SUBJECT: Settlement Agreement with CALPROMAX Engineering, Inc. for the Gage Avenue Bus Shelter Improvement Project
RECOMMENDATION:
It is recommended that t
he City Council approve:
1)
The settlement agreement between the City and CALPROMAX Engineering, Inc., which provides for
a payment of $44,483.00 to the City for the City to waive all claims against CALPROMAX Engineering, Inc. for the Gage Avenue Bus Shelter Improvement Project; and
2)
Read by title only, waive further reading and adopt Resolution No. 2023-15 titled:
“A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELL, CALIFORNI A
APPROVI
NG A SETTLEMENT AGREEMENT WITH CALPROMAX ENGINEERING,
INC. FOR THE GAGE AVENUE BUS SHELTER IMPROVEMENT PROJECT.” BACK
GROUND:
One of the City’s Capit
al Improvement Program (“CIP”) goals has been the replacement of aging bus shelters on the major boulevards. The City Council approved the Gage Avenue Bus Shelter Improvement Project (“Project”) for the FY 2021/2022 CIP. In September 2021, City staff opened nine (9) bids with a subsequent award of contract to CALPROMAX Engineering, Inc. on October 27, 2021.
The contract award was in the amount of $1,229,340 with a 10% construction contingency of $122,934 (“Contract”). The project’s construction funding was approved for Fiscal Year 2021/2022 and included Prop A, Prop C and Metro STP-L Exchange funds. The Project, as bid, involves the removal and replacement of the old bus furnishings (shelters, benches, trash receptacles) at 17 bus stops on Gage Avenue, one bus stop on Florence Avenue, and new pylon signs and totem signs at each bus stop. The Project also includes reconstruction of the sidewalk landing areas at each bus stop with all new decorative, color-stamped concrete.
City of Bell
Agenda Report
Due to the rising cost of material, CALPROMAX informed City that it was unable to perform the Contract for the sum agreed upon under the Contract. As a result of this, both the City and CALPROMAX wish to terminate the Contract. City staff believe that the Contract is no longer feasible for the City and that it is in the City’s best interest to terminate the Contract.
DISCUSSION:
Due to the rising cost of
the raw materials, CALPROMAX informed the City that it was unable to perform the Contract for the sum agreed upon. According to CALPROMAX, this was a result of suppliers increasing their costs ostensibly due to account of the high inflation that entered the supply chain.
After numerous discussions, and because of the efforts put in by both the City and CALPROMAX, City staff believe forcing CALPROMAX to perform under the Contract is no longer feasible for the City and that it is in the City’s best interest to terminate the Contract.
The City issued payment to the contractor in the amount of $230,888 as a deposit to start the project; however, due to the above reference economic inflationary factors the project was cancelled and because of terminating the Contract, CALPROMAX has offered a payment of $44,483.00 to the City and agree to waive any cl aims the City may have against CALPROMAX.
The City has also been provided with the equipment purchased prior to termination as part of the project valued at $128,697.70. The equipment is now properly inventoried and stored at a City facility.
Furthermore, the City has agreed that as part of the settlement, neither the City nor CALPROMAX will be apportioned any fault for the termination of the Contract.
FISCAL IMPACT:
The City will receive payment in the
amount of $44,483.00 that will be made by CALPROMAX to
the City.
ATTACHMENTS:
1. Resolution 2023-15 and Claim Release and Settlement Agreement between the City and CALPROMAX Engineering, Inc.
RESOLUTION NO. 2023-15
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELL,
CALIFORNIA, APPROVING A SET TLEMENT AGREEMENT WITH
CALPROMAX ENGINEERING, INC. FOR THE GAGE AVENUE BUS SHELTER
IMPROVEMENT PROJECT
WHEREAS, on October 27, 2021, the City Council awarded a contract to Calpromax Engineering Inc. (“Calpromax”) in the amount of $1,229,340, including a 10 percent construction contingency of $122,934, to complete the Gage Avenue Bus Shelter Improvement Project (“Project”); and
WHEREAS, the Public Works Agreement (“Contract”) between the City and Calpromax was executed on November 9, 2021; and
WHEREAS, the City issued payment to Calpromax in the amount of $230,888 as a deposit for the procurement of materials required for the Project: and WHEREAS, due to the rising cost of raw materials, Calpromax informed the City that it was not able to complete the Project for the original Contract amount; and WHEREAS, after numerous discussions with Calpromax and in consultation with the City Council, City staff believes that forcing Calpromax to perform under the Contract is no longer feasible and that it is in the City’s best interest to terminate the Contract; and WHEREAS, both the City and Calpromax wish to terminate the Contract and a settlement agreement was negotiated in good faith and provides for the payment of $44,483 from Calpromax to the City, and for the City to waive all claims against Calpromax for the Project; and
WHEREAS, Calpromax has provided the City with the equipment purchased for the Project, and the equipment is now properly inventoried and stored at the City Yard for future consideration.

