SUBJECT: Consideration and possible action to conduct the annual public hearing to consider whether the 5% Utility Users’ Tax (UUT) should continue in effect or be modified or repealed.

DATE: December 12, 2022

EXECUTIVE SUMMARY

Ordinance No. 818 requires the City Council to hold an annual public hearing in December regarding whether the Utility Users’ Tax (UUT) should continue in effect or be modified or repealed.

RECOMMENDATION TO CITY COUNCIL

1) Open the public hearing; take testimonial and documentary evidence; and after considering the evidence, approve the continuance of the UUT and fund the Community Policing Program with revenues generated from the UUT; or

2) Alternatively, discuss and take other action related to this item.

FISCAL IMPACT

The City projects that the UUT revenue will be approximately $3,100,000 for fiscal year 2022-2023.

PUBLIC NOTICE

On Friday, December 2, 2022, a Public Hearing Notice was published in the Los Cerritos Community News newspaper.

DISCUSSION

In 1997, voters approved a utility users tax equal to five percent (5%) of the gross charges made to each service user in the City for telephone (including cell phones), electricity, and natural gas.

Page 2 of 2 ends

DISCUSSION – Continued

Section 4 of Ordinance No. 818 requires the City Council to conduct a public hearing each December to consider whether to continue, amend, or repeal the UUT.

The current projection of UUT for fiscal year 2022-2023 is $3,100,000 ($2,400,000 below the estimated CPI growth and $3,600,000 below the combined estimated CPI and population growth). In a long-term view between 1994-1995 and 2021-2022 fiscal years, the total cumulative amount of UUT collected was $9,300,000 below the level of CPI growth and $28,600,000 below the level of combined CPI and population growth. As one can imagine, the measurement of CPI growth alone does not address the overall community policing needs arising from the City’s population growth of approximately 12,900 residents during the same period.

SECTION 1. Findings. The City Council finds as follows:

A. The City may adopt model codes by reference pursuant to Government Code §§ 50022.2, et seq.;
B. Health and Safety Code § 17958 requires the City to adopt certain codes that are set forth in Health and Safety Code § 17922 and published in the California Code of Regulations;
C. In accordance with Health and Safety Code § 17958.7, it is in the public interest to adopt the most recent codes published by the California Building Standards Commission;
D. 4. The California Mechanical Code, 2022 Edition, as published in Title 24, Part 4 of the California Code of Regulations;

5. The California Plumbing Code, 2022 Edition, as published in Title 24, Part 5 of the California Code of Regulations;

6. The California Energy Code, 2022 Edition, as published in Title 24, Part 6 of the California Code of Regulations;

7. The California Fire Code, 2022 Edition, as published in Title 24, Part 9 of the California Code of Regulations,

8. The California Existing Building Code, 2022 Edition, as published in Title 24, Part 10 of the California Code of Regulations;

9. The California Green Building Standards Code, 2022 Edition, as published in Title 24, Part 11 of the California Code of Regulations; and

10. The California Referenced Standards Code, 2022 Edition, as published at Title 24, Part 12, of the California Code of Regulations.

G. Should the City fail to adopt the Model Codes with local amendments on or before January 1, 2023, the Model Codes will take effect without local amendments on that date (Health & Safety Code § 17958 requires adoption of the Model Codes within 180 days from publication or January 1, 2023).

While the companion regular ordinance will be adopted on or about December 12, 20227 it will not take effect before January 1, 2023, necessitating adoption of this Ordinance on an urgency basis so that the Model Codes with local amendments take effect on that date; H. Based on the foregoing, and, in accordance with Government Code §§ 36934 and 36937(b) and the City's police powers, the City Council finds that that this Ordinance should be adopted on an urgency basis to preserve public peace, health, safety and welfare.

