No written public comments were received prior to the meeting. No additional public comments were received during the meeting.

Executive Director Shen introduced Ms. Marisa Perez of the Gateway Cities Council of Governments (GCCOG) to provide an update on the proposed West Santa Ana Branch Corridor Cities Committee.

Ms. Perez introduced herself to the Board. In addition to working on transportation issues for the COG, she also staffs Fernando Dutra, Metro Board representative of Gateway Cities. Transit priorities under them include WSAB Project and the Eastside Transit Corridor Phase 2.

Initial internal discussions were held with the COG steering committee, city managers, and the WSAB City Manager's TAC. The recommended initial action is for the COG to establish the WSAB Corridor Cities Committee, assuming participation and member dues from current member cities of Eco-Rapid Transit. The first phase, January 1st 2024- June 3e 2024, would be used to establish the committee. January and April meetings to be held on zoom from 6:00 to 7:30PM will be held. Administrative support during this period donated by the COG to amount to 23,000. The current JPA will cease its nouual operations after December 31, 2023 and no liabilities will be transferred to the COG.

The goal of the Committee would be to focus on the planning, advocacy, and construction of the WSAB Project. The committee to meet virtually for the first 6 months, then meet regularly to provide policy guidance and direction. Committee members will be expected to attend Metro's general briefings on the Gateway Cities, partner with Metro, and provide policy guidance.

The second phase to begin July lst 2024 -June 30th 2025. Bi-monthly meetings to be staffed according to the Brown Act. Member cities to pay a flat fee between 10,000-17,000 for this period. In regard to the amount, the Caltrans Grant requires a local cash grant match. Further discussions with Metro will be held to use as a local match for the Caltrans Grant. Member dues to cover administrative and accounting expenses, meeting stipends capped at 700 per member per year, and reimbursements up to 2,600 for members' trips to Sacramento and DC. The COG will also support the previous rebranding efforts of ERT.

The meeting was opened to questions from the Board.

Director Davila (South Gate) expressed the importance of ERT and the proposed Committee's missions to advance advocacy on behalf of the WSAB Project.

Director Martinez (Maywood) asked for clarification if new representative members for each city will be appointed to the new Committee. Ms. Perez replied that representative member appointment will be decided upon by each city.

Executive Director Shen informed the Board that based on discussion with GCCOG, future members of the new Committee will work with GCCOG to develop the by-law charter. For example, the new Committee by-law could permit non -elected individuals to represent their cities/agencies.

Chair Taj (Artesia) asked if there was an official name for the Committee. Ms. Perez replied that the Committee would be named the West Santa Ana Branch (WSAB) Corridor Cities Committee for now. It may be changed when the project name is changed after the rebranding process.

Chair Taj (Artesia) inquiries for a more specific timeline. Following the Metro Board approval of the EIS in March 2024, the request for Record of Decision from the FTA will be submitted. State funding sources will also be discussed during the Phase 1 time.

No further comments were made by the Board. The Item was received and filed.

OUTREACH ACTIVITIES BY LOS ANGELES METRO

Metro will form a review consisting of five members and has requested a member representative from the ERT Board. Review will be held in early October to be narrowed to ten names. Metro's marketing to narrow the list to five names, then the public will vote on a name in November.

Ms. Perez shared the first WSAB Project newsletter to the Board. Highlights include the First/Last Mile planning, public action initiatives, and updates on entries for name rebranding.

TO:

FROM:

BY:

Honorable Mayor and City Council Members
Michael B. O'Kelly, City Manager
Scott Fairfield, Chief of Police
Rigo Barrios, Lieutenant
SUBJECT: ACCEPTANCE OF ABC GRANT FUNDING
DATE: October 9, 2023
RECOMMENDATION:

It is staff recommendation that the City Council adopt the attached Resolution accepting funds and entering into Agreement No. 23-APP05 with the Department of Alcoholic Beverage Control (ABC) Grant Acceptance Program and appropriate these funds for use by the Bell Gardens Police Department.

BACKGROUND/DISCUSSION:

The Department of Alcoholic Beverage Control ("ABC") offers grant opportunities once a year for qualified law enforcement agencies. The Bell Gardens Police Department (BGPD) submitted a grant for FY 2023-24. Upon review of the grant application, BGPD was awarded funding to support specific projects.

The BGPD will receive approximately $34,000 to support efforts to develop an effective, comprehensive and strategic approach to eliminating the crimes of underage drinking and public nuisance problems associated with problem alcoholic beverage outlets.

