SUBJECT: Consideration and possible action to conduct a public hearing to consider adopting Resolution No. 22-65 — A Resolution approving Conditional Use Permit Case No. CU -22-11 to modify Conditional Use Permit Nos. CU 15-02 and 16-05 for a behavioral health hospital within the M-1 (Light Industrial) District and the C -G (General Commercial) Zone located at 9542 Artesia Boulevard; Applicant: Hector Hernandez (Representing Alta Los Angeles Hospital, Inc. dba Los Angeles Community Hospital at Bellflower).

DATE:

EXECUTIVE SUMMARY
A Conditional Use Permit ("CUP") application to modify conditions of approval of Conditional Use Permit Case No. Cu 16-02 was originally considered by the Planning Commission on June 20, 2022. The Planning Commission directed City staff to draft a resolution denying the modification request. The resolution was set to be considered on July 5, 2022, but was continued. On July 11, 2022, the City Council considered an appeal from the City Attorney to order a de novo public hearing regarding the Planning Commission's decision made on June 20, 2022. At that meeting, the Applicant was directed to withdraw its CUP application and submit a modified application. On July 12, 2022, the Applicant withdrew its CUP application. On October 10, 2022, a new CUP application to modify conditions of approval of CU 15-02 and CU 16-05 was submitted. If approved, the conditions of approval will be modified to: 1) remove the 8 -foot high perimeter block wall requirement; 2) allow an alternate fagade improvement design/materials, landscaping, and signage; and 3) eliminate the requirement for new lighting in the rear parking lot. For this project, the City Council will act as the City's Planning Agency in accordance with Bellflower Municipal Code ("BMC") § 2.32.050(F).

Accordingly, there is no Planning Commission recommendation regarding the project. —1—

CEQA STATUS
(9524 Artesia Blvd.)
The Resolution was reviewed pursuant to the California Environmental Quality Act (Public Resources Code §§ 21000, et seq.; "CEQA") and the CEQA Guidelines (14 California Code of Regulations §§ 15000, et seq.). Additional environmental review is not required because the Resolution would allow a negligible expansion of an existing land use which includes modifying existing conditions and conditions of approval related to the existing perimeter walls, exterior fagade, landscape, signage, and parking lot lighting. Accordingly, it is Categorically Exempt as a Class 1 (Existing Facilities) project (CEQA Guidelines § 15301).

TYPE OF ACTION (LEGISLATIVE;
UASI-JUDICIAL; OR ADVISORY',
Quasi judicial: The recommended action includes issuing a CUP. In considering such actions, the City Council acts in a quasi-judicial role. While doing so, the City Council acts like a court: it applies facts gathered during a public hearing to existing law. Just like a court, the City Council can only consider facts that are relevant to the case. A party appearing before the legislative body is entitled to
Notice of the proposed action;
• Reasons for the action;
• A copy of the evidence on which the action is based; and • The right to respond before a reasonably impartial, noninvolved reviewer.

If the City Council asks irrelevant questions and bases its decision-making on such questions, a court may overturn the City Councs decision and hold the City potentially liable for violating the Applicant's constitutionally protected due process rights.

In this matter, the City Council must make these findings:

A. The use applied for at the location set forth in the application is properly one for which a Conditional Use Permit is authorized by the BMC; B. The land use is necessary or desirable for the development of the community, is in harmony with the various elements or objectives of the General Plan, and is not detrimental to existing uses or to uses specifically permitted in the district in which the proposed use is to be located;
C. The site for the intended use is adequate in size and shape to accommodate the land use, and for all the yards, setbacks, walls or fences, landscaping and other features that may be required in order to adjust said use to those existing or possible future uses of land in the neighborhood; and
D. The site for the proposed use relates to streets and highways properly designed and improved so as to carry the type and quantity of traffic generated or to be generated by the proposed use.

DISCUSSION
• Block Walls
BMC § 17.44.060 requires, fences or walls where C -G zoning abuts a residential district either on a side or rear yard, not less than 6'-0" or more than 8'-0" in height, to protect the peace, privacy, and general welfare of the residential district.

The existing CUPs require new 8 -foot high block walls be placed adjacent to residential uses/districts along the south perimeter property line and along the east and west perimeter property lines. A noise assessment study was submitted in 2015 demonstrating that installing new 8 -foot high block walls would minimize all noise levels associated with the hospital use. The total wall length is approximately 1,141 lineal feet. COA Nos. 15, 17, 18, 19, and 22 of Resolution No. PC 16-16 - Exhibit A were included to address the wall.

