EXECUTIVE SUMMARY

This action would find California Professional Engineering (CPE) to be a non-responsive bidder and award a contract to Elecnor Belco Electric, Inc. (Belco), to perform the work described in the Plans and Specification documents for the Lakewood Boulevard Traffic Signal Improvements (the Project).

RECOMMENDATION TO CITY COUNCIL

1) Find CPE to be non-responsive, award a contract to Belco for the Project; and authorize the City Manager to execute a contract with Belco, in a form approved by the City Attorney; and

2) Authorize a budget amendment for Account No. 135-47148-9000 to increase the project funding by $150,000 for construction management/inspection; or

3) Alternatively, discuss and take other action related to this item.

FISCAL IMPACT

Belco submitted the lowest responsive bid in the amount of $3,545,651. The Engineer’s estimated cost plus contingency to perform the work under Specifications No. 20/21-01 and for the purchase of traffic signal equipment was $3,389,450. DISCUSSION

The Project will combine two separate traffic signal projects designated for the Lakewood Boulevard corridor.

First, there is the traffic signal project funded by a grant made available through L.A.

County Metropolitan Transportation Authority Measure M Subregional program to fund the installation of two new traffic signals on Lakewood Boulevard, one located at Cedar Street and the other located at Mayne Street. It will also include modifications to the existing traffic signals at Flower Street and Somerset Boulevard to introduce protected left turn lanes on both streets for east and westbound vehicles crossing Lakewood Boulevard.

The second project will include traffic signal and roadway improvements at the Lakewood Boulevard and Alondra Boulevard intersection. The Gateway Cities COG identified this intersection as a “Hot Spot” as part of its I-605/SR-91/I-405 Corridor Feasibility Study. The project will include an intersection upgrade to help increase roadway capacity at the intersection by introducing north, south, east and west exclusive right turn lanes. It will also increase left turn pocket vehicle storage capacity, construction of new concrete bus pads and new ADA compliant curb ramps. The existing traffic signals will also be upgraded and pavement rehabilitation will be done within the intersection as well as the east and west bound approaches on Alondra Boulevard.

On August 8, 2022, the City Council adopted Resolution No. 22-45 authorizing solicitation of bids. The City advertised Specifications No. 20/21-01 for bids in accordance with BMC Section 3.28.090. Four bids were submitted at the formal bid opening on October 25, 2022. The names of those bidders and their bid amounts are listed below:

BIDDER BID PRICE
California Professional Engineering, Inc. $3,471,520.15 Elecnor Belco Electric, Inc. $3,545,651.00
Select Electric, Inc. $3,987,893.00
Palp, Inc. dba Excel Paving Company $4,298,376.00

During review of bid packets at the bid opening, it was noted and confirmed by City staff that CPE’s bid packet did not include pages B-7 through B-9, which included pricing for several bid items. Since CPE submitted an incomplete bid package, staff was unable to calculate and verify their overall total bid price and therefore concluded CPE’s bid to be incomplete. Following the bid opening, CPE reached out to the City in an attempt to get the missing pages included; however, they were notified that their bid was non-responsive.

BID ANALYSIS

Belco submitted a complete bid package. Staff has verified its contractor’s license status, references, and registration with the Department of Industrial Relations. Belco is qualified to perform the work described and has fulfilled the requirements set forth in the Specification documents. On October 27, 2022, Belco submitted a letter of clarification to the City Engineer, as the subcontractor listing page contained an error in price listed for asphalt. This error did not change, alter or affect the project bid price submitted by Belco. Therefore, Public Works staff recommends that the City Council waive this error as a minor bid irregularity since it does not impact the total bid price. Staff concludes Belco is the lowest responsive and responsible bidder and recommends that the City Council award a contract to Belco.

SPECIFICATIONS

The Plans and Specification documents are available for public inspection at the Public Works Department Office, 9944 Flora Vista Street, Bellflower, California until completion of the Project and, subsequently, as official records, will be maintained by the City Clerk’s Office.

ENVIRONMENTAL REVIEW

Pursuant to the California Environmental Quality Act (CEQA) (Public Resources Code §§ 21000, et seq.) and CEQA Guidelines (California Code of Regulations, Title 14, §§ 15000, et seq.), the City conducted an environmental assessment. Based on the environmental assessment, the project was determined to be categorically exempt pursuant to CEQA Guidelines § 15303 (Class 3 – New Construction or Conversion of Small Structures).
