations; noise; blocked fire hydrants; fire hazards; hazards posed by vending equipment; improper disposal of trash and wastewater; and sale of agerestricted items to minors.
WHEREAS, the City finds that outdoor food vending by persons not operating upon public sidewalks, pedestrian paths, and parks (“non-sidewalk vendors”) has proliferated throughout the City and raises similar public health, safety, and welfare concerns as those raised by sidewalk vendors.
WHEREAS, the City finds that Government Code section 51036 et seq. does not apply to the City’s regulation of non-sidewalk food and other vendors.
WHEREAS, the City finds it prudent to amend Chapter 5.40 of the Barstow Municipal Code to distinguish between sidewalk vendors and non-sidewalk vendors and establish reasonable time, place, and manner restrictions for each category of vendors consistent with state law to protect and promote public health, safety and welfare.
SECTION 2. Municipal Code Amendment. Chapter 5.40 of the Barstow Municipal Code, titled, "Sidewalk Vending Permit" is hereby renamed “Outdoor Vending” and amended as follows with additions denoted in underline and deletions noted in strikethrough:
