TO: Honorable Mayor and Members of the City Council

ATTENTION: Jeffrey L. Stewart, City Manager

FROM: Joel Hockman, Director of Public Safety

SUBJECT: Consideration and possible action to conduct the annual public hearing to consider whether the 5% Utility Users’ Tax (UUT) should continue in effect or be modified or repealed.

DATE: December 11, 2023

EXECUTIVE SUMMARY

Ordinance No. 818 requires the City Council to hold an annual public hearing in December regarding whether the Utility Users’ Tax (UUT) should continue in effect or be modified or repealed.

RECOMMENDATION TO CITY COUNCIL

1) Open the public hearing; take testimonial and documentary evidence; and after considering the evidence, approve the continuance of the UUT and fund the Community Policing Program with revenues generated from the UUT; or

2) Alternatively, discuss and take other action related to this item.

FISCAL IMPACT

The City projects that the UUT revenue will be approximately $3,900,000 for fiscal year 2023-2024.

PUBLIC NOTICE

On Friday, December 1, 2023, a Public Hearing Notice was published in the Los Cerritos Community News newspaper.

DISCUSSION

In 1997, voters approved a utility users tax equal to five percent (5%) of the gross charges made to each service user in the City for telephone (including cell phones), electricity, and natural gas.

1 Staff Report – Annual Public Hearing Re: Utility Users’ Tax December 11, 2023

Page 2 of 2 ends

DISCUSSION – Continued

Section 4 of Ordinance No. 818 requires the City Council to conduct a public hearing each December to consider whether to continue, amend, or repeal the UUT.

The current projection of UUT for fiscal year 2023-2024 is $3,900,000 ($1,500,000 below the estimated CPI growth and $2,700,000 below the combined estimated CPI and population growth). In a long-term view between 1994-1995 and 2022-2023 fiscal years, the total cumulative amount of UUT collected was $10,800,000 below the level of CPI growth and $31,200,000 below the level of combined CPI and population growth. As one can imagine, the measurement of CPI growth alone does not address the overall community policing needs arising from the City’s population growth of approximately 12,400 residents during the same period.

15-B
TO: Honorable Mayor and Members of the City Council

FROM: Tae Rhee, Director of Finance/City Treasurer

SUBJECT: Consideration and possible action to receive and file the City’s Development Impact Fee Annual Report for Fiscal Year 2022-23 pursuant to Government Code Section 66006.

DATE: December 11, 2023

EXECUTIVE SUMMARY

The City of Bellflower imposes and collects Park Facilities, and Public Facilities, Transportation Facilities and Public Safety Facilities Fees on new development projects pursuant to BMC Chapter 3.36 (Ordinance No. 1118), BMC Chapter 3.40 (Ordinance No. 1424) adopted in FY 2022-23, and BMC Chapter 3.24 (Ordinance No. 1117) repealed in FY 2022-23. Government Code § 66006 requires an annual report on these fees containing certain financial and other information for the City Council and public.

As supplemental information, the annual report incorporates similar data on the Public Arts Fee (BMC Chapter 3.32; Ordinance No. 1098). The Public Arts Fee has a unique provision in that any developer can choose to install public art on the property that is being developed instead of paying a fee to the City. Such installation of public art by a developer requires City Council approval.

RECOMMENDATION TO CITY COUNCIL

1) Receive and file the Development Impact Fee Annual Report for Fiscal Year 2022-23 pursuant to Government Code § 66006; or

2) Alternatively, discuss and take other action related to this item.

FISCAL IMPACT

None. The Fund balances as of June 30, 2023, were as follows:

Park Facilities Fund $ 1,532,805
Public Facilities Fund 3,395
Public Arts Fund 262,909

Transportation Facilities and Public Safety Facilities Fees were in effect on April 28, 2023 for non-residential developments and July 7, 2023 for residential developments. There were no development projects that were subject to the new development impact fees in FY 2022-23.

PUBLIC NOTICE

On November 13, 2023, a Public Notice was posted at City Hall, Bellflower Substation, Caruthers Park, Thompson Park, and Simms Park. In addition, Southern California Gas Company and Southern California Edison were also notified on that same day pursuant to their written request on file with the City Clerk’s Office.

DISCUSSION

The City collects Park Facilities, Public Facilities, Transportation Facilities, and Public Safety Facilities Fees, which are fees associated with new development projects.

