4 STUDY SESSION

A Consideration and possible action to approve the recommended changes to the enforcement process of applicable codes carried out by Code Enforcement personnel; and adopt Resolution No. 22-56 - A Resolution adopting a general policy regarding enforcing applicable law including, without limitation, the Bellflower Municipal Code and directing the City Manager and City Attorney to implement such policy as is practicable; and superseding Resolution No. 08-64.

City Manager Stewart introduced the item.

Director of Public Safety Hockman 1) provided a brief verbal overview of the recommended changes to the enforcement process of applicable codes carried out by Code Enforcement personnel; and 2) along with City Manager Stewart, Assistant City Attorney Campen, City Attorney Berger, and Director of Planning and Building Services Corpuz, responded to Council Members’ questions.

Following lengthy discussion, without objection, Mayor Pro Tem Santa Ines requested that a typographical error in Section 12.b.ii of Exhibit A to Resolution No. 22-56 be corrected to change the word “required” to “successful” so that the section reads: “Where ongoing efforts to maintain compliance are not successful.”

Without objection, Council Member Hamada requested that a typographical error in the last sentence of Section 8.a of Exhibit A to Resolution No. 22-56 be corrected to strike out the first mention of “infraction” so that the sentence reads: “Nothing in this section will preclude a Code Enforcement Inspector or Community Services Officer from issuing more than one infraction citation to a violator.”

For the record, in response to Mayor Dunton’s question as to whether staff had enough direction to move forward, City Manager Stewart confirmed that sufficient direction was received and staff would bring back the Code Enforcement Policy to the City Council periodically for further direction, as needed.

At the suggestion of Assistant City Attorney Campen, and at the consensus of the City Council, staff directives for reporting violations when observed during the normal course of conducting City business will be added to Section 7 of Exhibit A to Resolution No. 22-56 so that the second sentence of the section reads: “This includes, without limitation, providing: reports to Code Enforcement of violations observed in normal course of conducting City business…”
