TO: Honorable Mayor and Members of the City Council
ATTENTION: Jeffrey L. Stewart, City Manager
FROM: Elizabeth C. Oba, Director of Planning and Building Services SUBJECT: Consideration and possible action to set a public hearing for Zoning Ordinance Text Amendment Case No. ZOTA 23-01 and Conditional Use Permit Case No. CU 23-01.

DATE:

September 11, 2023

E)CECUTIVE SUMMARY
On August 7, 2023, the Planning Commission held a public hearing to consider a Zoning Ordinance Text Amendment (ZOTA 23-01) to amend the Bellflower Municipal Code ("BMC") to reduce the minimum distance requirement between automobile repair shops/centers and a Conditional Use Permit (CU 23-01) to allow an automobile repair shop and a spray booth within an existing building located at 9638-9648 Artesia Boulevard. At the conclusion of the public hearing, the Planning Commission adopted Resolution Nos. 23-04 and PC 23-05 recommending denial of the IOTA and the CUP to the City Council. In the staff report and at the public hearing, staff informed the Commission that it was acting as an advisory body only to the City Council and that its action for approval or denial would be a recommendation to the City Council.

However, the information provided to the Planning Commission and the applicant was incorrect and the Planning Commission's action for denial of the ZOTA and CUP should have been final unless an appeal was filed pursuant to BMC § 17.104.070(b). To address this error and allow the applicant the opportunity for its application to be heard by the City Council, the City Council should consider setting this matter for a public hearing on September 25, 2023.
1) Set a public hearing for IOTA 23-01 and CU 23-01 for September 25, 2023; or 2) Alternatively, discuss and take other action related to this item.

None.

ENVIRONMENTAL REVIEW
The recommended action, by itself, is exempt from review under C3 Environmental Quality Act (Public Resources Code §§ 21000, et seq., "CEQA") and CEQA regulations (14 California Code of Regulations §§ 15000, et seq.) because it does not involve any commitment to a specific project which could result in a potentially significant physical impact on the environment; and constitute an organizational or administrative activity that will not result in direct or indirect physical changes in the environment. Accordingly, the proposed action does not constitute a "project" that requires environmental review (see specifically 14 Cal. Code of Regs. § 15378(b)(4-5)).

DISCUSSION
On August 7, 2023, the Planning Commission conducted a public hearing to consider an application from Roderick Graham for a Zoning Ordinance Text Amendment (IOTA 23-01) to amend the BMC to reduce the minimum distance requirement between automobile repair shops/centers and a Conditional Use Permit (CU 23-01) to allow an automobile repair shop and a spray booth within an existing building located at 9638- 9648 Artesia Blvd. within the Light Industrial ("W") District.

In the staff report and during the public hearing, the Planning Commission was informed that it was acting as an advisory body to the City Council and that its action to approve or deny the application request would be a recommendation only to the City Council.

At the conclusion of the public hearing, the Planning Commission adopted Resolution Nos. PC 23-04 and PC 23-05 recommending denial of the IOTA and CUP applications to the City Council. The applicant was informed its application would be scheduled for a public hearing before the City Council at the next available meeting.

Following the public hearing, staff discovered that BMC 17.104.070(b) indicates that if a zone change, which includes a text amendment, is denied by the Commission, then the action is final unless appealed to the City Council. Therefore, staff provided incorrect information to the Commission and the applicant that the Commission's action to deny the application would be a recommendation only to the City Council. The Planning Commission's action should have been final unless appealed. To address this error and to allow the applicant the opportunity for its application to be heard by the City Council, staff recommends the City Council set a public hearing for September 25, 2023 to consider ZOTA 23-01 and CU 23-01.

A. On fVlarch 27, 2023, Roderick Graham ("Applicant") filed an application and plans for a Conditional Use Permit and a Zoning Ordinance Text Amendment.