SECTION 2. In accordance with Health and Safety Code § 17958.7, the City Council finds that there are local climatic, geographic, and topographic conditions justifying the various local amendments to the California Building Standards Code. The City Council finds and determines that certain building standards established by these Codes are inadequate for use and enforcement in the City of Bellflower because of unique geological conditions prevailing within the City. Such geological conditions affect the potential consequences of soil strength loss due to known liquefaction zones within the City and the nearby location of earthquake faults, resulting in the possibility of tremendous loss of life and structures within the City unless appropriate building standards are adopted. The lessons learned from previous earthquakes, such as the Northridge and Whittier earthquakes, have been refined with studies and tests that have continued since the last code adoption cycle. The results of these studies and tests necessitate adoption of further amendments to the structural requirements of the California Building Standards —4—

City of Bellflower
Ordinance No. 1422

Page 3 of 29 ends

Code. The proposed structural amendments are detailed in the sections of the Bellflower Municipal Code adopted by this ordinance which amend the California Building Standards :;ode and California Residential Code. Additionally, the City of Bellflower is a densely populated area within a climate system capable of producing major winds, fire and rain related disasters, including but not limited to those caused by the Santa Ana winds and EI Nino (or La Nina) subtropical -like weather. This region is especially susceptible to more active termite and wood attacking insects and microorganisms. Los Angeles County and the City of Bellflower are located in a semi -arid Mediterranean type climate which predisposes all fuels, including wood shingles to rapid ignition and spread of fire.

Therefore, there exists a need for additional fire protection measures. The proposed structural amendments are detailed in the sections of the Bellflower Municipal Code adopted by this ordinance which amend the California Building Standards Code. The proposed fire -safety amendments are detailed in the sections of the Bellflower Municipal Code adopted by this ordinance which amend the California Fire Code.

1. SECTION 3. Chapter 15.04 of the Bellflower Municipal Code ("BMC") is amended in its entirety to read as follows:
"Chapter 15.04 BUILDING CODE

15.04.010 Building Code —Adopted by Reference; Where filed.

In accordance with Government Code § 50022.6, one copy of the chapters and appendices must remain on file with the Building Official within the Planning Department and must be at all times maintained by the Building Official for use and examination by the public.

15.04 .020 Definition of terms.

The Building Official must attempt to notify the serving utility, and wherever possible the owner or the owner's authorized agent and occupant of the building, structure, premises, system, equipment, fixture, or device, of the decision to disconnect before taking such action; provided that the Building Official may dispense with any attempt at prior notification if, in the sole discretion of the Building Official, the nature or severity of the hazard justifies such inaction. If not notified before disconnecting, the Building Official must notify the owner of the owner's authorized agent or occupant of the building, structure, premises, system, equipment, fixture, or device in writing of the disconnection as soon as practical thereafter.

The utility service must remain disconnected or discontinued until the Building Official releases the utility service. The Building Official cannot release the utility service until:

conditions. All such unsafe buildings or conditions are public nuisances and must be abated by repair, rehabilitation, improvement, removal, or demolition, in whole or part.

A vacant building or structure that is not secure against entry is deemed "unsafe." 116.2 Placards and orders relating to occupancy of unsafe structures and buildings. Pursuant to the completion of a visual, nondestructive examination to determine the condition for continued occupancy, the Building Official or designee is authorized to designate the condition of the unsafe building or structure with a placard or order, as follows:

1. A "stop work" order means an order requiring the immediate cessation of all work being done contrary to the provisions of Title 15 or other pertinent laws or ordinances implemented through the enforcement of this Code, or which results in a dangerous, hazardous or unsafe condition. Persons notified of this order must immediately stop such work until otherwise authorized by the Building Official or designee.

2. A "limited access" order or "yellow tag" denotes restricted use and is to be posted on each building or structure that has been damaged wherein the damage has resulted in some form of restriction to the continued occupancy. The individual who posts this placard will note in general terms the type of damage encountered and will clearly note the restrictions on continued occupancy.

3. A "do not enter —unsafe to occupy" order or "red tag" denotes that the building or structure is so damaged that continued occupancy poses a threat to life safety. Buildings or structures posted with this placard may not be entered under any circumstance except as authorized in writing by the building official or designee. Safety assessment teams are authorized to enter these buildings at any time. This placard is not to be used or considered as a demolition order. The individual who posts this placard will note in general terms the type of damage encountered.

The appropriate placard must be posted at each entry point to a building or structure.

