FROM: Jim DellaLonga, Director of Economic Development

SUBJECT: Consideration and possible action to conduct a public hearing to receive comments on the Fiscal Year 2022-2023 Annual Action Plan (AAP).

DATE: April 25, 2022

EXECUTIVE SUMMARY

Each year, the City must submit an application to HUD for Community Development Block Grant (CDBG) and HOME Investment Partnership (HOME) entitlement funds.

The Annual Action Plan (AAP) serves as the City’s application and details the proposed uses of its funds within a given year. On April 4, 2022, the City was notified by HUD that a waiver had been issued advising cities to not submit Annual Action Plans to HUD until CDBG Funding allocations for FY 22-23 had been received.

RECOMMENDATION TO CITY COUNCIL

1) Continue the public hearing to June 13, 2022; or

2) Alternatively, discuss and take other action related to this item.

FISCAL IMPACT

Last year the City received $943,612 in CDBG funds and $359,523 in HOME funds.

Finalized amounts from HUD for Fiscal Year 2022-2023 have not been determined and are anticipated to be released mid-May of 2022.

PUBLIC NOTICE

On March 25, 2022, a Notice of a 30-Day Public Comment Period and this Public Hearing was published in the Bellflower Herald American (The Wave) newspaper. The AAP was made available for public review and comments from March 25, 2022 through April 25, 2022. At this time, no comments have been received during this period. Any comments received during tonight’s public hearing will be incorporated in the AAP prior to submittal to HUD.

DISCUSSION

On April 4, 2022, the City of Bellflower was notified by HUD that a waiver had been issued advising cities to not submit Annual Action Plans to HUD until CDBG Funding allocations for FY 22-23 had been received. HUD waives 24 CFR 92.212(b) allowing cities to submit their Annual Action Plan 60 days after allocation announcements, but no later than August 16, 2022

Due to the recently issued HUD waiver and given that the Notice of Funding Availability has been published in accordance with the City’s Citizen Participation Plan, staff is requesting that this Public Hearing is continued to June 13, 2022. It is projected that the HUD Allocations will be received mid-May of 2022.

SUBJECT: Consideration and possible action to read by title only, waive further reading, and introduce Ordinance No. 1413 – An
Ordinance adding a new Chapter 12.42 to Title 12 of the Bellflower Municipal Code entitled “Permits Authorizing Events Conducted in City Parks and Facilities.”

DATE: April 25, 2022

EXECUTIVE SUMMARY

The proposed Ordinance adds a new Chapter 12.42 to Title 12 of the Bellflower Municipal Code (BMC). Chapter 12.42 entitled “Permits Authorizing Events Conducted in City Parks and Facilities” clarifies permit requirements for parks and facilities. Among other things, the Ordinance carves out a distinct permitting path for events that significantly feature constitutionally protected free speech; establishes due process procedures related to applications, permitting, permit conditioning, and revocations. Furthermore, the proposed Ordinance and regulations will ensure that City parks remain shared public resources and that opportunities to use the parks for organized and commercial purposes are allocated fairly and consistently.

A Public Hearing will also be held on May 9, 2022 for the City Council to consider a Resolution to adopt all Parks and Recreation Facility Use Fees and the policies and procedures that govern facility use. That Resolution will be considered in conjunction with the second reading of this Ordinance as the items work together.

RECOMMENDATION TO CITY COUNCIL

1) Read by title only, waive further reading, and introduce Ordinance No. 1413; or

2) Alternatively, discuss and take other action related to this item.

FISCAL IMPACT

None.

DISCUSSION

BMC Chapter 12.40 Regulations for Public Parks currently lacks specific permit requirements for events proposed on City parks and recreation facilities, including constitutionally protected free speech events.