The application was deemed incomplete on April 26, 2023. Revised plans and documents were submitted on June 12, 2023, and subsequently deemed complete on June 22, 2023;
B. The application was reviewed by the Director for, in part, consistency with the General Plan and conformity with the BINK;
C. In addition, the City reviewed the project's environmental impacts under the California Environmental Quality Act (Public Resources Code C.I. 21000) et seq., "CEQA"), the regulations promulgated thereunder (14 Cal. Code of Regulations §§15000, et seq., the "CEQA Guidelines"), and the City's Environmental Guidelines ("Bellflower Guidelines"; CEQA, CEQA Guidelines and Bellflower Guidelines collectively referred to as "CEQA Regulations"); D. The Director completed review and scheduled a public hearing regarding the application before the Planning Commission for July 17, 2023; E. Notice of Public Hearing before the Planning Commission was duty given and published in the time, form, and manner as required by law; F. I. The Planning Commission considered the information provided by City staff, public testimony, and the Applicant. This Resolution, and its findings, are made based upon the evidence presented to the Planning Commission at its August 7, 2023 hearing including, without limitation, the staff report submitted by the Department of Planning and Building Services.

SECTION 2. Factual Findings and Conclusions. The Planning Commission finds that the following facts exist:

A. Subsection H of B11C 17.44.160 (C -G —Automobile Repair Center) states "Location of any automobile repair centers shall not be within five hundred (500) feet of another automobile repair shop or center." B. Subsection G of BIv1C § 17.44.170 (C -G —Automobile Repair Shop) states "Location of any automobile repair shop shall not be within five hundred (500) feet of another automobile repair shop."
G. The Applicant is requesting a Zoning Ordinance Text Amendment to amend the §§ 17.44.160 (C -G — Automobile Repair Center) and 17.44.170 (C -G — Automobile Repair Shop) of the BIVIC to reduce the minimum distance requirement between automobile repair shops / centers within the C -G Zone from 500 feet to 300 feet.

SECTION 3. Environmental Assessment. -The Zoning Ordinance Text Amendment is exempt from additional environmental review pursuant to 14 Cal. Code Regs. § 15061(b)(3) because the Zoning Ordinance Text Amendment will not result in any development or changes to the physical environment, and following an evaluation adverse impacts, it can be seen with certainty that there is no possibility that Df possible
the Ordinance will have a significant effect on the environment.

SECTION 4. Zoning Ordinance Text Amendment Findings. The Planning Commission does hereby find, determine, and declare that it is unable to make three of the findings for approval of a Zoning Ordinance Text Amendment, as required by the Bellflower Municipal Code § 17.104.030, as follows:

A. IiVhether there are changed conditions since the existing zoning became effective to warrant other or additional zoning
There are no
changed conditions since the existing requirements for
automobile repair shops became effective that warrant the proposed zoning amendment, in that, among other things, the City already has ample automobile repair shops / centers to meet the needs of the community.

B. Proposed change of zone will not
adversely affect adjoining property as to
value or precedent, and will not be defrimental to the area.

As it currently stands, there are already an average of 22 automobile repair shops / centers per square mile in the City of Bellflower. Allowing additional —4—

City of Bellflower
(Resolution No. PC 2304

Page 3 of 4 ends

automobile repair shops and centers in C -G and (VI -1 areas will exacerbate these areas already saturated by said uses.

C. The change of zone t/vill be in the interest or fitfherance of public health, safety and general welfare.

As it currently stands, there are already 136 active business licenses for automobile repair shops within the City. The proposed Zoning Ordinance Text Amendment will not be in the interest or furtherance of public health, safety and general welfare because reducing the minimum distance requirement between automobile repair shops and centers will allow additional automobile repair shops / centers in all C -G and M-1 areas throughout the City, resulting in further proliferation of said use.

SECTION 5. Recommendation. Based on the foregoing, the Planning Commission hereby adopts this resolution recommending the City Council deny Zoning Ordinance Text Amendment Case No. ZOTA 23-01.

SECTION 6. Construction. This Resolution must be broadly construed in order to achieve the purposes stated in this Resolution. It is the Planning Commission's intent that the provisions of this Resolution be interpreted or implemented by the City and others in a manner that facilitates the purposes set forth in this Resolution.

