Consideration of future design & use of solar-powered light fixtures at palm park and on the MTA Bike trail

March 13, 2023

1 Background
Since 2021, City facilities have experienced extensive copper wire theft, particularly lighting fixture wiring MTA Bike Trail lights repairs have exceeded $100,000
Palm Park light repairs are approx. $15,000
Caruthers snack shack and ballfields have experienced wire theft that has caused more than $10,000 in repairs

2 Repairs and in-house solutions
Public Works has used staff and outside contractors to make the necessary repairs at facilities.

Staff has also utilized unconventional ideas to remedy thefts including:

Tack/Spot welding access plates on light poles & pull boxes Metal banding of decorative collars for light poles
Use of tamper-proof screws
Strategic placement of heavy boulders on top of pull boxes at ground level

3 Solar-powered lighting solutions
In recent years, the exterior lighting industry has made significant strides in the develop and design solar-powered exterior lighting fixtures The largest benefit of solar-powered lights is that there is no need for an electrical power source, resulting in a lower operating costs and they are no longer targeted by wire thieves.

However, solar-powered light fixtures are costly and are limited in the design styles

4 Solar-powered lighting solutions
The City worked with Willdan Engineering and South Coast Lighting and Design to assess the lights on the MTA Bike Trail and Palm Park to provide an option of converting the existing light fixtures to solar-power as well or switch to a comparable solar-powered light fixture.

The goal of the assessment was to focus on the actual light fixture and re-use the existing vertical pole in an effort to reduce costs.

5 Palm Park
There are two separate lighting fixtures currently at Palm Park:
35 Shepard’s Hook fixtures for the walking path
12 box lights for the parking lot
Retrofit of Shepard’s Hook light fixtures
Existing pole estimated at $5,525/fixture - $193,375 total New pole estimated at $4,200/fixture - $147,000 total
New light fixture, similar Shepard’s Hook style
$2,750/fixture - $96,250 total
Park Lot Box Lights
Cannot be retrofitted
Recommended to replace existing fixtures with all-in-one light fixture with solar panel built in $3,170/fixture - $38,040

Survey Specifics and Methodology
Not all results will sum to 100% due to rounding
In 2005 and 2007, the survey used a Random Digit Dial (RDD) sampling methodology. In the 2013 through 2016 studies, a voter listed sample was used.

The survey was conducted in 2003 and 2001 as well, but results are only presented for the last seven studies.

28 The Most Important Thing
the City Can Do to Improve City Services for the People Who Live/Work in Bellflower

29 29

Addressing crime and homelessness remain atop the list of the most important things the City can do to improve services Q12. In thinking about all the issues we have discussed or some other issue related to Bellflower, what is the most important thing the City of Bellflower can do to improve city services for the people who live and/or work in Bellflower? Topic areas are the same from past years, yet descriptions reflect results in 2023; * In past years this category focused on gangs; ** in past years this category included other government issues (Open-ended; Multiple Responses Allowed; Grouped Responses; Ranked by 2023)

30 Summary of Key Findings

31 31

Key Findings
Two out of 3 residents view Bellflower favorably as a place to live—a finding that is unchanged since 2018 but down slightly from years prior.

Homelessness is the most top-of-mind issue, and its saliency continues to rise. Homelessness also tops a list of 17 issues in the proportion calling it a serious problem in Bellflower today.

The proportion who call a lack of affordable housing a serious problem is second only to homelessness—and up notably from 2018 and past years. In addition to housing costs, this year’s study showed a heightened concern about inflation and the cost of living.

Crime rounds out the most mentioned concerns and is a growing concern as well. Concern about crime is near equal to that of homelessness in saliency, and issues related to crime rank just behind homelessness and affordable housing in seriousness on the list of issues tested.

32 32

Key Findings; Continued
Nearly half of residents believe crime has increased in their neighborhood in the past five years—up notably from 2018 and continuing an upward trend from years prior.

When asked the most serious public safety concerns in their neighborhood, homelessness; unsafe driving; and home burglaries, break-ins, and theft were the most mentioned, followed by drug abuse, security and police patrols, and gangs and juvenile violence.

Three out of four or more residents respond positively to increasing public spending on policies that would address homelessness, with policies related to prevention and response generating more intensity of support than those related to supportive housing.

Ratings for Bellflower’s community service officers are modest generally—perhaps reflecting the term “officers” suggests “police.” Positive ratings were higher among those who heard a job description.

