TO: Honorable Mayor and Members of the City Council
ATTENTION: Ryan Smoot, City Manager
FROM: Len Gorecki, Assistant City Manager/Director of Public Works
SUBJECT: Consideration and possible action to conduct a protest hearing to consider proposed adjustments to the maximum rates for
residential, commercial and multi-family solid waste collection services; adopt Resolution No. 24-51 - A Resolution establishing rate adjustments for residential, commercial and multi-family solid waste collection services charged by CR&R Incorporated for a five-year period commencing on September 1, 2024.
DATE: August 26, 2024
EXECUTIVE SUMMARY
This item would allow for testimony to be heard for and against proposed adjustments to the maximum rates for residential, commercial and multi-family solid waste collection services (“Rates”) charged by CR&R Incorporated (CR&R), through the Revised and Restated Franchise Agreement, Agreement File No. 399.2, for Solid Waste Management Services (the “Franchise Agreement”). The recommended action would adopt a resolution establishing potential rate adjustments for residential, commercial and multi-family solid waste collection services through August 31, 2029, in accordance with Proposition 218. Such rate adjustments will be based on the Consumer Price Index for All Urban Consumers, Series ID: CUURS49ASA0, Not Seasonally Adjusted, All items, Los Angeles-Long Beach-Anaheim, CA, as maintained and published by the US Bureau of Labor Statistics. Per Proposition 218 regulations, the maximum allowable increase cannot exceed 5% in any year.
RECOMMENDATION TO CITY COUNCIL
1) Open the protest hearing; take testimonial and documentary evidence; and after considering the evidence, adopt Resolution No. 24-51;
2) Approve CR&R’s rate adjustment request effective September 1, 2024; or
4) Alternatively, discuss and take other action related to this item.
FISCAL IMPACT
There is no material fiscal impact to the City related to this item. The proposed refuse rate increases as detailed in the staff report under “Rate Adjustments” and other sections are paid by the service recipients – residents, business owners, and property owners. All costs associated with the Proposition 218 process are reimbursed by the Franchisee.

PUBLIC NOTICE
Pursuant to Proposition 218, on July 10, 2024, a Notice of Protest Hearing for proposed adjustments to the maximum rates for residential, commercial and multi-family solid waste collection services (the “Notice”) was mailed to each property owner and customer-of-record (a total of 13,523 notices), informing them of the August 26, 2024, protest hearing and the protest procedure. As of August 22, 2024, the City Clerk’s office has received a total of 121 protest ballots.
DISCUSSION
A. Franchise Background and Proposed Amendment
On April 11, 2011, the City entered into Revised and Restated Franchise Agreement File No. 399.2 with CR&R for Solid Waste Management Services (the “Franchise Agreement”). Those services include, without limitation, residential automated curbside collection, multi-family and commercial refuse and recyclable bin collection, and roll-off refuse and recyclable material processing and collection. The term of the Franchise Agreement is set to expire on August 31, 2024.
In August 2023, the City Council approved the establishment of a two (2) Council Member ad hoc committee to review and consider the City’s options related to Solid Waste Management Services. The committee, along with representatives from CR&R, MuniEnvironmental (the City’s environmental consultant) and City staff met on several occasions to review the existing Franchise Agreement. As a result, recommendations related to the operations of the Solid Waste Management Services and service rates were incorporated into proposed Amendment No. 3. On June 24, 2024, the City Council approved draft Amendment No. 3 to Agreement File No. 399.2, approved the Proposition 218 Notice and directly staff to initiate the Proposition 218 Protest Hearing process.
Highlights from the proposed Amendment No. 3 are as follows:
Agreement Term
Amendment No. 3 proposes to extend the existing Franchise Agreement with CR&R for an additional eight (8) years through August 31, 2032, with the option to extend the agreement for a single 2-year extension.
