Good Evening Honorable Mayor and members of the City Council, before you is a presentation on Ordinance No. 1426 related to Zone Change Case No. ZC 23-04. 1 General Plan and Zoning

General Plan:

Long-term “blueprint” for the physical development of the City. Facilitates City’s goals for the future.

Zoning:

The law that supports the general plan and regulates allowable uses and development standards.

2 State Law requires that each city prepare and adopt a comprehensive, long-term general plan for the physical development – a plan that acts like the City’s “blueprint.” The general plan is meant to facilitate the City’s goals for the future. It represents the community's view of its future; and it is a constitution made up of the goals and policies upon which land use decisions will be based upon.

Zoning is the law that supports the general plan, and it regulates allowable uses and development standards for each property. Zoning must comply with the general plan because its purpose is to implement the policies of the general plan.
2 Background

Ordinance 919 (July 1998)
Amended Zoning Designation to General Commercial (“C-G”).

Resolution No. 98-115 (October 1998): Amended the General Plan Land Use Map; however, the land use designation remained Low-Density Residential (“L”).

3 State Law:

Requires Zoning to be consistent with the General Plan Map.

State law requires that zoning be consistent with a City’s general plan (for example, a property zoned General Commercial must have a general plan land use designation of “Commercial” and a property zoned Low Density Residential must have a general plan land use designation of Low Density Residential). Because the general plan supersedes zoning, when there is inconsistency, it must be remedied by changing the zoning designation to be consistent with the general plan land use designation. The City is required to amend the zoning ordinance within a reasonable time so that it is consistent with the general plan.

On July 13, 1998, the City Council amended the Zoning Map changing the zoning designation from Agricultural Residential to General Commercial for properties located at 10473, 10505, and 10511 Artesia Boulevard. That same year on October 26, 1998, the City Council amended the General Plan Land Use Map but the land use designation for these properties remained “L” or Low Density Residential.

Recently, the city became aware of this inconsistency and therefore, the City intends to rectify it by proposing to change the current zoning from C-G to R-1 for all 3 properties to match the general plan land use designation. This is essentially a “clean-up” item. 3 Current Zoning Map
4 Shown on this slide and also included on page 3 of the staff report is a map illustrating the subject properties’ current zoning designation.

The property at 10473 Artesia Boulevard (Parcel 1) is developed with a 5,900-square foot commercial building built in 2004. The existing use on the property is inconsistent with the general plan land use designation of “L”. The change of zone to R-1 would not disrupt the existing business and would be allowed to continue pursuant to Bellflower Municipal Code (“BMC”) Chapter 17.92 (Nonconforming Buildings and Uses).

The properties at 10505 and 10511 Artesia Boulevard (Parcels 2 & 3) are each developed with a single-family residence and zoned C-G. The C-G zoning designation is inconsistent with the General Plan Land Use designation of “L.”

4 November 6, 2023
Planning Commission Meeting
5 Planning Commission:

Recommended the City Council approve the Zone Change.

On November 6, 2023, the Planning Commission considered Zone Change Case No. ZC 23-04. At the meeting, the property owners for 10505 and 10511 Artesia Boulevard expressed their support for the Zone Change.

At that same meeting, the property and business owner for 10473 Artesia Boulevard expressed concerns regarding his ability to continue the commercial use of the property, the property value, and the limitation on future expansions of the use and structure.

At the conclusion of the meeting, the Planning Commission adopted Resolution No. PC 23-09 recommending the City Council approve the Zone Change. 5 RECOMMENDATION
Open the public hearing; take testimonial and documentary evidence; and after considering the evidence, introduce Ordinance No. 1426; or

Alternatively, discuss and take other action related to this item.