Once it has been attached to a building or structure, a placard is not to be removed, altered or covered until done so by an authorized representative of the building official. It is unlawful for any person, firm or corporation to alter, cover or deface a placard pursuant to this section.
116.3 Notice. If an unsafe condition is found, the Building Official must serve on the owner, agent or person in control of the structure, a written notice that describes the condition deemed unsafe, and specifies the required repairs or improvements to be made to abate the unsafe condition, or that requires the unsafe structure to be demolished within a reasonable time. Such notice will be deemed properly served when made in conjunction with section 1.04.080 of the Bellflower Municipal Code.

10. The California Referenced Standards Code, 2022 Edition, as published at Title 24, Part 12, of the California Code of Regulations.

The results of these studies and tests necessitate adoption Df further amendments to the structural requirements of the California Building Standards Code. The proposed structural amendments are detailed in the sections of the Bellflower Municipal Code adopted by this ordinance which amend the California Building Standards Code and California Residential Code.

Therefore, there .exists a need for additional fire protection measures. -33-

No building or structure can be used or occupied in whole or in part, and no change in the existing use or occupancy classification of a building or structure or portion thereof can be made until the Building Official has issued a certificate of occupancy therefore as provided herein. The Building Official cannot issue a Certificate of Occupancy to the builder upon the completion of a commercial structure where there is tenant space. Instead, a Certificate of Occupancy is issued to a business entity that is going to occupy the building or a portion thereof. Issuance of a certificate of occupancy must not be construed as an approval of a violation of the provisions of the codes or other ordinances of the City. Certificates presuming to give authority to violate or cancel the provisions of the codes or other ordinances are not valid.

Exception: The Building Official does not issue Certificate of Occupancies for single and duplex residential dwelling units and owner -occupied dwelling units, such as townhomes, condominiums and U occupancies. Certificates of occupancy are not required for work exempt from permits in accordance with Section 105.2.
111.2 Time limitation of application. An application for a certificate of occupancy is deemed abandoned one year after the date of filing, unless such application has been pursued in good faith or a certificate of occupancy has been issued. 111:3 Certificate issued. After the Building Official inspects the building or structure and finds no violations of the provisions of the codes or other laws that are enforced by the City; the Building Official must issue a certificate of occupancy that contains the following:

1. The building permit number.

2. The address of the structure.

3. The name and address of the owner.

In the event the building is not completed and ready for final inspection in the time prescribed by the Building Official, the building must be vacated and the utilities disconnected until such time the building is completed, final inspection is completed and a Certificate of Occupancy is issued.
111.5 Revocation. The Building Official is authorized to, in writing, suspend or revoke a certificate of occupancy or completion issued under the provisions of the codes, in writing, wherever the certificate is issued in error, or on the basis of incorrect information supplied, or where it is determined that the building or structure or portion thereof is in violation of any ordinance or regulation or any of the provisions of the codes.

K. Chapter 1, Division I I (Scope and Administration), Section 112 —Service Utilities, is amended as follows:

SECTION 112 —SERVICE UTILITIES

112.2 Temporary connection. The Building Official has authority to authorize the temporary connection of the building or system to the utility, the source of energy, fuel or power, or the water system or sewer system for the purpose of testing systems or for use under a temporary approval.

Temporary connections may be terminated by the Building Official in the event the permit for such work expires, temporary occupancy is terminated, or it is determined by the Building Official that conditions associated with the connected utility are not met. 112.3 Authority to disconnect service utilities. The Building Official is authorized and empowered to cause or order the disconnection or discontinuance of utility service to a building, structure, premises, system, equipment, fixture, or device that is regulated by this Code or by the referenced codes and standards set forth in Section 101.4, or elsewhere in the Bellflower Municipal Code: (i) when necessary to eliminate or mitigate an immediate hazard to life, health, safety, or property; (ii) when such building, structure, system, equipment, fixture, or device, or any utility service thereto, has been installed, equipped, altered, or used without requisite approvals, permits, or inspections; or (iii) when such building, structure. premises, system, equipment. fixture or device is found to be an unlicensed cannabis facility. An "unlicensed cannabis facility" means any facility within the City conducting commercial cannabis activity.

(i) the imminent hazard has been abated or eliminated; or (ii) all requisite approvals, permits, and inspections have been obtained for the building, structure, system, equipment, fixture, or device, or any utility service thereto.