Rate Adjustments
CR&R is proposing no rate increase for residential accounts during the upcoming year (through August 31, 2025). Additionally, CR&R will introduce additional cart sizes categories (both 60 gallon and 35 gallon) for residential service at reduced rates . There will also be rate reductions for Organics Collection (-6.25%); Green Waste Only bins (-
6.25%); and Manure bins (ranging from -6.25% to -17.93%). CR&R is proposing a rate increase of (15.38%) for commercial accounts that use two (2) and three (3) yard recycling bins. Such rate adjustments will be based on the Consumer Price Index (CPI) for All Urban Consumers, Series ID: CUURS49ASA0, Not Seasonally Adjusted, All items, Los Angeles-Long Beach-Anaheim, CA, as maintained and published by the US Bureau of Labor Statistics. Proposition 218 regulations cap the maximum allowable increase at 5% for each year. If the CPI Index is less than 5%, then the index percentage will be used to adjust the rates for the particular year. 2 Staff Report – CR&R Protest Hearing for Proposed Rate Adjustments August 26, 2024
DISCUSSION – Continued
Franchise Fee
Beginning September 1, 2024, the Franchise Fee will annually be adjusted using the percentage change to the Consumer Price Index (CPI) for the previous twelve (12) month period ending May 31st each year. The annual increase in the Franchise Fee will not exceed 5%.
Downtown Infrastructure Impact Fee
Beginning January 1, 2025, CR&R will pay an annual fee of $200,000 to be used for infrastructure improvements to the City parking lot trash enclosures the City is required to implement as part of the three (3) container collection methodology imposed by the State of California. Beginning September 1, 2025, this fee will annually be adjusted using the percentage change to the Consumer Price Index (CPI) for the previous twelve (12) month period ending May 31st each year.
Abandoned Item Collection
CR&R will establish a dedicated abandoned item collection team of two (2) CR&R employees utilizing a collection vehicle that will work five (5) days per week (Monday – Friday) for 8 hours each day to patrol the City streets and alleyways to pick up and dispose abandoned items.
Collection Vehicle Specifications and Street Sweeping Equipment To ensure collection vehicles are in good working order, collection vehicles shall not exceed an average of eight (8) years of age with no single current o r replacement vehicle exceeding and maximum of twelve (12) years of age. Based on the current fleet inventory, four (4) vehicles will be replaced in 2025, three (3) vehicles will be replaced in 2027, and one (1) vehicle will be replaced in 2028.
CR&R proposes to replace the street sweeper and the back -up sweeper by December 31, 2025. Additionally, if a sweeper unit over the age of five (5) years experiences more than three (3) mechanical breakdowns in a three (3) month rolling period that results in service interruption outside of the posted sweeping schedule, then the sweeper must be replaced by a sweeper less than five (5) years old.
CR&R will repaint all collection vehicles at least every five (5) years or within thirty (30) days’ notice from City if City determines that any collection vehicle’s appearance warrants repainting.
Collection Cart Replacement and Color Scheme
CR&R proposes to replace all collection carts for single -family dwellings and multi- family dwellings without bin service. CR&R must provide evidence of the order by December 1, 2024, and must provide a logistical plan for the distribution of the carts prior to January 1, 2025. The appearance of the new carts will include black bodies and the lids will be color coded by material type (black lid for refuse, blue lid for recyclables and green lid for organics).

Billing Cycle Conversion for Commercial and Multi-Family Customers Effective January 1, 2025, CR&R shall convert from billing Commercial and Multi -Family customers in arrears to billing them in advance. To prevent customers from the financial burden of having 2 month’s charges due concurrently, CR&R will allow the past month’s charges to be paid in twelve (12) equal installments over 12 months (interest fee).
Compost and Mulch Procurement
As mandated by the State of California, the City is required to procure certified compost/ mulch in an effort to reach its “Recovered Organic Waste Product Procurement Target.” The City estimates that it will procure approximately 2,000 cubic yards annually to be used at City parks, other landscaped areas and public giveaway events. The fee for the procurement is included in the Maximum Rate Schedule.
B. Rate Comparison with Surrounding Cities
For purposes of illustration only (Proposition 218 does not allow for calculating rates based upon comparisons with other jurisdictions; it allows only for the City to recover its own unique costs), the charts below illustrate how CR&R’s rates for 202 4 compare with those from surrounding communities. Please note that some rates do not reflect full implementation of Senate Bill 1383 at this time.

