SUBJECT:Consideration and possible action to authorize the City Manager to waive the film permit fee for Wounded Warrior Project film permit request.
DATE:June 10, 2024
EXECUTIVE SUMMARY
The Public Works Department requests authorization to waive the film permit fees for Wounded Warrior Projects film permit request.
RECOMMENDATION TO CITY COUNCIL
1) Authorize the City Manager to waive the film permit fees for Wounded Warriors; or 2) Alternatively, discuss and take other action related to this item.
FISCAL IMPACT
Waiving the film permit fees would result in a loss of $525.00 of revenue.
DISCUSSION
The City recently received a request for a film permit from the Wounded Warrior Project team. Per their submitted application (attached), the filming is to take place on July 5th at the Hollywood Sports Park and includes a livestream filming of a capture the flag paintball event with program participants. All filming will occur on private property only. The Wounded Warriors project is a Non-Profit organization with a verified 501(c)3 status that serves veterans of the armed forces throughout the United States, including in Bellflower.
The organization’s mission is to honor and empower wounded warriors through a variety of services and programs. These include, but are not limited to, providing comfort and care items to service members in the hospital, counseling, long-term rehabilitative care, mental health and wellness programs, operation of resource centers, and advocacy services for veteran policies and initiatives. Their services are available to any veterans or service members who served in the military on or after September 11, 2001, and incurred a physical or mental injury, illness, or wound during or after service. By alleviating the permit fees, the City can demonstrate their commitment to honoring and supporting veterans' causes, enabling Wounded Warriors to allocate more resources directly to their vital programs and services.

EXECUTIVE SUMMARY
This action would authorize the City Manager to execute an amendment to the previously approved Memorandum of Understanding (MOU) with the Los Angeles Gateway Region Integrated Regional Water Management Joint Powers Authority (GWMA) for administration and cost sharing for the implementation of the coordinated compliance, monitoring, and reporting plan for the Dominguez Channel and Los Angeles and Long Beach Harbors Waters Toxic Pollutants Total Maximum Daily Loads (Harbor Toxic TMDL). This amendment would extend the term of the MOU for five years and allow for an increase to the annual cost allocation.

Staff Report – Amendment No. 1 to AFN 20.1
June 10, 2024
DISCUSSION
On May 5, 2011, the Los Angeles Regional Water Quality Control Board (Regional Board) adopted the Harbors Toxics TMDL, which named the City of Bellflower as a responsible party. On March 23, 2012, the TMDL was subsequently approved by the U.S.
Environmental Protection Agency (EPA).
The Harbors Toxics TMDL established numerical discharge limits for a wide variety of pollutants, including metals such as copper, lead, zinc, and other organic compounds such as DDT and PCB which are generally referred to as “toxics.” Bellflower was included as a responsible party because the City’s stormwater and urban runoff drains into the Los Angeles and Long Beach Harbor Waters via the Los Cerritos Channel Watershed. The TMDL required responsible parties to develop and implement a monitoring plan that includes sediment testing, water column testing, and analysis of fish tissues. In order to comply with the requirements of the TMDL, representatives from Bellflower, Lakewood, Long Beach, Los Angeles, Los Angeles County, Paramount, Rancho Palos Verdes, Rolling Hills, Rolling Hills Estates, Signal Hill, and the ports of Los Angeles and Long Beach, worked together as a group with the GWMA to develop a MOU to share the costs of developing and implementing the monitoring plan.
On June 9, 2014, the City Council approved the original Memorandum of Understanding File No. 20 for the above-mentioned services. On February 25, 2019, the City Council approved a new Memorandum of Understanding File No. 20.1 which is set to expire on December 31, 2024. This proposed amendment will extend the terms of this agreement until December 31, 2029, and updates the annual cost allocation for all parties.
Exhibit A of the attached Amendment includes a cost sharing summary. The MOU participants are assessed a share of the permit cost based on each agency’s jurisdictional area, which accounts for 60% of the overall costs, and an equal base cost assessed to all participants, which accounts for 30% of the overall costs. The L.A. County Flood Control District is contributing an amount equal to 10 percent (10%) of the remaining overall costs. This MOU also allows for individual industrial NPDES permittees to participate in the group’s monitoring efforts for a fee of $171,155. The City’s annual contribution has increased under the agreement to a maximum of $34,908 from the previous agreement’s annual contribution of $13,342. The overall increase is based on increases in consultant services costs as well as the reduction of individual industrial permittee participation shown in the cost allocation. While there are currently no individual permittees under agreement to participate at this time, if they elect to participate, then each agency’s annual costs would be reduced equitably. For reference, during the last MOU term, there were seven (7) individual permittees that participated. The updated cost allocation amount will be provided with the invoice typically in June of each year.