The Department of Parks and Recreation routinely issues permits for groups and organizations seeking to utilize outdoor facilities, most commonly used is the athletic field areas. Permittees include youth non-profit groups as well as private, for-profit entities and typically require security deposits, usage fees, a facility or ballfield use agreement, and insurance. Over the years, it has become increasingly difficult for Parks and Recreation staff, Code Enforcement, and the Public Safety Department to regulate unpermitted groups due to the lack of specific BMC requirements and regulations. The COVID-19 pandemic has escalated concerns as permitted groups have abided by regulations, restrictions, and the temporary suspension of field permits; however unpermitted groups have become more common and fail to go through the formal permitting process for field space and refuse to vacate the facilities when contacted by staff. There has recently been an influx of groups coordinating and implementing full-fledged tournaments without permits, which can create conflict with groups in good standing and frustrate the City’s ability to efficiently coordinate its outdoor facilities’ use.

The proposed Ordinance and regulations will ensure that City parks remain shared public resources and that opportunities to use the parks for organized and commercial purposes are allocated fairly and consistently, as well as assisting staff with a defined enforcement mechanism.

CEQA

The proposed Ordinance is exempt from review under the California Environmental Quality Act (California Public Resources Code §§ 21000, et seq., “CEQA”) and CEQA regulations (14 California Code of Regulations §§ 15000, et seq.) because it clarifies existing regulations related to the unlawful use of public property; does not involve any commitment to a specific project which could result in a potentially significant physical impact on the environment; and constitutes an organizational or administrative activity that will not result in direct or indirect physical changes in the environment. Accordingly, this Ordinance does not constitute a “project” that requires environmental review (see specifically 14 CCR § 15378(b)(2, 5)).

E. The concentration of persons, animals, and/or vehicles at the event prevents public safety and/or emergency services from reaching areas at or contiguous to the event;

F. The size of the event will overextend public safety and/or emergency services to the extent that the safety of event participants, attendees, and/or the remainder of the city will be seriously jeopardized; provided, however, that this does not authorize denying a permit because of the need to protect participants from the conduct of others;

G. The location of the event will substantially interfere with previously scheduled construction or maintenance work at the event site;

H. The application was not timely submitted and there is insufficient time to investigate and process the application pursuant to the timelines herein;

I. The applicant has any outstanding financial obligations or debts of any kind to the City including, without limitation, outstanding licensing or permitting fees and administrative citation fines;

J. The proposed event conflicts or interferes with an event previously permitted, or about to be permitted, for the same location, date, and time; or

K. The nature or size of the event threatens to cause significant damage to a park or park property, including, without limitation, landscaping or natural vegetation; provided, however, this does not authorize denying a permit because of threatened damage to a park or park property caused by the actions of persons not conducting such event.

12.42.200 Alternative Time, Place, or Manner.

If the Director denies a permit for an event that would be acceptable by changing the event’s time, place, or manner, then the Director will inform 12 City of Bellflower
Ordinance No. 1413

Page 11 of 19 ends

the applicant of such alternatives. Should the applicant accept the alternative time, place, or manner then the Director will issue a permit in accordance with this chapter.

12.42.210 Notice of Denial. Where the Director denies a permit, the Director will serve notice to the applicant and provide copies to the city attorney.

12.42.220 Indemnification Agreement.

Permittees must enter into a hold harmless agreement, in a form approved by the city attorney, with the city which will, in part, indemnify city, its officers, employees, and agents, from any liability arising from permittee’s event. Such an agreement will be filed with the Director before a permit is issued.

12.42.230 Liability Insurance.

A. Insurance Requirements. Except as otherwise provided by this chapter, permittees must obtain public liability insurance from an insurance company licensed to do business in the state of California and having a financial rating in Best’s Insurance Guide of not less than “A:VII.” Such insurance must provide “occurrence” coverage against liabilities for death, personal injury or property damage arising out of or in any way connected with such event.

The amount of such insurance will be based upon the city’s insurance guidelines and reflect the size and nature of the event and the risks foreseeably involved. Such insurance will name the city , its elected and appointed officials, employees and volunteers, and agents as additional insureds under the coverage afforded. In addition, such insurance must be primary and noncontributing with respect to any other insurance available to the city and will include a severability of interest (cross-liability) clause. If alcoholic beverages are sold or served at the event, the policy must also include an endorsement for liquor liability in an amount not less than $1,000,000.00.