C. Proposition 218 Notice of Protest Hearing
Pursuant to Article XIII D, Section 6 of the California Constitution (approved by the voters by Proposition 218), before imposing a new or increasing an existing property-related fee such as solid waste collection fees, the City is required to mail notice of the protest hearing to the record owner of and any tenant who is directly liable for the payment of the proposed fees (i.e., a customer-of-record) and hold a public protest hearing. The notice must be provided at least 45 days before the date of the protest hearing on the proposed fees.
In 2018, the City Council adopted Resolution No. 18-18 establishing procedures for increasing maximum rates for solid waste collection services, in accordance with the requirements of Proposition 218. These procedures require the City Council to approve a Proposition 218 Notice, which contains the proposed monthly rates for residential and commercial services, including organic waste and roll-off box collection services; and the date in which the rates would become effective if approved.
In order to consider the proposed adjustments to the Rates submitted by CR&R as part of the proposed extension to the Franchise Agreement, a new Proposition 218 proceeding must be conducted utilizing the procedures established by Resolution No. 18-18.
Public Works prepared the attached Notice, which provides notice of the August 26, 2024, protest hearing date; contains the proposed Rates for the next five years beginning September 1, 2024, through August 31, 2029; discloses that if the proposed Rates are approved, they will take effect on September 1, 2024; and contains the official ballot for property owners or authorized representatives wishing to protest the proposed Rates.
On June 24, 2024, the City Council directed staff to issue the Notice, which was mailed on July 10, 2024, to each property owner and customer-of-record.

CITY OF BELLFLOWER
RESOLUTION NO. 24-51
A RESOLUTION ESTABLISHING RATE ADJUSTMENTS FOR
RESIDENTIAL, COMMERCIAL AND MULTI-FAMILY SOLID
WASTE COLLECTION SERVICES CHARGED BY CR&R
INCORPORATED FOR A FIVE-YEAR PERIOD COMMENCING
ON SEPTEMBER 1, 2024
THE CITY COUNCIL RESOLVES AS FOLLOWS:
SECTION 1. The City Council finds and declares as follows:
A. On April 11, 2011, the City Council entered into Revised and Restated Franchise Agreement File No. 399.2 with CR&R Incorporated (CR&R), for Integrated Solid Waste Management Services (Franchise Agreement) and adopted maximum rates for solid waste collection services through the approval of the Franchise Agreement.
B. Since the approval of the Franchise Agreement, California law changed to now require the City to implement additional diversion programs that were not included as part of the original Franchise Agreement. A summary of these follows:
i. Assembly Bill 1826 (Mandatory Commercial Organics Recycling) – This bill requires businesses to arrange for organic recycling services if they generate four or more cubic yards of commercial solid waste per week.
It requires multi-family residential dwellings to arrange for organic recycling service if they have five or more dwelling units; however, multi-family dwellings are only required to divert green waste, not food waste. In September 2020, the State of California’s Department of Resources Recycling and Recovery (CalRecycle) further reduced the threshold to two or more cubic yards of commercial solid waste per week.
ii. Senate Bill 1383 (Short-lived Climate Pollutants (SLCP): Organic Waste Methane Emissions Reductions) – This Bill mandates that California reduce organic waste by 50% by January 1, 2020, and 75% by January 1, 2025. It mandates that public agencies increase edible food recovery by January 1, 2025. As a result, organic waste will no longer be able to be disposed of in the landfill. SB 1383 requirements will take effect on January 1, 2022, at which time CR&R must provide all customers required to participate with compliant programs such as organic waste collection, coordination with food rescue organizations to promote edible food recovery, education and outreach, reporting, and contamination monitoring. This will also include providing mandatory organics food scrap collection to all residential customers and mandatory organic waste recycling services to all businesses subject to the requirements of AB 1826.
6 City of Bellflower
Resolution No. 24-51
C. To comply with these new laws, the City negotiated with CR&R to provide the necessary services.
D. On June 24, 2024, the City Council directed staff to issue a Proposition 218 Notice for proposed adjustments to the maximum rates for residential, commercial and multi-family solid waste collection services (the “Notice”).
