FROM: P.J. Mellana, Director of Parks and Recreation

SUBJECT: Consideration and possible action to conduct a public hearing to consider adopting Resolution No. 20-17 – A Resolution adopting Parks and Recreation Facility Use Fees, establishing facility use policies and procedures, and superseding Resolution No. 09-72; and waive further reading and adopt Ordinance No. 1413 – An Ordinance adding a new chapter 12.42 to Title 12 of the Bellflower Municipal Code entitled “Permits Authorizing Events Conducted in City Parks and Facilities.”

DATE: May 9, 2022

EXECUTIVE SUMMARY

The current Parks and Recreation Facility Use Fees were adopted on November 23, 2009. The fees established by Resolution No. 09-72 have not been updated since that date. Since 2009, staff has regularly reviewed policies and fees, and monitored revenue related to parks and recreation facility rentals. While operating costs were increasing incrementally, demand for affordable facility rentals also increased. Staff was prepared to bring updated fees to the City Council in 2020, but the response to the COVID-19 pandemic shut down facility operations and took priority. The attached Resolution for City Council consideration is to adopt all Parks and Recreation Facility Use Fees presented to the City Council during the public hearing process, and adopt the policies and procedures governing such facility use. The City engaged Willdan Financial Services (Willdan) to determine operational costs of providing facility use services and examine the cost recovery of such activities for the purpose of recommending an update of the associated fees.

The proposed Ordinance adds a new chapter 12.42 to Title 12 of the Bellflower Municipal Code (BMC). Chapter 12.42 entitled “Permits Authorizing Events Conducted in City Parks and Facilities” clarifies permit requirements for parks and facilities. Among other things, the Ordinance carves out a distinct permitting path for events that significantly feature constitutionally protected free speech; establishes due process procedures related to applications, permitting, permit conditioning, and revocations. Furthermore, the proposed Ordinance and regulations will ensure that City parks remain shared public resources and that opportunities to use the parks for organized and commercial purposes are allocated fairly and consistently.

RECOMMENDATION TO CITY COUNCIL

1) Open the public hearing, take testimonial and documentary evidence, and after considering the evidence, adopt Resolution No. 22-17; and

2) Waive further reading and adopt Ordinance No. 1413; or

3) Alternatively, discuss and take other action related to this item.

FISCAL IMPACT

Through the end of FY 2018-2019 a five-year average of $251,587 in annual revenue was recovered from groups using City parks and recreation facilities. There is a sharp decline in revenue since that time due to the shutdown of City facilities resulting from COVID-19 and the inability to rent parks and recreation facilities. It is anticipated that this decline will be a factor over the next several years as the City resumes full operations and users demand increases again.

DISCUSSION – FEES

Willdan’s report identifies cost recovery for the City’s services and recommended level of recovery determined through discussion with departmental staff. Additionally, the report states that typically, full cost recovery is not the goal for facility use fees as there is a general benefit inherent to such services. Historically, City policy has been in line with this philosophy for parks and recreation facility use.

Attached for review and discussion is the Parks & Recreation Facility Fee Study, proposed Fee Schedule, Description of Classifications, and Facility Use Policies and Procedures.

DISCUSSION – PERMITTING ORDINANCE

BMC Chapter 12.40 Regulations for Public Parks currently lacks specific permit requirements for events proposed on City parks and recreation facilities, including constitutionally protected free speech events.

The Department of Parks and Recreation routinely issues permits for groups and organizations seeking to utilize outdoor facilities, most commonly used is the athletic field areas. Permittees include youth non-profit groups as well as private, for-profit entities and typically require security deposits, usage fees, a facility or ballfield use agreement, and insurance. Over the years, it has become increasingly difficult for Parks and Recreation staff, Code Enforcement, and the Public Safety Department to regulate unpermitted groups due to the lack of specific BMC requirements and regulations. The COVID-19 pandemic has escalated concerns as permitted groups have abided by regulations, restrictions, and the temporary suspension of field permits; however, unpermitted groups have become more common and fail to go through the formal permitting process for field space and refuse to vacate the facilities when contacted by staff. 2 Staff Report – Parks and Recreation Facility Use Fees and Permitting Ordinance May 9, 2022

Page 3 of 3 ends

DISCUSSION – PERMITTING ORDINANCE – Continued

There has recently been an influx of groups coordinating and implementing full-fledged tournaments without permits, which can create conflict with groups in good standing and frustrate the City’s ability to efficiently coordinate its outdoor facilities’ use.

The proposed Ordinance and regulations will ensure that City parks remain shared public resources and that opportunities to use the parks for organized and commercial purposes are allocated fairly and consistently, as well as assisting staff with a defined enforcement mechanism.

CEQA

The proposed Ordinance is exempt from review under the California Environmental Quality Act (California Public Resources Code §§ 21000, et seq., “CEQA”) and CEQA regulations (14 California Code of Regulations §§ 15000, et seq.) because it clarifies existing regulations related to the unlawful use of public property; does not involve any commitment to a specific project which could result in a potentially significant physical impact on the environment; and constitutes an organizational or administrative activity that will not result in direct or indirect physical changes in the environment. Accordingly, this Ordinance does not constitute a “project” that requires environmental review (see specifically 14 CCR § 15378(b)(2, 5)).