B. Certificates of insurance. A copy of the policy or a certificate of insurance along with all necessary endorsements, in a form approved by the city’s risk manager, must be filed with the Director not less than 10 business days, except as otherwise provided in this chapter, before the date of the event unless the Director for good cause waives the filing deadline.

12.42.240 Waiver of Insurance Requirements.

The Director must waive insurance required by this chapter for a free speech permit.

12.42.250 Special Permit Conditions.

A. The Director may condition a permit with reasonable requirements concerning the time, place, or manner of holding such event as necessary to protect the safety of persons and property or to control vehicular and pedestrian traffic in and around the site of the event, provided that these requirements are not imposed in a manner that will unreasonably restrict the exercise of free speech rights.

B. Conditions may include, without limitation:

1. Accommodating an event’s pedestrian and vehicular traffic, including restriction of events to a particular park;

2. Avoiding substantial interference with public safety and/or emergency service access;

3. Limiting the number and type of vehicles, animals, or structures to be displayed or used in the event;

4. Having city personnel inspecting and approving stages, booths, and other structures or vehicles to be used or operated in the event, in order to ensure that such structures or vehicles are safely constructed and can be safely operated;

5. Providing the city a security deposit for repair and/or additional maintenance if the event uses structures, displays or uses large animals, operates water stations, food sales, beverage sales, and/or sales of other goods or services;

6. Providing and using traffic cones and barricades;

7. Providing and operating first aid stations or sanitary facilities, including sanitary facilities accessible to the disabled;

8. Providing and using garbage containers, and cleaning and restoring the event site upon termination of the event;

9. Using sound amplification equipment, and restricting the amount of noise generated by motors and other equipment used in the course of the event;

10. The manner for providing notice of permit conditions to event participants;

11. Providing and using emergency services;

12. Obtaining any and all licenses or permits required by this code or California law for the sale or distribution of food, beverages, or other goods or services at the event, including, without limitation, a valid health permit as required by California Health and Safety Code § 113920, and any successor statute or
regulation, if food is distributed to the public more than three days in any 90-day period;

13. Providing electricity, gas, and water for the event;

14. Providing signage and barricades that may be necessary to avoid conflicts between persons participating in the event and other persons using the park in and around the site of the event or which may be necessary to protect the park, landscaping, or natural vegetation in and around site of the event;

15. Providing monitors and security personnel that may be necessary to safely carry out the event;

16. Permitting access to the site of the event through park gates at times when gates are normally closed in order to prepare for an event or to clean up and remove equipment and structures at the conclusion of the event;

17. Permitting overnight camping by persons engaged in preparing for the event or providing overnight security for equipment and structures utilized in such event; and

18. Providing for the manner in which alcohol sales and service, if any, are conducted.

12.42.260 Subsequent Conditions.

A. The Director may add additional conditions to previously issued permits upon learning or discovering facts not previously disclosed or reasonably discoverable.

B. Should subsequent conditions be required, the Director must serve written notice on the permittee of this decision. When acting upon information obtained 24 hours before an event, the Director may orally inform the permittee, and city personnel overseeing the event, of the new conditions.
15 City of Bellflower
Ordinance No. 1413

Page 14 of 19 ends

C. Except where otherwise provided, a permittee may seek review of imposition of subsequent conditions to the Director as provided in this chapter. The City Manager’s decision is a final determination.

There is no right of city council appeal.

D. Except where otherwise provided, an applicant conducting a free speech event may appeal the decision to impose subsequent conditions through a hearing before the City Manager. The City Manager’s decision is a final determination. There is no right of city council appeal.

1. An applicant is entitled to an appeal hearing provided the applicant appeals the Director’s decision within 24 hours of receiving notice of such conditions and the event’s purpose is for free speech.

2. The hearing will be at the City Manager’s office at 4:00 p.m. the next business day after the hearing is requested, unless otherwise agreed upon. The City Manager must issue a
decision orally at the conclusion of the hearing and also notify the applicant and the Director in writing of the City Manager’s decision. Any notification will describe, with particularity, the facts and reasons supporting the decision.

