RECOMMENDATION:

It is recommended that the City Council approve the proposed Stipulations and Award for Police Sergeant Jose Jimenez, which was made pursuant to the authority from the City Council given at the closed session meeting on October 26, 2022.

BACKGROUND:

This litigation concerns the pending workers’ compensation claim alleging a low back injury with DOI: 03/26/2019.

SETTLEMENT TERMS:

The salient point in the settlement agreement is as follows:
 City to pay Mr. Jimenez $32,687.50 to settle by Stipulations and Award at 27% PD (permanent disability) his workers’ compensation claim with DOI: 03/26/2019.

FISCAL IMPACT:

The City will save a significant amount in litigation cost and legal fees if the case does not proceed to trial based on the medical evidence. The cost of the settlement agreement will be paid out of the City’s Risk Management fund.