Government Code Section 66006 requires the City to prepare an annual report that describes certain information about the fees, such as the amount of fees collected, public improvements for which the fees were expended, fund balance, and other information.

In addition, Government Code Section 66001 requires the City to provide a report and make findings every five years regarding unexpended fund fees. The next five-year report is required for FY 2025-26 for Park Facilities and Public Facilities Fees and FY 2026-27 for Transportation Facilities and Public Safety Facilities Fees.

City staff recommends that the City Council receive and file the attached annual reports.

PARK FACILITIES FEE ANNUAL REPORT
(FISCAL YEAR 2022-23)

Page 1 of 4 ends

This annual report section has been prepared pursuant to the requirements of Government Code Section 66006.

(A) Brief description of the type of fee in the account or fund.

Pursuant to BMC Chapter 3.36 (Ordinance No. 1118) and BMC Chapter 3.40 (Ordinance No. 1424), the Park Facilities Fee is collected for the development of new and rehabilitation of existing neighborhood or community parks and recreational facilities within the City.

The objective of the Park Facilities Fee is to ensure that new development pays the capital costs associated with population growth which increases the demand for municipal services and park facilities.

(B) Amount of the fee.

A fee may be paid in lieu of or in addition to land dedication. The amount of such fee is determined by multiplying the number of acres of land which would otherwise be required to be dedicated by the fair market value per acre of the land within the proposed residential development.

Single Family Per Unit $21,839
Multi-Family Per Unit $18,288
ADUs larger than 750 s.f. Fee proportional to primary unit

The amount of land to be dedicated is equal to .0025 acres per person multiplied by the number of persons added to the City’s population by the new residential development.

The number of persons added to the City’s population by the new residential development is determined by multiplying the number of new dwelling units being developed by the density factor determined.

(C) Beginning and ending balance of the account or fund. (D) Amount of the fees collected and the interest earned.

SUBJECT: Consideration and possible action to authorize the City Manager to execute Easement Agreement File No. 837.8, in a form approved by the City Attorney, with 16411 Bellflower LLC for a portion of private property located 16411 Bellflower Boulevard for the purpose of constructing an ADA curb ramp at the southwest corner of Bellflower Boulevard and Mayne Street.

DATE: December 11, 2023

EXECUTIVE SUMMARY

This agreement would grant a public easement to the City for the property located at 16411 Bellflower Boulevard for the purpose of constructing an ADA curb ramp at Bellflower Boulevard and Mayne Street.

RECOMMENDATION TO CITY COUNCIL

1) Authorize the City Manager to execute Easement Agreement File No. 837.8, in a form approved by the City Attorney, with 16411 Bellflower LLC, property owner at 16411 Bellflower Boulevard; or

2) Alternatively, discuss and take other action related to this item.

FISCAL IMPACT

None.

DISCUSSION

Currently, the southwest corner of Bellflower Boulevard and Mayne Street has a non-ADA compliant curb ramp in place. For the City to properly construct a compliant curb ramp that lines up with the existing crosswalks, the City must utilize a small portion of private property located at 16411 Bellflower Boulevard. As part of the second phase of the private development at this location, Public Works staff met with the property owner (16411Bellflower LLC) and proposed the easement to the City for the purpose of the curb ramp construction.

This agreement establishes the granting of the easement and provides detailed exhibits needed in order for the easement to be recorded with the County Registrar.

SUBJECT: Consideration and possible action to authorize the Director of Public Works, or designee, to convert the existing 2-way ‘Stop’ controls to 4-way ‘Stop’ controls on Virginia Avenue at Olive Street, Virginia Avenue at Mayne Street, Virginia Avenue at Oak Street, and Virginia Avenue at Laurel Street (C.E.# 23-15).

DATE: December 11, 2023

EXECUTIVE SUMMARY

On November 21, 2023, the Public Safety Commission considered and subsequently recommended to the City Council the conversion of the existing 2-way ‘Stop’ controls to 4-way ‘Stop’ controls pursuant to Bellflower Municipal Code (“BMC”) Chapter 10.04.

This action would approve the conversion of 2-way ‘Stop’ controls to 4-way ‘Stop’ controls at the following intersections: Virginia Avenue at Olive Street, Virginia Avenue at Mayne Street, Virginia Avenue at Oak Street, and Virginia Avenue at Laurel Street.