12.42.270 Right of Administrative Review.

Except as otherwise provided, an applicant may request administrative review of the Director’s decision pursuant to this chapter.

12.42.280 Time for Administrative Review.

A. Except as otherwise provided, a request for review must be commenced within five days from the date on which written notice of the Director’s decision is served on the applicant/permittee.

B. If the request is untimely, the Director may, nevertheless, extend the time for commencing such review for good cause shown.

12.42.290 Commencement of Administrative Review.

A request for administrative review must be on a form provided by the Director and contain the following information:

A. The name, address, and telephone number of the person making the request;

16 City of Bellflower
Ordinance No. 1413

Page 15 of 19 ends

B. A description of the decision, determination, or order which is the subject of the review, and the date such decision, determination, or order was made or issued;
C. A brief description of all grounds for making the request; and D. Such other information as may be required by the Director.

12.42.300 Administrative Review.

A. Upon request for administrative review being filed, the Director must promptly provide a copy of the notice to the City Manager; B. Upon reviewing a request for review from the Director, the City Manager must review the request, and, within 10 days of receiving the request notice, provide the applicant with a written notification that:

1. The Director’s decision is affirmed;

2. The Director’s decision is modified; or

3. The Director’s decision is reversed and a permit is issued or issued without special conditions.

C. The City Manager may, but is not required to, conduct a hearing at a time and place mutually agreeable to the parties. If the parties cannot agree on a time or place, then it will be held the next business day at 4:00 p.m. at the City Manager’s office.

D. In addition to the other provisions of this chapter, any notification to the requestor must set forth any modifications to the Director’s decision.

12.42.310 City Council Appeal.

Unless otherwise provided, an applicant may appeal the City Manager’s decision to the city council within 10 days of that decision, as provided elsewhere in this code or by city policy and procedure.

12.42.320 Free Speech Events.

A. The applicant may seek, in writing, administrative review by the City Manager within one business day of the Director’s oral or written notification, whichever is first, of a denial, revocation, or subsequent conditioning. An administrative hearing will be held at a time and place mutually agreeable to the parties. If the parties cannot agree 17 City of Bellflower
Ordinance No. 1413

on the time or place, then it will be held the next business day after the Director’s decision at 4:00 p.m. in the City Manager’s office.

The City Manager may issue a decision orally at the conclusion of the hearing, but must notify the applicant and the Director in writing of the City Manager’s decision. Any notification will describe, with particularity, the facts and reasons supporting the decision.

B. The City Manager’s decision:

1. Is a final determination without right to city council appeal if the applicant waived the applicant’s right to city council appeal as provided in this chapter;

2. If the right to city council appeal is not waived, may be appealed to the city council in writing within two business days of either oral or written notification of the City Manager’s decision, whichever is first.

C. Applicant will be deemed to have waived administrative review rights should the applicant fail to:

1. File a completed application at least two days before an event;

2. Seek review of the Director’s decision; or

3. Attend the administrative hearing personally or through an authorized representative.

12.42.330 Permit Revocation.

A. The Director may revoke a permit upon learning or discovering facts requiring permit denial not previously disclosed or reasonably discoverable.

B. The Director may revoke an event permit when the permittee and/or event violates the permit’s terms and conditions, or when event participants violate applicable laws or regulations; provided, however, that this subsection will not authorize revoking a permit because of the need to protect participants from the conduct of others; and, provided further, that the Director will not revoke a permit without warning the permittee and allowing him/her to correct the violation(s) within a reasonable time.

C. If the Director revokes a permit before the date of the event, the Director must immediately serve written notice of revocation on the permittee and provide copies of the notice to all city personnel charged with carrying out any responsibility under this chapter. 18 City of Bellflower
Ordinance No. 1413

Page 17 of 19 ends

If the Director revokes a permit on the day of the event after learning of facts justifying revocation less than 24 hours before the event commences, the Director must announce such action to the event participants, to those city officers and employees monitoring or controlling traffic during the event, and to the person in charge of the event, if such person can be located at the site of the event.

Written notice must be delivered after such action to the permittee and Director.

