COUNCIL AGENDA ITEM
AGENDA MATTER:

RESOLUTION TO ADOPT FY 2026-2027 PROJECTS FUNDED BY SENATE BILL 1 (SB 1), THE ROAD REPAIR AND ACCOUNTABILITY ACT OF 2017
EXECUTIVE SUMMARY:

In order to be eligible for transportation funding under Senate Bill 1 (SB1), the Road Repair and Accountability Act of 2017, the City is required to adopt a project list annually by resolution.

DISCUSSION:

On April 28, 2017, the Governor signed Senate Bill 1 (SB1) which is known as the Road Repair and Accountability Act of 2017. By increasing per gallon fuel excise taxes, increasing diesel fuel sales taxes, and vehicle registration fees with inflationary adjustments to tax rates in future years, SB 1 will fund necessary road maintenance, rehabilitation, and critical safety needs on both the state highway and local roadway systems.

Beginning November 1, 2017, the State Controller began depositing various portions of funding into the Road Maintenance and Rehabilitation Account (RMRA). Each fiscal year, eligible cities and counties receive an apportionment of RMRA funds pursuant to State Highway Code 2032(h)(2) from the California Transportation Commission (Commission). The State Controller continuously apportions RMRA funds on a monthly basis to eligible cities and counties using a process and system similar to that of the Highway Users Tax Account (HUTA).

The RMRA receives funding from taxes imposed under the Road Repair and Accountability Act of 2017.

RMRA local streets and road allocations must be used for projects “that include, but are not limited to,” the following:

Road Maintenance and Rehabilitation
• Safety Projects
• Railroad Grade Separations
• Traffic Control Devices
• Complete Street Components
o To include active transportation purposes, pedestrian and bicycle safety project, transit facilities, and drainage and storm-water capture project in conjunction with any other allowable project.

RMRA funds may also be used to satisfy match requirements in order to obtain state or federal funds for eligible projects.

SB1 also contains non-obligatory intent language regarding the use of funds. “To the extent possible Joint Special Meeting

RECOMMENDED ACTION:

1. Staff recommends that the City Council approve Resolution No. XXXX-2026, adopting the FY 2026-2027 projects list (Exhibit A) funded by Senate Bill 1 (SB1) and waive the full reading.