E. On July 10, 2024, the City mailed the Notice, including the protest ballot, by first class mail to a total of 13,523 property owners and customers-of-record of parcels to which the proposed maximum rates for residential, commercial and multi-family solid waste collection services would apply, informing them of the August 26, 2024, protest hearing.
F. On August 26, 2024, the City Council conducted a protest hearing and received 121 valid written protests prior to the closing of the protest hearing.
G. The total number of valid written protests was 121, which is less than 50 percent of the total number of valid written protests that could legally be presented.
H. After hearing public testimony, the City Council considered whether to establish potential rate increases for residential, commercial and multi-family solid waste collection services.
SECTION 2. Based upon the testimony provided at the protest hearing, the City Council establishes the rate increases for residential, commercial and multi-family solid waste collection services charged by CR&R for a five-year period commencing on September 1, 2024, as set forth in attached Exhibit A, which is incorporated by reference.
SECTION 3. This Resolution does not affect any penalty, forfeiture, or liability incurred before, or preclude prosecution and imposition of penalties for any violation occurring before, this Resolution’s effective date. Any such amended part will remain in full force and effect for sustaining action or prosecuting violations occurring before the effective date of this Resolution.
SECTION 4. If any part of this Resolution or its application is deemed invalid by a court of competent jurisdiction, the City Council intends that such invalidity will not affect the effectiveness of the remaining provisions or applications and, to this end, the provisions of this Resolution are severable.
SECTION 5. Electronic Signatures. This Resolution may be executed with electronic signatures in accordance with Government Code §16.5. Such electronic signatures will be treated in all respects as having the same effect as an original signature.
SECTION 6. The Mayor, or presiding officer, is authorized to execute this Resolution signifying its adoption by the City Council of the City of Bellflower and the City Clerk, or duly appointed deputy, may attest thereto.
7 City of Bellflower
Resolution No. 24-51
SECTION 7. This Resolution will become effective immediately upon adoption and will remain effective unless repealed or superseded.
PASSED, APPROVED, AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF BELLFLOWER ON THIS 26TH DAY OF AUGUST 2024.

Company acknowledges that this conversion may cause an undue financial burden on customers if two month’s charges are due concurrently (i.e., charges from the previous month billed in arrears and as the charges for the upcoming month billed in advance due at once).
To prevent Customers from experiencing such a burden, Company must allow the past month’s charges to be paid in 12 equal installments, over the same number of months, interest free (for example, if the past month’s balance is $150, one twelfth’s (1/12th) of this amount, or $12.50, would be included on each future monthly bill until the total amount is paid).
On or before December 1, 2024, Company must submit to the City Manager or his designee for review and approval of the final plan details and related notices to be sent to Customers.” SECTION 24.Pursuant to Section 13.5 of the Agreement, Article 6 (Company Compensation and Rates), Sections 6.1 through 6.7 are deleted in their entirety, and replaced by Sections 6.1 through
6.6, to read as follows:
“ARTICLE 6 – COMPANY COMPENSATION AND RATES
6.1 Initial Rates
Company must provide services to Customers pursuant to the Agreement, at rates it sets, charges to, and collects from Customers, which rates may not exceed those set forth in EXHIBIT A and incorporated herein by this reference (“Maximum Rate Schedule”), as such maximum rates may be adjusted periodically under the terms hereof. The maximum rates set forth in EXHIBIT A are inclusive of all services to be provided, including transportation, disposal, and container costs, as well as City Fees, and no other charges may be imposed by Company for such services.

Agreement File No. 399.2 - Amendment No. 3
CR&R, Incorporated
City and Company acknowledge that City, in accordance with Section 6(A) of Article XIII D of the California Constitution (Proposition 218), will provide required Notices regarding proposed rate increases and an opportunity for protest and a hearing, as applicable.
6.2 Schedule of Future Rate Adjustments
Beginning with rate year September 1, 2025 through August 31, 2026, and for all subsequent rate years, Company may request an annual rate adjustment within the parameters of said Maximum Rate Schedule.
At least 60 days before seeking an adjustment in rates due to changes in the CPI or disposal component, Company may request the City Manager's approval to do so by providing written notice of its intent to increase rates. The City Manager must approve such request within a timeframe so as to allow for a 30 day advance notice to customers, pursuant to Government Code Section 53756(d).