1. Name and Purpose.

a) Name. This Policy may be referred to as the City’s “Parks and Recreation Facility Use Policy”

b) Purpose.

i) This policy is adopted for the purpose of regulating events conducted in City parks and facilities. Among other things, this policy provides Parks and Recreation Department personnel with the authority to issue facility use permits for City-owned facilities, operated by the Department of Parks and Recreation.

2. Policy and General Conditions. The Director of Parks and Recreation (“Director”), or designee, may review all requests for use of parks and determine the availability of the facility requested.

a) Except as otherwise provided, the Director is authorized to administer and implement this Policy.

b) For purposes of this Policy, the term “City-owned facilities” does not include public streets, alleys or parking lots, nor does it include entire buildings, structures, entire parks, or general open space areas. In the case of these excluded City facilities, availability, terms, and conditions of use and user fees will be determined by the Director, or designee, on a case-by-case basis; or may be required to go through the City’s Temporary Use Permit (TUP) process.

c) Use of public parks and recreation facilities owned by the City of Bellflower may be authorized by the Director, or designee. d) The City Manager may, but is not required to, grant federal, state, and county government agencies (except the Bellflower Unified School District) serving the Bellflower community permission to use City facilities if it is available. Facilities may not be reserved for more than two consecutive days. Such government agencies may be charged a cleaning fee for such use.

e) Subject to the approval of the Director, organizations in Category II of the Description of Classifications may make periodic temporary use of City facilities for events of direct benefit to the Bellflower community up to four times in a 10 City of Bellflower May 9, 2022

calendar year. In such cases, the Director, or designee, will require those groups to make maximum use of their own volunteer and professional staffs to support those events, including clean-up of the facility after the event. Organizations in these categories wishing to use City facilities for more than four events in a calendar year be assessed fees at the same rate as non-profit organizations and service clubs that are based in Bellflower and that do not receive financial support from the City.

f) Organizations in Category III, Co-sponsored Bellflower non-profit youth service and non-profit youth sports organizations, may make periodic temporary use of City facilities. In such cases, the Director, or designee, will require those groups to make maximum use of their own volunteer and professional staffs to support those events.

Organizations in Category III must meet the following general criteria and conditions to be granted Co-sponsored status:

i) Organizations must provide proof of incorporation within the United States and be registered with the California Secretary of State; proof of nonprofit, tax- exempt status under Internal Revenue Code § 501(c)(3) and (6).

iii) Organizations must not have any outstanding financial obligations or debts of any kind to the City including, without limitation, outstanding licensing or permitting fees and administrative citation fines.

iv) Organizations must demonstrate that they are in good standing with all applicable state and federal agencies, including the City of Bellflower.

As circumstances warrant, this may include Sheriff’s deputies, armed or unarmed sponsor-provided security personnel, and/or sponsor- provided individuals designated to safeguard attendees and the City-owned facility. 5. Any activity where the nature of the activity necessitates reservation of a park, or portion thereof, before the activity of the applicant’s exclusive use or where a permit applicant otherwise seeks to reserve a park, or portion thereof, before the activity for the applicant’s exclusive use.

D. “Event” does not mean any of the following:

A. The Director is authorized to administer and implement this chapter and the City’s Parks and Recreation Facility Use Policy, including without limitation, receiving and reviewing applications and issue, denying, or revoking permits as authorized by council resolution.

B. The Director may promulgate regulations implementing this chapter, including without limitation, regulations addressing authorization procedures; permit type issuance requirements and methods; indemnification and proof of insurance; limits on locations, hours and group size restrictions; and other necessary regulations. Those regulations will ensure City parks remain shared public resources with equitable opportunities for various uses.

12.42.040 Permit required.

Except as otherwise provided, it is unlawful for any person to sponsor or conduct an event in a park unless authorized by a permit issued pursuant to this chapter.

12.42.050 Notices.

12.42.060 Establishing Fees.

The city council will establish all fees applicable to this chapter, including, without limitation, the basic rate, by resolution.

12.42.070 Application Fee.

Applications for a permit authorizing an event in a park must be accompanied by an application fee based on the estimated administrative costs incurred by the city for processing applications and issuing permits.

12.42.080 Free Speech Events.

The Director must waive any fee required by this chapter for any permit authorizing a free speech event upon proof of the applicant’s inability to pay, which must be supported by a financial declaration.

12.42.090 Basic Rate.

The city will not issue a permit pursuant to this chapter unless the permittee has paid the city’s basic rate according to the categories set forth and authorized by council resolution.

12.42.100 Additional Use Fee.

A condition of issuing a permit is that the permittee must pay the city additional park use fees equal to the city’s total estimated cost for providing city personnel and/or equipment, if any, needed to monitor an event or otherwise provide city services for, or in connection with, the event. These fees will be determined by the Director based on the estimate of the Director as to the number and hours of employment of city personnel necessary to control the event or otherwise provide city services for or in connection with such event.

12.42.110 Time for Depositing Fees.

A permit is not valid unless, in addition to the other conditions contained in this chapter, the permittee pays all additional use fees to the city within fifteen business days of the event permit date.