SECTION 7. Reliance On Record. Each and every one of the findings and determinations in this Resolution are based on the competent and substantial evidence, both oral and written, contained in the entire record relating to the project. The findings and determinations constitute the independent findings and determinations of the Planning Commission in all respects and are fully and completely supported by substantial evidence in the record as a whole.

SECTION 3. Limitations. The Planning Commission's analysis and evaluation of the project is based on the best information currently available. ft is inevitable that in evaluating a project that absolute and perfect knowledge of all possible aspects of the project will not exist. One of the major limitations on analysis of the project is the Planning Commission's lack of knowledge of future events. In all instances, best efforts have been made to form accurate assumptions. Somewhat related to this are the limitations on the City's ability to solve what are in effect regional, state, and national problems and issues. The City must work within the political framework within which it exists and with the limitations inherent in that framework.

SECTION . Severability. If any part of this Resolution or its application is deemed invalid by a court of carrpetent jurisdiction, the Planning Commission intends that such invalidity will not affect the effectiveness of the remaining provision or application and, to this end, the provisions of this Resolution are severable.

SECTION 10. Preservation. This Resolution does not affect any penalty, forfeiture, or liability incurred before, or preclude prosecution and imposition of penalties for any violation occurring before, this Resolution's effective date. Any such amended —5—

I. The Planning Commission considered the information provided by City staff, public testimony, and the Applicant. This Resolution, and its findings, are made based upon the evidence presented to the Planning Commission at its August 7, 2023 hearing including, without limitation, the staff report submitted by the Department of Planning and Building Services, as well as the Planning Commission's adoption of Resolution No. 23-04 recommending denial of the Zoning Ordinance Text Amendment to reduce the minimum distance between auto repair businesses from 500 to 300 feet, which must be approved by the City Council before any granting of the requested Conditional Use Permit, SECiI®N 2. Facfual findings and Conclusions. The Planning Commission finds that the following facts exist:

A. The Applicant seeks a Canditionai Use Permit to allow an automobile repair shop and a spray booth within an existing 9,970 -square foot building located at 9638-9648 Artesia Boulevard ("Project Site") within the Light Industrial ("M- 1 ") District;
B. The Project Site is accessible from Artesia Boulevard, a 100 -foot wide right- of-way, and a major arterial;
C. The Project Site is located within the Light Industrial ("M-1 ") District, with a General Plan Land Use Designation of "I" (Industrial);
D. The Project Site is bounded to the north, separated by Artesia Boulevard, by a plumbing business and a vacant storefront in the General Commercial ("G -G") zone. To the south, the property is adjacent to a condominium development and a multifamily residential use within the R-2 medium density residential zone. To the west is a used car dealership in the M-1 District, and to the east is a residential care facility also within the M-1 District; and, E. The Project Site is composed of two adjacent Iats located at 9638 Artesia Boulevard (AFRI: 7161-009-012) and 9648 Artesia Boulevard7161- 009-011). Each lot measures 17,390.16 square feet (0.39 acres) in area. The subject site is currently developed with one commercial building and parking lot. The owner has indicated willingness to merge the two lots into one, which would meet the minimum lot frontage requirement of 100 feet and provide sufficient parking for the proposed use.

SECTION 3. Environmental Assessment.

Because of the facts identified in
Section 2 of this Resolution, the Project is exempt from further environmental review under CEQA because it consists of minor alterations in land use: the Project results in minor alterations to existing private facilities involving no significant expansion of the existing use. The Project is not anticipated to have any significant impacts with regard to traffic, noise, air quality, or water quality. There are adequate utilities and public services to serve the project. The Project, therefore, is categorically exempt from further CEQA review under CEQA Guidelines § 15301.

approval of a Conditional Use Permit, as required by the Bellflower Municipal Code

17.96.040, as follows.

A. Whether the use applied for at the location set forth in the application is not properly one for which a Conditional Use Permit is authorized by Title 17 (Zoning) of the Bellflower Municipal Code.