SUBJECT: Consideration and possible action to adopt Resolution No. 24-32 – A Resolution adopting the annual appropriations limit for fiscal year 2024-2025.
DATE: June 10, 2024
EXECUTIVE SUMMARY
In accordance with Article XIIIB of the California Constitution, the appropriations limit (also referred to as the "Gann limit") for fiscal year 2024-2025 has been calculated by applying inflation and population factors provided by the State Department of Finance.
RECOMMENDATION TO THE CITY COUNCIL
1) Adopt Resolution No. 24-32; or
2) Alternatively, discuss and take other action related to this item.
FISCAL IMPACT
None.
BACKGROUND
On November 6, 1979, California voters approved the Gann Spending Limitation Initiative (Proposition 4) establishing Article XIIIB of the State Constitution. Subsequently, on June 5, 1990, California voters approved the Traffic Congestion Relief and Spending Limitation Act (Proposition 111), which made various amendments to Article XIIIB of the State Constitution. Article XIIIB sets limits on the amount of tax revenues that the State and most local governments can appropriate within a given fiscal year.

The appropriations limit for fiscal year 2024-2025 is $102,412,579, an increase of $4,206,338 from the preceding fiscal year (Exhibit A). This new limit has been calculated by adjusting the fiscal year 2023-2024 appropriations limit for the changes in the California per capita personal income and the Los Angeles County’s population. Based on the Operating Budget, the appropriations that are subject to this limit total $38,536,207 (Exhibit B). Due to the fact that the annual appropriations limit is greater than the appropriations that are subject to the limit, the City is in compliance with the provisions of Article XIIIB of the California Constitution. The City’s calculation of the annual appropriations limit must also be reviewed by the auditors as part of the standard annual financial audit.

A RESOLUTION ADOPTING THE ANNUAL APPROPRIATIONS
LIMIT FOR FISCAL YEAR 2024-2025
THE CITY COUNCIL RESOLVES AS FOLLOWS:
SECTION 1. The City Council finds and declares as follows:
A. The City Council may choose the method of calculating adjustments to the City’s Appropriations Limit on an annual basis pursuant to Article XIIIB of the California Constitution. For inflation, pursuant to Article XIIIB, § 8(e)(2), adjustments to the Appropriations Limit may be calculated using either the percentage change in per capita personal income from the preceding year or the percentage change in the local assessment roll from the preceding year because of local nonresidential new construction. For population growth, pursuant to Government Code § 7901(b), the City may either use the percentage growth either in its jurisdiction or from the surrounding county;
B. Pursuant to Article XIIIB of the California Constitution, and those Government Code sections adopted pursuant to Article XIIIB, § 8(f), the City Council chooses to adjust the City’s Appropriations Limit by calculating inflation using the percentage change in the California per capita personal income from the preceding year and calculating population growth by using the percentage change in the County of Los Angeles population;
C. The information necessary for making these adjustments is illustrated in attached Exhibits A and B, which are incorporated by reference; and
D. The City of Bellflower has complied with all the provisions of the amended Article XlIIB in determining the appropriations limit for fiscal year 2024-2025.
SECTION 2. The appropriations limit for fiscal year 2024-2025 for the City of Bellflower is established at $102,412,579.
SECTION 3. The appropriations subject to the annual limit as contained in the Operating Budget for fiscal year 2024-2025 are $38,536,207.
SECTION 4. This Resolution does not affect any penalty, forfeiture, or liability incurred before, or preclude prosecution and imposition of penalties for any violation occurring before, this Resolution’s effective date. Any such amended part will remain in full force and effect for sustaining action or prosecuting violations occurring before the effective date of this Resolution.