SUBJECT: Project #PW2022-08 – Projec t Management, Construction Management & Inspection Services
RECOMMENDATION:
It is recommended that the City Council approve the following:
1. Award the Pritchard Field Project – Project Management, Construction Management & Inspection Agreement in the amount of $299,089 to Transtech Engineers, Inc.; and
2. Authorize the City Manager or his designee, to execute change orders in a total amount not to exceed $25,000 (ten percent of the co ntract amount) for any necessary additional work.
BACKGROUND:
On May 5, 2020, the City was awarded $4,499,388, from the 2018 Parks Bond Act by the California Department of Parks and Recreation (D PR), for the park improvements at Pritchard Field Park, located at 7006 Walker Avenue and 7109 Walker Avenue.
On July 8, 2020, a deed restriction was filed restricting the properties for the purposes of a park site and parking lot for the addresses mentioned above. The deed restriction is a grant requirement where improvements are locked in a period thirty (30) years from July 1, 2018, to June 30, 2048.
On August 24, 2020, The City executed an amendment (Contract No. C9801029 Amendment No. 1) to extend the grant performance period from June 30, 2022, to June 30, 2024. During this time period, the City of Bell shifted its priorities and resources to address critical issues related to the height of the pandemic.
For example, city staff managed and implemented several food bank drives, administered a multi- partner vaccination clinic, continuous hosting COVID-19 testing sites, and operating with reduced staff levels for all other normal city operational functions and essential services.
On August 1, 2022, the City released the RFP for the Pritchard Field Design Build Project. The project budget for design and construction was estimated at $4,000,000. The procurement was City of Bell
Agenda Report
advertised for bid on August 1, 2022, with the bid due date scheduled for December 2, 2022, at 2:00 p.m. (PST). The initial bid review was conducted at City Hall on December 6, 2022, and the bid was advertised for a total of 124 days. There was only one (1) bid that was submitted for the project in the amount of $7,981,973.
After reviewing the bid schedule and total compensation amount, the total dollar amount to complete the project far exceeds the total estimated project budget more than $3,981,973.
On January 11, 2023, Staff informed the Council that City Staff was to review the scope and propose changes to the approach that will keep the project within budget and delivered in a timely manner. In this action, City Staff recommended to Council to Reject All Bids for Pritchard Field Design-Build Project # PW-202206.
On February 8, 2023, City Staff provided an update to the City Council that provided the current status of the project and the revised approach from Design-Build to a more traditional approach knows as Design-Bid-Build.
DISCUSSION:
In the update provided to the City Council on February 8, 2023, City Staff communicated the current state of the project. The City Council approved the Pritchard Field Park Strategy which is essentially an action plan of the following elements as noted below:
1. Assemble the Project Team
2. Design Process

Thereafter, City Staff began negotiation of costs with the highest rated firm overall (Transtech Engineers, Inc. – letter dated 2/16/23) as the design process and timelines were changing from Design-Build to Design-Bid-Build. This was communicated to all consultants/firms in advance of Round #2. Transtech Engineers, Inc. and City Staff discussed costs on February 17, 2023, and received a revised fee proposal in the amount of $299,089.

RE: CITY OF BELL – PROJECT MANAGEMENT, CONSTRUCTION MANAGEMENT AND
INSPECTION SERVICES FOR PRITCHARD FIELD
Dear Ali,
After careful consideration after the proposals were rated and the City interviewed all three eligible candidates for the entitled contract, the following final rankings were established:
1. Transtech Engineers, Inc.
2. Z & K Consultants
3. Skanska USA Building Inc.
Let me be the first to tentatively congratulate you on your first-place ranking. Of course, since this project is no longer a Design-Build project, the City needs to negotiate a more reasonable cost for the implementation of this project prior to discussing a contract for Professional Services. If our negotiations are successful, the City will continue to recommend your company for being awarded a contract to provide these services. If the negotiations are not successful, the City will need to discuss this with the No. 2 ranked firm.
Let me know what times are good for you to discuss this matter in the next week. Call me at (323) 835-3536 to schedule a time. Thank you.
Sincerely,
Gabino C. Luna

