TO AGREEMENT TO PROVIDE CODE ENFORCEMENT SERVICES
FOR THE CITY OF BARSTOW
This Amendment Dated: May __, 2026 (the "Amendment") to the Agreement to Provide Code Enforcement Services for the City of Barstow is entered into by and between the City of Barstow, a municipal corporation ("City"), and Dapeer, Rosenblit & Litvak, LLP ("Firm").
RECITALS
A. City and Firm are parties to that certain Agreement to Provide Code Enforcement Services for the City of Barstow, effective as of September 15, 2003 (the "Agreement").
B. The Agreement includes Exhibit A, entitled "Proposal to Provide Code Enforcement/Prosecutor Services," which describes the services to be provided and the thenapplicable proposed fees and costs.
C. The parties desire to amend the Agreement to update the Firm's compensation, and confirm the continuing term of the Agreement.
NOW, THEREFORE, in consideration of the mutual promises contained in the Agreement and this Amendment, the parties agree as follows:
AMENDMENT
1. Scope of Services. The services described in the Agreement and Exhibit A thereto remain unchanged.. 2. Compensation. Section 3 of the Agreement and Section 4 of Exhibit A are amended as follows:
(a) Regular Services. Except as provided in subsection (b) below, Firm's fee for professional services performed under the Agreement, including services performed for the District, shall be $295.00 per hour for all services. (b) Special Services. Notwithstanding subsection (a), special services referred to Firm with the approval of the City Attorney or City Manager shall be billed at the standard rate for such services in the City of Barstow and surrounding area. (c) Billing Procedures and Costs. Except as expressly amended by this Section 2, the Agreement's billing procedures, monthly statement requirements, cost reimbursement provisions, and extraordinary expense approval requirements remain unchanged.
3. Term. The Agreement shall continue in full force and effect unless and until terminated in accordance with its terms, including the termination provisions in Section 6 of the Agreement.
4. No Other Amendments. Except as expressly modified by this Amendment, the Agreement is ratified, reaffirmed, and remains unchanged and in full force and effect. If there is any conflict between this Amendment and the Agreement, this Amendment shall control.
5. Counterparts and Electronic Signatures. This Amendment may be executed in counterparts, each of which shall be deemed an original, and all of which together shall constitute one instrument. Signatures transmitted electronically shall have the same force and effect as original signatures.
