BARSTOW MANAGEMENT EMPLOYEES' ASSOCIATION (BMEA) SIDE LETTER-CONTRACT
AMENDMENTS
EXECUTIVE SUMMARY:
The City of Barstow and the Barstow Management Employees’ Association (BPME) have identified several provisions within the recently approved Memorandum of Understanding (MOU) that require clarification or correction to accurately reflect the intent and agreement of the parties.
Following a subsequent review of the final agreement, the parties identified several provisions that require clarification, as well as language that was inadvertently omitted from the final document. The proposed amendments clarify language related to the newly established longevity benefit, restore previously agreed upon language in the performance bonus, correct retiree medical benefit , and correct negotiated language pertaining to Sick Leave Balance and separation.
These amendments are intended to ensure the MOU accurately reflects the agreement and intent of the parties and provides clear and consistent language.
DISCUSSION:
Following approval of the successor Memorandum of Understanding (MOU), City staff and the Barstow Management Employees Association (BMEA) identified several provisions requiring clarification to ensure the final written agreement accurately reflects the parties negotiated intent.
Specifically, the longevity provision was intended to recognize both part-time and full-time City employment when determining eligibility. Following implementation of the successor MOU, the City received several questions regarding the application of this provision. As a result, the City and BMEA determined that additional clarifying language would be beneficial to accurately reflect the parties’ intent and minimize the potential for inconsistent interpretation or application.
In addition, language related to sick leave and the Performance Bonus that the parties intended to update during negotiations was inadvertently omitted from the final MOU.
The proposed amendments are intended to accurately memorialize the agreement between the City and BMEA, eliminate potential ambiguity in the administration of the affected provisions and benefits, and ensure the MOU accurately reflects the terms agreed upon by the parties.
FISCAL IMPACT:
No additional fiscal impact for FY 26/27
