COUNCIL AGENDA ITEM
AGENDA MATTER:
APPROVAL OF SIDE LETTER AGREEMENT AMENDING CONTRACT LANGUAGE BPOA ARTICLE 29 OVERTIME
EXECUTIVE SUMMARY:
As part of the recently negotiated Barstow Police Officers' Association (BPOA) Memorandum of Understanding, language within Article 29: was modified to provide for overtime calculations based on Fair Labor Standards Act (FLSA) requirements. Under the revised language, certain paid leave hours, including sick leave and vacation leave, were not treated as hours worked when determining overtime eligibility.
DISCUSSION:
Under the previous MOU and previous practice, overtime eligibility was calculated based on all paid hours within the applicable work period, including hours worked as well as applicable paid leave such as vacation, sick leave, and holiday leave. The revised Article 29 language changed this calculation by more closely aligning overtime eligibility with Fair Labor Standards Act (FLSA) requirements, resulting in certain paid leave hours no longer being included when determining overtime eligibility.
After further discussion and review, the City and Association desire to enter into a Side Letter Agreement to revert to the previous contractual overtime language and calculation methodology. The Side Letter will provide that applicable paid leave hours will again be included when determining overtime eligibility, consistent with the practice in effect prior to implementation of the current MOU. The change will become effective as of July 1, 2026, following execution of the Side Letter agreement. In addition the City will review overtime payments affected by the implementation of the revised Article 29 language and reimburse affected employees for overtime compensation that was reduced or not paid as a result of the change in calculation methodology.
The proposed Side Letter is intended solely to address Overtime. All other provisions, wages, benefits, and terms and conditions of the current MOU will remain unchanged and in full force and effect. Staff recommend approval of the Side Letter to restore the precious overtime calculation methodology and provide consistency with the parties’ prior contractual practices.