BMC §! 17.44.160 (C -G — Automobile Repair Center) and 17.44.170— Automobile Repair Shop) require a 500400t distance between an automobile repair shop or center and the subject site is located within 500 feet of another automobile repair shop. In addition, the subject site is located adjacent to a residentially -zoned parcel but does not provide an 8400t high wall between the properties.

B. l/hether the said use is necessary or desirable for the development of the community, is in harmony with the various elements or objectives of the General Plan, and is not detrimental to existing uses or to uses specifically permitted in the district in which the site is located.

The said use is not necessary for the development of the community in that there are already numerous automobile repair shops (HDL business license data shows a total of 136 business licenses) within the City that have active business licenses.

SECTION 5. Recommendation. Based on the foregoing, the Planning Commission hereby adopts this resolution recommending the City Council deny Conditional Use Permit Case No. CU 23-01.

SECTION 6. Construction. This Resolution must be broadly construed in order to achieve the purposes stated in this Resolution. It is the Planning Commission's intent that the provisions of this Resolution be interpreted or implemented by the City and others in a manner that facilitates the purposes set forth in this Resolution.

DISCUSSION – Continued

Bellflower Municipal Code (“BMC”) § 16.20.040 requires City Council approval for a final map when a subdivision improvement agreement is needed to ensure construction of public infrastructure. Here, the actions requested are for the City Council to determine whether the Final Map substantially complies with the tentative map and authorize the City Manager to execute the subdivision improvement agreement.

The subdivider has not yet finished constructing the public improvements, but is eager to record the Final Map. All public improvements, including driveway approaches, curbs, gutter, and sidewalks still need to be constructed. All construction will be secured to guarantee performance, including the projected cost of completed construction for all improvements.

CEQA STATUS

The City reviewed the project’s environmental impacts under the California Environmental Quality Act (California Public Resources Code §§ 21000, et seq., “CEQA”) and CEQA Guidelines (14 California Code of Regulations §§ 15000, et seq.) pursuant to CEQA Guidelines § 15532, Class 32 (In-Fill Development Projects).

No additional environmental review is required for the final map.

SUBDIVISION IMPROVEMENT AGREEMENT FILE NO. 1010

FINAL MAP NO. 83812

THIS AGREEMENT (“Agreement”) is made and entered into this 9/11/2023, by and between the CITY OF BELLFLOWER, a general law city and municipal corporation (“CITY”) and KMH Paramount Investments, LLC, a California Limited Liability Company (“SUBDIVIDER”).

The Parties agree as follows:

1. RECITALS. This Agreement is made with reference to the following facts and objectives:

A. SUBDIVIDER presented CITY with a subdivision map on land identified as Tract Map No. 83812 (“Map”).

B. SUBDIVIDER requested that CITY approve the Map before construction and completion of improvements including, without limitation, streets, highways, public ways, and public utility facilities (“Improvements”) which are part of or appurtenant to the subdivision (“Subdivision”) identified on the Map. The Improvements must be constructed in accordance with plans and specifications on file with CITY.

C. This Agreement is entered into in accord with the Subdivision Map Act (“Act”) and applicable ordinances adopted by CITY including, without limitation, as codified in the Bellflower Municipal Code (“BMC”).

2. CONSTRUCTION OF IMPROVEMENTS. At its sole cost and expense, SUBDIVIDER agrees to furnish the equipment, labor and materials necessary to complete the Improvements on the Map set forth in attached Exhibit “A,” which is incorporated by reference, and such other improvements required by CITY ordinances and/or the City Council when approving the Map. All of the above work, together with appurtenances, contingencies and engineering costs, are more particularly shown on the improvement plans for the Map.

3. ESTIMATED COST OF IMPROVEMENTS. The parties agree that the estimated cost of the Improvements is $4,159.20.
-6-

City of Bellflower
Agreement File No. 1010

Page 2 of 9 ends

4. COMPLETION. SUBDIVIDER must complete all Improvements within twelve months after recording the Map or within such further time as may be granted by the City Council.