D. An applicant is entitled to an appeal hearing before the City Manager provided:

1. The applicant appeals the Director’s decision within 24 hours of receiving notice of such conditions; and

2. The event is scheduled at least 48 hours after the hearing time.

The hearing will be at the City Manager’s office at 4:00 p.m. the day after the hearing is requested, unless otherwise agreed upon. The City Manager must issue a decision orally at the conclusion of the hearing and notify the applicant and the Director of the City Manager’s decision.

E. The City Manager’s decision is a final determination with no right of city council appeal.

F. The Director or City Manager can only revoke a permit for a free speech event after consulting with the city attorney.

12.42.340 Expedited Judicial Review.

Pursuant to Code of Civil Procedure Section 1094.8(c), and any successor statute or regulation, actions related to the conditioning or denial of free speech event permits in this chapter are designated for expedited judicial review pursuant to the procedure set forth in Code of Civil Procedure Section 1094.8.

12.42.350 Emergency Suspension of Event.

The Director and any sworn public safety officer may temporarily suspend an event whenever there is an emergency that requires such action to protect public safety. Should this occur, the permittee and event participants must immediately comply with the suspending officer’s instructions. The Director will immediately attempt to notify the applicant orally and will notify the applicant and the City Manager in writing, within 24 hours after the suspension, citing with particularity the facts and the reasons for the suspension.

12.42.360 Cordoning Off Event Site.

The City Manager, or designee, is authorized and directed to establish traffic and/or crowd control devices on or within the city’s streets, parking facilities, sidewalks, or other public rights-of-way, and to undertake other actions necessary to cordon off the site of an event. In addition, the City Manager, or Director, will, when appropriate, cause the route or site of such event to be posted as a no parking zone for the duration of the event and sufficiently in advance thereof as may be necessary to prevent vehicles from parking along the site of the event.

12.42.370 Public conduct during events.

A. Interference with Event. It is unlawful to physically obstruct, impede, or otherwise interfere with any event authorized by a permit issued under this chapter or with any person, animal, or vehicle participating or used in such event.

B. Prohibited Parking. It is unlawful to park vehicles along or within any portion of the site of an event authorized by a permit, when the route or site has been posted as a no parking zone by the Director in a manner authorized by this chapter.

C. The Director may revoke an event permit when the permittee and/or event violates the permit’s terms and conditions, or when event participants violate applicable laws or regulations; provided, however, that this subsection will not authorize revoking a permit because of the need to protect participants from the conduct of others; and, provided further, that the Director will not revoke a permit without warning the permittee and allowing him/her to correct the violation(s) within a reasonable time.”
SECTION 2. Environmental Review. This ordinance is exempt from review under the California Environmental Quality Act (California Public Resources Code §§ 21000, et seq., “CEQA”) and CEQA regulations (14 California Code of Regulations §§ 15000, et seq.) because it clarifies existing regulations related to the unlawful use of public property; does not involve any commitment to a specific project which could result in a potentially significant physical impact on the environment; and constitutes an organizational or administrative activity that will not result in direct or indirect physical changes in the environment. Accordingly, this Ordinance does not constitute a “project” that requires environmental review (see specifically 14 CCR § 15378(b)(2, 5)).

SECTION 4. Construction. This Ordinance must be broadly construed in order to achieve the purposes stated in this Ordinance. It is the City Council’s intent that the provisions of this Ordinance be interpreted or implemented by the City and others in a manner that facilitates the purposes set forth in this Ordinance.

SECTION 5. Severability. If any part of this Ordinance or its application is deemed invalid by a court of competent jurisdiction, the City Council intends that such invalidity will not affect the effectiveness of the remaining provisions or applications and, to this end, the provisions of this Ordinance are severable.

SECTION 6. The City Clerk, or her duly appointed deputy, is directed to certify the passage and adoption of this Ordinance; cause it to be entered into the City of Bellflower’s book of original ordinances; make a note of the passage and adoption in the records of this meeting; and, within 15 days after the passage and adoption of this Ordinance, and cause it to be published or posted in accordance with California law.

