COUNCIL RESOLUTION
AGENDA MATTER:
CONSIDERATION OF APPOINTMENT OF QUALIFIED CANDIDATES TO CITY COUNCIL DISTRICTS 1 AND 2 IN LIEU OF ELECTION PURSUANT TO ELECTIONS CODE SECTION 10229 EXECUTIVE SUMMARY:
The nomination period for the November 3, 2026, General Municipal Election has closed. Because the incumbent for District 1 did not file nomination documents, the nomination period for that office was extended through August 12, 2026, pursuant to California Elections Code section 10225. The nomination period for District 2 closed on August 7, 2026.
California Elections Code authorizes the governing body, under specified circumstances, to appoint the sole nominee to an uncontested office in lieu of conducting an election for that office. Adoption of the proposed resolution would appoint the sole nominees to the respective offices, and those offices would not appear on the November 3, 2026 ballot.
DISCUSSION:
On July 7, 2026, the City Council adopted resolutions calling the General Municipal Election and requesting consolidation with the San Bernardino County Registrar of Voters for November 3, 2026.
The regular nomination period for City Council Districts 1 and 2 closed on August 7, 2026. Because the incumbent for District 1 did not file nomination documents, the nomination period for that office was extended through August 12, 2026, pursuant to California Elections Code section 10225. The nomination period for District 2 was not extended because the incumbent filed nomination documents by the August 7, 2026, deadline.
Following verification by the San Bernardino County Registrar of Voters, the City elections official certified that only one qualified candidate was nominated for each of the following offices:
• City Council Member - District 1; and
• City Council Member - District 2
The sole qualified nominee for District 1 is not the incumbent. However, California Elections Code section 10229 authorizes the City Council to appoint the sole qualified nominee to an uncontested office regardless of whether the nominee is an incumbent or a new candidate.
Pursuant to Elections Code section 10229, the City Council may take one of the following actions for each uncontested office:
1. Appoint the person who has been nominated; or
2. Direct that the election be held.
The City elections official published the notice required by Elections Code section 10229, advising the public of the uncontested offices and the courses of action available to the City Council. More than five 3 Packet Pg. 6

COUNCIL RESOLUTION
days have passed since publication of the notice. Accordingly, the City Council may appoint the sole qualified nominees to the District 1 and District 2 offices in lieu of conducting an election for those offices.
A person appointed pursuant to Elections Code section 10229 qualifies, takes office, and serves for the full term prescribed by law in the same manner as if elected at the municipal election.
FISCAL IMPACT:
Appointment of the unopposed candidates in lieu of election may result in a reduction in election-related costs associated with placing the City Council District 1 and District 2 contests on the November 3, 2026 ballot. The actual cost savings, if any, will be determined by the San Bernardino County Registrar of Voters based on costs already incurred and the remaining costs associated with the consolidated election.
RECOMMENDED ACTION:
Adopt Resolution No. XXX-2026 appointing the sole qualified nominees to the City Council District 1 and District 2 offices in lieu of election pursuant to California Elections Code section 10229. 3 Packet Pg. 7
RESOLUTION NO. XXX-2026
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BARSTOW, CALIFORNIA, APPOINTING THE SOLE QUALIFIED NOMINEES TO THE CITY COUNCIL DISTRICT 1 AND DISTRICT 2 OFFICES IN LIEU OF ELECTION PURSUANT TO CALIFORNIA ELECTIONS CODE SECTION 10229 WHEREAS, the City Council called a General Municipal Election to be held on November 3, 2026, for the election of members of the City Council representing Districts 1 and 2; and WHEREAS, the regular nomination period for the District 1 and District 2 offices closed on August 7, 2026; and
WHEREAS, because the incumbent for District 1 did not file nomination documents, the nomination period for that office was extended through August 12, 2026, pursuant to California Elections Code section 10225; and

WHEREAS, more than five days have passed since publication of the required notice; and WHEREAS, California Elections Code section 10229 authorizes the City Council to appoint the sole qualified nominee to an uncontested office in lieu of conducting an election for that office; and WHEREAS, the City Council has determined that appointing the sole qualified nominees to the District 1 and District 2 offices in lieu of election is in the best interest of the City.