The Applicant is requesting the City Council modify COA No. 15, and remove COA Nos. 17, 187 19, and 22 associated with the 8400t high block.

Instead, the Applicant proposes to maintain the existing 6 -foot high block walls, repair damaged areas on the walls, and paint the walls to match the approved fagade design (COA included). Per the Applicant's updated 2019 Noise Assessment Addendum (Attachment D), the existing 6400t high block walls address concerns of privacy, noise levels in the area do not require the need to install 8400t high walls because the site has no emergency services (e.g. ambulance) that generate noise, and vehicle traffic on the site is minimal. Lastly, per the Applicant's submittal (See Attachment D), several surrounding neighbors prefer no changes to the walls. Staff can support eliminating the condition of approval requiring a new 8400t high block wall along the perimeter because the existing 6'-0" high block walls comply with the BMC.

In addition, the 2019 Noise Assessment Addendum shows that the existing walls mitigate noise. Alternatively, the City Council could require the Applicant to install the 8 -foot high block walls.
• Modified Site Improvements
The Development Review Board (DRB) conducted an advisory review of the CUP in 2015 and recommended approval of ahigh-quality building fagade design along with new landscaping material and new building signage (see COA No. 15 of Exhibit A of Resolution No. 15-10). The fagade remodel is located along the building walls along Artesia Boulevard and Ardmore Avenue. In addition, COA No. 15 of Resolution No. PC 16-16 - Exhibit A, was included with the project to address the exterior improvements. At the most recent Planning Commission meeting held on June 20, 2022, the Applicant requested to only add new paint to the existing building fagade. —4—

SECTION 4. Environmental Assessment. The Project was reviewed pursuant to the California Environmental Quality Act (Public Resources Code §§ 21000, et seq.; "CEQA") and the CEQA Guidelines (14 California Code of Regulations §§ 15000, et seq.).

The existing use is necessary for the development of the community in that it is consistent with the purpose and intent of the C -G (General Commercial) Zone which is to provide adequate areas properly located to serve the needs of the community and the surrounding area; this also consistent to the M-1 (Light Industrial) District because of the pyramid zoning. The use will continue to provide essential medical services to the community.

In addition, the proposed project is consistent with the following policies of the Land Use Element — General Policy 2.2, which is to "provide commercial facilities to meet the retail and service needs of the community"; General Policy

2.7, which is to "carefully scrutinize plans for developments which will have a significant impact on the city or on surrounding developments to ensure the highest quality design"; General Policy 2.8, which is to "Encourage rehabilitation or redevelopment of designated commercial and industrial areas;" and General Policy 2.12, which is to "develop strong themes identifying Bellflower as a city of visual and community quality." The proposed modifications also include design features and operational characteristics that will help integrate it into the surrounding community and not be detrimental to existing uses or to uses specifically permitted in the district. Additionally, a Noise Assessment was previously conducted as part of CUP 15-02, which concluded that there will be no noise impact to the surrounding area. The Applicant has submitted a 2019 Noise Assessment addendum showing that there is still no noise impact, despite the modification of some of the conditions of approval. Lastly, the use does not include any emergency vehicles with the operation that will generate noise/sirens.

C. The site for the intended use is adequate in size and shape to accommodate said use, and for all the yards, setbacks, walls or fences, landscaping, and other features that may be required in order to adjust said use to those existing or possible future uses of land in the neighborhood.

The site for the intended use is adequate in size and shape to accommodate said use, and for all the yards, setbacks, walls, or fences, landscaping, and other features that may be required in order to adjust said use to those existing or possible future uses of land in the neighborhood in that, the site is already developed with a behavior health hospital and the Applicant only proposes to modify previously approved conditions of approval related to site improvements. The modification of certain conditions of approval includes the elimination of the new perimeter block wall and lighting, which will reduce the construction burden (and related noise) on neighboring properties.

D. That the site for the proposed use relates to streets and highways properly designed and improved so as to carry the type and quantity of traffic generated or to be generated by the proposed use.

ATTACHMENT 1 TO CUP MODIFICATION APPLICATION
OCTOBER 109 2022 SUBMITTAL
I. APPLICANT AND PROPERTY INFORMATION
■ Applicant: Alta Los Angeles Hospitals, Inc. dba Los Angeles Community Hospital at Bellflower ("Hospital")
■ Property Location: 9542 Artesia Blvd., Bellflower, CA 90706 ("Property") ■ Zoning Information: M-1 (Light Industrial) and C -G (General Commercial) II. SUMMARY OF REQUEST
The Hospital seeks to modify its existing Conditional Use Permits because the current cost bids to complete certain items are infeasible. The Hospital intends to comply with the spirit and intent of the improvements that were contemplated in the original CUP approvals from 2015-2016, but seeks three modifications to the current conditions of approval in its CUPs: 1) elimination of improvements to perimeter block wall; 2) modification of facade improvements, pursuant to newly submitted plans, and 3) elimination of new lighting in the parking lot.

