CITY COUNCIL RESOLUTION NO. ____-2026
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BARSTOW, CALIFORNIA APPROVING REVISIONS TO THE CITY’S
ENCROACHMENT PERMIT AND TRENCHING SPECIFICATIONS
POLICIES
WHEREAS, Barstow Municipal Code, Title 12, Chapter 12 requires encroachments permits for excavation, construction, installation or maintenance of any improvement, structure or encroachment in, on, over or under any street without first obtaining from the City Engineer a permit therefore (“Encroachment Permit”) (Sec.
12.08.020(a)); and
WHEREAS, as a condition of the Encroachment Permit, the City Engineer shall require all excavation and encroachment work to be performed in compliance with the City’s encroachment permit and street trenching specifications policies, as adopted by resolution of the City Council (Sec. 12.08.020(f)); and WHEREAS, the City Council of the City of Barstow desires to adopt revisions to the City’s policies; as described in the revised Encroachment Permit and Trenching Specifications Policies (“Policies”).
NOW, THEREFORE, the City Council of the City of Barstow does hereby resolve as follows:
SECTION 1. Recitals. The City Council finds that all the facts, findings, and conclusions set forth above in this Resolution are true and correct.
SECTION 2. Encroachment Permits and Trenching Specifications.
Encroachment Permits and Trenching within City streets, highways, and rights-of-way shall conform to the Encroachment Permits and Trenching Specifications Policies attached hereto as Attachment A and hereby approved by the City Council.
SECTION 3. Franchise Utilities and Prior City Ordinances. The City Manager is authorized to enter into memoranda of understanding modifying the requirements of the Trenching Specifications Policies, but only if, and only to the extent, necessary to comply with utility franchise agreements previously approved by the City Council by ordinance.
SECTION 4. Severability Clause. Should any section, clause, or provision of this Resolution be declared by the Courts to be invalid, the same shall not affect the validity of the Resolution as a whole, or parts thereof, other than the part so declared to be invalid.
SECTION 5. CEQA. The City Council finds the adoption of this resolution is exempt from review under the California Environmental Quality Act (“CEQA”) because it relates to Category Exemptions for minor repairs, maintenance, or alterations for existing facilities and permit is ministerial and the trenching specifications do not have a significant 432290.3 2