The ABC Grant will provide an opportunity for BGPD to establish close working relationships between ABC district offices; prioritize law enforcement efforts and target those licensed outlets that cause alcohol -related crimes; develop records management systems to ensure police reports are systematically sent to the ABC district offices as required by law; and assist in the training of local law enforcement and ABC establishments personnel such as licensees and their employees.

There are various public and business related educational programs that will be utilized in conjunction with follow-up enforcement programs targeting the illegal consumption of alcohol by minors. By undertaking the training and enforcement actions provided for in this grant program the BGPD will address underage drinking in the community and the crime problems often associated with underage drinking, such as driving under the influence and assaultive behavior.

CONCLUSION:

If adopted, BGPD will receive funding to support crime prevention and enforcement activities related to young adult alcohol consumption.

FISCAL IMPACT:

Grant revenue in the amount of $34,000 will be received to fund this program and will be included in the FY 2023-24 432

budget.

AGENDA REPORT
Item 12.

TO:

FROM:

BY:

Honorable Mayor and City Council Members
Michael B. O'Kelly, City Manager
Bernardo I niguez, Director of Public Works/Facilities
Douglas Benash, P.E., City Engineer
SUBJECT: INSTALLATION OF RED CURB 'NO PARKING' RESTRICTIONS ADJACENT TO 6021

FLORENCE AVENUE
DATE: October 9, 2023
RECOMMENDATION:

It is staff's recommendation that the City Council adopt the attached Resolution authorizing seven (7) feet of red curb 'no parking' restrictions along the east side of Jaboneria Road, north of the northerly driveway adjacent to the commercial facility at 6021 Florence Avenue.

BACKGROUND/DISCUSSION:

A request was received from Community Development staff for the installation of red curb along the easterly side of Jaboneria Road, north of the northerly driveway adjacent to the commercial facility at 6021 Florence Avenue, to improve sight distance.

In response to the request, the City Engineer reviewed the request. In accordance with City policy, a field review of the site was conducted and it was determined that sight distance conditions for vehicles exiting the northerly driveway onto Jaboneria Road can be improved with the addition of red curb.

The additional red curb will allow vehicles exiting the commercial center improved sight distance entering onto Jaboneria Road, a collector street with greater traffic volumes than a local residential street.

On September 5, 2023, the Traffic and Safety Commission approved staff's recommendation for City Council consideration for up to 20 feet of red curb. However, after a reassessment of the field conditions, it was determined that seven feet of red curb would improve sight distance while preserving the existing number of on -street parking spaces.

CONCLUSION:

After a review of field conditions, the City Engineer recommends approving the request for painting red curb 'no parking' restrictions on the easterly curb, a distance of seven feet north of the northerly driveway on Jaboneria Road adjacent to 6201 Florence Avenue, based on the reported findings.

FISCAL IMPACT:

The estimated cost for the installation of red curb is approximately $500 and is available in the current Street Maintenance Budget.

MEMORANDUM OF UNDERSTANDING WITH THE LOS ANGELES COUNTY

METROPOLITAN TRANSPORTATION AUTHORITY FOR COLLECTING AND

REPORTING DATA FOR THE NATIONAL TRANSIT DATABASE FOR REPORT YEAR 2021
DATE: October 9, 2023
RECOMMENDATION:

It is staff's recommendation that the City Council adopt the attached Resolution authorizing the City Manager to execute the Proposition A Discretionary Incentive Grant Program Memorandum of Understanding for Collecting and Reporting Data for the National Transit Database for Report Year 2021.

BACKGROUND/DISCUSSION:

On November 14, 1980, the voters of the County of Los Angeles approved by majority vote Proposition A, an ordinance establishing a one-half percent sales tax for public transit purposes. The Los Angeles County Metropolitan Transportation Authority (LACMTA) is the designated Regional Transportation Planning Agency for Los Angeles County with authority to program and fund local transit services. On September 26, 2001, LACMTA authorized payment of Proposition A Discretionary Incentive funds to cities, such as Bell Gardens (City), that operate locally funded fixed -route and Dial -A -Ride transit services in Los Angeles County and participate in the National Transit Database (NTD) Voluntary Reporting Program. Each participating agency is paid dollar -for -dollar for what their service generates for the Los Angeles County region, minus the cost of an audit.

Rather than have each city report data directly to the Federal Transit Administration (FTA), LACMTA submits a consolidated NTD report to the FTA on behalf of 45+ cities. The data submitted by each of the local operators generates additional Urbanized Area Formula Funding Program (49 U.S.C. § 5307) capital funds to the region.

Once Congress apportions the funds, LACMTA enters into a memorandum of understanding with each respective city to issue payment for their share of the revenues generated for the Los Angeles County region. The funding amount is determined as described in Article 3.0 of the attached Memorandum of Understanding for Collecting and Reporting Data for the NTD (MOU).