III. INTRODUCTION AND PROJECT BACKGROUND
A. The 2015 and 2016 CUPS
On April 20, 2015, the Planning Commission approved Resolution No. PC 15-10, which approved Conditional Use Permit Case No. CU 15-02 ("CuP 15-0211), allowing a hospital facility within the M4 (Light Industrial) District and C -G (General Commercial) Zone. CUP 15- 02 is attached hereto as Exhibit 1.

On August 4, 2016, the Hospital filed an application for the modification of CUP 15-02, changing the type of care provided by the facility from combination behavioraUmedIV" l, to all -
behavioral, increasing the number of patient beds provided from 80 to 92, and adjusting the previously approved phasing plan ' for various site improvements to be implemented on the Property. On September 19, 2016, the Planning Commission adopted Resolution No. PC 1646, which approved Conditional Use Permit Case No. CU 16-05 ("CUP 16 -OS"), which made the modifications to CUP 15-02, and modified several of the conditions of approval. CUP 16-05 is attached hereto as Exhibit 2.

After CUP 16-05
was approved, the Hospital obtained relevant approvals from California's Office of Statewide Health Planning and Development! ("OSHPD") in connection with the change of the type of care from medical to all -behavioral. Also, plans were completed and the hospital went to bid for the project. However, when the bids were received, it became apparent that the Hospital's original budget and estimates for the work were well below the real costs it would take to actually perform the construction. The major work associated with increasing the number of hospital beds, and the related improvements needed to effectuate the change from 1 OSHPD is the California regulatory entity that specifically regulates and approves improvements that axe made to implement these types of changes. -23-

Page 2 of 9 ends

medical to behavioral rooms/Deus came out dramatically higher than the estimates that were originally obtained.

Moreover, there were several improvements that were required in the conditions of approval, relating to 1) a perimeter block wall, 2) fagade improvements, and 3) lighting improvements, that amount to millions of additional dollars in costs. The cost figures eclipsed the Hospital's budget for the original project contemplated by CUP 16-05, which prompted the Hospital to meet with Planning Division staff on January 17, 2019 to discuss potential solutions.

B. The Hospital Submits a CUP Modification Application which is later Withdrawn After Hearings before the Planning Commission and City Council At the January 17, 2019 meeting with the Planning Division, the Hospital explained that in order to be able to proceed with the project, it would need to modify and eliminate some of the requirements from the conditions of approval in CUP 16-05. It was determined that a CUP Amendment Application would need to be submitted in order to modify any of the conditions of approval, and certain items (such as a noise -study, and a new proposal/plan as to what changes the Hospital wishes to make to the fagade) would need to be completed.

On May 23, 2019, the Hospital submitted a CUP Modification Application (CUP Case No. CU 22-05), explaining that the Hospital intends to beautify the hospital through changes to the fh9ade, landscaping, and signage, and still intends to make improvements relating to access and ADA accessibility, but sought modification of conditions of approval principally relating to the block wall and fagade. The application was ultimately considered at Planning Commission hearings on June 20, 2022 and July 5, 2022, and a City Council hearing on July 11, 2022.

On July 12; 2022, the Hospital withdrew CUP Case No. CU 22-05, so that the Hospital could make changes to the facade plans, principally, to accommodate design -related comments relating to the fagade from Planning Commissioners and City Councilmembers at the June 20, July 5, and July I 1 hearings, and resubmit a new CUP Modification application directly to the City Council as the planning body.