33 33

Key Findings; Continued
A majority of residents rate Bellflower City government’s job performance positively, but ratings are slightly lower when considering the City Council specifically. While these ratings are little changed since 2018, the survey revealed increased concern about the quality of Bellflower’s basic City services and inefficiency in City government.

While residents express more concern about quality of City services and government inefficiency, they are at least somewhat satisfied on average with all 16 specific city services tested in the survey—including management of City finances.

Areas where comparisons between importance and satisfaction ratings suggest need for attention or improvement are management of City government finances, road maintenance, neighborhood clean-up, police protection, business development, after-school activities, and graffiti removal.

ATTENTION: Jeffrey L. Stewart, City Manager

FROM: Joel Hockman, Director of Public Safety

SUBJECT: Consideration and possible action to seek direction on current Code Enforcement procedures, current Southwest Patrol deployment, and potentially hiring a part-time Sheriff’s Liaison position.

DATE: March 13, 2023

EXECUTIVE SUMMARY

The Public Safety Department Staff is looking for direction on three components of their operation: Code Enforcement, Southwest Patrol services, and potentially adding the part-time position of Sheriff’s Liaison. Having moved the City’s Code Enforcement Division over to the Substation six months ago, giving a progress report and receiving direction from Council is well-timed. The same is true for reviewing the large increase of Southwest Patrol services at the beginning of this year. And, in response to some concerns about oversight of the City’s Sheriff’s patrol services, the potential value of hiring a retired member of that department to analyze the performance of current patrol personnel has merit.

RECOMMENDATION TO CITY COUNCIL

1) Direct staff whether to modify the existing direction of Code Enforcement, modify the current deployment level of Southwest Patrol, and initiate the hiring of a part-time Sheriff’s liaison position; or

2) Alternatively, discuss and take other action related to this item.

FISCAL IMPACT

The annual cost of adding a part-time Sheriff’s Liaison position at $94 per hour providing 15 hours of service per week is $79,000 including taxes. There would be no fiscal impact from providing direction on Code Enforcement and Southwest Patrol, unless the City Council recommended changing staffing or service levels (armed guard is $55 per hour and unarmed guard is $38 per hour).

DISCUSSION

1) CODE ENFORCEMENT: Transitioning the Code Enforcement Division over to Public Safety turned out to be a smoother process than many suspected. The enforcement culture of personnel already working in the Substation has been a good fit based on Council’s direction for Code Enforcement to take on a more assertive posture with some of its caseloads. Also, the department is continuing to make progress on cross-training the field duties of code enforcement inspectors and community service officers, which greatly expands the City’s ability to expand both services. Some of the specific highlights include:

Year-to-date case and administrative citation comparison between 2022 and 2023.

Jan 1-Mar 6, 2023 232 100 37

Enhancements to Code Enforcement services, based on the recent merger:

 Community service officers (CSOs) serve as extra eyes in the field to spot and report visible violations more readily.
 CSOs assist with performing numerous re-inspections of minor violations, during the performance of their other duties – which frees up time for code enforcement inspectors.
 Recently expanded weekend and evening coverage for both CSOs and code enforcement inspectors (currently going through additional cross-training).  More Substation office support to assist citizens in person and on the phone.  Daily interaction with and support from Sheriff’s personnel regarding problem properties, vendors, etc.
 City Hall front counter has been freed up from numerous Code Enforcement contacts.

Although it already has been six months since the merger began, the department is still looking to expand its ability to deliver service with further cross-training, door hanger violation notices, possible enhanced program management software, support from the City Attorney’s office, and other strategies to get more compliance on a variety of code violations – especially those visible from the street-view.

2) SOUTHWEST PATROL: The City has made fairly extensive use of Southwest Patrol’s services in recent years to provide better support to its parks, parking structure, and commercial and residential corridors – both day and night-time shifts. In addition to being a visible deterrent, the armed officers have been engaging suspicious and/or criminal persons to a limited degree (e.g., illegal campers, people parked suspiciously, responding to burglary alarm calls). A review of Southwest Patrol logs reveals other examples of actions taken:

2 Staff Report – Options for Increasing Public Safety Services March 13, 2023

Page 3 of 3 ends

DISCUSSION – Continued

General Activities
 Evening patrols of local businesses – especially in the downtown area.  Patrolling liquor stores/bars and moving along those loitering and/or drinking in public.
 Investigating suspicious vehicles driving around neighborhoods slowly with no lights on (possibly with criminal intent).
 Multiple checks of bus shelters in town, removing persons found camping or loitering.
 Numerous instances of locating suspicious people, and calling LASD to investigate.
 Found multiple stolen vehicles which were reported to and recovered by LASD.  Documenting graffiti incidents around the city.