12.42.120 Refunds.

A. The Director will refund all fees submitted pursuant to this chapter, except for the application fee, if a permittee cancels a permit 90 calendar days or more before the date of an event.

37 City of Bellflower
Ordinance No. 1413

Page 6 of 19 ends

B. If a permittee cancels a permit between 89 and 60 calendar days before the event, the Director will refund fifty percent (50%) of the basic rate fees and all other fees excluding the initial application fee and any fees for cancelled services such as security, law enforcement or insurance incurred by the city.

C. If a permittee cancels a permit 59 calendar days or less before the event, the Director will refund twenty-five percent (25%) of the basic rate fees and all other fees excluding the initial application fee and any fees for cancelled services such as security, law enforcement or insurance incurred by the city.

12.42.130 Application; Time Requirements.

A. Except as provided in this chapter, completed applications for a permit authorizing an event must be filed in the Director’s office at least:

1. 60 calendar days before the date of such event to ensure time for administrative review and any city council appeal.

2. 20 business days before the date of such event, in which case the opportunity for a city council appeal is deemed waived; or

3. A lesser time period approved by the Director provided there is sufficient time to process the application pursuant to this chapter. Any applicant submitting an application pursuant to this chapter less than 20 business days before an event is deemed to have waived the opportunity for a city council appeal.

B. Except as provided in this chapter, completed applications for a permit authorizing an event will be denied, approved, or conditionally approved by the Director within seven business days after receiving the completed application. Following such determination, the Director must promptly attempt to notify the applicant orally, and will provide written notification to the applicant.

C. Unless otherwise provided, the Director must receive the applicant’s acceptance of the approval or conditional approval within five business days after the applicant was served with notification of the decision. Failure to receive actual notice does not invalidate the permit.

12.42.140 Application for Free Speech Event; Time Requirements.

A. Completed applications for a permit authorizing a free speech event must be filed in the Director’s office at least:
38 City of Bellflower
Ordinance No. 1413

Such notice must provide detailed facts and reasons for any denial or conditional approval. The Director must consult with the city attorney before denying, or specially conditioning, a permit for a free speech event.

C. The Director must receive applicant’s acceptance of the approval or conditional approval at least 24 hours before the event. Failure to accept the Director‘s decision or to timely file an administrative review request is deemed a withdrawal of the application.

12.42.160 Director-Required Supplemental Information.

In addition to the information required in this chapter, applications for all permits authorizing an event must include such supplemental information which the Director may find reasonably necessary, given the nature of the event, in order to determine whether to approve or deny a permit.

12.42.170 Action on Permit Application; Review by City Officers.

A. After an event permit application is filed, the Director will promptly forward the application to Directors or designees (collectively “reviewing officers”), whose departments are affected by the

Ordinance No. 1413

Page 9 of 19 ends

proposed event for their recommendations. The reviewing officers may include, without limitation:

1. The public works Director;

2. The public safety Director; and

3. The planning Director.

B. Upon receiving an application, the reviewing officers will consider the application, conduct any necessary investigation, and provide the Director with written recommendations regarding:

1. Any special conditions for a permit;

2. Whether, based on the scope of the proposed event, a pre- event operational meeting is required. Should such a meeting be necessary, the Director will notify the applicant of the time and place of the meeting within a reasonable time before the event; and

3. Any additional recommendations.

C. The reviewing officers should complete their review before when the Director must make a decision on the application.

12.42.180 Permit Issuance.

A. The Director must issue a permit if:

1. The application was complete in accordance with this chapter;

2. There are no grounds for denying the permit; and

3. The applicant accepts the permit approval or conditional approval in writing.

A permit may be denied for one or more of the following reasons:

A. The application is incomplete;

41 City of Bellflower
Ordinance No. 1413

Page 10 of 19 ends

B. The applicant failed to provide reasonable supplemental application information requested by the Director;

C. Information submitted by the applicant is materially false;

D. The event’s time and/or method will unreasonably interrupt the safe and orderly movement of traffic contiguous to the site of the event;

E. The concentration of persons, animals, and/or vehicles at the event prevents public safety and/or emergency services from reaching areas at or contiguous to the event;

F. The size of the event will overextend public safety and/or emergency services to the extent that the safety of event participants, attendees, and/or the remainder of the city will be seriously jeopardized; provided, however, that this does not authorize denying a permit because of the need to protect participants from the conduct of others;

G. The location of the event will substantially interfere with previously scheduled construction or maintenance work at the event site;

H. The application was not timely submitted and there is insufficient time to investigate and process the application pursuant to the timelines herein;

I. The applicant has any outstanding financial obligations or debts of any kind to the City including, without limitation, outstanding licensing or permitting fees and administrative citation fines;

J. The proposed event conflicts or interferes with an event previously permitted, or about to be permitted, for the same location, date, and time; or

K. The nature or size of the event threatens to cause significant damage to a park or park property, including, without limitation, landscaping or natural vegetation; provided, however, this does not authorize denying a permit because of threatened damage to a park or park property caused by the actions of persons not conducting such event.