C. The Hospital Works with City Regarding New CUP Modification Application to Be Submitted Directly to City Council
Code enforcement action had been put on hold while CUP Case No, CU 22-05 was being
processed, but upon withdrawal, the City took action to enforce the existing CUPs. On July 12, 2022 (the same day that CUP Case No. CU 22-05 was withdrawn), the City issued a Notice of Violation and Corrective Action regarding the Hospital's failure to comply with certain Conditions of Approval that were imposed by the City in the 2015/2016 CUPs. Pursuant to the NOV, the "following exterior improvements pursuant to the Conditions of Approval have not been completed per Resolution Nos. PC 1540 and PC 1646: 1) Exterior improvements consisting of building facade remodeling, complete landscaping; installation of lighting, and construction of perimeter block walls, 2) the installation of decorative stamped concrete along the first 10'4' of each driveway entrance and architecturally compatible with the proposed building remodel, 3) upgraded permanent decorative trash cans and outdoor furniture affixed to

Page 3 of 9 ends

the ground, 4) decorative bicycle racks, and 5) upgrade four existing drive approaches serving the property."
On August 23, 2022, representatives from the City, and representatives from the Hospital met at the Property to conduct a site visit, and to observe any additional conditions at the Property that should be incorporated into the Hospital's improvement plans. On August 30, 2022, the City sent to the Hospital an email, and an additional list of items on the Property that require corrective action. The Hospital has taken corrective action on most of the outstanding code enforcement items, and provided proof of same to the City in emails dated September 8, 2022 and September 27, 2022. Any code enforcement items that remain outstanding at the Property will be handled in conjunction with this new CUP application.

The Hospital now submits this CtJP Modification Application, to be considered directly by the City Council as the planning body, and seeks: 1) elimination of improvements to perimeter block wall; 2) simplification of fagade improvements, pursuant to newly submitted plans, and 3) elimination of lighting in the parking lot.

IV. ELIMINATION 4F PERIMETER BLOCK WALL (CONDITIONS OF APPROVAL # 15, 17, 18, 199 22 To CUP 16-05)
The original requirement for the perimeter block wall in CUP 15-02 was to replace the existing 6400t high block wall surrounding the entire Property with an 8400t high block wall surrounding the entire property. The intent of the requirement was presumably to protect adjacent neighbors from noise in the parking lot. Importantly, this change to an 8400t high block wall requires complete demolition of the existing wall, and construction of a new wall with new footings, etc. This is project, as contemplated in CUP 15-02, would cost approximately $1.4 million dollars in and of itself.

It should be noted that when CUP 16 -OS modified CUP 15-02, it already included a reduction in scope of the original block wall requirement. As explained in the staff report for the September 19, 2016 meeting, and fully supported by staff at the time, CUP 16-05 modified that requirement so that a portion of the wall could be left at 64eet in height, as reflected in the modified condition of approval number 17: "The existing perimeter wall located on the northwest portion of the property directly adjacent to the apartment building may be maintained as is at 6'-0" in height."
The Applicant is now requesting that the entire block wall improvement requirement be eliminated from the conditions of approval. This is because the increase in height of the block wall is totally unnecessary, and will accomplish nothing, and the current block wall is in good condition, both structurally and visually. Some portions of the wall have sustained minimal damage, and the Hospital is committed to fixing those portions. There are two main reasons why there is no need for the increase in wall height.
-25-

Page 4 of 9 ends

1) Because the Hospital's use has been changed to behavioral health only, there are no longer any emergency services, no oxygen tanks (and related deliveries), and essentially none of the prior noise -generating activities that the previous hospital use had in place are currently operative. As such, the general noise levels at the Hospital are low. There have been no recent complaints from neighbors regarding noise.
2) Behavioral health patients typically do not drive, and do not have many visitors. This was addressed throughout the approval process for CUP 16-05. As such, the number of cars and traffic that is generated by the new use is substantially lower than the prior hospital operation, which correspondingly generates less noise as well.

Pursuant to the Planning Department's request, the Hospital conducted a supplemental noise study to analyze whether the change from a 6 foot block wall to an 8 foot block wall would make any difference. The study, which is attached hereto as Exhibit 3, concluded that the change in noise levels would be minimal, and that even with the 6 foot block wall, there would be no noise impacts on surrounding properties and development.

Some neighbors living adjacent to the Property have also been contacted by Hospital representatives, and have submitted signed declarations (prepared by the Hospital, and discussed with each neighbor at a meeting), explaining that they would prefer no additional changes to the block wall. Some of these declarations have been provided in Exhibit 4, but the Hospital expects to meet with additional neighbors, and will supplement this application with additional declarations prior to the hearing date.

Therefore, the Hospital requests, through this CUP Amendment Application, that alI requirements relating to the block wall (including, but not limited to, those contained in conditions of approval 15, 17, 18, 19, and 22), be eliminated entirely.2 V. MODIFICATIONS TO FAA.DE (CONDITION OF APPROVAL 44
15 TO CUP lfi-OS)
The Hospital will improve the facade of the building, improve signage, improve landscaping, and beautify the street. The newly proposed facade and signage improvements are being submitted concurrently with this Application, and/or will be provided on or before October 31, 2022.