Section 3 – Understanding and Approach 3.3
TECHNICAL PROPOSAL
Project Management, Construction Management, and Inspection Services for the Pritchard Field Design-Build Project, RFP No. PW-202208 will provide the requested services in an efficient and cost effective manner.
As indicated in City’s RFP, the professional disciplines furnished by Respondent will vary according to the specific requirements of each particular phase as requested by the City. Therefore, the Responded must have the capability to provide the full range of services associated with project management, construction management and inspection. The selected PMCMCI consultant will manage design work performed by another consultant(s) under DB Entity, and the contractor during the construction phase.
The RFP states, specifically, the City is seeking individuals with professional registration in civil engineering or
demonstrated project management experience for public work and design -build type projects , tasks may include but are not necessarily limited to the review of other items as the design process progresses. The required services will also involve review of engineering plans, which will require experienced licensed engineers and plan checkers. Transtech has in- house staff to perform these tasks. We are not just a Project Management Firm, but we are a multi-disciplinary consulting firm capable of providing an array of services and experienced staff for the project. Transtech has been in business for 33 years. Our staff and resources include approximately 200 staff , including professional registered engineers ICC certified building officials, plan checkers, inspectors, project managers, construction managers , and various support personnel. In addition, our team includes specialty subconsultants to complement our team and services, and provide technical specialty support for soils/materials testing/inspection, landscape architectural review, labor and funding compliance.
3.2. Approach
Structured Approach: We have a structured approach to execute projects in an efficient manner that makes Transtech capable of providing the City with an efficient and quality product. Transtech has established guidelines and policies, including written manuals on quality control, project management, and design procedures for its staff and for its contract cities. These guidelines ensure a consistent approach to the execution of assignments undertaken by our organization in compliance with City’s specific procedures, standards and requirements. The following paragraphs describe our general approach to deliver projects in an efficient and cost -effective manner. A project specific approach will be provided for each assigned project and will become part of the specific contract for the specific project. • Project Management: Our approach is to provide proactive management and attempt to identify potential issues and problems in advance and take corrective actions before they become problems. This requires extensive hands- on knowledge, experience and management skills of the people involved in managing the project. Our team members have extensive experience and proven track record in managing large and complex projects and bringing them to a completion on time and within budget.
• Approach to Cost Control and Change Orders: We evaluate project costs and develop feasible mitigation measures to minimize additional costs. We work as a team to solve problems or make modifications in the field to address unforeseen conditions or owner generated changes in a cost-effective manner. • Approach to Scheduling and Timely Completion of Project and Schedule Recovery : The baseline schedule should properly identify the project scope, critical path, project milestones, target dates, phases and sequences of work, and activity durations. When significant activities show that they are slipping from the baseline, we work with the contractor to develop recovery plans.
• Management of Documents: We use an electronic file management system. All construction forms, daily dairies, weekly statement of working days, etc. are stored in our electronic file system, and are per Caltrans documentation system. We provide these documents at the end of the project to the client in organized files as well as pdf files. • Safety and Security: W
e hold meetings with the contractor to review and discuss safety and security requirements, OSHA conformance, emergency security and safety procedures, and enforce security and safety responsibilities. • Funding Closeout: We prepare necessary closeout documentation required by the funding agencies, submit final reimbursement documentation, follow-up on the reimbursements, and final funds balance report.
Section 3 – Understanding and Approach 3.4
TECHNICAL PROPOSAL
Project Management, Construction Management, and Inspection Services for the Pritchard Field Design-Build Project, RFP No. PW-202208 • Project Closeout: We recognize that closeout is an important part of the construction process. It signifies that the new facility structure is ready to use. We methodically handle all closeout tasks to ensure a smooth transition from construction to occupancy.
• M ethodology for Communication to Inform City on Work Progress: Key project team members will attend periodic project progress meetings with City staff throughout the project duration. • Electronic common project information and file sharing platform: W e create and provide access to project participates a common project information and file sharing platform.
PROJECT CONTROL SYSTEMS: Project controls are essential to keep complex construction projects on budget and on time.
They help teams and stakeholders identify emerging risks early, before they become expensive, time- consuming problems. With advance warning, these issues can be mitigated or avoided altogether. Project controls also give leadership the data they need to set realistic expectat ions, manage subcontractors, and plan with confidence. During the course of a project, program and project managers use controls to monitor time and cost expenditures and compare them to project lifecycle forecasts. They also rely on them to coordinate onsite execution with the milestones established during the design, procurement, entitlement, and pre -construction stages. The benefits of project controls are many.
When they are put in place and used appropriately, they contribute to increased efficiency, decrease in delays and cost overruns, and fewer claims and costly litigation.
Our staff has experience wi th various
document control software
systems including Procore,
Autodesk ConstructWare (which
has now become Construction
Cloud), and Primavera P6. In our
experience all major control
software programs work basically
the same way, and adapting
from one sof tware offering to
another has a fairly small learning
curve. Because the specific
software is generally a choice
made by the prime contractor,
our staff is ready to partner with
any user of any program. That
said, not all projects require the
‘fire power’ associated with an
expensive, sophisticated
control system. Sometimes an
intelligently designed filing
system that stores basic Word,
Excel, PDF, and email documents
in the cloud is all a project really
needs.
Transtech has a proven track
record for completing projects on
time. As part of our role as Project
Managers is to develop, review,
update and manage the project
schedules and confirm that tasks
are scheduled within reasonable
and appropriate timeframes. We
constantly review, monitor and
update the schedule to confirm it is in compliance with the original schedule and that related coordination with external/3
rd parties/regulatory agencies/utility companies, etc. are on track. If the look ahead schedule is not in compliance with the original schedule , we take appropriate actions to avoid potential delays. Our approach to Scheduling and Timely Completion of Project and Schedule Recovery includes having the contractor prepare a baseline schedule, which identifies the project scope, critical path, project milestones, target dates, phases and sequences of SAMPLE DB PROJECT SCHEDULE: PROJECT DESIGN, AND PERMITTING (PRIMAVERA, P6) SAMPLE DB PROJECT SCHEDULE: CONSTRUCTION (PRIMAVERA, P6)