N. Chapter 1, Division II (Scope and Administration), the title of Section 116 —Unsafe Structures and Equipment, is amended as follows:

SECTION 116 —UNSAFE STRUCTURES AND BUILDINGS
O. Chapter 1, Division I I (Scope and Administration), Sections 116.1, 116.2,116.3 are amended as follows:
116.1 General. All buildings, structures or existing equipment that are or hereafter become unsafe, insanitary or deficient because of inadequate means of egress facilities, inadequate light and ventilation, or which constitute a fire hazard, or are otherwise dangerous to human life or the public welfare, or that involve illegal or improper occupancy or inadequate maintenance, are, for the purpose of this section, unsafe conditions.

3. A "do not enter — unsafe to occupy" order or "red tag" denotes that the building or structure is so damaged that continued occupancy poses a -52-

Once it has been attached to a building or structure, a placard is not to be removed, altered or covered until done so by an authorized representative of the building official. It is unlawful for any person, firm or corporation to alter, cover or deface a placard pursuant to this section.
116.3 Notice. If an unsafe condition is found, the Building Official must serve on the owner, agent or person in control of the structure, a written notice that describes the condition deemed unsafe and specifies the required repairs or improvements to be made to abate the unsafe condition, or that requires the unsafe structure to be demolished within a reasonable time. EXECUTIVE SUMMARY
The 2022 California Building Standards Code ("CBSC") takes effect on January 1, 2023.

These are part of the uniform codes imposed by the California Legislature every three years via Title 24 of the California Code of Regulations. Health and Safety Code §17958 allows local governments to amend the CBSC based upon local climatic, topographical, and geological conditions, or for administrative reasons.

The Planning Department, including the Building and Safety Division, is proposing amendments to the Bellflower Municipal Code relating to building code regulations for the purpose of complying with State requirements and to update current administrative and technical standards. The last code adoption with amendments to the Bellflower Municipal Code relating to building code regulations was December 9, 2019.

This Ordinance would amend portions of the proposed 2022 CBSC and adopt the . 2022 Edition of the CBSC. The most significant changes with the 2022 Edition of the CBSC relate to fire protection, solar photovoltaic power systems, electric vehicle ("EV") charging stations, and the permit expiration timeframe.

RECOMMENDATION TO CITY COUNCIL
1) Read by title only, waive further reading, and introduce Ordinance No. 1421; and 2) Set a public hearing for the December 127 20223 City Council Meeting for second reading and possible adoption of the Ordinance; or
3) Alternatively, discuss and take other action related to this item.

FISCAL IMPACT
The cost to administer implementation of the CBSC is recovered via Building Division permit fees.

PUBLIC NOTICE
For the adoption of uniform codes, state law requires that the second reading of the Ordinance be noticed as a public hearing. Accordingly, if the City Council follows staff's recommendation to set a public hearing for December 12, 2022, legal notice will be published on November 25, 2022, and December 2, 2022, in the Los Cerritos Community News newspaper in anticipation of the upcoming Public Hearing.

ENVIRONMENTAL ASSESSMENT
This Ordinance is exempt from review under the California Environmental Quality Act (Public Resources Code §§ 21000, et seq., "CEQA") and the regulations promulgated thereunder (14 California Code of Regulations §§ 15000, et seq., the "CEQA Guidelines') because it consists only of minor revisions and clarifications to an existing code of construction -related regulations and specification of procedures. These will not have the effect of deleting or substantially changing any regulatory standards or findings.

Accordingly, the Ordinance (by itself) does not have the potential to cause significant effects on the environment. In addition, this Ordinance is an action being taken for enhanced protection of the environment and is exempt from further review under CEQA Guidelines § 15308.

DISCUSSION
The California Building Standards Commission is authorized by the California Building Standards Law (Health and Safety Code § 18901 through 18949.31) to administer the processes related to the adoption, approval, publication, and implementation of California's building codes.

California Code of Regulations Title 24, also known as the CBSC, is a compilation of three types of building criteria from three origins:
• Building standards that have been adopted by state agencies with change from building standards contained in national model codes;
• Building standards that have been adopted and adapted from the national model code standards to meet California conditions; and

These building codes are comprised of 12 parts containing the regulations that govern and serve as the basis for the design and construction of all buildings and structures in California.