RECOMMENDATION TO CITY COUNCIL

1) Authorize the Director of Public Works, or designee, to convert the existing 2-way ‘Stop’ controls to 4-way ‘Stop’ controls on Virginia Avenue at Olive Street, Virginia Avenue at Mayne Street, Virginia Avenue at Oak Street, and Virginia Avenue at Laurel Street; or

2) Alternatively, discuss and take other action related to this item.

FISCAL IMPACT

The estimated cost to convert the existing 2-way ‘Stop’ controls to 4-way ‘Stop’ controls is $6,000.00 for all four (4) intersections listed above. Funds are budgeted in Account No. 010-43180-3100 (Street Maintenance Street Signs).

December 11, 2023

Page 2 of 2 ends

DISCUSSION
The City recently received a request to install additional ‘Stop’ controls at the intersection of Virginia Avenue and Laurel Street, specifically to convert the existing 2-way ‘Stop’ controls into 4-way (all directions) ‘Stop’ controls. Based upon an engineering assessment of this request, staff determined that this intersection along with the intersections at Virginia Avenue and Oak Street, Virginia Avenue at Mayne Street and Virginia Avenue at Olive Street should all be considered for conversion from the existing 2-way to 4-way ‘Stop’ controls.

The guidelines for ‘Stop’ control installations are contained within the California Manual on Uniform Traffic Control Devices (CA MUTCD). The guidelines state that ‘Stop’ signs should be used on a less important road (minor street) that intersects with a main road because the application of the normal vehicle right-of-way rule would not be expected to provide reasonable compliance with the law. For the intersections under consideration, when the characteristics of intersecting streets are similar (both considered minor streets), and to assign right-of-way more clearly, the conversion from a 2-way ‘Stop’ to a 4-way ‘Stop’ does not require an extensive and detailed traffic engineering study.

The field assessment performed by the City Engineer confirmed that conditions such as limited driver line-of-sight exist at the proposed intersections. As a result, staff is proposing to install ‘Stop’ controls (Stop signs, limit lines and ‘STOP’ pavement legends) in both travel directions at each intersection. At the November 21, 2023, Public Safety Commission meeting, the Commission recommended the inclusion of the intersection at Virginia Avenue at Belmont Street. However, this intersection is currently 4-way ‘Stop’ controlled. Therefore, in an effort to enhance safety and more clearly assign right-of-way, the conversion of the existing 2-way ‘Stop’ control measures to 4-way ‘Stop’ controls at the other four intersections is being recommended. The proposed changes are illustrated in the attached aerial photograph.

On November 7, 2023, the City provided notice to area residents of this request and that this matter would be brought before the Public Safety Commission at its November 21, 2023, meeting. To date, the City has received no response to the notification of the proposed 4-way Stop controls.

DATE: December 11, 2023

EXECUTIVE SUMMARY

On November 21, 2023, the Public Safety Commission considered and subsequently recommended to the City Council the installation of red curb parking restrictions pursuant to Bellflower Municipal Code (“BMC”) Chapter 10.04. This action would approve the installation of red curb parking restrictions at 9349 Rose Street.

RECOMMENDATION TO CITY COUNCIL

1) Authorize the Director of Public Works, or designee, to install red curb parking restrictions at 9349 Rose Street; or

2) Alternatively, discuss and take other action related to this item.

FISCAL IMPACT

The estimated cost for the installation of the red curb parking restrictions listed above is $200. Funds are budgeted in Account No. 010-43170-3100 (Street Maintenance Traffic Paint).

DISCUSSION
The City recently received a request for the installation of red curb parking restrictions to establish on-street emergency vehicle parking fronting the assisted living facility at 9349 Rose Street. The City Engineer conducted a sight visit and spoke with the facility owner to better understand their needs. The facility provides round-the-clock care for elderly patients, sometimes requiring the need to request medical emergency services.

Hence, to provide access for emergency vehicles, staff recommends the installation of twenty-four (24) feet of red curb parking restrictions on each side of the drive approach.

The location of the proposed change is illustrated in the attached aerial photograph. -1-

This AGREEMENT is entered into by and between the LOS ANGELES COUNTY FLOOD CONTROL DISTRICT, a body corporate and politic (hereinafter referred to as the LACFCD), and the City of Bellflower, a municipal corporation (hereinafter referred to as CITY).