5. COMPLETION BY CITY. Should SUBDIVIDER fail to complete the Improvements within the time for completion, CITY, at its option, may enter onto SUBDIVIDER’s property to complete the Improvements at SUBDIVIDER’s cost.

6. WARRANTY OF IMPROVEMENT PLANS. SUBDIVIDER warrants that the plans and specifications for the Improvements comply with the tentative map approval and the master plan for the Subdivision previously approved by CITY’s Planning Commission and the City Council, together with all conditions made a part of such approval(s).

SUBDIVIDER further warrants that the plans and specifications can be relied upon to accomplish the improvement work covered by this Agreement in a good, workmanlike manner and in accordance with accepted construction practices. Should the plans and specifications at any time before final acceptance of the Improvements prove to be inadequate in any respect, SUBDIVIDER agrees to make such changes deemed necessary by CITY to accomplish improvement work in a good, workmanlike manner and in accordance with accepted construction practices. SUBDIVIDER further agrees to make or cause to be made such engineering, soils and other reports as may be required by CITY.

7. CITY NOT LIABLE FOR PLANS AND SPECIFICATIONS. CITY is not an insurer or surety for the design or construction of the Subdivision. And no CITY official, officer, or employee is liable or responsible for any claim arising during construction of the Subdivision or Improvements, unless it can be shown that such person specifically directed that the Subdivision or Improvement be accomplished in a manner contrary to the wishes and desires of SUBDIVIDER, and SUBDIVIDER filed a written objection with the City Engineer before commencing such work or Improvement.

8. WARRANTY OF WORK. SUBDIVIDER warrants that the Improvements will be constructed in a manner consistent with CITY’s specifications and the highest industry standards. Should any Improvement fail to comply with this warranty or any other provision of this Agreement within one (1) year after CITY’s final acceptance, SUBDIVIDER must, without delay and without cost to CITY, repair, replace or reconstruct any defective or otherwise unsatisfactory part or parts of the Improvements.

Should SUBDIVIDER fail to act promptly or in accordance with this requirement or should the exigencies of the case require repairs or replacements to be made before SUBDIVIDER can be notified, CITY may, at its option, make the necessary repairs or replacements or perform the necessary work and SUBDIVIDER must pay to CITY the actual cost of such repairs plus fifteen percent (15%) for CITY’s administrative overhead costs. This Section is not a waiver of any other right CITY may have for correcting faulty workmanship or defective materials.

9. REPAIRS AND REPLACEMENTS. SUBDIVIDER must replace/repair, as appropriate, all pipes and monuments shown on the Map destroyed or damaged by SUBDIVIDER’s actions and to replace/repair, as appropriate, any property damaged or destroyed by SUBDIVIDER. Any such repair or replacement must be completed to CITY’s satisfaction and approval.

10. CITY’S RIGHT OF ENTRY. SUBDIVIDER grants City a license to enter SUBDIVIDER’s property to inspect the improvements constructed by SUBDIVIDER and to ensure compliance with this Agreement.

11. CONTRACT SECURITY.

A. Concurrently with the execution of this Agreement, SUBDIVIDER must furnish:

i. A surety bond in an amount equal to at least one hundred percent (100%) of the estimated cost of improvements as security for the faithful performance of this Agreement;

ii. A separate surety bond in an amount equal to at least one hundred percent (100%) of the contract price for said improvements as security for the payment of all persons performing labor and furnishing materials in connection with this Agreement.

B. SUBDIVIDER agrees that the form of the bonds provided by CITY are substantially similar to Government Code §§ 66499.1 and 66499.2.

12. MAINTENANCE BONDS. The bonds referred to in Section 11 will not be released until a surety bond guaranteeing the warranty requirements of Section 8 in the amount of at least ten percent (10%) of the sum shown in Section 3 is filed with CITY. The maintenance bond will be released one (1) year from the date of final acceptance of the Improvements.

13. PERFORMANCE BY CITY OR SURETY.

A. Should SUBDIVIDER fail to construct the improvements in the manner and at such locations as specified within the time requirements of this Agreement, or if SUBDIVIDER is not carrying out the intent of this Agreement, CITY may serve written notice upon SUBDIVIDER and the surety on SUBDIVIDER’s faithful performance bond demanding satisfactory compliance with this Agreement.