Appropriations (Gann) Limit FY 2024-25 - Exhibits A & B.xlsx - 6 -
April 30, 2024
Dear Fiscal Officer:
Price Factor and Population Information
Appropriations Limit
California Revenue and Taxation Code section 2227 requires the Department of Finance to transmit an estimate of the percentage change in population to local governments.
Each local jurisdiction must use their percentage change in population factor for January 1, 2024, in conjunction with a change in the cost of living, or price factor, to calculate their appropriations limit for fiscal year 2024-25. Attachment A provides the change in California’s per capita personal income and an example for utilizing the factors to calculate the 2024-25 appropriations limit. Attachment B provides the city and unincorporated county population percentage change. Attachment C provides the population percentage change for counties and their summed incorporated areas. The population percentage change data excludes federal and state institutionalized populations and military populations.
Population Percent Change for Special Districts
Some special districts must establish an annual appropriations limit. California Revenue and Taxation Code section 2228 provides additional information regarding the appropriations limit. Article XIII B, section 9(C) of the California Constitution exempts certain special districts from the appropriations limit calculation mandate. Special districts required by law to calculate their appropriations limit must present the calculation as part of their annual audit. Any questions special districts have on this requirement should be directed to their county, district legal counsel, or the law itself. No state agency reviews the local appropriations limits.
Population Certification
The population certification program applies only to cities and counties. California Revenue and Taxation Code section 11005.6 mandates Finance to automatically certify any population estimate that exceeds the current certified population with the State Controller’s Office. Finance will certify the higher estimate to the State Controller by June 1, 2024. Please note: The prior year’s city population estimates may be revised. The per capita personal income change is based on historical data.
If you have any questions regarding this data, please contact the Demographic Research Unit at (916) 323-4086.

Attachment A
A. Price Factor: Article XIII B specifies that local jurisdictions select their cost of living factor to compute their appropriation limit by a vote of their governing body. The cost of living factor provided here is per capita personal income. If the percentage change in per capita personal income is selected, the percentage change to be used in setting the fiscal year 2024-25 appropriation limit is:
Per Capita Personal Income
Fiscal Year Percentage change
(FY) over prior year
2024-25 3.62
B. Following is an example using sample population change and the change in California per capita personal income as growth factors in computing a 2024-25 appropriation limit.
2024-25:
Per Capita Cost of Living Change = 3.62 percent
Population Change = 0.17 percent
Per Capita Cost of Living converted to a ratio: 3.62 + 100 = 1.0362 100
Population converted to a ratio: 0.17 + 100 = 1.0017 100
Calculation of factor for FY 2024-25: 1.0362 x 1.0017 = 1.0379

SUBJECT: Consideration and possible action to adopt Resolution No. 24-33 - A Resolution fixing the tax levy for the maintenance of Vehicle Parking District No. 1 for fiscal year 2024-2025.
DATE: June 10, 2024
EXECUTIVE SUMMARY
Pursuant to Sections 31822 and 31823 of the California Streets and Highways Code, the City of Bellflower is required to fix the tax levy each year for the maintenance of Vehicle Parking District No. 1, located on the west side of Bellflower Boulevard, from Flower Street to Mayne Street. The currently assessed rate of $0.15 per $100 of assessed property value is the maximum allowed by law.
RECOMMENDATION TO THE CITY COUNCIL
1) Adopt Resolution No. 24-33; or
2) Alternatively, discuss and take other action related to this item.
FISCAL IMPACT
The current assessment rate of $0.15 per $100 of assessed property value (the maximum rate allowed by law) will raise approximately $43,000 to offset the estimated maintenance cost of $60,000 for fiscal year 2024-2025. No other revenue is derived from the operation of the Parking District No. 1 (west side of Bellflower Boulevard, from Flower Street to Mayne Street). The maintenance cost not covered by this assessment will be paid by the General Fund.
DISCUSSION
Vehicle Parking District No. 1 was established by a series of ordinances between 1960 and 1966 in accordance with the Vehicle Parking District Law of 1943. The District was formed with the concurrence of the then property owners on the west side of Bellflower Boulevard within the Town Center for the purpose of providing increased parking for businesses in the Town Center.

Staff Report – Vehicle Parking District Assessment for Fiscal Year 2024-2025 June 10, 2024
DISCUSSION – Continued
No tax increase is being requested at this time for the maintenance of the Parking District.
Pursuant to Section 31823 of the California Streets and Highways Code, the currently assessed rate of $0.15 per $100 of assessed property value is the maximum allowed by law for maintenance, operation, repair, and improvement of Vehicle Parking District No. 1.
Any higher tax rate would require a different method of assessment requiring the affected property owners’ approval of the levy.
Section 31823 of the California Streets and Highways Code
The tax levy for maintenance, operation, repair, and improvement of parking places in any year shall not exceed fifteen cents ($0.15) on each one hundred dollars ($100) assessed value of taxable land and improvements within the district. The tax levy for acquisition of additional parking places in any year shall not exceed twenty-five cents ($0.25) on each one hundred dollars ($100) assessed value of taxable land and improvements within the district.