RECITALS

WHEREAS, State Water Resources Control Board has promulgated water-quality regulations, including a Statewide Trash Amendment, applicable to cities located in the San Gabriel River Watershed; and

WHEREAS, CITY desires to achieve compliance with the Statewide Trash Amendment by installing TRASH EXCLUDERS (as hereafter defined) within catch basins owned by the LACFCD, located within CITY streets; and

WHEREAS, CITY will administer the procurement and installation of said TRASH EXCLUDERS. Once installed, the purpose of this agreement is to ensure that the CITY maintains the TRASH EXCLUDERS installed on catch basins owned by the LACFCD;

NOW, THEREFORE, in consideration of the mutual covenants herein contained, the LACFCD and CITY hereto mutually agree as follows:

(1) DEFINITION:

a. TRASH EXCLUDER, as referred to in this AGREEMENT, shall mean any device, which partially blocks the opening or outlet of a catch basin to prevent trash from entering the storm drain system, including Automatic Retractable Screen devices (ARS) and Connector Pipe Screen devices (CPS).

(2) CITY AGREES AS FOLLOWS:

a. CITY shall prepare a list of locations and other information for the TRASH EXCLUDERS that CITY proposes to install on LACFCD catch basins, in a form prescribed by the LACFCD. Once completed by the CITY, the list shall be attached hereto as Exhibit A, and be incorporated herein as if set forth in full.

b. CITY shall apply for and obtain a permit from the LACFCD for the installation of the TRASH EXCLUDERS identified on Exhibit A.

c. Upon completion of the installation of the TRASH EXCLUDERS in accordance with the terms and conditions of the permit from the LACFCD, CITY shall provide to the LACFCD an updated Exhibit A as necessary, to reflect any differences between the proposed and the as-built conditions.

Once approved by the LACFCD, the updated Exhibit A shall replace and supersede the prior Exhibit A.

d. CITY shall inspect all catch basins fitted with TRASH EXCLUDERS. If, during an inspection, CITY discovers damage to any catch basin other than damage to the TRASH EXCLUDER, CITY shall report said damage to the LACFCD within 14 calendar days from the date of the inspection.

e. CITY shall maintain all TRASH EXCLUDERS so as to function properly during storm events and so as not to prevent storm flows from entering the catch basin. CITY shall promptly repair or replace damaged TRASH EXCLUDERS.

f. CITY shall remove all trash and debris from each catch basin fitted with a TRASH EXCLUDER at least once each year. CITY shall stencil the appropriate month and year of cleanout on each catch basin.

g. CITY shall be authorized to remove the existing manhole covers as required to access the inside of the catch basins fitted with TRASH EXCLUDERS and shall reinstall the manhole covers wherever the catch basins are left unattended. If screws or bolts are damaged while removing the manhole covers, CITY shall replace the screws or bolts. CITY shall thoroughly clean all debris from the manhole frame and cover before reinstallation of the cover.

h. During storm events, CITY shall conduct a reasonable number of patrols of areas in which any TRASH EXCLUDERS have been installed to verify that all TRASH EXCLUDERS are functioning properly, and, if identified by CITY, shall relieve any instances of plugging of any catch basin fitted with a TRASH EXCLUDER.
i. CITY shall indemnify, defend, and hold the LACFCD and the County of Los Angeles, and their agents, officers, and employees, harmless from and against any and all claims, demands, liability, damages or costs arising from the breach by CITY of any obligation under this Agreement, or from the installation, operation or maintenance of any TRASH EXCLUDER. -3-

Nothing in this AGREEMENT shall be construed as transferring liability or responsibility to the CITY for the LACFCD's obligations under the applicable NPDES Permit, or transferring liability or responsibility to the LACFCD for the CITY's obligations under the applicable NPDES Permit.

k. CITY shall include the LACFCD within the protection of any indemnification clause contained in any ancillary contract relating to the maintenance of the TRASH EXCLUDERS.

(3) LACFCD AGREES AS FOLLOWS:

a. CITY is authorized to operate and maintain the TRASH EXCLUDERS on LACFCD-owned catch basins identified in Exhibit A.

b. LACFCD shall pay CITY the amount of $15.25 in 2012 dollars, adjusted annually according to the Consumer Price Index for all urban consumers in the Anaheim, Los Angeles, and Riverside areas, as published by the U.S. Government Bureau of Labor Statistics, per year, for each catch basin identified in Exhibit A. This amount represents the annual amount the LACFCD would otherwise have had to incur for removing trash and debris from the catch basins identified in Exhibit A, had CITY not installed TRASH EXCLUDERS in those catch basins.