THE LOS ANGELES COUNTY POOLED SURPLUS INVESTMENTS
The Treasurer and Tax Collector (the Treasurer) of Los Angeles County has the delegated authority to invest funds on deposit in the County Treasury (Treasury Pool).

As of February 28, 2022, investments in the Treasury Pool were held for local agencies including school districts, community college districts, special districts and discretionary depositors such as cities and independent districts in the following amounts:

Invested Funds
Local Agency (in billions)
County of Los Angeles and Special Districts $17.737
Schools and Community Colleges 20.156
Discretionary Participants 4.495
Total $42.388
The Treasury Pool participation composition is as follows:

Non-discretionary Participants 89.40%
Discretionary Participants:

Independent Public Agencies 9.97%
County Bond Proceeds and Repayment Funds 0.63%
Total 100.00%
Decisions on the investment of funds in the Treasury Pool are made by the County Investment Officer in accordance with established policy, with certain transactions requiring the Treasurer's prior approval. In Los Angeles County, investment decisions are governed by Chapter 4 (commencing with Section 53600) of Part 1 of Division 2 of Title 5 of the California Government Code, which governs legal investments by local agencies in the State of California, and by a more restrictive Investment Policy developed by the Treasurer and adopted by the Los Angeles County Board of Supervisors on an annual basis. The Investment Policy adopted on March 9, 2021, reaffirmed the following criteria and order of priority for selecting investments:

1. Safety of Principal

2. Liquidity

3. Return on Investment
The Treasurer prepares a monthly Report of Investments (the Investment Report) summarizing the status of the Treasury Pool, including the current market value of all investments. This report is submitted monthly to the Board of Supervisors. According to -11-

the Investment Report dated March 31, 2022, the February 28, 2022 book value of the Treasury Pool was approximately $42.388 billion, and the corresponding market value was approximately $41.585 billion.

An internal controls system for monitoring cash accounting and investment practices is in place. The Treasurer's Compliance Auditor, who operates independently from the Investment Officer, reconciles cash and investments to fund balances daily. The Compliance Auditor’s staff also reviews each investment trade for accuracy and compliance with the Board adopted Investment Policy. On a quarterly basis, the County’s outside independent auditor (External Auditor) reviews the cash and investment reconciliations for completeness and accuracy. Additionally, the External Auditor reviews investment transactions on a quarterly basis for conformance with the approved Investment Policy and annually accounts for all investments.

The following table identifies the types of securities held by the Treasury Pool as of February 28, 2022:

Type of Investment % of Pool
Certificates of Deposit 4.72

Municipal Obligations 0.07
Corporate Notes & Deposit Notes 0.08
Repurchase Agreements 0.00
Asset Backed Instruments 0.00
Other 0.00

TO: Honorable Mayor and Members of the City Council

ATTENTION: Jeffrey L. Stewart, City Manager

FROM: Elizabeth Corpuz, Director of Planning and Building Services

SUBJECT: Consideration and possible action to approve the 2022 Fireworks Permits.

DATE: April 25, 2022

EXECUTIVE SUMMARY

Bellflower Municipal Code (“BMC”) Chapter 8.16 regulates the use and sale of fireworks in the City. Chapter 8.16 establishes the procedure for obtaining a permit. Each year, a list of all qualified applicants is presented to the City Council for formal acceptance.

Upon approval by the City Council, Fireworks Permits are issued.

RECOMMENDATION TO CITY COUNCIL

1) Approve fourteen (14) Fireworks Permits; or

2) Alternatively, discuss and take other action related to this item.

FISCAL IMPACT

All fourteen (14) applicants submitted the required fees of $106.00 for the Fireworks Permit and $58.00 for the Miscellaneous Permit, for a total of $2,296.00.

A $150.00 cash deposit was also collected from each applicant, for a total of $2,100.00, to guarantee faithful performance of the terms and provisions of the BMC. The deposit is refundable upon expiration of the permit and removal of the stand, less any actual costs incurred by the City as a result of a permittee's failure to perform. The total amount collected is $4,396.00. All fees were collected before April 1, 2022.