ISSUES TRACKING SYSTEM: An issue tracking system provides an easy way to document issues, assign responsible party, and view the status of how the issue resolution is progressing. Complete documentation of issues is critical to mitigate risks on current projects and prevent similar issues on future projects. When issue tracking is integrated with the p roject management system, all documentation, and communications related to the project become centralized to provide complete transparency into project status. Key components of effective issue tracking are:
• Date the issue was identified. This is important to document when the issue was first identified and how long an issue is open. Issues that have long resolution times could be further investigated by performing a root cause analysis. • Description. A thorough description of the issue along with potential impacts to a project should be noted. Including pictures or video along with pertinent annotations is vital to provide a visual reference to the issue documentation. • Issue Priority. When multiple issues need attention setting a priority of Low, Normal, or High will accurately present the hierarchy of which issues are most critical to impacting project success or need immediate resolution due to safety issues.
• Responsible Party. By assigning the person(s) responsible for resolving the issue (e.g., in the issue tracking system) provides accountability. The transparency of an issue tracking system allows for the responsible parties to be held accountable for completing tasks and keeping the project moving forward. • Due Date. The issue t racking system sh ould provide the ability to set reminders for those tasks to ensure that due dates do not get missed which could jeopardize project closure dates. Setting reminders of due dates ensure that no tasks slip through the cracks!
• Status. The visibility of issue status is essential for all project stakeholders to know if any progress is being made. If there are bottlenecks or further approva ls needed, it is important that these items be documented and a plan of action created to resolve the issue.
Main benefits of an effective issues tracking system are:
• Lesser chance of delays; Enhanced operation visibility; More informed decision-making; Improved accountability; Prevents misunderstanding; Faster formulation of contingency plans; Improved accountability. Following is a snap shot of issues tracking documents on a recent project Transtech s managing.
T
he project status and issues are discussed at weekly meetings with involved parties. Following is a screen shot of weekly meeting for the same project.