Through the implementation of the changes proposed in this CUP Modification request, the exterior of the building, and the signage throughout the Property, will be significantly modified and improved. New plans and renderings are being included with this modified application, to show the proposed changes to the fagade.

The original plan submitted with CUP 16-05
would have required major structural changes to the
building with excessive costs (over $2.2 million). The Hospital's new proposal makes significant cosmetic improvements to the site, could be performed at a much faster rate, and at a much lower price point. The improvements that the Hospital intends to incorporate in the beautification of the z There are also wall -related conditions of approval in CUP 15-02, but those were modified through CUP 16-05. To the extent that the conditions of approval in CUP 15-02 are still considered operative, the Hospital also requests that those conditions be removed (including, but not limited to conditions of approval 17, 25, 26, 27, and 74). -26-

building and fagade, and making improvements to access and ADA accessibility. In the spirit of the originally approved CUP 15-02 (Exhibit 1), and its subsequent modification through CUP 16-05 (Exhibit 2), the new proposal fulfills the ultimate goal of beautifying the fagade of the Hospital substantially.

VI. ELCNllNATION OF LIGHTING RCQUIRCNIENTS (CONDITIONS OF APPROVAL #35, 365 4$ TO CUP 15-02)
There are three conditions of approval in CUP 15-02 that require signif cant lighting changes in the parking lot of the Hospital. However, it appears that when the original plans from 2015 were drawn up, they did not take into consideration the four existing light poles (operated by Edison).

The base of these four light poles are located directly outside the perimeter block wall surrounding the Hospital parking lot, but lights themselves protrude over the perimeter block wall, and directly onto the Hospital parking lot, as shown below:

VII. PROPOSED FINDINGS
Pursuant to Municipal Code section 17.96.040, the Planning Commission must be satisfied that the below 4 conditions are met prior to granting the CUP. Each of these findings are discussed below. Note that these findings were already made in connection with both CUP 15-02 and CUP 16-05. The below proposed findings also explain how this proposed modification would affect those findings, if at all.

A. The use applied for at the location set forth in the application is properly one for which a Conditional Use Permit or Minor Use Permit is authorized by this title.

The use applied for at the location set forth in the application is properly one for which a Conditional Use Permit is authorized, in that pursuant to Bellflower Municipal Code subsection

17.44.030.A.35 and 17.52.030, a Conditional Use Permit is required in the C -G (General Commercial) zone and the M-1 (Light Industrial) District for a Hospital use.

The site is currently developed as a hospital, and CUP 16 -OS only proposed to change the type of care provided, the number of patient beds, and the phasing plan for the implementation of various required s41 ite improvements.

This application, which seeks to modify the conditions of approval of CUP 16-05, does not affect the fact that the underlying CUP hospital use is properly authorized by the Bellflower Municipal Code.

B. The said use is necessary or desirable for the development of the community, is in harmony with the various elements or objectives of the Master Plan, and is not detrimental to existing uses or to uses specifically permitted in the district in which the proposed use is to be located.

The said use is necessary or desirable for the development of the community, is in harmony with thC; various elements or objectives of the Master Plan, and is not detrimental to existing uses or to uses specifically permitted in the district in which the site is located. The proposed hospital use is consistent with Goal 2, Policies 2.2, 2.8 and 2.11 of the General Plan, which state that the City should provide commercial facilities to meet the retail and service needs of the community, encourage rehabilitation or redevelopment or designated commercial and industrial areas, and retain industries now in Bellflower. The hospital is necessary or desirable for the development of fihe community as it will provide essential medical services to the community.

The proposed modificati
ons also include design features and operational characteristics that will help integrate it into the surrounding community and not be detrimental to existing uses or to uses specifically permitted in the district. Additionally, a Noise Assessment was previously conducted as part of CUP 15-02, which concluded that there will be no noise impact to the surrounding area. The Applicant has submitted a Noise Assessment aowi ddendum shng that
there is still no noise impact, despite the modification of some of the conditions of approval. -29-

C. The site for the intended use is adequate in size and shape to accommodate said use, and for all the yards, setbacks, walls or fences, landscaping and other features that may be required in order to adjust said use to those existing or possible future uses of land in the neighborhood.