DISCUSSION

Per BMC Chapter 8.16, the process in effect for applying for a Fireworks Permit is as follows:

 In December, an invitation letter from the City is mailed out to all previous Fireworks Permit Holders requesting they once again apply for a Fireworks Permit. This “Letter of Intent” is the first step in the application process.

 Upon receipt of the “Letters of Intent,” a list is generated of those who wish to obtain a Fireworks Permit. Pursuant to BMC Subsection 8.16.030(D), the maximum number of permits to be issued is fourteen (14).

DISCUSSION – Continued

 Following the determination of the number of applications to be submitted, a letter is mailed in March to all eligible applicants indicating their current Fireworks Permit status and, depending on their status, may or may not contain a revised Fireworks Permit Application, Business License, Miscellaneous Permit, and Electrical Permit.

 All applications are due back to the City by April 1, 2022, and each application for a Fireworks Permit is required to include the following:
 A copy of the rental agreement with the landowner;
 A copy of the agreement with the fireworks supplier;
 A diagram showing the exact location of the stand in relation to adjacent streets and any other structures on the lot or adjacent lots, and onsite traffic circulation;
 A list containing a minimum of twenty (20) of the organization's members who either reside in the City, are employed in the City, or are owners or operators of a business or other establishment located in the City, including their names, addresses, and telephone numbers, as of the date of the application;
 An application for a Miscellaneous Building Permit for location and erection of a temporary structure, accompanied by the requisite permit fees, as determined by separate Resolution of the City Council;  An application for an Electrical Permit for any stand using an electrical power source other than a portable generator, accompanied by the requisite permit fees, as determined by separate Resolution of the City Council; and
 A $150.00 cash deposit to guarantee faithful performance of the terms and provisions of BMC Subsection 8.16.020(E)(7), refundable upon expiration of the permit and removal of the stand, less actual costs incurred by the City as a result of the permittee's failure to perform.

 The list of all qualified applicants is then presented to the City Council for formal acceptance (at the April 25, 2022, City Council meeting) and upon approval by the City Council, Fireworks Permits will be issued.

 Fireworks Stands are allowed to be erected starting on noon of June 21, 2022, and a City Inspector will then inspect all fourteen (14) stands.

 Fireworks Stands are permitted to sell merchandise from July 1 through July 4, 2022.

 By July 10, 2022, all Fireworks Stands are to be dismantled and the location cleaned of all debris.

 The $150.00 cash bond will then be refunded provided the stand locations are returned to their previous state.

Dear Dakota,

I hope that you’re doing well. I wanted to share my notes for the City Council meeting public comment. Unfortunately I will not be able to attend (4/25) in person however I’m hoping that my comments can be read aloud for the Council.

Please know that I have spoken with Joel about my concerns regarding public safety and feel good about our conversation. He has promised to dedicate patrol to Woodruff Place by shifting some shifts around. Having said this, I feel that it is important to publicly document the communities concerns.

Here is my public comment:

Appreciation: Woodruff Place property owners are thankful to Joel Hockman and Jerry Stock for their support in addressing some of the parking and enforcement challenges associated with the overcrowding on the street. They met with property owners on the sidewalk to personally inspect and see the experience from a resident/property owner perspective.

Problem: Public safety/nuisance concerns
Currently when residents call the Bellflower sub station after 7PM they are routed to the Lakewood Sherriffs Dispatch.

There is no urgency on their part to respond to residents calls for help addressing illegal activity like suspected drug deals (around the area of 15301‐15311 Woodruff Place) and or drinking in public and loitering. People involved in these activities have learned that there is no surveillance or consequence. People also routinely park in front of the red curb that is located between 15134 Woodruff Pl. and 15142 Woodruff Pl. and consume alcohol and smoke marijuana in the car.

Request:
‐We are requesting routine patrol on Woodruff Place after 7 PM during the week and on weekends. ‐Installation of a physical barrier (i.e. large flower pot) in front of red zone located between 15134 Woodruff Pl. and 15142 Woodruff Pl. (Crime prevention through environmental design/barriers).

Problem: Overcrowding has created the parking issues, ongoing parking violations, increasing public nuisances, and straining City resources. Multi‐unit landlords need to be held accountable to their strain on the City.

