AGENDA MATTER:
AMENDMENT NO. 2 TO AGREEMENT NO. 15-100118 AND THE MEMORANDUM OF
UNDERSTANDING (MOU) FOR THE RELINQUISHMENT EARMARKED FUNDS BETWEEN THE CITY
OF BARSTOW AND SAN BERNARDINO COUNTY TRANSPORTATION AUTHORITY (SBCTA) FOR
THE NORTH FIRST AVENUE BRIDGES OVER THE MOJAVE RIVER/OVERFLOW PROJECT EXECUTIVE SUMMARY:
The City of Barstow and San Bernardino County Transit Authority (SBCTA) entered into Project Funding Agreement 15-100118 on March 4, 2015, to fund the North First Avenue Bridge over Mojave River.
Bridge No. 54C-0089. A federal earmark request was made to Congressman Obernolte in Fiscal Year 2023 and SBCTA was granted $2,000,000 ($2M) in Community Project Funding/Congressionally Directed Spending (CPF/CDS) toward the project with an obligation deadline of September 30, 2026. SBCTA will now relinquish the $2M award for the project to the City of Barstow. City Staff has identified a need for the additional $2,000,000 in project funding for the right-of-way (ROW) Phase of the N. First Ave Bridges over the Mojave River/Overflow project.
DISCUSSION:
The City entered into Agreement No. 15-1001118 with SBCTA in 2015 securing $3,178,871 of Measure I Major Local Highway Program (MLHP) funding. Amendment No. 1, which occurred in 2019, updated the project scope and added the Mojave River Overflow Bridge to the project. Additionally, an additional allocation of $4,255,014 was approved for the project, bringing the total of MLHP funding to $7,403,885.
The City, with the assistance of the SBCTA (San Bernardino County Transportation Authority) Team, successfully secured an additional $2,000,000 ($2M) in project funding from Community Project Funding/Congressionally Directed Spending (CPF/CDS) with assistance from Representative Obernolte’s Office. The CPF/CDS funding has a reimbursable rate of 80% and has an obligation deadline of September 30, 2026. The CPF/CDS funds will be obligated to the right-of-way (ROW) phase of the project. The relinquishment of funding for consideration by the City Council would accept the relinquishment of these funds from SBCTA to the City, with the City responsible for administration of the $2M award from CPF/CDS and other funding sources listed in the Agreement for the project.
Acceptance of the Memorandum of Understanding (MOU) for the change of awardee allows City Staff to appropriately obligate and ultimately spend and request reimbursement of CPF/CDS funding.
Additionally, acceptance of Amendment No. 2 to Agreement 15-1001118 will bring the total available funding amount to $9,403,885 and extend the agreement termination date from June 30, 2026, to December 31, 2030, bringing the project timeline into alignment with project milestones.
FISCAL IMPACT:
Amendment No. 2 to SBCTA Agreement No. 15-100118 for North First Avenue Bridges Over the Mojave River and Overflow would provide an additional $2,000,000 in project funding. The funding would provide a reimbursement at the rate of 80% for right-of-way (ROW) Phase.