The site for the intended use is adequate in size and shape to accommodate said use, and for all the yards, setbacks, walls or fences, landscaping, and other features that may be required in order to adjust said use to those existing or possible future uses of land in the neighborhood in that, based on the maximum occupancy of 92 hospital beds and a maximum employee count of 82 during any one shift, the site provides adequate parking onsite. The modification of certain conditions of approval includes the elimination of the proposed modification to a perimeter block wall and lighting, which will reduce the construction burden (and related noise and nuisance) on neighboring properties.

D. The site for the proposed use relates to streets and highways properly designed and improved so as to carry the type and quantity of traffic generated or to be generated by the proposed use.

The site for the proposed use relates to streets and highways properly designed and improved so as to carry the type and quantity of traffic generated or to be generated by the proposed use, because a Traffic Assessment was previously prepared for the project which concluded that the study intersections and street levels of service would not be impacted by the project as initially proposed. An updated analysis was provided to address the increase in the number of patient beds proposed in CUP 16-05, and is consistent with the previous determination. The City Traffic Engineer determined that the conclusions were accurate and that the streets and highways would continue to carry the type and quantity of traffic generated by the proposed use with no issues.

The modifications in CUP 16-05 relating to type of care provided, and an increase in the number of patient beds from 80 to 92 and maximum number of staff from 80 to 82 are negligible, and should not create greater impacts on adjacent streets and highways. The Applicant submitted a data -driven report with CUP 16-05 demonstrating that the shift to all -behavioral type of care would even reduce the number of trips generated to the facility, due to a lower rate of visitation for patients associated with behavioral care versus acute medical care. None of the modifications to the conditions of approval herein effect traffic or parking issues.

VIII. CEQA CATEGORICAL EXEMPTION: NO UNUSUAL CIRCUMSTANCES EXIST WITH RESPECT TO THE PROJECT OR PROJECT SITE.

The project is categorically exempt fr
om the requirements of the California Environmental
Quality Act (CEQA} pursuant to 14 California Code of Regulations § 15301 as a Class 1 categorical exemption (Existing Facilities) and § 15311 (Accessory Structures) and § 15332 (In - Fill Development Projects}. This project is not anticipated to .have any significant impacts with regard to traffic, noise, air quality, or water quality. CUP 16-05 involved a negligible expansion of an existing use, in that the facility is proposing to shift from combination behavioral/medical to all -behavioral care, and add a total of twelve (12) beds to its existing operation. The proposed modifications to certain conditions of approval will not create any additional impacts. -30-

NO. CU 15-D2, WHICH ALLOWED A HOSPITAL FACILITY
WITHIN THE Alt -1 (LIGHT INDUSTRIAL) DISTRICT AND C-

G (GENERAL COMMERCIAL) ZONE, BY CHANGING THE

TYPE OF CARE PROVIDED BY THE FACILITY FROM

THE PREVIOUSLY APPROVED PHASING PLAN FOR

VARIOUS SITE IMPROVEMENTS TO BE IMPLEMENTED,
ON PROPERTY LOCATED AT 9542 ARTESIA
BOULEVARD. APPLICANT: HARVEY ROSS / LA

COMMUNITY HOSPITAL
The Planning Commission of the City of Bellflower does hereby resolve as follows:

SECTION 1. The Planning Commission finds as follows:

A. On August 4, 2016, -Harvey Ross / LA Community Hospital (the "Applicants) filed an application for the modefccation of Conditional Use Permit Case No. CU '15-02, which allowed a hospital facility wi#his the M-1 {Light Industrial) District and C -G (General Commercial) Zone, by changing the type of care provided by the facility from  combination behaviora!/medical to all -behavioral, increasing the number of patient beds provided from 80 to 92, and adjusting the previously approved phasing plan for various site improvements to be implemented, on property located at 9542 Artesia Boulevard;
B. Applicant's application was reviewed by the City for, in part, consistency with the General Pian and conformity with the Bellflower Municipal Code ("BMCs);
C. In addition, the City reviewed the project's environmental impacts under the California Environmental Quality Act (Public Resources Cade §§ 21000, et seq., "CEQA") and the regulations promulgated thereunder (14 Cal. Code of Regulations §§15000, et seq., the "CEQA Guidelines); D. The City completed its review and scheduled a public hearing regarding the application, before the Planning Comrirtission on September 19, 20'!6; E. The Planning Commission opened the

F. The Planning Commission considered the information provided by City staff, public testimony, and the Applicant. This Resolution, and its findings, is made based upon the evidence presented to the Planning Commission at its September 19, 2016 hearing including, without limitation, the staff report.