Following is a screen shot of weekly meeting for the same project discussing 3-week look-ahead schedule.
QUALITY ASSURANCE PROGRAM: During construction, an effective Quality Assurance Program will ensure the materials and workmanship incorporated into project conform to the requirements of the contract plans and specifications including approved changes.
Typical Quality Assurance/Quality Control Measures: We believe that quality control is the setting of minimum standards and/or quality requirements for the specific project. Quality assurance is the means by which the quality control measures will be monitored and/or enforced. We also believe that quality control and quality assurance measures need to be developed jointly with the client. To effectively establish quality control measures, we must understand the County’s specific expectations and/or level of desired quality for the specific project. Once the expectations have been defined, and the quality control measures established, the quality assurance measures can be established. A significant part of establishing the quality assurance measures includes the timing of the measure. QC/QA can only be effective when the measures are applied and/or evaluated in a timely manner.
Value Engineering: Depending on a project’s size, complexity and the owner’s requirements, Value Engineering may also be considered. The Value Engineering may consist of a systematic process of review and analysis of the project during the concept and design phases, by a multi- disciplined team of persons not involved in the project, may include recommendations such as:
• T o improve the value and quality of the project.
• To provide the needed functions safely, reliably, and at the lowest overall cost. • To reduce the time to complete the project.
• To combine or eliminate otherwise inefficient use of costly parts of the original proposed design for the project.
Approach and Strategy For Managing, Negotiating, And Incorporating Changes In Project Scope: Our approach and strategy is structured based on minimizing cost and schedule impacts, while evaluating change orders in a timely, fair and equitable manner.
A number of different factors can influence the development of Change Orders on projects, which can result from either foreseen or unforeseen conditions and may include:
• Design Modifications; Errors and Omissions; Changed Condit ions; Additional/Reduced Work Scope; Owner - Directed Schedule Acceleration or Slowdown; Work Sequencing; Adjustments to Unit Pricing; Force Majeure Delays; Added Cost Incentives; Delayed, Denied, or Restricted Access to a Project Site; Inappropriate Rejection of the Contractor’s Work; Delays to Owner-Supplied Services and Materials Our initial evaluation of a change order request incudes various elements:
• Is it already covered in the contract? Is it necessary to complete the work? Impact on the planned wor k? Will SAMPLE SCREEN SHOT OF LOOK AHEAD SCHEDULE UPDATE, WEEKLY CONSTRUCTION MEETING ONLINE: SCHEDULE ON PRIMAVERA

Will it cause a work -character change? Impact on the contract time? Methods of payment? Are there sufficient contingency funds? If not, can additional funds be obtained soon enough to prevent delays? Impacts on any regulatory conditions, permits, utilities, etc..
Change Order Documentation:
• We prepare the change order in a clear, concise, and explicit manner. A change orders should be easily understood by third parties reviewing it what work was performed without further explanation.
Project Partnering: Based on project’s size and complexity, Project Partnering may also be considered:
• Partnering is a relationship between the owner and the contractor, formed in order to effectively complete the contract to the benefit of both parties. Through trust, cooperation and teamwork, the goal is to resolve conflicts at the lowest possible level.
Coordination with City: Key project team members will attend periodic project progre ss meetings with City staff throughout the project duration. We will maintain and establish and maintain a close working relationship with City staff.
We will manage assigned projects, carefully control costs and resources, and complete assigned work on sc hedule. We will provide progress reports to the City at regular intervals.
Methods/Procedures for Developing /Publishing Project Status Reports/Records: Project status reporting is another area where the solution should be tailored to the size and scope o f the project being managed and the actual reporting product anticipated by the City. In addition to the size and scope of the project, the actual point in time of the project matters. For example, project status reporting for a design building project that is currently preparing bridging documents will be significantly different from the report that would be prepared once construction has commenced.
APPROACH AND STRATEGY FOR MANAGING, NEGOTIATING, AND INCORPORATING CHANGES IN PROJECT SCOPE : Our approach and strategy is structured based on minimizing cost and schedule impacts, while evaluating change orders in a timely, fair and equitable manner.

CONTRACT ADMINISTRATION APPROACH (CALTRANS LAPM): For construction contract administration, we follow guidelines similar to described in Caltrans Local Assistance Procedures Manual (LAPM). Maintaining complete and accurate files is an important aspect of managing federally funded projects. Generally, whenever the local agency is unable to produce requested data or information, it is assumed by reviewing personnel that the required actions were either never performed or not properly recorded. Organized project files can minimize these negative assumptions. Organization and content of the project file is one indicator of effective and efficient management of the project by the resident engineer.

Local Agency Design-Build Projects. (CAPCC, CHAPTER 4. Local Agency Design-Build Projects [22160 - 22169])
Design-Build ('DB')
Design-build contracts comb ine professional design services and construction services into a single contract with the owner. The owner selects the successful DB- team based on performance specifications (also referred to as bridging documents). The performance specifications define what is owed by the DB-team to the owner.
Benefits of Design-Build:
• Greater flexibility in the contract award process.
• A single point of accountability (eliminates finger-pointing between designer and contractor). • Higher quality construction work.
• Fewer change orders.
• Fewer claims.
• Faster project completion.
• Lower project cost.
• Greater cost certainty.
• More opportunity for innovation.

