RECOMMENDATION:

It is staff's recommendation that the City Council review the Commissions Appointments List and by motion, remove commissioners and/or make appointments to the posted vacancies.

BACKGROUND / DISCUSSION:

The Local Appointments List includes all Bell Gardens Commissions and Commissioners. The City Council adopted Ordinance No. 825 on July 13, 2009 establishing minimum requirements for service on commissions. All Commissioners must reside within the City of Bell Gardens and may only serve on one Commission at a time. Once appointed, each Commissioner must adhere to the requirements of the City's Conflict of Interest Code and state-mandated AB 1234 ethics training and AB 1661 harassment training.

Ordinance No. 825 allows each Council Member to remove or appoint one candidate per Commission, subject to the approval of the Council majority. Appointed Commission Members serve terms that coincide with the term of the Council Member who made the appointment.

CONCLUSION:

After an appointment is made, Commission members will receive their Oath of Office before beginning service with their respective Commission at the next regularly scheduled Commission meeting. The City Clerk's Office will arrange for the proper filing of Conflict of Interest Code forms and schedule trainings for AB 1234 and AB 1661.

FISCAL IMPACT:

RECOMMENDATION
It is staff’s recommendation that the City Council take one of the following actions:

1. Receive and file this report and take no further action; or

2. Direct staff to coordinate with the City’s Economic Development consultant to identify five to ten (5-10) priority properties and identify opportunities for each property and then work to market the properties for the benefit of the community; or

3. Direct staff to prepare a vacant property registration ordinance for consideration at a future public hearing; or

4. Direct staff to investigate/initiate ballot tax measure.

BACKGROUND/DISCUSSION
As reported in the October 9, 2023, Agenda Report, vacant, underutilized and/ or abandoned property can lower property values in the surrounding area; particularly when neglected and left in that condition. The visibly derelict sites may cause investment hesitation investment, thus perpetuating the conditions. Whilst partially vacant property may drain resources from the City since they can lead to a decline in property values and economic activity. Inefficient land use can lead to environmental degradation, diminished community pride and engagement, missed opportunities for private developers, and optimization of land and use value that could potentially address housing shortages, commercial enterprises and meet demand for space needed for further development.

Partially vacant properties can hinder efforts to revitalize areas and manage growth consistent with the policies and programs already contained in the Bell Gardens General Plan, which could involve a multifaceted approach that includes regulations and incentives for potential development or redevelopment.

At the September 11, 2023, regular City Council meeting, staff presented two possible options to address the impacts of vacant/ abandoned land and/ or buildings:

1. FEE REGISTRATION PROGRAM: The recommended first option was an ordinance to ensure that vacant/ abandoned properties are properly tracked and monitored through a fee registration program that would keep property owners accountable and encourage the development and improvement of said properties.

2. BALLOT TAX MEASURE: The second and/ or concurrent option was a voter tax measure that would tax property owners who keep property and/ or buildings vacant for an extended period.

The City currently has approximately 30 vacant or underutilized properties that could be subject to a future Vacant Registration Program. A fee collected under this program would be a regulatory fee intended to pay for the cost of issuing licenses and permits, performing investigations, inspections and audits and the administrative enforcement of these activities. Using our Rent Stabilization Program Fee of $156 as a guide, the overall program registration would be $4,680.00 annually. A Fee Study would be required to determine and establish this fee, and an estimated cost for this study would be approximately $20,000.

The City of Oakland established a Vacant Property Tax program in 2019. Using Oakland’s program as a model, staff can estimate potential revenue for a similar tax program here in the City. Since being implemented, Oakland’s program has resulted in applying a tax to approximately 25% of the vacant properties in the city. Their program includes 10 exceptions that excuse participation in the program, including (but not limited to) financial hardship, active construction, and non-profit organization status If the city moved forward with a similar Vacant Property Tax program that would address 25% of the approximately 30 vacant properties in the city (8 properties) and assess the same amount as Oakland ($6000/ property), the resultant revenue would be approximately $48,000.00 annually.

A third potential option would be to identify five to ten (5-10) priority vacant properties and direct staff to coordinate with the City’s Economic Development consultant to contact the property owners and identify opportunities for each property and then work to market the properties for the benefit of the community.

CONCLUSION
Proper management, monitoring and marketing of vacant, underutilized, and abandoned sites are crucial to promoting an economically sustainable environment that impact the quality of life for all residents and visitors alike.