12.42.200 Alternative Time, Place, or Manner.

If the Director denies a permit for an event that would be acceptable by changing the event’s time, place, or manner, then the Director will inform 42 City of Bellflower
Ordinance No. 1413

Page 11 of 19 ends

the applicant of such alternatives. Should the applicant accept the alternative time, place, or manner then the Director will issue a permit in accordance with this chapter.

12.42.210 Notice of Denial. Where the Director denies a permit, the Director will serve notice to the applicant and provide copies to the city attorney.

12.42.220 Indemnification Agreement.

Permittees must enter into a hold harmless agreement, in a form approved by the city attorney, with the city which will, in part, indemnify city, its officers, employees, and agents, from any liability arising from permittee’s event. Such an agreement will be filed with the Director before a permit is issued.

12.42.230 Liability Insurance.

A. Insurance Requirements. Except as otherwise provided by this chapter, permittees must obtain public liability insurance from an insurance company licensed to do business in the state of California and having a financial rating in Best’s Insurance Guide of not less than “A:VII.” Such insurance must provide “occurrence” coverage against liabilities for death, personal injury or property damage arising out of or in any way connected with such event.

The amount of such insurance will be based upon the city’s insurance guidelines and reflect the size and nature of the event and the risks foreseeably involved. Such insurance will name the city , its elected and appointed officials, employees and volunteers, and agents as additional insureds under the coverage afforded. In addition, such insurance must be primary and noncontributing with respect to any other insurance available to the city and will include a severability of interest (cross-liability) clause. If alcoholic beverages are sold or served at the event, the policy must also include an endorsement for liquor liability in an amount not less than $1,000,000.00.

B. Certificates of insurance. A copy of the policy or a certificate of insurance along with all necessary endorsements, in a form approved by the city’s risk manager, must be filed with the Director not less than 10 business days, except as otherwise provided in this chapter, before the date of the event unless the Director for good cause waives the filing deadline.

Page 12 of 19 ends

12.42.240 Waiver of Insurance Requirements.

The Director must waive insurance required by this chapter for a free speech permit.

12.42.250 Special Permit Conditions.

A. The Director may condition a permit with reasonable requirements concerning the time, place, or manner of holding such event as necessary to protect the safety of persons and property or to control vehicular and pedestrian traffic in and around the site of the event, provided that these requirements are not imposed in a manner that will unreasonably restrict the exercise of free speech rights.

B. Conditions may include, without limitation:

1. Accommodating an event’s pedestrian and vehicular traffic, including restriction of events to a particular park;

2. Avoiding substantial interference with public safety and/or emergency service access;

3. Limiting the number and type of vehicles, animals, or structures to be displayed or used in the event;

4. Having city personnel inspecting and approving stages, booths, and other structures or vehicles to be used or operated in the event, in order to ensure that such structures or vehicles are safely constructed and can be safely operated;

regulation, if food is distributed to the public more than three days in any 90-day period;

13. Providing electricity, gas, and water for the event;

14. Providing signage and barricades that may be necessary to avoid conflicts between persons participating in the event and other persons using the park in and around the site of the event or which may be necessary to protect the park, landscaping, or natural vegetation in and around site of the event;

15. Providing monitors and security personnel that may be necessary to safely carry out the event;

16. Permitting access to the site of the event through park gates at times when gates are normally closed in order to prepare for an event or to clean up and remove equipment and structures at the conclusion of the event;

17. Permitting overnight camping by persons engaged in preparing for the event or providing overnight security for equipment and structures utilized in such event; and

18. Providing for the manner in which alcohol sales and service, if any, are conducted.

12.42.260 Subsequent Conditions.

A. The Director may add additional conditions to previously issued permits upon learning or discovering facts not previously disclosed or reasonably discoverable.

2. If the right to city council appeal is not waived, may be appealed to the city council in writing within two business days of either oral or written notification of the City Manager’s decision, whichever is first.

C. Applicant will be deemed to have waived administrative review rights should the applicant fail to:

1. File a completed application at least two days before an event;

2. Seek review of the Director’s decision; or

3. Attend the administrative hearing personally or through an authorized representative.

12.42.330 Permit Revocation.

A. The Director may revoke a permit upon learning or discovering facts requiring permit denial not previously disclosed or reasonably discoverable.

B. The Director may revoke an event permit when the permittee and/or event violates the permit’s terms and conditions, or when event participants violate applicable laws or regulations; provided, however, that this subsection will not authorize revoking a permit because of the need to protect participants from the conduct of others; and, provided further, that the Director will not revoke a permit without warning the permittee and allowing him/her to correct the violation(s) within a reasonable time.

C. If the Director revokes a permit before the date of the event, the Director must immediately serve written notice of revocation on the permittee and provide copies of the notice to all city personnel charged with carrying out any responsibility under this chapter. 48 City of Bellflower
Ordinance No. 1413

Page 17 of 19 ends

If the Director revokes a permit on the day of the event after learning of facts justifying revocation less than 24 hours before the event commences, the Director must announce such action to the event participants, to those city officers and employees monitoring or controlling traffic during the event, and to the person in charge of the event, if such person can be located at the site of the event.

Written notice must be delivered after such action to the permittee and Director.

