AGREEMENT TO PROVIDE CODE ENFORCEMENT SERVICES
FOR THE BARSTOW FIRE PROTECTION DISTRICT
This BFPD Agreement Dated: May __, 2026 (the "BFPPD Agreement") to the Provide Code Enforcement Services for the Barstow Fire Protection District (“BFPD”) is entered into by and between the Barstow Fire Protection District , a a subsidiary district of the City of Barstow ("City"), and Dapeer, Rosenblit & Litvak, LLP ("Firm") (BFPD, City and Firm collectively shall be known as the “Parties”.).
RECITALS
A. City and Firm are parties to that certain Agreement to Provide Code Enforcement Services for the City of Barstow, effective as of September 15, 2003 (the "Agreement").
B. The Agreement includes Exhibit A, entitled "Proposal to Provide Code Enforcement/Prosecutor Services," which describes the services to be provided and the thenapplicable proposed fees and costs.
C. The City and Firm amended the Agreement on May __, 2026 (“Amended Agreement”), to update the Firm's compensation, and confirm the continuing term of the Agreement between City and Firm;
D. The Parties desire to add services for the Barstow Fire Protection District, and confirm the Amended Agreement applies to the BFPD, and appoint Firm as prosecutor on behalf of the BFPD.
NOW, THEREFORE, in consideration of the mutual promises contained in the BPFD Agreement, the parties agree as follows:
AMENDMENT
1. Scope of Services; Barstow Fire Protection District. In addition to the services described in the Agreement and Exhibit A thereto, and the Amended Agreement, Firm shall provide code enforcement and related services to, for, and on behalf of the Barstow Fire Protection District.
Such services may be provided directly to the District's leadership and staff. Such services rendered shall be invoices separately to the BFPD Fire Chief.
2. All Terms and Conditions Same. All terms and conditions within the Amended Agreement shall apply to this BFPD Agreement as if stated in full herein.
3. Term. The BFPD Agreement shall continue in full force and effect unless and until terminated in accordance with its terms, including the termination provisions in Section 6 of the Agreement.
4. No Other Amendments. Except as expressly modified by this BFPD Agreement is ratified, reaffirmed, and remains unchanged and in full force and effect. If there is any conflict between this BFPD Agreement, the Amended Agreement and the Agreement, this BPFD Agreement shall control.
5. Counterparts and Electronic Signatures. This BFPD Agreement may be executed in counterparts, each of which shall be deemed an original, and all of which together shall constitute one instrument. Signatures transmitted electronically shall have the same force and effect as original signatures.