California law requires that the City Council conduct a public hearing before second reading of ordinances that adopt the CBSC by reference. Staff recommends that the City Council set a public hearing for the second reading of the Ordinance at its December 12, 2022 meeting.

The most significant changes with the 2022 Edition of the CBSC relate to fire protection, solar photovoltaic power systems, electric vehicle ("EV") charging stations, and the permit expiration timeframe. The fire protection and prevention codes have been updated to comply with the NFPA 72 standards, which includes without limitation, photovoltaic power systems, portable fire extinguishers, gas detection systems, and roofing assembly.

Significant changes to the California Green Building Standards Code have been made to EV charging system requirements for residential and commercial projects, which also alters the requirements for the number of parking spaces. All codes have changed the permit expiration timeframe from 180 days to 12 months from permit issuance.

The recommended action includes amending Title 15 of the Bellflower Municipal Code by adopting the 2022 Edition of the CBSC. In considering such action, the City Council acts in its discretionary legislative capacity (formulating rules that apply to all future cases).

For the proposed amendments, the City Council must find that they are reasonably necessary because of local climatic, geological or topographical conditions (Health and Safety Code § 17958.7). These findings, and the facts upon which they rely, are included within the draft Ordinance.

Projects for which a building permit application and building plans were submitted before the Ordinance's effective date, and for which building permits are obtained within 90 days of the effective date, are exempt from the updated regulations in the the Ordinance.

Should, however, the building permit expire, all building plans must comply with the updated regulations.

SUBJECT: Consideration and possible action to authorize the Director of Public Works, or designee, to install red curb parking restrictions at 10145 Walnut Street fronting Woodruff Avenue (C.E. #22-08).

DATE: December 12, 2022

EXECUTIVE SUMMARY

This action would approve and authorize the installation of red curb parking restrictions at 10145 Walnut Street fronting Woodruff Avenue pursuant to Bellflower Municipal Code (“BMC”) Chapter 10.04.

RECOMMENDATION TO CITY COUNCIL

1) Authorize the Director of Public Works, or designee, to install red curb parking restrictions at 10145 Walnut Street fronting Woodruff Avenue; or

2) Alternatively, discuss and take other action related to this item.

FISCAL IMPACT

The estimated cost to install the red curb parking restrictions is $100.00. The required funds are contained within the current fiscal year budget.

DISCUSSION

Earlier this year, the City received a request from a resident to install red curb parking restrictions at 10145 Walnut Street fronting Woodruff Avenue. Specifically, the request was to install approximately sixty (60) feet of red curb on the west side of Woodruff Avenue immediately north of Walnut Street. The basis of the request was to improve line of sight for vehicles entering Woodruff Avenue off of Walnut Street.

Staff Report – Installation of Red Curb Parking Restrictions at 10145 Walnut Street fronting Woodruff Avenue
December 12, 2022

Page 2 of 2 ends

DISCUSSION – Continued

In response to the request, the City Engineer conducted a sight visit and a line of sight assessment. The assessment determined that vehicles parked on Woodruff Avenue just north of Walnut Street do obstruct the view of oncoming traffic. Hence, to enhance safety while minimizing the loss of on-street parking, staff recommended the installation of twenty-five (25) feet of red curb parking restrictions on Woodruff Avenue which would have resulted in the elimination of one on-street parking space. The proposed red curb parking restrictions are illustrated on the attached aerial photograph.

On April 5, 2022, the City Engineer provided notice to area residents of this request and that this matter would be brought before the Public Safety Commission at its April 19, 2022, meeting. Prior to the Commission meeting, the City received two responses to the notification - one in support of the red curb restrictions and one opposing the restrictions.

The City Engineer presented an overview of the staff report at the April 19, 2022 Public Safety Commission Meeting and answered questions from the Commission. There were no comments made by members of the public in attendance. Following discussion among the Commission, a motion was made to approve the recommended installation of red curb parking restrictions; however, the motion failed due to lack of a second.

At the request of Mayor Dunton, Public Works staff has brought this item before City Council for discussion and possible consideration.