B. Should CITY serve such written notice, CITY may do any one, or combination of, the following:

Page 4 of 9 ends

i. Serve written notice upon the surety on its faithful performance bond demanding satisfactory compliance with this Agreement. In such event the surety must, within five (5) days, assume control and construct the Improvements as SUBDIVIDER’s successor;

ii. CITY may construct the improvements itself, or by contract, at SUBDIVIDER’s expense on a time a materials basis. In such event, CITY may take possession of and utilize in completing improvement construction, materials, appliances, and other property belonging to SUBDIVIDER as may be on the site of the work without liability to CITY. SUBDIVIDER’s surety will be liable to CITY for any excess cost of damages incurred by CITY.

C. Nothing in this Section waives, or serves as a limitation upon, any additional remedy CITY may have under this Agreement or applicable law.

14. SURETY BOND TO INCLUDE LETTER OF CREDIT. The term “surety bond” also includes such other acceptable security, such as letters of credit or cash deposit agreements issued by responsible financial institutions, which are approved by the City Attorney. The term “surety” includes the issuer of any letter of credit or cash deposit agreement, which is acceptable to CITY as security for the performance of this Agreement. Sureties must be admitted to do business in California.

15. BEST MANAGEMENT PRACTICES. SUBDIVIDER agrees to use best management practices (“BMPs”), as that term is defined under applicable law including, without limitation, the MPMC, in constructing the improvements anticipated by this Agreement. SUBDIVIDER’s failure to comply with the terms of this Section constitutes a material breach of this Agreement.

16. OWNERSHIP OF DOCUMENTS. All documents, data, studies, drawings, maps, models, photographs and reports prepared by SUBDIVIDER under this Agreement are CITY’s property. SUBDIVIDER may retain copies of said documents and materials as desired, but must deliver all original materials to CITY upon CITY’s written notice.

17. INDEPENDENT CONTRACTOR. CITY and SUBDIVIDER agree that SUBDIVIDER will act as an independent contractor and will have control of all work and the manner in which is it performed. SUBDIVIDER will be free to contract for similar service to be performed for other employers while under contract with CITY. SUBDIVIDER is not an agent or employee of CITY and is not entitled to participate in any pension plan, insurance, bonus or similar benefits CITY provides for its employees. Any provision in this Agreement that may appear to give CITY the right to direct SUBDIVIDER as to the details of doing the work or to exercise a measure of control over the work means that SUBDIVIDER will follow the direction of CITY as to end results of the work only.

18. CASH CHARGES. SUBDIVIDER must pay to CITY in cash such subdivision fees that are established by ordinance or by the City Council in conferring approval or extension of time to the Subdivision.

19. INDEMNIFICATION.

A. SUBDIVIDER indemnifies and holds CITY harmless from and against any claim, action, damages, costs (including, without limitation, attorney’s fees), injuries, or liability, arising out of this Agreement, or its performance.

Should CITY be named in any suit, or should any claim be brought against it by suit or otherwise, whether the same be groundless or not, arising out of this Agreement, or its performance, SUBDIVIDER must defend CITY (at CITY’s request and with counsel satisfactory to CITY) and indemnify CITY for any judgment rendered against it or any sums paid out in settlement or otherwise.

B. For purposes of this section “CITY” includes CITY’s officers, officials, employees, agents, representatives, and certified volunteers.

C. The requirements as to the types and limits of insurance coverage to be maintained by SUBDIVIDER, and any approval of such insurance by CITY, are not intended to and will not in any manner limit or qualify the liabilities and obligations otherwise assumed by SUBIDIVIDER pursuant to this Agreement, including, without limitation, to the provisions concerning indemnification.