Recent Noteworthy Incidents
 Found a group of “mini-bikers” riding around Simms Park, made contact and cleared the group from the park.
 Assisted parents of a missing teenager with autism look for their child at Riverview Park.
 Came upon a vehicle stopped in the roadway at Lakewood Boulevard/Flower Street, contact was made with the driver who appeared under the influence. LASD was contacted and arrived on scene. The driver was later arrested for DUI.  While patrolling around the vacant “Just Tires” an alarm noise was heard coming from the building. A sweep of the exterior revealed a forced entry point. LASD was called to assist with cleaning the building.
 Officers were flagged down regarding a hit and run, the victim pointed out where the suspect vehicle was last seen. The officers checked the area and located the vehicle/suspect. They held the suspect at the location until LASD arrived.

3) HIRING A PART-TIME SHERIFF’S LIAISON POSITION: The City of Bellflower has a long history of reviewing the delivery of Sheriff’s patrol services. Most of this past effort was focused on how patrol time was assigned within the requirements of the City’s contract. Since that time, the City cancelled a sergeant position, and the past Sheriff removed all service area lieutenants (SAL’S) who were assigned to contract cities, as a cost-saving measure (those positions had been paid for by the County for >20 years).

As a result, Bellflower went from having three Sheriff’s supervisors/manager down to one supervisor, whose primary responsibilities are the SAO team and other administrative duties. The idea of hiring back the City’s recently retired SAL to review the performance of Bellflower’s patrol deputies is seen as a way to increase oversight, but at approximately 25% the cost of contracting another full-time sergeant position. In the role of Sheriff’s liaison, the new hire would have access to the various documents needed to review deputy performance, as well as opportunities to meet with personnel who need to show improvement or who are deserving of affirmation as a good example to others.

This proposed position is rather unique and somewhat experimental. If after some reasonable number of months, the service does not lead to some performance improvements within the patrol personnel assigned to Bellflower, the City would have the ability to discontinue the position.

SUBJECT: Consideration and possible action to provide direction for the design and use of solar-powered pedestrian and safety lights on the MTA Bike Trail and at Palm Street Park.

DATE: March 13, 2023

EXECUTIVE SUMMARY

The City has recently experienced costly copper wire thefts involving the pedestrian lights along the MTA Bike Trail as well as at Palm Street Park. Staff has consulted with Willdan Engineering and South Coast Lighting on converting the existing light fixtures to solar-power as well as other solar-powered light fixtures currently available on the market that could be incorporated onto the existing poles.

RECOMMENDATION TO CITY COUNCIL

1) Provide direction to staff regarding future usage of solar-powered light fixtures on the MTA Bike Trail and at Palm Street Park; or

2) Alternatively, discuss and take other action related to this item.

FISCAL IMPACT

Depending on whether the existing fixtures are retrofitted or new fixtures are utilized, the estimated cost will range between $2,000 - $6,000 per light fixture. This project is not part of the current year budget. If approved, a Capital Improvement Project account will be created and the budget will be established.

DISCUSSION

Staff has obtained estimated costs from Willdan Engineering and South Coast Lighting to retrofit existing pedestrian light fixtures to solar-power as well as estimated costs for new solar-powered light fixtures that are similar in style to the existing light fixtures for both the MTA Bike Trail and Palm Street Park.

TO: Honorable Mayor and Members of the City Council

ATTENTION: Jeffrey L. Stewart, City Manager

FROM: Travis Sais, Assistant to the City Manager

SUBJECT: Consideration and possible action to consider adopting Resolution No. 23-09 – A Resolution opposing Ballot Initiative No. 21-0042A1, the Taxpayer Protection and Government Accountability Act.

DATE: March 13, 2023

EXECUTIVE SUMMARY

The Taxpayer Protection and Government Accountability Act would amend the California Constitution with provisions that limit voters’ authority and input, adopt new and stricter rules for raising taxes and fees, and may make it more difficult to impose fines and penalti es for violations of state and local laws. The League of California Cities estimates the measure puts billions of local government tax and fee revenues at risk statewide with related core public service impacts. The proposed constitutional initiative has qualified for the November 2024 ballot and is sponsored by the California Business Roundtable. The League of California Cities, along with a broad coalition of local governments, labor and public safety leaders, infrastructure advocates, and businesses, strongly oppose this initiative.