D. An applicant is entitled to an appeal hearing before the City Manager provided:

1. The applicant appeals the Director’s decision within 24 hours of receiving notice of such conditions; and

2. The event is scheduled at least 48 hours after the hearing time.

The hearing will be at the City Manager’s office at 4:00 p.m. the day after the hearing is requested, unless otherwise agreed upon. The City Manager must issue a decision orally at the conclusion of the hearing and notify the applicant and the Director of the City Manager’s decision.

E. The City Manager’s decision is a final determination with no right of city council appeal.

F. The Director or City Manager can only revoke a permit for a free speech event after consulting with the city attorney.

12.42.340 Expedited Judicial Review.

Pursuant to Code of Civil Procedure Section 1094.8(c), and any successor statute or regulation, actions related to the conditioning or denial of free speech event permits in this chapter are designated for expedited judicial review pursuant to the procedure set forth in Code of Civil Procedure Section 1094.8.

12.42.350 Emergency Suspension of Event.

The Director and any sworn public safety officer may temporarily suspend an event whenever there is an emergency that requires such action to protect public safety. Should this occur, the permittee and event participants must immediately comply with the suspending officer’s instructions. The Director will immediately attempt to notify the applicant orally and will notify the applicant and the City Manager in writing, within 24 hours after the suspension, citing with particularity the facts and the reasons for the suspension.

12.42.360 Cordoning Off Event Site.

The City Manager, or designee, is authorized and directed to establish traffic and/or crowd control devices on or within the city’s streets, parking facilities, sidewalks, or other public rights-of-way, and to undertake other actions necessary to cordon off the site of an event. In addition, the City Manager, or Director, will, when appropriate, cause the route or site of such event to be posted as a no parking zone for the duration of the event and sufficiently in advance thereof as may be necessary to prevent vehicles from parking along the site of the event.

12.42.370 Public conduct during events.

A. Interference with Event. It is unlawful to physically obstruct, impede, or otherwise interfere with any event authorized by a permit issued under this chapter or with any person, animal, or vehicle participating or used in such event.

B. Prohibited Parking. It is unlawful to park vehicles along or within any portion of the site of an event authorized by a permit, when the route or site has been posted as a no parking zone by the Director in a manner authorized by this chapter.

C. The Director may revoke an event permit when the permittee and/or event violates the permit’s terms and conditions, or when event participants violate applicable laws or regulations; provided, however, that this subsection will not authorize revoking a permit because of the need to protect participants from the conduct of others; and, provided further, that the Director will not revoke a permit without warning the permittee and allowing him/her to correct the violation(s) within a reasonable time.”
SECTION 2. Environmental Review. This ordinance is exempt from review under the California Environmental Quality Act (California Public Resources Code §§ 21000, et seq., “CEQA”) and CEQA regulations (14 California Code of Regulations §§ 15000, et seq.) because it clarifies existing regulations related to the unlawful use of public property; does not involve any commitment to a specific project which could result in a potentially significant physical impact on the environment; and constitutes an organizational or administrative activity that will not result in direct or indirect physical changes in the environment. Accordingly, this Ordinance does not constitute a “project” that requires environmental review (see specifically 14 CCR § 15378(b)(2, 5)).

It is the City Council’s intent that the provisions of this Ordinance be interpreted or implemented by the City and others in a manner that facilitates the purposes set forth in this Ordinance.

SECTION 5. Severability. If any part of this Ordinance or its application is deemed invalid by a court of competent jurisdiction, the City Council intends that such invalidity will not affect the effectiveness of the remaining provisions or applications and, to this end, the provisions of this Ordinance are severable.

SUBJECT: Consideration and possible action to authorize the City Manager to execute Amendment No. 2 to Agreement File No. 853, in a form approved by the City Attorney, with Mercy House Living Centers, to extend the term for Temporary Shelter Services at New Hope Shelter.

DATE: May 9, 2022

EXECUTIVE SUMMARY

The City entered into an agreement with Mercy House Living Centers (“Mercy House”) on December 19, 2019 and the services began on May 20, 2020 for Temporary Shelter Services at New Hope Shelter. The initial agreement expired on May 20, 2021, and the agreement was extended for one year through May 20, 2022. The proposed Amendment No. 2 would extend the agreement for another year to allow for continued Temporary Shelter Services by Mercy House staff at New Hope Shelter.

RECOMMENDATION TO CITY COUNCIL

It is recommended that the City Council:

1) Authorize the City Manager to execute Amendment No. 2 to Agreement File No. 853, in a form approved by the City Attorney; or

2) Alternatively, discuss and take other action related to this item.

FISCAL IMPACT

The cost for Mercy House to operate the New Hope Temporary Shelter for one year (May 21, 2022 to May 20, 2023) is proposed at $2,237,784.75. This is a 5.87% increase ($124,084.75) from the preceding one-year term (May 21, 2021 to May 20, 2022).

DISCUSSION

In an effort to address the concerns of Bellflower residents, the City settled a homelessness-related federal lawsuit filed against the City by a homeless advocate group and, in the settlement (The Catholic Worker of Orange County v. City of Bellflower), Federal District Court Judge David O. Carter ordered the City to build a temporary services shelter for 50 persons.