The overall reporting process and local and federal funding practices with this program lag behind several years which are the reasons why the City would be receiving funds in 2023 for the MOU that covers Report Year 2021.

The City's contracted transportation service provider, Parking Company of America, prepares all NTD documentation and reports for this program and also goes through the audit with City and LACMTA staff annually.

The local funds received through the MOU must be spent in accordance with Proposition A and C Local Return Guidelines adopted by the LACMTA Board, as described in Article 4.3 of the MOU. 479

CONCLUSION:

Adoption of the attached Resolution will allow the City Manager to execute the MOU and in exchange, the City will receive transportation funding.

FISCAL IMPACT:

The City will receive a payment of $75,125 from LACMTA for its participation in the NTD program for Report Year 2021.

LOCAL COMMISSIONS APPOINTMENT LIST
October 9, 2023
RECOMMENDATION:

It is staff's recommendation that the City Council review the Commissions Appointments List and by motion, remove commissioners and/or make appointments to the posted vacancies.

BACKGROUND/DISCUSSION:

The Local Appointments List includes all Bell Gardens Commissions and Commissioners. The City Council adopted Ordinance No. 825 on July 13, 2009 establishing minimum requirements for service on commissions. All Commissioners must reside within the City of Bell Gardens and may only serve on one Commission at a time. Once appointed, each Commissioner must adhere to the requirements of the City's Conflict of Interest Code and state - mandated AB 1234 ethics training and AB 1661 harassment training.

Ordinance No. 825 allows each Council Member to remove or appoint one candidate per Commission, subject to the approval of the Council majority. Appointed Commission Members serve terms that coincide with the term of the Council Member who made the appointment.

CONCLUSION:

After an appointment is made, Commission members will receive their Oath of Office before beginning service with their respective Commission at the next regularly scheduled Commission meeting. The City Clerk's Office will arrange for the proper filing of Conflict of Interest Code forms and schedule trainings for AB 1234 and AB 1661.

FISCAL IMPACT:

No fiscal impact.

UPDATED INVENTORY FOR VACANT AND/OR ABANDONED PROPERTY CITYWIDE

TO INCLUDE VACANT LEASE SPACE AND PARTIALLY VACANT PROPERTY OVER 5,000 SF
DATE: October 9, 2023
RECOMMENDATION:

It is staff's recommendation that the City Council take one of the following actions:

1. Receive and file this report and take no further action;

2. Direct staff to prepare a vacant property registration ordinance for consideration at a future public hearing; or

3. Provide staff with other direction.

BACKGROUND/DISCUSSION:

At the September 25, 2023, City Council meeting, staff provided an inventory of all existing vacant and/or abandoned land and buildings citywide, per the Council's prior direction, in order to determine the need for a registration program and/or future tax ballot measure. The Council directed staff to revise the inventory to include vacant lease spaces and partially vacant property over 5,000 square feet in area and return to the Council for direction at the October 9, 2023, meeting.

As previously reported, vacant and/or abandoned property can lower property values in the surrounding area when neglected and left in the same state for many years. This can lead to lack of investment in a community, thus creating more vacant and/or abandoned properties. Partially vacant property can also drain resources from cities since they can lead to a decline in property values and economic activity. Inefficient land use can lead to environmental degradation, diminished community pride and engagement, missed opportunities for private developers, and optimized value that could potentially address housing shortages and meet demand for space.

Partially vacant properties can hinder efforts to revitalize areas and manage growth consistent with the policies and programs already contained in the Bell Gardens General Plan, which could involve a multifaceted approach that includes regulations and incentives for potential development or redevelopment.

At the September 11th meeting, staff presented two options to address the impacts of vacant/abandoned land and/or buildings:
1 FEE REGISTRATION PROGRAM: The recommended first option is an ordinance to ensure that vacant/abandoned properties are properly tracked and monitored through a fee registration program that would keep property owners accountable and encourage the development and improvement of said properties. 2 BALLOT TAX MEASURE: The second and/or concurrent option is a voter tax measure that would tax property owners who keep property and/or buildings vacant for an extended period of time. 494

VACANT/ABANDONED SITE INVENTORY
An inventory of vacant and/or abandoned sites was compiled using the Bell Gardens General Plan Housing Element sites inventory, the monthly updated vacant commercial properties maintained by the Community Development Department Code Enforcement Division, and observation during routine inspections and enforcement activity. The registration list (Exhibit 1) includes vacant sites, partially vacant sites over 5,000 square feet in area, commercially available lease areas, and City -owned land.

