FROM: Len Gorecki, Assistant City Manager/Director of Public Works Bernardo Iniguez, Public Works Manager

SUBJECT: Consideration and possible action to award a contract to GreenCal Construction, Inc., for the Aquatic Center Weight Room Roof Repair (Specifications No. 19/20-09); and authorize the City Manager to execute a contract with GreenCal, Inc., in a form approved by the City Attorney.

DATE: April 11, 2022

EXECUTIVE SUMMARY

This action would award a contract to GreenCal, Inc. (GreenCal) to perform the work described in the Plans and Specification documents for the Aquatic Center Weight Room Roof Repair (the “Project”).

RECOMMENDATION TO CITY COUNCIL

1) Consider GreenCal’s bid to be reasonable, sufficient funds to be appropriated for the Project, and GreenCal’s bid to be within the limits specified by Public Contract Code § 22032; award a contract to GreenCal for the Project; and authorize the City Manager to execute a contract with GreenCal, in a form approved by the City Attorney; or

2) Alternatively, discuss and take other action related to this item.

FISCAL IMPACT

GreenCal submitted the lowest responsive base bid in the amount of $78,391.53. The Engineer’s estimated cost plus contingency to perform the work was $62,000. Sufficient funds are budgeted in Account No. 011 47220 9000 (Aquatic Center Improvements).

DISCUSSION

This project will be for the repair of the Aquatic Center weight room roof.

On November 22, 2021, the City Council adopted Resolution No. 21-66 authorizing solicitation of informal bids from contractors on the list of qualified contractors for the construction of the Project, in accordance with the Uniform Public Construction Cost Accounting Act (the “Act”).

DISCUSSION – Continued

The Notice Inviting Sealed Bids was furnished to contractors on the list of qualified contractors; however, no prospective bidders attended the mandatory jobsite walk on January 4, 2022 and the City received no bids through the informal bid process. Public Contract Code § 22038(c) of the Act allows the City to carry out a project by force account or negotiated contract if no bids are received through the informal procedure.

Public Works staff accordingly reached out to other potential contractors and solicited bids to perform the work for the Project through negotiated contract. Four bids were received and the names of those bidders and their bid amounts are listed below:

BIDDER BASE BID PRICE
GreenCal, Inc. $78,391.53
4 Seasons Roofing Inc. $92,930.00
ERC Roofing and Waterproofing $98,361.00
FC & Sons Roofing Incorporated $106,040.00

BID ANALYSIS

Staff has reviewed GreenCal’s bid and verified its contractor’s license status, references, and registration with the Department of Industrial Relations. GreenCal is qualified to perform the work described in the Plans and Specification documents for the Project. Staff concludes GreenCal is the lowest responsive and responsible bidder to whom the City should award the negotiated Project contract.

SPECIFICATIONS

The Plans and Specification documents are available for public inspection at the Public Works Department Office, 9944 Flora Vista Street, Bellflower, California until completion of the Project and, subsequently, as official records, will be maintained by the City Clerk’s Office.

ENVIRONMENTAL REVIEW

Pursuant to the California Environmental Quality Act (CEQA) (Public Resources Code §§ 21000, et seq.) and CEQA Guidelines (California Code of Regulations, Title 14, §§ 15000, et seq.), the City conducted an environmental assessment. Based on the environmental assessment, the project was determined to be categorically exempt pursuant to CEQA Guidelines § 15303 (Class 1 - Existing Facilities).