RECOMMENDATION TO CITY COUNCIL

1) Consider adopting Resolution No. 23-09; or

2) Alternatively, discuss and take other action related to this item.

FISCAL IMPACT

If the Taxpayer Protection and Government Accountability Act is placed on the November 2024 ballot and passes, City of Bellflower fee and tax revenue would be put at risk, and legal defense costs would likely increase. In particular, any tax or fee (including adjustments) adopted after January 1, 2022 (e.g., Development Impact Fees) could be subject to legal challenge. The League of California Cities estimates the Taxpayer Protection and Government Accountability Act could take billions of dollars away from local government services statewide.

DISCUSSION

On January 4, 2022, the California Business Roundtable filed the “Taxpayer Protection and Government Accountability Act” or AG# 21-0042A1. On February 1, 2023, the measure qualified for the November 2024 ballot. The League of California Cities (“Cal Cities”), along with a broad coalition of local governments, labor and public safety leaders, infrastructure advocates, and businesses, strongly oppose this initiative. The Taxpayer Protection and Government Accountability Act adds and expands restrictions on voters and local government tax and fee authority. Major provisions of The Taxpayer Protection and Government Accountability Act are listed below:

Fees and Charges1

• Except for licensing and other regulatory fees, fees and charges may not exceed the “actual cost” of providing the product or service for which the fee is charged. “Actual cost” is the “minimum amount necessary.” The burden to prove th e fee or charge does not exceed “actual cost” is changed to “clear and convincing” evidence. • Requires fees and charges paid for the use of local and state government property and the amount paid to purchase or rent government property to be “reasonable.” T hese fees and charges are currently allowed to be market -based. Whether the amount is “reasonable” (introducing a new legal standard aiming to force below market fee and charge amounts) must be proved by “clear and convincing evidence.”2 The standard may significantly reduce the amount large companies (e.g., oil, utilities, gas, railroads, garbage/refuse, cable, and other corporations) will pay for the use of local public property.
• Prohibits fees on new development based on vehicle miles traveled .

Examples of affected fees and charges are:

• Commercial franchise fees
• Facility use charges, fees for parks and recreation services, garbage disposal tipping fees
• Development Impact Fees (DIFs)
• Cannabis Business Permit (CBP) fees
• Parking permit fees

Virtually every city, county, and special district must regularly adopt increases to fee rates and charges and revise rate schedules to accommodate new users and activities. Most of these would be subject to new standards and limitations under threat of legal challenge.

DISCUSSION – Continued

Based on the current volume of fees and charges imposed by local agencies, including council-adopted increases to simply accommodate inflation, Cal Cities estimates the amount of local government fee and charge revenue at risk is approximately $2 billion per year incl uding those adopted since January 1, 2022. Over ten years, Cal Cities estimates $20 billion of local government fee and charge revenues will be at heightened legal peril.

Taxes3

• Taxes and fees adopted after January 1, 2022, that do not comply with the new rules, are void unless reenacted.4
• Invalidates Upland decision that allows a majority of local voters to pass special taxes.

The measure specifies that taxes proposed by the initiative are subject to the same rules as taxes placed on the ballot by a city council.
• Expressly prohibits local advisory measures which allow local voters to express a preference for how local general tax dollars should be spent.5 • Requires voter approval to expand existing taxes (e.g., Utility, Transient Occupancy) to new territory (e.g., annexations) or to expand the tax base (e.g., new utility service) • New taxes can only be imposed for a specific time period. • City charters may not be amended to include a tax or fee. • All state taxes require majority voter approval.

Hundreds of local tax measures were approved in 2022 that likely do not comply with the provisions of the initiative. Nearly $2 billion of annual revenues from these voter -approved measures could cease a year after the effective date of the measure, reducing the local public services funded by these measures, unless the tax is re-submitted for voter approval.

Reductions on local government tax revenues have impacts on core services and infrastructure including fire and emergency response, law enforcement, streets and roads, drinking water, sewer sanitation, parks, libraries, public schools, affordable housing, homelessness prevention, and mental health services.

Fines and Penalties6

• May require voter approval of fines, penalties, and levies for corporations and pr operty owners that violate state and local laws unless a new, undefined adjudicatory process is used to impose the fines and penalties.