Request:
‐Increase taxes on multi‐unit landlords and use the increased revenue towards City patrolling and beatification ‐AND/OR implement maximum occupancy of 2 adults per bedroom and one car per bedroom. Enforce and fine the landlords and tenants (similar to airbnb). Post a sign in front of each unit (indicating occupancy) so that the community can call and report on specific units while maintaining anonymity.

Problem: There are multiple apartments on Woodruff Place therefore almost every day, there is someone moving out.

Large and small items are left on the sidewalks. It’s an eyesore, indicator that no one cares, and brings property values down.

Request:

2 ‐Fine apartment owners, hold them accountable to the trash their business is producing at the City’s expense. ‐Schedule large item pick ups 3 times a week, instead haphazardly responding to resident calls

Concern: The City of Bellflower has contracted police services from Lakewood Sherriffs since 1958. The Lakewood Sherriffs also vends their police services to Artesia, Hawaiian Gardens, Paramount, and an unincorporated area. The population of the 5 Cities and the unincorporated area they also serve, exceeds a population of 250,000 and it’s a large geographic area. Bellflower is not a priority and all things being equal on a call, who receives the attention? When does this contract get renewed?

Request: Revisit the terms of the current contract with Lakewood Sherriffs, are they delivering on the terms? Also, put this contract out to bid so that other agencies can compete for Bellflower’s business.

Thank you,
Lupe Lugo 562‐644‐0940

Ordinance for Consideration - Item 12.A.

Consideration and possible action to read by
title only, waive further reading, and introduce
Ordinance No. 1413 — An Ordinance adding a
new Chapter 12.42 to Title 12 of the Bellflower
Municipal Code entitled "Permits Authorizing
Events Conducted in City Parks and Facilities."
April 25, 2022

BACKGROUND
➢ The proposed Ordinance adds a new Chapter 12.42 to Title 12 of the Bellflower Municipal Code (BMC). Chapter 12.42 entitled "Permits Authorizing Events Conducted in City Parks and Facilities" clarifies permit requirements for parks and facilities.
➢ The current BMC lacks specific permit requirements for events proposed on City parks and recreation facilities, including constitutionally protected free speech events. ➢ The current permitting process for the City's parks and recreation facilities with controlled access (i.e. indoor and fenced in facilities) is efficient and well regulated. This proposed ordinance reinforces those regulations while
providing strengthened regulations for open areas of parks that are more challenging to regulate including athletic fields, sport courts, fitness centers, and picnic areas.

DISCUSSION
➢ Key elements of the proposed Ordinance include:
➢ Carves out a distinct permitting path for events that significantly feature constitutionally protected free speech.
➢ Establishes due process procedures related to applications, permitting, permit conditioning, and revocations.
➢ Ensures that City parks remain shared public resources and that opportunities to use the parks for organized and commercial purposes are allocated fairly and consistently.

DISCUSSION
➢ A Public Hearing will also be held on May 9, 2022 for the City Council to consider a Resolution to adopt all Parks and Recreation Facility Use Fees and the policies and
procedures that govern facility use. That Resolution will be considered in conjunction with the second reading of this Ordinance as the items work together.

RECOMMENDATION
1) Read by title only, waive further reading, and introduce Ordinance No. 1413; or
2) Alternatively, discuss and take other action related to this item.

5 What is Reliability?
In simplest terms:

Having dependable electricity when you need it.

Outages:

Maintenance outages (aka planned outages)
Repair outages (aka unplanned outages)
Sustained Outage = An outage lasting > 5 minutes
Momentary Outage = An outage lasting ≤ 5 minutes
Major Event Day (MED)
Major Event Day (MED) : A day in which the daily system SAIDI exceeds a threshold value. For the purposes of calculating daily system SAIDI, any interruption that spans multiple calendar days is accrued to the day on which the interruption began. Statistically, days having a daily system SAIDI greater than a threshold value are days on which the energy delivery system experienced stresses beyond that normally expected (such as severe weather). MEDs are sometimes excluded in reporting; in those reports the exclusions will be noted.