SECTION 2. Factual Findings and Conclusions. The Planning Commission finds that the following facts exist:

A. That the use applied for at the location set forth in the application is properly one for which a Conditional Use Permit is authorized by the Zoning Code in that a hospital is a conditionally permitted use in the C -G (General Commercial) Zone. The site is currently developed as a hospital, and the Applicant only proposes to change the type of care provided, the number of patient beds, and the phasing plan for the implementation of various required site improvements.

B. That the said use is necessary or desirable for the development of the community, is in harmony with the various elements or objectives of the Master Plan, and is not detrimental to existing uses or to uses specifically permitted in the district in which the site is located. The proposed CUP modification is consistent with Goal 2, Policies 2.2, 2.8 and 2.11 of the General Plan, which state that the City should provide commercial facilities to meet the retail and service needs of the community, encourage rehabilitation or redevelopment or designated commercial and industrial areas, and retain industries now in Bellflower. ' A condition of approval addressing maintaining adequate separation from the adjacent residential uses to protect the peace, privacy and general welfare of the residents has been included (Condition of Approval #17). Additionally, a Noise Assessment was previously conducted as part of Conditional Use Permit Case No. CU 15-02, which concluded that there will be no noise impact to the surrounding area.

C. That the site for the intended use is adequate in size and shape to accommodate said use, and for all the yards, setbacks, walls or fences, landscaping, and other features that may be required in order to adjust said use to those existing or possible future uses of land in the neighborhood in that, based on the maximum occupancy of 92 hospital beds and a maximum employee count of 82 during any one shift, the site provides adequate parking onsite. The project also incorporates new perimeter fencing, additional landscaping, and parking lot improvements, all of which were approved as part of Conditional Use Permit Case No. CU 15-02 and some of which are hereby proposed to be modified, that will enhance, the subject site.

D. That #h® site for the proposed use relates to streets and highways properly designed and improved so as to carry the type and quantity of traffcc generated or to be generated by the proposed use in that a Traffic Assessment was previously prepared for the project which concluded that the study intersections and street levels of service would not be impacted by the project as initially proposed. An updated analysis has been provided to address the increase in the number of patient beds, and is consistent with the previous determination. The City Traffic Engineer • determined that the conclusions were accurate and that the streets and highways would continue to carry the type and quantify of #raffic generated by . the proposed use with no issues. The Applicant's proposed mod cations relating to type of care provided, and an 'increase in the number of patient beds from 80 to 92 and' maximum number of staff from 80 to 82 are negligible, and should not create greater impacts on adjacent streets and highways. The Applicant has submitted adata-driven report demonstrating that the shift to ail -behavioral type of care would even reduce the number of trips generated to the facility, due to a lower rate of visitation for patients . associated with behavioral care versus acute medical care.

SECTICN 3. Environmental Assessment. This project is categorically exempt from the requirements of the Califomia Environmental Quality Act (CEQA) pursuant to 14 Califomia Code of Regulations § 15301 as a Class 1 categorical exemption (Existing Facilities). This project is not anticipated to have any significant impacts with regard to traffic, noise, air quality, or water quality. The project involves a negligible expansion of an existing use, in that the facility is proposing to shift from combination behavioral/medical to all -behavioral care, and add a total of twelve (12} beds to its existing operation.

SECTICN 4. Approval Subject to the conditions listed on the attached Exhibit A, which is incorporated into this Resolution by reference, the Planning Commission approves Conditional Use Permit Case No. CU 16,05.

SECTICN 5. This resolution does not affect any penalty, forteiture, or liability incurred before, or preclude prosecution and imposition of penalties for any violation occurring before, this Resolution's effective date. Any such amended part will remain in full force and effect for sustaining action or prosecuting violations occirring before the effective date of this Resolution.

SECTICN 6. If any part of this Resolution or its application is deemed invalid by' a court of competent jurisdiction, the Planning Commission intends that such invalidity will not affect the effectiveness of the remaining provisions or applications and, to this end, the provisions of this Resolution are severable.

SECTION 7. Reliance On Record Each and every one of the findings and determinations in this Resolution are based on the competent and substantial evidence, both oral and written, contained in the entire record relating to the project. The findings and determinations constitute the independent findings and determinations of the Planning Commission i
Pln all resprects and are fully and completely supported by substantial evidence in the record as a whole.

SECTION 8. Limifatians. The Planning Commission's analysis and evaluation of the project is based on the best information currently available. It is inevitable that in evaluating a project that absolute and* perfect knowledge of all possible aspects of the project will not exist. One of the major limitations on analysis of the project is the Planning Commission's lack of knowledge of future events. In all instances, best efforts have been made to form accurate assumptions. Somewhat related to this are the limitations on the city's ability to solve what are in effect regional, state, and national problems and issues. The City must work within the political framework within which it exists and with the limitations inherent in that framework.