3 Initiative No. 21-0042A1 (pgs.4-6; Section 1 (a)-(j)) 4 Initiative No. 21-0042A1 (pg.7; Section 6 (Sec. 2)(g)) 5 Initiative No. 21-0042A1 (pg.6 (3))
6 Initiative No. 21-0042A1 (pg. 5 (4))

Staff Report – Resolution No. 23-09 – Ballot Initiative No. 21-0042A1 March 13, 2023

Page 4 of 4 ends

DISCUSSION – Continued

Under existing law, cities are required to provide due process before imposing a penalty or fine for violation of its municipal code:

1. A local agency must adopt administrative procedures that govern imposing fines and penalties, including providing a reasonable period of time for a person responsible for a continuing violation to correct or remedy the violation.

2. Notice must be given to the violating party before imposing the penalty; and give the party an opportunity to be heard and present any facts or arguments.

3. The fine may not be "excessive.”

The initiative converts administratively-imposed fines and penalties into taxes unless a new, undefined, and ambiguous “adjudicatory due process” is followed. This pr ovision may put at risk authority to impose fines and penalties for violations of state and local law.

CITY OF BELLFLOWER

RESOLUTION NO. 23-09

A RESOLUTION OPPOSING BALLOT INITIATIVE NO. 21-0042A1, THE

TAXPAYER PROTECTION AND GOVERNMENT ACCOUNTABILITY
ACT

THE CITY COUNCIL RESOLVES AS FOLLOWS:

SECTION 1. The City Council finds and declares as follows:

A. An association representing California’s wealthiest corporations and developers is spending millions to push a deceptive proposition aimed for the November 2024 statewide ballot;

B. The measure includes undemocratic provisions that would make it more difficult for local voters to pass measures needed to fund local services and infrastructure, and would limit voter input by prohibiting local advisory measures where voters provide direction on how they want their local tax dollars spent;

C. The measure creates new constitutional loopholes that allow corporations to pay far less than their fair share for the impacts they have on our communities, including local infrastructure and our environment;

D. The measure may make it much more difficult for state and local regulators to issue fines and levies on corporations that violate laws intended to protect our environment, public health and safety, and our neighborhoods; and

E. The measure puts billions of dollars currently dedicated to local services at risk and could force cuts to fire and emergency response, law enforcement, public health, parks, libraries, affordable housing, services to support homeless residents, mental health services, an d more.

SECTION 2. The City of Bellflower opposes Initiative 21 -0042A1 and will join the “No” on Initative 21-0042A1 coalition, a growing coalition of public safety, education, labor, local government, and infrastructure groups throughout the state.

SECTION 3. Preservation. Repeal or amendment of any previous resolutions does not affect any penalty, forfeiture, or liability incurred before, or preclude prosecution and imposition of penalties for any violation occurring before this Resolution’s effective date. Any such repealed part will remain in full force and effect for sustaining action or prosecuting violations occurring before the effective date of this Resolution.

City Manager Stewart 1) provided a brief verbal presentation of the Staff Report; and 2) responded to Council Members’ questions.

Continuing the discussion from the January 23, 2023, City Council Meeting , 1) Council Member Dunton, Council Member Sanchez, and Council Member Koops stated that they were in favor of keeping the current method of selecting commissioners from the City at-large and not from the Council Members’ specific districts; and 2) Mayor Santa Ines expressed that he now favored Council Member Koop’s previous suggestion of requiring each Council Mem ber to appoint at least one commissioner from their Council District to ensure that each district had representation on the commissions.

Lengthy discussion ensued among the City Council regarding the matter.

Guy Bremer, resident, stated that he supported the City Council continuing to select commissioners from the whole City in order to not limit themselves and find the best candidates to serve on the commissions.

Mitch Haack, Parks & Recreation Commissioner, stated that he supported the Council Members continuing to select commissioners from the whole City, as they may have individuals from different districts with certain skill sets and personalities that would be great for specific commissions.

James Cody Birkey, resident, 1) expressed that although he understood the intentions of the discussion, suggested that the City Council consider it a guideline instead of a rule; and 2) stated that the topic at hand may warrant a future discussion of possible initiatives to garner more civic engagement f rom residents in Council District 4.

Following discussion, it was moved by Council Member Sanchez, seconded by Council Member Koops, and carried by the following roll call vote, to direct staff to maintain the status quo for the City Council to continue to appoint commissioners at-large from the entire City:
