TO: Honorable Mayor and Members of the City Council
ATTENTION: Ryan Smoot, City Manager
FROM: Joel Hockman, Director of Public Safety
SUBJECT: Consideration and possible action to adopt Resolution No. 24-05 – A Resolution extending Permit Parking District “Y” on Nichols Street between Woodruff Place and Cornuta Avenue.
DATE: February 12, 2024
EXECUTIVE SUMMARY
Pursuant to Bellflower Municipal Code (“BMC”) Chapter 10.10, the City received the attached petition signed by eight residents requesting the modification of Permit Parking District Y (the “Petition”). Permit Parking District Y is located on a portion of the north and south sides of Nichols Street, between Woodruff Place and Cornuta Avenue. The Petition requests extending Permit Parking District Y west so that it includes all of Nichols Street (north and south sides) between Woodruff Place and Cornuta Avenue, except the northern portion that fronts the real property at 10101 Nichols Avenue (see attached aerial map). On December 29, 2023, the Director of Public Safety notified all residents in Permit Parking District Y of the Petition. On January 16, 2024, the Public Safety Commission considered the item, heard public testimony, and recommended extending Permit Parking District Y.
RECOMMENDATION TO CITY COUNCIL
1) Adopt Resolution No. 24-05; or
2) Alternatively, discuss and take other action related to this item.
FISCAL IMPACT
Each household in the affected area would be required to obtain a residential parking permit at an annual cost of $50 per permit for each of the first two permits if parking a vehicle on the public street. If a household desires more than two permits, the cost increases to $100 for the third and $200 for the fourth permit (maximum of four permits per dwelling unit). If a permit is purchased after June 30 of each year, the resident need only pay 50% of the regular fee for the permit.

DISCUSSION
The basis of the request is the residents’ concern of a lack of available on-street parking and safety concerns of non-resident vehicles parking/loitering in the area. The original Permit Parking District Y was established in 2017 and residents of the eight homes who now want to join the district have complained that nonresident vehicles are occupying the street parking leaving them and their guests with no alterative parking options. Public Safety staff observed and confirmed some of the residents’ concerns, as recorded in the attached Inspection Sheet.
The modification of Permit Parking District Y would provide greater on-street parking opportunities for area residents and their guests. Permit parking means that vehicles parked on the above-mentioned section of Nichols Street would require rearview mirror hanging permits issued by the City to be displayed in the vehicles. Because they are a mirror hanging variety, parking permits can be switched among vehicles as necessary.
Permits are not mandatory if homeowners do not intend to park on the street. Single -day guest permits would also be available to each household at no cost, for a very limited number of days per year. Vehicles parking on the street displaying a disabled placard are exempt from displaying a City-issued parking permit. The petition calls for parking to be restricted on both sides of the street, seven days a week, 24 hours a day.

6 CITY OF BELLFLOWER
RESOLUTION NO. 24-05
A RESOLUTION EXTENDING PERMIT PARKING DISTRICT “Y” ON
NICHOLS STREET BETWEEN WOODRUFF PLACE AND
CORNUTA AVENUE
THE CITY COUNCIL RESOLVES AS FOLLOWS:
SECTION 1. Recitals. The City Council finds as follows:
A. Bellflower Municipal Code (“BMC”) § 10.10.170 allows the City Council to modify, remove, or dissolve a specific area(s) within existing permit parking districts.
B. On January 16, 2024, at its Regular Meeting the Public Safety Commission received public testimony and other evidence regarding, in part, to modify permit parking district on Nichols Street between Woodruff Place and Cornuta Avenue.
C. The City reviewed this Resolution’s environmental impacts under the California Environmental Quality Act (Public Resources Code §§ 21000, et seq., “CEQA”), the regulations promulgated thereunder (14 Cal. Code of Regulations §§15000, et set., the “CEQA” Guidelines”), and the City’s Environmental Guidelines.
D. This Resolution is adopted based upon the entirety of the administrative record including, without limitation, testimony and evidence presented to the Public Safety Commission on January 1, 2024, and the staff report submitted by the Director of Public Safety.
SECTION 2. Factual Findings. Pursuant to BMC § 10.10.150, the City Council makes the following findings:
A. On October 9, 2017, the City Council adopted a resolution creating Permit Parking District Y. Permit Parking District Y is located on a portion of the north and south sides of Nichols Street, between Woodruff Place and Cornuta Avenue.
B. On May 23, 2022, the City Council adopted Resolution No. 22 -22 which, among other things, describes every parking district in the City.
C. On November 7, 2023, Public Safety staff received a petition from residents living on Nichols Street requesting District Y be extended to include all of Nichols Street (north and south sides) between Woodruff Place and Cornuta Avenue, except the northern portion that fronts t he real property at 10101 Nichols Avenue (the “Petition”).
7 City of Bellflower
Resolution No. 24-05
D. The Petition is signed by 8 residents who represent 8 dwelling units in the affected area. There are a total of 24 dwelling units in the affected area.
E. On December 29, 2023, the Director of Public Safety notified all residents in Permit Parking District Y of the Petition.
F. That vehicles owned or operated by persons who are not residents substantially and regularly interfere with the use of the majority of available public street or alley parking spaces in the proposed specified area by adjacent residents;
G. Interference by such vehicles occurs in the proposed specified area at regular and significantly daily or weekly intervals;
H. These nonresident vehicles significantly contribute to unreasonable noise; traffic hazards; and environmental pollution or devaluation of real property in the area of the proposed specified area; and
I. There is a shortage of reasonably available and convenient residential related parking spaces within the proposed specified area.
SECTION 3. Environmental Assessment. The City reviewed the environmental impacts of the proposed Ordinance pursuant to the California Environmental Quality Act (Public Resources Code §§ 21000, et seq. “CEQA”) and the regulations promulgated thereunder (14 Cal. Code of Regs. §§ 15000, et seq., the “CEQA Guidelines”). CEQA Guideline § 15303 exempts activity that results in new construction or conversion of small structures. The Resolution creates a preferential parking district governing parking within a designated area and which requires installation of pedestrian level street signage.
Accordingly, the Resolution is exempt from further review.
SECTION 4. Amendment & Supersession. The modification of Permit Parking District Y is added to the approved Permit Parking Districts as set forth in attached Exhibit “A,” which is incorporated by reference. The attached Exhibit “A” supersedes the Exhibit “A” included in Resolution No. 22-22 in its entirety.
SECTION 5. This Resolution does not affect any penalty, forfeiture, or liability incurred before, or preclude prosecution and imposition of penalties for any violation occurring before, this Resolution’s effective date. Any such amended part will remain in full force and effect for sustaining action or prosecuting violations occurring before the effective date of this Resolution.
SECTION 6. Limitations. The City Council’s analysis and evaluation of the project is based on the best information currently available. It is inevitable that in evaluating a project that absolute and perfect knowledge of all possible aspects of the project will not exist. One of the major limitations on analysis of the project is the City Council’s lack of knowledge of future events. In all instances, best efforts were made to form accurate assumptions. Somewhat related to this are the limitations on the City's ability to solve what are in effect regional, state, and national problems and issues. The City must work within the political framework within which it exists and with the limitations inherent in that framework. 8

Resolution No. 24-05
SECTION 7. Summaries of Information. All summaries of information in the findings, which precede this section, are based on the substantial evidence in the record.
The absence of any particular fact from any such summary is not an indication that a particular finding is not based in part on that fact.
SECTION 8. Construction. This Resolution must be broadly construed to achieve the purposes stated in this Resolution . It is the City Council’s intent that the provisions of this Resolution be interpreted or implemented by the City and others in a manner that facilitates the purposes set forth in this Resolution.
SECTION 9. Severability. If any part of this Resolution or its Application is deemed invalid by a court of competent jurisdiction, the City Council intends that such invalidity will not affect the effectiveness of the remaining provisions or applications and, to this end, the provisions of this Resolution are severable.
SECTION 10. Electronic Signatures. This Resolution may be executed with electronic signatures in accordance with Government Code §16.5. Such electronic signatures will be treated in all respects as having the same effect as an original signature.
SECTION 11. The Mayor, or presiding officer, is authorized to affix its signature to this Resolution signifying its adoption by the City Council of the City of Bellflower, and the City Clerk, or its duly appointed deputy, is directed to attest.
SECTION 12. Effective Date. This Resolution will become effective immediately upon adoption and will remain effective unless repealed or superseded.
PASSED, APPROVED, AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF BELLFLOWER THIS 12TH DAY OF FEBRUARY 2024.
