PUBLIC HEARINGS:

4. RESOLUTION APPROVING A REQUEST BY BURRTEC WASTE INDUSTRIES FOR A

CONSUMER PRICE INDEX (CPI) INCREASE
Recommended Action:

Conduct the Public Hearing and subject to testimony received, adopt Resolution No. 5289 - 2026, approving a request by Burrtec Waste Industries for a Consumer Price Index (CPI) increase of

3.28% to existing rates for waste collection and recycling services and waive the full reading.

ADMINISTRATIVE ANALYST TAYLOR BRITT provided the report as filed to the City Clerk's office.

MIKE HERNANDEZ, BARSTOW, CALIFORNIA

Minutes-June 16, 2026

Page 5 of 17 ends

MAYOR SILVA closed the public hearing at 8:00 p.m.

MAYOR PRO TEM NOBLE
- Asked about the profit generated from recycling.

ADMINISTRATIVE ANALYST TAYLOR BRITT
- Clarified that the annual report indicates it costs more to process recycling than the profit generated. She noted that she can provide those specific numbers if necessary.

CITY ATTORNEY ANDREW L. JARED
- Explained that the reason there is not a public hearing regarding the increase tonight is that a public hearing was held several years ago, as required. He added that the rate study initiated the process for annual Consumer Price Index (CPI) rate increases.

CITY MANAGER ROCHELLE CLAYTON
- Clarified that the rate increase requested by Burrtec is $1.71 on the monthly rate to customers, resulting in a total increase of 3.28%.
- Stated that there is currently approximately a $500,000 surplus, and the cost of the 3.28% increase is estimated to be between $220,000 and $250,000, which the surplus can absorb. - Mentioned that Proposition 2018 was conducted in 2024 and covered 5 years. - Noted that if approved, this increase would take effect on July 1, 2026.

COUNCIL MEMBER HERNANDEZ
- Inquired if the surplus could be used for a one-time cost-of-living adjustment during this period.

Motion made by MAYOR PRO TEM NOBLE to approve the request by Burrtec Waste Industries for a CPI increase of 3.28% to existing rates for waste collection and recycling services and a rate increase of $1.71.

SUBSEQUENT motion made by MAYOR SILVA, seconded by COUNCIL MEMBER HERNANDEZ, to approve the CPI increase of 3.28% to Burrtec but to hold off on the residential rate increase of $1.71 to the public at this time.

COUNCIL MEMBER HERNANDEZ
- Expressed concerns about fairness, stating that it is not right to place this burden on residents when there is a surplus, especially given the current rate of inflation at 4.2%.

MAYOR SILVA
- Added that since there is a surplus, the rate not increasing for this one year would maintain the surplus. He expressed that it would not be fair to pass the rate increase to residents at this time.

COUNCIL MEMBER WILLIAMS
- Expressed the importance of ensuring that both the council and the community are focused on the future and understanding the costs associated with services.

COUNCIL MEMBER HERNANDEZ*
- Inquired whether it is true that landfill fees are decreasing. - Mentioned that there is pending legislation regarding organics, which will provide reimbursements to companies like Burrtec from the state.

Minutes-June 16, 2026

Page 6 of 17 ends

FINANCE DIRECTOR SYDNIE HARRIS provided the report as filed to the City Clerk's office.

Minutes-June 16, 2026

Page 13 of 17 ends

COUNCIL MEMBER WILLIAM
- Inquired about the process involved in projecting the budget.

FINANCE DIRECTOR SYDNIE HARRIS
- Explained that staff compiled data from several previous years, along with estimates received from various sources, including the county.
- Announced that the projected revenue across all funds is approximately $158,733,255, which represents a significant increase from the previous year, and detailed the various factors contributing to this rise that were not included in last year's projections.

MAYOR SILVA
- Requested clarification on the Statement of Investment Policy, specifically regarding the increase of the reverse purchase agreement from 10% to 20%, and asked for the rationale behind this change.
- Noted that in the Solid Waste calculations, the $1.71 figure was included in the proposed budget; adding revenues would decrease by about $250,000, which would bring the reserve down to around $250,000.

FINANCE DIRECTOR SYDNIE HARRIS*
- Clarified that the update aligns with the California State Investments Authority; therefore, when the city modified the investment policy, it referred to the California State Investments Authority’s guidelines, meaning any changes they implement must also be reflected in the city’s Investment Policy.

SPEAKERS

MIKE HERNANDEZ, BARSTOW, CALIFORNIA
- Expressed some concerns regarding the proposed budget presented.

MAYOR PRO TEM NOBLE
- Asked why certain funds are being transferred to the General Fund.

FINANCE DIRECTOR SYDNIE HARRIS
- Responded that this decision stemmed from recommendations by the council. While reviewing some costs, staff noticed splits between the General Fund and Measure Q, and therefore funds are being returned to the General Fund. These funds can be moved easily and make more financial sense, and staff will continue to evaluate what other funds can be transferred back.

CITY MANAGER ROCHELLE CLAYTON
- Emphasized the need for sustainability, considering the numerous additions to the budget, urging caution about what is assigned to Measure Q.

DISCUSSIONS

COUNCIL MEMBER WILLIAMS
- Commended staff for their diligent budget preparation and accurate projections, noting that the City of Barstow outperforms surrounding cities in this regard. - Thanked Council Member Hernandez for his leadership of the finance committee.

MAYOR PRO TEM NOBLE
- Agreed with Council Member Williams’ remarks and expressed gratitude to staff for their efforts.

MAYOR SILVA
- Requested clarification on the $4.3 million discrepancy observed in the year-over-year reserves from 2024 to 2026, as mentioned by Mr. Hernandez.

Minutes-June 16, 2026

Page 14 of 17 ends

FINANCE DIRECTOR SYDNIE HARRIS
- Explained that the items presented in the budgets are merely snapshots based on estimates.

The budget projected reflects anticipated balances at the end of the year before it concludes.

Once the year-end period passes, and the accounting books are closed and audited, staff then reviews and adjusts the actual balance, which might lead to changes between reporting periods.

However, staff strives to ensure accuracy in their projections.

CITY MANAGER ROCHELLE CLAYTON
- Clarified that the $6.2 million for Measure Q represents the beginning fund balance for Fiscal Year 2026, indicating the balance as of July 1, 2025.