20. INSURANCE.

A. Before commencing performance under this Agreement, and at all other times this Agreement is effective, SUBDIVIDER must procure and maintain the following types of insurance with coverage limits complying, at a minimum, with the limits set forth below:

Type of Insurance Limits (combined single)

Commercial general liability: $2,000,000

Professional Liability $2,000,000

Workers compensation statutory requirement

B. Commercial general liability insurance must meet or exceed the requirements of ISO-CGL Form No. CG 00 01 11 85 or 88. The amount of insurance set forth above will be a combined single limit per occurrence for bodily injury, personal injury, and property damage for the policy -10-

coverage. Liability policies must be endorsed to name CITY, its officials, and employees as “additional insureds” under said insurance coverage and to state that such insurance will be deemed “primary” such that any other insurance that may be carried by CITY will be excess thereto. Such endorsement must be reflected on ISO Form No. CG 20 10 11 85 or 88.

Such insurance will be on an “occurrence,” not a “claims made,” basis and will not be cancelable or subject to reduction except upon thirty (30) days prior written notice to CITY.

C. Professional liability coverage will be on an “occurrence basis” if such coverage is available, or on a “claims made” basis if not available. When coverage is provided on a “claims made basis,” SUBDIVIDER will continue to renew the insurance for a period of three (3) years after this Agreement expires or is terminated. Such insurance will have the same coverage and limits as the policy that was in effect during the term of this Agreement, and will cover SUBDIVIDER for all claims made by CITY arising out of any errors or omissions of SUBDIVIDER, or its officers, employees or agents during the time this Agreement was in effect.

D. SUBDIVIDER must furnish to CITY duly authenticated Certificates of Insurance evidencing maintenance of the insurance required under this Agreement and such other evidence of insurance or copies of policies as may be reasonably required by CITY from time to time. Insurance must be placed with insurers with a current A.M. Best Company Rating equivalent to at least a Rating of “A:VII.” Certificate(s) must reflect that the insurer will provide thirty (30) day notice of any cancellation of coverage.

SUBDIVIDER will require its insurer to modify such certificates to delete any exculpatory wording stating that failure of the insurer to mail written notice of cancellation imposes no obligation, and to delete the word “endeavor” with regard to any notice provisions.

21. NOTICES.

A. All notices given or required to be given pursuant to this Agreement will be in writing and may be given by personal delivery or by mail. Notice sent by mail will be addressed as follows:

Staff Report – Personnel and Salary Adjustments
September 11, 2023

Page 2 of 2 ends

BACKGROUND

The City Manager's Office encompasses multiple functions, including Administration, as well as the Human Resources and Risk Management division. The suggested revisions to the personnel and salary plan are prompted by two factors: the recent retirement of the City's Human Resources and Risk Manager and an evaluation of the duties and responsibilities associated with the Human Resources and Risk Management division.

These personnel changes involve several key adjustments:

1. Elimination of Human Resources and Risk Manager Position ;

2. Promotion of Assistant to the City Manager to the position of Deputy City Manager. This elevation in role will entail assuming the responsibilities formerly held by the Human Resources and Risk Manager, which includes overseeing the Human Resources and Risk Management division; and

3. Addition of a Management Assistant Position: A new, full -time Management Assistant position will be incorporated into the City Manager's Office. This addition is intended to provide enhanced support to the Deputy City Manager and to facilitate the efficient functioning of the City Manager’s Office.

The Deputy City Manager will carry forward the responsibilities previously held by the Assistant to the City Manager and will also oversee the Human Resources and Risk Management division. Concurrently, the Management Assistant will assist the Deputy City Manager.

The proposed new Management Assistant will assist Administration with tasks including, without limitation, grant research, grant writing, grant reporting, processing cannabis business permit renewals and modifications, conducting city surveys, preparing and rating requests for proposals and bids, agreement and amendment processing, preparing staff reports and agenda items, and assisting with various research tasks as needed. Additionally, the Management Assistant will also assist the Human Resources and Risk Management division with ensuring accurate and timely processing of personnel-related paperwork, facilitating changes in employee benefits and assisting staff with related inquiries, coordinating necessary background and reference checks for new hires and relevant personnel, assisting in the onboarding process for new employees, and assisting with claims (e.g., worker’s compensation, property damage).
