COUNCIL AGENDA ITEM
AGENDA MATTER:

AMENDMENT NO. 9 TO WASTE DISPOSAL AGREEMENT (WDA)
EXECUTIVE SUMMARY:

The proposed amendment to the Waste Disposal Agreement reduces landfill disposal rates for member cities and extends the agreement term through 2035 to align with the County’s landfill operator contract.

DISCUSSION:

Over the past year, representatives of the Waste Disposal Agreement (WDA) Cities and the County have been working to evaluate disposal rates and negotiate revisions to the existing agreement. These discussions were driven in part by changing regional waste disposal conditions, increased demand for landfill capacity throughout Southern California, and concerns among WDA member agencies regarding the difference between rates paid by WDA cities and those paid by other users of County landfill facilities.

As part of these discussions, the County considered options to address disposal rates for WDA member agencies while maintaining the long-term financial sustainability of the County's solid waste system. The resulting amendment provides a reduction in disposal rates for participating cities and establishes a rate structure that will continue to provide a discount from the published landfill Gate Rate.

Under the proposed amendment, the City's disposal rate would be reduced to 83% of the published Gate Rate, which is less than the current 85%. Based on the current Gate Rate of $49.49 per ton, the City's disposal rate would be approximately $41.08 per ton, resulting in a savings of approximately $0.99 per ton compared to the current WDA rate. Based off of last year's disposal tonnage, staff estimates that this reduction will result in annual savings of approximately $19,800 for the first year of the amended agreement.

The amendment also extends the term of the WDA through June 30, 2035, aligning the agreement with the term of the County's current landfill operator contract with Athens. Extending the agreement term provides greater certainty regarding future disposal services and allows WDA member agencies to continue working with the County on potential future evaluations of landfill operations, disposal rates, and long-term system costs.

Staff representatives from the WDA Member Cities participated in the negotiations leading to the proposed amendment and generally support its adoption as a practical solution that addresses the current needs of participating jurisdictions. Staff and the WDA will continue to monitor County actions Joint Special Meeting