CONCLUSION:

Vacant, partially vacant, abandoned, and unused buildings and properties have several implications for cities. Proper management and monitoring is crucial to promote sustainable environments that impact the quality of life for all residents and visitors alike. An ordinance would hold property owners accountable for maintaining the property while encouraging development. Requiring property owners to register and pay annual fees for vacant land and buildings is consistent with state law and the City's General Plan. Further, an ordinance could provide public benefits to address blight, safety, property maintenance, development concerns, and build relationships with property owners for a stronger sense of community and cooperation in efforts to improve neighborhoods. The Planning Commission would be the initial body to review any proposed ordinance with a recommendation to the City Council.

FISCAL IMPACT:

None. More information would be forthcoming should Council choose to have staff move forward with an ordinance, which would then require a fee study to identify the registration fees.

Waive full reading and introduce Ordinance No. 937
(Exhibit 1) by title only, amending Title 9 (Zoning and Planning Regulations) of the Bell Gardens Municipal
Code ("BGMC"); and
Find the proposed ordinance exempt from the
provisions of the California Environmental Quality Act
("CEQA") pursuant to State CEQA Guidelines Section
15061.

BACKGROUND
On September 20, 2023, the Planning Commission unanimously adopted a resolution recommending approval of Ordinance No. 937 to the City Council.

Ordinance 937 intends to provide a solution to alleviate parking impacts from automobile service uses on residential streets by allowing off -site parking lots as stand-alone uses for such uses.

Currently, all repair activity for automobile service facilities is required to be conducted within enclosed buildings and on the same property. This ordinance will allow off -site lots to be converted to parking lots for the temporary parking and storage of customer vehicles, limited to only vehicles that are in running condition, and on fully improved lots.

City Council I October 9, 2023

BACKGROUND - Cont
Automobile repair facilities require enclosed buildings and parking.

These same facilities are
often overburdened with
customer vehicles and
overspill into the streets.

In many cases, impacts
are felt by residential
neighborhoods adjacent
to commercial or
industrial zones.

Resident complaints
continue to increase due
to limited street parking.

BACKGROUND - Cont
While Code
Enforcement does
its best to obtain
compliance,
citations are not a
viable solution.

Additional parking
options are
needed.
.*, Allowing off -site parking for vehicle repair facilities as primary uses associated with the repair facilities would result in facilitating vehicle storage on lots with proper filtration, drainage, and paving.

Non -operating vehicles would not be allowed. Such vehicles would remain on the primary repair facility property.

PROPOSED AMENDMENT
Ordinance No. 937 would clarify "automobile storage" as an accessory or primary use when connected to, or in the
vicinity of, automobile repair facilities.

Yes!

1. Require fully improved lots with proper drainage, paving, and decorative perimeter walls.

2. Add locational criteria and development standards.

3. Allow only operable vehicles within striped parking spaces.

No!

1. Unimproved lots.

2. Outside repair activity.

3. In -operable, impounded, and/or salvage vehicles.

City Council I October 9, 2023

CONCLUSION
The Planning Commission found Ordinance No. 937
necessary to allow automobile repair facilities
options to temporarily park and store customer
vehicles.

Ordinance No. 937 would mitigate impacts on
residential streets by providing optional off -site
parking facilities.

As such, staff and the Planning Commission find
that the proposed ordinance merits adoption.

BACKGROUND
On September 11, 2023, staff presented two options for
addressing vacant/abandoned land and/or buildings.

1. FEE REGISTRATION PROGRAM
Ordinance to track and monitor vacant property
through a fee registration program to keep property
owners accountable and encourage development and
improvement of said properties.

2. BALLOT TAX MEASURE
Concurrent or separate voter tax measure that would
tax property owners who keep property and/or
buildings vacant for an extended period (to be
determined by ordinance).

BACKGROUND
On September 25, 2023, an inventory of vacant
and/or abandoned sites was provided. However, the
City Council postponed the item, asking staff to add
vacant lease spaces and partially vacant sites over
5,000 SF in area to the inventory and return to the
next meeting.

REQUESTED UPDATES
To assess proposed ordinance feasibility, staff was requested to evaluate the types of properties that would be affected to include vacant or partially vacant property over 5,000 SF in area.

42 CONCLUSION
The Problem. Vacant sites hold the potential to key
entitlements for housing production, economic activity, and could harbor protected space for homeless
encampments and illegal activity.

The Solution. Property registration and fees facilitate accountability, safe and orderly development, and
community investment. An optional tax provides
further incentive for property owners to maintain and
develop their properties or sell them to investors willing to do so.
