COUNCIL AGENDA ITEM
AGENDA MATTER:

CONSIDER APPROVAL OF AMENDMENT TO THE PROFESSIONAL SERVICES AGREEMENT FOR

CODE ENFORCEMENT AND CITY PROSECUTOR SERVICES BETWEEN CITY OF BARSTOW AND

DAPEER, ROSENBLIT, & LITVAK, LLP
EXECUTIVE SUMMARY:

DISCUSSION:

For several years, the City has contracted with the law firm Dapeer, Rosenblit & Litvak, LLP for code enforcement services. The current contract dates back to 2003. A copy of that agreement is attached as Exhibit 1. The scope of work remains focused on code enforcement and includes responsibilities of working with staff to identify and development code compliance cases, and prosecuting such in court and other appropriate proceedings.

The scope of work under the proposed agreement remains unchanged. The amendment addresses the continuing term of the agreement and an update to the hourly rate for all regular services at $295 per hour.

These updates ensure that the agreement reflects current legal requirements, aligns with the City’s administrative structure, and provides a more robust framework for managing the code enforcement. A copy of the amendment is attached as Exhibit 2.

Attachment 1 - Professional Services Agreement for Code Enforcement Services Attachment 2 - Amendment to Professional Services Agreement for Code Enforcement Services FISCAL IMPACT:

The updated rates in the amendment to the Agreement are $295 per hour.

RECOMMENDED ACTION:

Staff recommends that the City Council approve the Amendment to the Professional Services Agreement with Dapeer, Rosenblit & Litvak, LLP for Code Enforcement and City Prosecutor services, and authorize the City Manager to execute the agreement.