SECTION 9. Effecfrve Rafe. This Resolution is the Planning Commission's final decision and will become effective 10 days following adoption of this resolution unless the action is appealed pursuant to BMC chapters 17.96 and 17.112.

SECTION 10. The Planning Commission Chairman, or presiding officer, is hereby authorized to affix his signature to this Resolution signifying its adoption by the Planning Commission, and the Planning Commission Secretary, is directed to attest thereto.

Memorandum
Subject: Bellflower Medical Center Project— CU 16-05 Noise Assessment Addendum Seena: we are pleased to submit this addendum to the prior Noise Assessment (prepared by AECOM, March 2015) for the Bellflower Medical Center project, located at 9542 East Artesia Boulevard in Bellflower, CA. As we understand it, the current Conditional Use Permit for the Medical Center (CU 16- 05) allows for increasing the number of patient beds provided from 80 to 92 and allows for adjustments in the previously approved phasing plan for various site improvements to be
implemented. This addendum includes the following two items: 1) analysis of potential traffic noise impacts due to the increase in beds, and 2) evaluating the necessity of increasing the height of the existing 6 -foot high perimeter wall.

Traffic Noise Assessment Due to Increase in Beds
Section 4.0 Traffic Noise in the previous noise assessment analyzed changes in traffic noise level, due to the reduction in beds from 144 to 80, using the developed average daily traffic (ADT) volumes for several roadways near the Medical Center. The prior assessment (Table 2) concluded that traffic noise levels would reduce by as much as 1 dB at Ardmore Avenue, south of Artesia Boulevard, and would remain unchanged at all other roadways adjacent to the project. An excerpt from Table 1; shows the ADT volumes for Ardmore Avenue, south of Artesia Boulevard, closest to noise sensitive residential receptors directly adjacent to the project site.

2015 Noise Assessment Table 1 (excerpt): Average Daily Traffic (ADT) Volumes by Alternative As seen in the table above, the reduction of patient beds from 144 to 80 corresponded to a reduction in ADT by 860, approximately 13 ADT per hed. Based on this ratio, we estimate that increasing the beds from 80 to 92 would result in an increase in ADT of approximately 160 trips (from 3,990 to 4,150). This increase would not raise traffic noise levels at Ardmore Avenue or at any other of the roadways adjacent to the project. As a result, increasing the facility beds from 80 to 92 would result in no noise impact.

Evaluating the Necessity of Increasing the freight of the Exiscing Perimeter UUall The prior noise assessment estimated that an increase in wall height from 6 to 8 feet should result in a reduction in noise from activities within the parking area of the facility by 1 to 4 decibels. It is widely acknowledged (U.S. EPA, CPUC, Cowan, others) that a 3 decibel change in environmental noise levels is the minimum change that is perceptible and recognizable to the human ear. Therefore, increasing the wall height would not result in a significant reduction in noise from parking lot activity.

Moreover, the prior noise assessment assumed that existing conditions, including the existing 6 -foot high perimeter wall and larger number of beds, were already compliant with the City of Bellflower exterior noise level standards. As shown above, increasing the beds from 80 to 92 would result in no noise impact; increasing the height of the existing wall is not required for the project to remain in compliance with the City of Bellflower Noise Element. Therefore, keeping the existing perimeter wall at 6 -feet high would result in no noise impact.

1 am a resident of the City of Bellflower, and live adjacent to the Bellflower Hospital parking lot. For the last few years, l have noticed that there is a lot less noise and activity coming from the Bellflower Hospital parking tot. This has been a noticeable change from the prior operation of the full-service hospifal that was there previously.

Bellflower Hospital representatives have informed me that the City of Bellflower may require additional lighting to be installed in the Bellflower Hospital parking Jot in conjunction with upcoming modifications to the Hospital facade. l want the City of Bellflower to know that 1 strongly oppose the installation of any additional lights or lighting on the Bellflower Hospital parking lot. l support the Bellflower Hospital's efforts to beautify the facade of the hospital, but that plan should not include any changes to the lighting, because new lighting will cause a nuisance, and will be disruptive, and will negatively impact my quolity of life.

Also, 1 oppose any construction to expand the size or height of the block wall that surrounds the parking lot. Because the parking lot Is generally quiet, we see no reason to make any changes.