TO: Honorable Mayor and Members of the City Council

ATTENTION: Jeffrey L. Stewart, City Manager

FROM: Tae Rhee, Director of Finance/City Treasurer

SUBJECT: Consideration and possible action to adopt Resolution No. 22-18 – A Resolution ratifying Administrative Policy and Procedure No. 3 (“AP&P No. 3”), as amended, determining that the City of Bellflower’s cannabis tax applies to the sale of industrial hemp-derived products.

DATE: May 9, 2022

EXECUTIVE SUMMARY

In accordance with Bellflower Municipal Code (“BMC”) § 3.37.120, the Director of Finance reviewed the cannabis tax regulations within BMC Chapter 3.37 to determine whether the cannabis tax applies to retail establishments selling industrial hemp-derived products.

The cannabis tax regulations are separate from the BMC regulations governing cannabis business permits issued in accordance with BMC Title 14. After reviewing the matter and consulting with the City Attorney’s office, the Director of Finance promulgated administrative policy and procedure (“AP&P”) No. 3, which authorizes collection of cannabis taxes from the businesses selling industrial hemp-derived products effective July 1, 2019.

On April 20, 2022, the City received a request for refund for cannabis taxes paid by My CBD Hub, LLC totaling $39,761.85. While that request was denied in accordance with the BMC – and is not the subject of this agenda item – it prompted a reexamination of AP&P No. 3. The amended AP&P No. 3, issued on April 28, 2022, clarifies that only those businesses that sell industrial hemp-derived products exceeding 50% of their overall sales are required to pay the cannabis tax. The purpose of Resolution No. 22-18 is to retroactively ratify AP&P No. 3 effective July 1, 2019 and authorize its implementation since that date and as amended on April 28, 2022.

RECOMMENDATION TO CITY COUNCIL

1) Adopt Resolution No. 22-18 which ratifies AP&P No. 3 and authorizes collection of the cannabis tax from the businesses selling industrial hemp-derived products effective July 1, 2019 and amended April 28, 2022; or

2) Alternatively, discuss and take other action related to this item.

Staff Report – Amended AP&P No. 3, Industrial Hemp-Derived Products May 9, 2022

Page 2 of 2 ends

FISCAL IMPACT

The amended AP&P No. 3, issued on April 28, 2022, clarifies that only those businesses that sell industrial hemp-derived products exceeding 50% of their overall sales are required to pay the cannabis tax. Based on the current cannabis tax collection data, the impact of the amended AP&P No. 3 may be approximately $100 per year in reduction in cannabis tax from exempting a business that sells below this 50% threshold.

DISCUSSION

AP&P No. 3 was administratively adopted on July 1, 2019, pursuant to BMC § 3.37.120(A). That section authorizes the Finance Director to promulgate administrative regulations needed to implement BMC 3.37 which governs the cannabis tax authorized by voters in 2017. These regulations are distinctly separate from BMC Title 14 which authorizes cannabis business permits; the cannabis tax is applicable regardless of whether a business is engaging in commercial cannabis activities as defined in BMC Title 14.

Currently, when applying the cannabis tax, retail establishments selling industrial hemp- derived products are considered a “dispensary” for purposes of tax collection under BMC § 3.37.060(D)(1) and must pay the applicable gross receipts tax if the establishment’s gross receipts are attributable to the sale of industrial hemp-derived products.

The change to AP&P No. 3 implemented on April 28th clarifies that to be classified a “dispensary” for purposes of tax collection only requires more than 50% of the establishment’s gross receipts are attributable to the sale of industrial hemp-derived products. Accordingly, if an establishment’s gross receipts attributable to the sale of industrial hemp-derived products are 50% or less, then no cannabis tax would be owed and payable by the business. In contrast, if an establishment’s gross receipts attributable to the sale of industrial hemp-derived products are more than 50%, then 100% of the establishment’s gross receipts (including non-cannabis items sold such as t-shirts, hats, etc.) would be subject to the cannabis tax.

Such retail establishments, however, are not necessarily required to obtain a cannabis business permit pursuant to BMC Title 14. As explained in greater detail by AP&P No. 3, the definition of “cannabis” in BMC Chapter 3.37 (the cannabis tax regulations) is broader since it does not exclude “industrial hemp” as defined by California law. BMC Title 14, however, contains a narrower definition of “cannabis” to determine whether a business is engaged in commercial cannabis activity and, therefore, is required to obtain a cannabis business permit (BMC § 14.08.010). As a result, a business may be required to pay the cannabis tax, but is not required to obtain a cannabis business permit.

CITY OF BELLFLOWER

RESOLUTION NO. 22-18

A RESOLUTION RATIFYING ADMINISTRATIVE POLICY AND
PROCEDURE NO. 3 (“AP&P NO. 3”), AS AMENDED,
DETERMINING THAT THE CITY OF BELLFLOWER’S CANNABIS

TAX APPLIES TO THE SALE OF INDUSTRIAL HEMP-DERIVED

PRODUCTS

THE CITY COUNCIL RESOLVES AS FOLLOWS:

SECTION 1. The City Council finds and declares as follows:

A. Bellflower Municipal Code (“BMC”) § 3.37.120 authorizes the City Manager, or designee, to implement BMC Chapter 3.37 by, in part, promulgating administrative policies and procedures (“AP&P”) to facilitate collection of the cannabis tax authorized by voters in 2017.