The City considers the following situations as potential conflicts of interest that will not be allowed with the selected firm(s):
• Directly or indirectly participating in, managing, or overseeing any consultant selection procurement process in which the selected firm is competing as a consultant or sub- consultant. • D
irectly or indirectly influencing any employee, staff member or other individual participating in any consultant selection procurement process in which the selected firm is a consultant or sub- consultant. • Directly or indirectly participating in, managing, or overseeing any local agency contract that is with the selected firm, regardless of whether the involvement of the selected firm in the contract is as a consultant or sub- consultant. Among other things, this includes approving changes in the schedule, scope, deliverables, or invoices.
Transtech agrees with the above statements and will comply accordingly.
The City recognizes that consulting firms that currently hold design contracts may wish to compete as a prime consultant for this contract. Transtech agrees with the above statement and will comply accordingly.
Consultants shall disclose any financial, business, or other relationship with the City that may have an impact upon the outcome of the contract or the construction projects. SUBJECT: Approve Amendment No. 1 with Ladayu Consulting for On-Call Public Works Professional Services
RECOMMENDATION:
It is recommended that the City Council approve Amendment No. 1 with Ladayu Consulting for On-Call Public Works Professional Services.
BACKGROUND:
The Public Works Department administers the Ci ty’s Capital Improvement Program (CIP) by implementing short to long term infrastructure projects. These projects include but are not limited to roads, bridges, storm collection systems, public facilities, streetlights, traffic systems, sidewalks, and underground utilities.
On August 26, 2022, the City Manager’s office began discussions with Ladayu Consulting Group for to request a proposal for On-Call Public Works Professional Services to assist in the Public Works Department with administrative and project support to elevate the departments goals.
On October 25, 2022, staff issued a purchase order under the City Manager’s Authority in order to formally engage the firms services to assist public works staff with the implementation of several high priority public work projects, including but not limited to: the preparation of a Curb Policy, Pritchard Field Project - administrative project support (RFP for Design and Project Management and Construction Services), and the preparation of a local Bell school focused circulation plan, and administrative support for the Cal Fire Grant RFP (the Landscape Architect ) and various other public works projects.
Since then, Ladayu Consulting Group has successfully completed several tasks and assisted the City in moving projects forward. We are at the point where we’ve had the ability to know and understand their role as a consultant resource and how their services can uniquely provide high value to the department.
DISCUSSION:
To continue service with Ladayu Consulting Group, an amendment is necessary to adjust the total City of Bell

SUBJECT: Appointments of Council Members to Serve on the California Cities Gaming Authority
RECOMMENDATION:
It is recommended that the City Council appoint two Councilmembers to the California Cities Gaming Authority and add such appointments to Resolution 2022-52 “Exhibit A”.
BACKGROUND:
The California Cities Gaming Authority (“CCGA”) was established by the execution of a Joint Exercise of Powers Agreement (“Agreement”) by the City of Gardena and the City of Inglewood on November 13, 2019. Subsequently, the City of San Jose and Town of Colma were both admitted as members of the CCGA.
The purpose of the CCGA is to protect member cities interests and to monitor the activities of the California Gaming Commission, the California Bureau of Gambling Control, and the Department of Public Health Office of Problem Gambling. The CCGA advocates for policies that support and protect the cities interests, revenues, and right to govern and opposes policies that are contrary.

SUBJECT: 2023 City Council Reorganization
RECOMMENDATION:
It is recommended that the City Council receive and file this report.
DISCUSSION AND BACKGROUND:
Historically, the City Counc il reorganizes its May or and Vice-Mayor seats each year during March or April. However, due to the Council aligning its March 2022 election with the June 7, 2022, statewide primary, reorganization was delayed until August 2022.
Due to this alignment of the Bell Election with the Statewide Election schedule, the current Mayoral was given a shorter term of 8 months; instead of the normal twelve (12) months . Given these facts, staff is seeking direction from Council to either maintain the current reorganization schedule of March/April or select an alternative reorganization date.
Pursuant to Bell Mu nicipal Code Section 2.04.03, in odd numbered years , the Council could reorganize at the second meeting in March or at such other times as majority of the council shall order.
In accordance with the City of Bell Code Section 2.04.030 Council Reorganization:
Beginning with the election on March 3, 2020, the council shall reorganize and select one of its members as Mayor and one as Mayor Pro Tempore (Vice Mayor), on the following occasions:
A. In even numbered years, when designated by applicable provisions of the Government Code at the time the city council certifies the results of the municipal election;
B. In odd numbered years at the second regular meeting held during the month of March; or
C. At such other times as a majority of the council shall so order.
