Item 14.

TO: Honorable Mayor and City Council Members
FROM: Michael B. O'Kelly, City Manager

SUBJECT: AQUATIC CENTER PROJECT UPDATE-OCTOBER2022
DATE: October 24, 2022
RECOMMENDATION:

It is staff's recommendation that the City Council receive and file the John Anson Ford Park Aquatic Center update presentation.

BACKGROUND/DISCUSSION:

On February 24, 2021, the City entered into an agreement with RJ M Design Group (RJ M) for design, architecture and engineering services for the Aquatic Center and John Anson Ford Park(Ford Park).

Project Costs:

The estimated construction and soft costs to fully fund the Aquatic Center is approximately $23.7 million. Actual costs will be determined once the bidding and procurement process takes place.

Project Costs:

Construction Costs
Demolition to Pool $1.1 M
New Aquatics Center $18 M
Soft Costs
Architect, engineering,
project and construction $4.6M
management, materials,
testing & inspection
Estimated Total Project Cost: $23.7 M
This October update is being presented to provide Council new information on activities that have been completed to date, along with challenges that staff has been addressing.

Completed Progress To Date:

Demolition and Construction
• The City has invested approximately $1.5 million in pre-construction "soft costs" using Community Development Block Grant (CDBG) Funds. The Los Angeles County Development Authority (LACDA) is the 339

agency that mandates the requirements for the City's CDBG spending for the Aquatic Center Project. • LACDA is now requiring that the City provides proof that this project is 100% funded prior to allowing the City to begin demolition/construction.
• Additionally, LACDA will not allow for the City to separate the demolition and construction into two phases.

Rather, they are requiring that the project be combined into one single bid project. • The City Engineer and architect are currently combining the demolition and construction plans into one bid document. Then, LACDA review and approval of the bid package is required before Council authorizes bidding.
• Based on the new estimated timeline below, the soonest the awarded contractor could begin work is around April 2023, if no further delays occur.

Funding:
• With the new funding prerequisites from LACDA, staff have been diligently working on creative ways to meet those requirements and move the project forward.
• To avoid costly bank fees and extending the timeline, one option is to request that Council appropriate the project balance (between $10 and $15 million)from the General Fund to the project, to satisfy LACDA's requirement of having 100%funding.
• If the funding is appropriated by Council, staff would continue to pursue other funding sources throughout the duration of the project in order to minimize the impact to the general fund. • Land and Water Conservation Fund $6 million.
• Staff are waiting for the State agreement which needs to be executed prior to the City receiving the funds. • Supervisor Janice Hahn - $4 million
o Supervisor Hahn's office estimates that the City will receive the $4 million grant in the coming weeks. • Assemblymember Cristina Garcia- $2 million
o The money has been allocated to the City's project, but the State Budget Committee is currently identifying and hiring new staff to help with processing the funds, which is extending the timeline for the City receiving the funds. The Budget Committee expects Bell Gardens to receive the funds at the beginning of 2023.
• Congresswoman Roybal-Allard
o $1.5 million was proposed on the Congresswoman's bill which needs to be passed prior to the funds being disseminated. The City expects to receive notice of award in the late Spring 2023.

Current Aquatic Programming_
• The Recreation and Community Services (RCS) Department extended Swim Lessons into the Fall. The first fall session had over 100 participants had approximately 75 participants. We are working to fix the pool's heater in order to offer water aerobics classes in the cooler months. Staff are considering the possibility of transporting Seniors to the pool for water aerobics classes during the fall and early spring months. • Montebello has allowed Bell Gardens exclusive access to their pool at Chet Holifield Park. RCS staff will continue to build the aquatic programs by adding classes and swim lessons and activities throughout the year. • RCS staff are preparing to offer swim lessons during the Montebello Unified School District's Spring Break which will catapult us into the aquatic summer programming.

Key Next Steps:
• Staff will continue providing monthly project updates to the Aquatics Center Ad Hoc Committee as well as seek additional funding for the project.
• Staff is finalizing the Request for Proposals (RFP) to hire a construction/project management firm to oversee and manage the project from beginning to end.
• Staff will need to provide proof of 100% project funding to LACDA to allow the project to go forward. • Once the plans and specs including both the demolition and construction are completed, staff will submit to 340

LACDA for review and approval.
• Request City Council to authorize bidding of demolition/construction.

CONCLUSION:

Staff will keep council informed of progress with securing funding and receiving necessary review and approval from LACDA.

FISCAL IMPACT:

The National Park Service grant and any future allocations secured through various elected officials, will help offset the cost of new Aquatic Center. The balance of funds needed may come from general fund and CDBG/private financing.