B. On June 25, 2019, the City Manager promulgated AP&P No. 3 that was subsequently amended on April 28, 2022 and is attached as Exhibit “A,” and incorporated by reference. As set forth in AP&P No. 3, the cannabis tax imposed by BMC Chapter 3.37 applies to all retail establishments selling industrial hemp-derived products within the City’s jurisdiction. As further detailed within AP&P No. 3, while such retail establishments may be required to pay the cannabis tax, they may not be required to obtain a cannabis business permit contemplated by BMC Title 14.

SECTION 2. Ratification. The City Council finds that it is in the public interest to ratify the City Manager’s actions in promulgating AP&P No. 3 in order to properly implement the will of the voters as set forth in BMC Chapter 3.37 and assist in the collection of the cannabis tax. Accordingly, the City Council retroactively ratifies AP&P No. 3 effective July 1, 2019 and authorizes its implementation since that date and as amended April 28, 2022.

SECTION 3. This Resolution does not affect any penalty, forfeiture, or liability incurred before, or preclude prosecution and imposition of penalties for any violation occurring before, this Resolution’s effective date. Any such amended part will remain in full force and effect for sustaining action or prosecuting violations occurring before the effective date of this Resolution.

SECTION 4. If any part of this Resolution or its application is deemed invalid by a court of competent jurisdiction, the City Council intends that such invalidity will not affect the effectiveness of the remaining provisions or applications and, to this end, the provisions of this Resolution are severable.

An increasing number of retailestablishments are incorporating these industrial-hemp derived goods into their productmix and some retail establishments are choosing to specialize in the sale of industrialhemp-derived products, making them the focus of their business model.This policy addresses the question of when a retail establishment selling cannabisproducts derived from industrial hemp becomes a “dispensary” for purposes of theCannabis Tax Ordinance and, therefore, subject to the applicable gross receipts tax.This policy does not apply to any person or retail establishment engaged in thebusiness of selling cannabis or cannabis products that are not derived from industrialhemp.II. SUBJECT: Consideration and possible action to approve a request for a change in operating hours for the Bellflower Certified Farmers Market in conjunction with its relocation to Town Center Plaza.

DATE: May 9, 2022

EXECUTIVE SUMMARY

After a request for proposal process, the City Council approved a license agreement with Harbor Area Farmers Markets (HAFM) to manage and operate the Bellflower Certified Farmers Market (Farmers Market) at Town Center Plaza, located at 16521 Adenmoor Avenue. After initial discussions with their network of vendors as well as with the existing market vendors, HAFM is requesting to change the operating hours of the Farmers Market from 9:00 a.m. to 1:00 p.m. to 3:00 p.m. to 7:00 p.m. It will continue to operate on Mondays.

RECOMMENDATION TO CITY COUNCIL

1) Approve the relocation of the Bellflower Certified Farmers Market to Town Center Plaza and the change of operating hours from 9:00 a.m. to 1:00 p.m. to 3:00 p.m. to 7:00 p.m.; or

DISCUSSION

City Parks and Recreation Department staff has been managing and operating the City’s weekly Farmers Market on Mondays from 9:00 a.m. to 1:00 p.m.

On March 28, 2022, after a request for proposal process, the City Council approved a license agreement with HAFM to operate the Farmers Market and relocate it to Town Center Plaza. HAFM manages six weekly markets in surrounding cities and they participate in the Cal Fresh food assistance program, WIC, and Market Match.

DISCUSSION – Continued

Since being approved to operate the Farmers Market, HAFM has been working with staff and other agencies to coordinate the relocation of the market to Town Center Plaza on Monday, June 6, 2022. The Farmers Market currently has 9 to 11 active vendors. After discussions with the existing vendors, HAFM indicated that they have received interest from six of the existing vendors to participate in the relocation of the Market. HAFM will be following up with these vendors throughout the month of May, leading up to June 6th. HAFM has also indicated that they have received significant interest from additional vendors to join the Bellflower Certified Farmers Market if it is moved to the afternoon/evening and actually has a waiting list of vendors. HAFM is confident that they will initially have 30 vendors signed up for the Market at the new location, that will include, but not be limited to:

• Me Gusta Tamales (current vendor)
• Old Town Bread (current vendor)
• Garcia’s Roasted Peanuts (current vendor)
• Aunt Willie’s Apiary Honey (current vendor)
• GB Farms (current vendor)
• Castellanos, seasonal fruit and citrus (current vendor) • Qualls, seasonal fruit, and citrus
• Golden Farms, seasonal produce including berries
• Aztlan Micro Greens
• Don Betos - Staples, Eggs, Potatoes, Onions
• Ha’s Apple Farm, apples, pears, kiwis, peaches, duck eggs, blue eggs • Tea
• Olive Oil
• Hummus
• Yogurt
• Fresh pressed Citrus Juices
• Agua Fresca
• Hey Brother Baker, Artisan bread (delivers to Solid Coffee located in Steel Craft) • Roasted Corn – (tentative)
• FC Cafe, Futbol & Burritos, trailer w/big screen showing perpetual soccer matches (tentative future vendor)
• Plus, approximately ten crafters every week.