At least 45 days before imposing any rate increase, Contractor must obtain the City Manager's approval to do so. The City Manager must approve such a request unless it is determined, based upon substantial evidence, that the requested adjustment to the maximum rate does not meet the requirements as set forth herein. It is anticipated that to obtain City Manager's approval of Company's requested rate increase, Company must provide all necessary information to justify the request.
6.3 Method of Future Rate Adjustments
6.3.1 Annual Consumer Price Index Adjustment
Commencing on September 1, 2025, the maximum rates as set forth in EXHIBIT A are be adjusted, and such rates may be adjusted annually thereafter on each subsequent September 1st during the Term hereof (the "Adjustment Dates"), by multiplying each rate in effect on August 31st of each year by the percentage change in the Consumer Price Index (“CPI”) for All Urban Consumers, Series ID: CUURS49ASA0, Not Seasonally Adjusted, All items, Los Angeles-Long Beach-Anaheim, CA, for the 12 month period ending May 31, immediately prior to the applicable Adjustment Date.
6.3.2 Adjustment to Disposal Component of Rates
The rates set forth in EXHIBIT A also are subject to increase or decrease to account for pass-through disposal fee changes at solid waste landfills or other facilities generally in Los Angeles County. The disposal fee change is a pro-rata pass through of change in fees charged by the Los Angeles County Sanitation Districts or any other public agency providing disposal services. Such costs include, without limitation, landfill tipping fees or other disposal, processing, recycling, or diversion costs as required or allowed by California law. Company must 23 City of Bellflower
Agreement File No. 399.2 - Amendment No. 3
CR&R, Incorporated
submit documentation substantiating the fee changes, in conjunction with pertinent rate adjustment calculations based on the proportional impact that the disposal component cost changes have on the maximum rates.
All future rate increases for pass-through disposal fee changes may generally occur on September 1st of each year, unless in the event of an unanticipated, extraordinary fee change by the provider of disposal services, in which event Company may seek a rate increase up to the maximum amount permissible.
6.3.3 Limitations to Annual Adjustment Increases
In no event may the rates set forth in EXHIBIT A be increased for either the CPI or the Disposal Component pass-through in any single year by more than an aggregate 5%; however, in the event an increase exceeds the 5% cap, the un-applied percentage may be rolled forward and applied to maximum rate increases in subsequent years.
In any year that CPI is negative, rates for that year will not decrease and remain static.
6.4 Extraordinary Rate Adjustments
Company may request an adjustment to the maximum rates set forth in EXHIBIT A, at reasonable times other than as set forth above, for unusual changes in the cost of providing service under the Agreement, which includes changes in the scope of Solid Waste Services or Programs provided hereunder, if such changes are due to new or expanded recycling legislation mandating heightened diversion or recovery standards for Solid Waste materials handled by Company pursuant to the Agreement. For each request for an adjustment to the maximum rates brought pursuant to this Section, Company must prepare a schedule documenting the extraordinary costs. Such request must be prepared in a form acceptable to the City Manager or his designee with support for assumptions and representations made by Company in preparing the estimate. The City Manager or his designee WILL review Company's request and, in the City Council's sole judgment and absolute discretion, make the final determination as to whether an adjustment to the maximum rates will be made, subject to compliance with Proposition 218; and, if an adjustment is permitted, the appropriate amount of the adjustment.
City may consider increases or decreases in Company's total revenues and total cost of services when reviewing a Discretionary Rate Adjustment request. Company may not request a discretionary rate adjustment in the maximum rates as a result of changes in fees or taxes such as Social Security; disability or income tax; changes in the market value of Recyclables or processing costs for Recyclables or Organic Waste Materials; inaccurate estimates by Company of its cost of operations; or costs of compliance with South Coast Air Quality Management District and Air Resource Board rules and standards for Solid Waste Collection Vehicles. 24 City of Bellflower

6.5 Compliance with Proposition 218 Required
As set forth in EXHIBIT A, City approved the Maximum Rate Schedule, which governs what Company may charge its customers in City. The Maximum Rate Schedule becomes effective as of September 1, 2024. Company may not receive any other fees or compensation for services to be performed pursuant to the Agreement in excess of those authorized by the Maximum Rate Schedule under the terms hereof. Further adjustments and/or increases beyond those authorized by the Maximum Rate Schedule are strictly subject to the City Council’s sole judgment and absolute discretion; and compliance with Proposition 218, the Proposition 218 Omnibus Implementation Act, and all applicable laws.
