Contracts for competitively bid public projects must be awarded to the lowest responsible bidder. As shown above, Woodcliff Corporation submitted the lowest bid and is the apparent low bidder. However, on August 21, 2024, City staff received a written protest from the third lowest bidder, New Dynasty Construction. The bid protest claimed that the apparent first and second lowest bidders, Woodcliff Corporation and Keystone Builders, Inc., failed to list one of the required product suppliers according to the project specification requirements. In response to the protest, both the first and second lowest bidders provided rebuttals to the protest claim.
The original bid protest documentation and the protest rebuttals were turned over to the City Attorney’s office. Upon the close review and examination of all relevant protest documents, the City Attorney’s office recommends that all bids be formally rejected by the City Council and that the City Council authorize the solicitation of new bids for the project. The City Council may, in its discretion, reject all bids per Public Contract Code §20166.
City staff has already begun discussions with NCA Studio (architect) and SouthStar Engineering (construction management) to refine the plans and specifications in an effort to eliminate any ambiguities and to ensure concise bid documents. -2-