(4) IT IS MUTUALLY UNDERSTOOD AND AGREED AS FOLLOWS:

a. The TRASH EXCLUDERS are the property of CITY. The LACFCD shall retain ownership of the catch basins, exclusive of the TRASH EXCLUDERS. CITY’s agreement to maintain the TRASH EXCLUDERS in the catch basins does not include any obligations to maintain any portion of the LACFCD’s storm drain system downstream of the catch basins.

b. CITY may, from time to time, with the consent of the LACFCD, install additional TRASH EXCLUDERS on or remove existing TRASH
EXCLUDERS from LACFCD-owned catch basins. Prior to installing any new TRASH EXCLUDER or removing any existing TRASH EXCLUDER, CITY shall apply for and obtain a permit from the LACFCD for the installation or removal. Upon completion of the installation or removal in accordance with the terms and conditions of the permit, CITY shall provide to the LACFCD an updated Exhibit A to reflect the additional or removed TRASH EXCLUDERS. Once approved by the LACFCD, the updated Exhibit A shall replace and supersede the prior Exhibit A.

c. Termination

(i) CITY may request the LACFCD to perform the inspection and maintenance of the TRASH EXCLUDERS, or any of them, on CITY's -4-

If the LACFCD, in its sole discretion, determines to do so, the parties shall enter into a new agreement providing for said inspection and maintenance by the LACFCD, on CITY's behalf.

Upon the execution of the new agreement by both CITY and the LACFCD, this AGREEMENT shall be deemed terminated.

(ii) CITY may unilaterally terminate this AGREEMENT without cause, in CITY’s sole discretion, at any time, by giving a thirty (30)-day prior written notice to the LACFCD. In the event this AGREEMENT is terminated, pursuant to this Section (4)b.(ii), the LACFCD may, in its sole discretion, provide CITY with a written notice to remove the TRASH EXCLUDERS or any of them, and restore the affected catch basin(s) to a condition similar to that which existed prior to installation of the TRASH EXCLUDERS. If the LACFCD provides CITY with such a notice, CITY shall complete all work required to comply with the notice within ninety (90) days. If CITY fails to do so, the LACFCD may, in its sole discretion, complete said work at CITY’s expense.

(iii) If CITY fails to comply with any of the terms or conditions of this AGREEMENT, the LACFCD may, in its sole discretion, terminate this AGREEMENT and provide CITY with a written notice to remove the TRASH EXCLUDERS, or any of them, and restore the catch basin(s) to a condition similar to or better than that which existed prior to installation of the TRASH EXCLUDERS. If the LACFCD provides CITY with such a notice, CITY shall complete all work required to comply with the notice within ninety (90) days. If CITY fails to do so, the LACFCD may, in its sole discretion, complete said work at CITY’s expense.

(iv) If the LACFCD removes any TRASH EXCLUDER pursuant to Sections (4)c.(ii) or (4)c.(iii), the LACFCD shall submit a billing invoice to CITY indicating the costs and expenses incurred by the LACFCD in connection with the removal of the TRASH EXCLUDER, specifically including any work required to restore the affected catch basin to a condition similar to or better than that which existed prior to installation of the TRASH EXCLUDER, and CITY shall reimburse the LACFCD all such costs and expenses within thirty (30) days of the billing invoice.

d. The LACFCD is not responsible for assisting CITY with any regulatory compliance activities related to the operation or maintenance of the TRASH EXCLUDERS including, for example, conducting monitoring, weighing of trash, and reporting amounts of trash collected from inside catch basins where TRASH EXCLUDERS have been installed.

Requests for Service coming to the LACFCD to clean any catch basin identified in Exhibit A will be forwarded to CITY for their prompt handling, action, and closure.

f. The LACFCD may remove any TRASH EXCLUDER, if the LACFCD determines, in its reasonable discretion, that removal of the TRASH EXCLUDER is necessary to prevent or mitigate flooding of any public or private property. LACFCD shall notify CITY of removal as soon as possible upon identification of a potential flooding issue and preferably before removal if feasible. CITY expressly releases the LACFCD from, and waives, all claims for any damages, loss, costs, or expenses resulting from the LACFCD's removal of any TRASH EXCLUDER pursuant to this section.

In such case, CITY may thereafter reinstall the TRASH EXCLUDER only after first consulting with the LACFCD with regards to the reasons for the removal. If CITY thereafter chooses to reinstall the TRASH EXCLUDER, it must do so at its sole expense.