6.6 Notice of Increases
Pursuant to Government Code § 53756(d), Company must give advance, written notice to customers of any duly adopted rate increase at least 30 days before its effective date, including without limitation, the requirements of Proposition 218, as determined by City.” SECTION 25.Pursuant to Section 13.5 of the Agreement, Section 11.3 (Liquidated Damages), Subsection B.2, Subcategory i) [RE: Sunset of City Option to Require Mixed Waste Processing of Bin Loads per Section 9 herein] is deleted in its entirety.
SECTION 26. This Amendment may be executed in any number or counterparts, each of which will be an original, but all of which together constitutes one instrument executed on the same date.
SECTION 27.Taxpayer Identification Number. Company will provide City with a Taxpayer Identification Number.
SECTION 28.Waiver. A waiver by City of any breach of any term, covenant, or condition contained in this Amendment will not be deemed to be a waiver of any subsequent breach of the same or any other term, covenant, or condition contained in this Amendment, whether of the same or different character.
SECTION 29.Construction. The language of each part of this Amendment will be construed simply and according to its fair meaning, and this Amendment will never be construed either for or against either party.
SECTION 30.Severable. If any portion of this Amendment is declared by a court of competent jurisdiction to be invalid or unenforceable, then such portion will be deemed modified to the extent necessary in the opinion of the court to render such portion enforceable and, as so modified, such portion and the balance of this Agreement will continue in full force and effect.

NOTICE OF PUBLIC HEARING – PROPOSED ADJUSTMENTS FOR SOLID WASTE
COLLECTION SERVICES
The City of Bellflower (the “City”) is proposing an adjustment to the maximum rates for residential, commercial and multi-family solid waste collection services (collectively, the “Rates”). The proposal will be presented to the City Council for approval at a Protest Hearing on August 26, 2024 at 7:00 p.m. If approved, the Rates outlined in the charts included in this notice would become effective September 1, 2024. Article XIII D, Section 6 of the California Constitution (Proposition 218) requires that the City mail notice of these proposed Rate changes to all impacted property owners and solid waste collection service customers at least 45 days before a protest hearing. Proposition 218 also establishes a protest process for the public to follow if they wish to oppose the proposed Rates.
DATE, TIME AND LOCATION OF THE PUBLIC HEARING
The Public Hearing will be held on August 26, 2024 at 7:00 p.m. at the City’s Council Chambers located at 16600 Civic Center Drive, Bellflower, California.
PROTEST PROCEDURE
At the August 26, 2024 public hearing, any person may be heard regarding the proposed Rate adjustments. If you wish to oppose the proposed Rate adjustments, you are requested to submit a written protest by mail or hand delivered in advance of the hearing to the following address:
City of Bellflower
City Clerk’s Office
Attn: City Clerk
16600 Civic Center Drive
Bellflower, CA 90706
In addition, written protests may be submitted in person before or at the hearing. The City will count all properly filled out written protests received before the conclusion of the public hearing. If a majority of affected property owners and solid waste collection service customers submit a written protest, the proposed new Rates will not take effect. The City will not count written protests received after the conclusion of the public hearing. Verbal protests unaccompanied by a written protest will not be counted.
Protests should contain the following information: 1) the property’s Assessor’s Parcel Number, if known, and/or address; 2) your customer account number with City’s franchise solid waste collection service provider; 3) whether you are the owner or a tenant that is billed directly by the City’s franchise solid waste collection service provider; 4) a statement that you are protesting the Rate adjustments; and 5) your printed name, date, and original signature.
Only one protest per property will be counted. If you own multiple properties affected by the proposed adjustments, you should submit separate protests for each affected parcel, as the protest threshold is based upon a majority of the total number of parcels.