To make the market as successful as possible and a downtown destination, HAFM believes an afternoon farmers market will be more convenient and attract more patrons, allowing many to shop at the market after school and work. As a result of a suggestion from a citizen, HAFM is also interested in collaborating with Parks and Recreation to include the B.R.I.M. Program in the future. They are also working with StreelCraft to coordinate potential events and activities such as the current Monday Night Trivia.

HAFM is planning to print and hand out postcards to patrons informing them of the move. Economic Development staff will assist HAFM in advertising and promoting the Farmers Market relocation and its ongoing operation through a banner program, the E-citizen newsletter, its social media platforms, the City website, as well as a ribbon-cutting ceremony within a few weeks of the move.

SUBJECT: Consideration and possible action to authorize the Director of Public Works, or designee, to install red curb parking restrictions at 9835 Rosecrans Avenue and 9939 Rosecrans Avenue (C.E.
#22-06).

DATE: May 9, 2022

EXECUTIVE SUMMARY

On April 19, 2022, the Public Safety Commission considered and subsequently recommended to the City Council the installation of red curb parking restrictions pursuant to Bellflower Municipal Code (“BMC”) Chapter 10.04. This action would approve and authorize the installation of red curb parking restrictions at 9835 Rosecrans Avenue and 9939 Rosecrans Avenue.

RECOMMENDATION TO CITY COUNCIL

1) Authorize the Director of Public Works, or designee, to install red curb parking restrictions at 9835 Rosecrans Avenue and 9939 Rosecrans Avenue; or

2) Alternatively, discuss and take other action related to this item.

FISCAL IMPACT

The estimated cost to install the red curb parking restrictions is $200.00. The required funds are contained within the current fiscal year budget.

DISCUSSION

The City recently received a request from a resident to install red curb parking restrictions at 9835 Rosecrans Avenue and 9939 Rosecrans Avenue. The basis of the request is to improve line of sight for vehicles entering Rosecrans Avenue off of Leahy Avenue and off of Dunrobin Avenue due to vehicles parked along the north side of Rosecrans Avenue. In response to this request, the City Engineer conducted a sight visit and a line of sight assessment. The assessment determined that vehicles parked at the northeast corners at both intersections do obstruct the view of oncoming traffic.

Hence to enhance safety while minimizing the loss of on-street parking, staff recommends the installation of forty (40) feet of red curb parking restrictions at both intersections. If approved, two on-street parking spaces would be eliminated at each location. The proposed red curb parking restrictions are illustrated on the attached aerial photograph.

To date the City has received one response to the notification in support of the recommended red curb installation.

SUBJECT: Consideration and possible action to authorize the Director of Public Works, or designee, to install an on-street disabled parking space (blue curb) in front of 10441 Somerset Boulevard (C.E. #22-07).

DATE: May 9, 2022

EXECUTIVE SUMMARY

On April 19, 2022, the Public Safety Commission considered and subsequently recommended to the City Council the installation of one on-street disabled parking space (blue curb) pursuant to Bellflower Municipal Code (“BMC”) Chapter 10.04. This action would approve and authorize the installation of one on-street disabled parking space (blue curb) in front of 10441 Somerset Boulevard.

RECOMMENDATION TO CITY COUNCIL

1) Authorize the Director of Public Works, or designee, to install an on-street disabled parking space (blue curb) in front of 10441 Somerset Boulevard; or

2) Alternatively, discuss and take other action related to this item.

FISCAL IMPACT

The estimated cost to install the on-street disabled parking space (blue curb) is $100.00. The required funds are contained within the current fiscal year budget.

DISCUSSION

The City recently received a request from the homeowner at 10441 Somerset Boulevard to install one on-street disabled parking space (blue curb). In response to this request, the City Engineer conducted a site visit and discussed the matter with the homeowner.

The homeowner is disabled and confined to a wheelchair and possesses a valid disabled placard.

-1-

Staff Report – Installation of an on-street disabled parking space (blue curb) in front of 10441 Somerset Boulevard

Page 2 of 2 ends

DISCUSSION – Continued

The homeowner does have a garage; however, it is only accessible through the rear alleyway. Due to the limited mobility of the resident, and given that the distance between the garage and the back door far exceeds the distance from the curb to the front door, the shortest accessible path of travel is on-street parking. Furthermore, there is a pool located between the garage and the rear entryway of the home resulting in limited room to maneuver his wheelchair. In addition, a concrete pad is located in the grass parkway between the curb and sidewalk providing an ADA compliant loading area. The homeowner has also installed a ramp to create an accessible path to the front door. Hence to provide a more accessible path of travel the installation of a twenty-foot (20’) long on-street disabled parking space is recommended. The location of the proposed blue curb is illustrated on the attached aerial photograph.

On April 5, 2022, the City provided notice to area residents of this request and that this matter would be brought before the Public Safety Commission at its April 19, 2022, meeting. To date the City has received no response to the notification.
