EXECUTIVE SUMMARY

Resolution No. 24-63 recites the facts of the November 5, 2024, Special and General Municipal Election regarding Members of the City Council, Districts 1, 2, and 4, and Measure B (City Charter) for the City of Bellflower.

RECOMMENDATION TO CITY COUNCIL

1) Adopt Resolution No. 24-63; or

2) Alternatively, discuss and take other action related to this item .

BACKGROUND

A Special and General Municipal Election was held and conducted in the City of Bellflower, California, on Tuesday, November 5, 2024, as required by law. Notice of the election was given in time, form, and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects the election was held and conducted and the votes were cast, received, and canvassed and the returns made and declared in time, form, and manner as required by the provisions of the California Elections Code. The County Election Department canvassed the returns of the election, certified the returns, and the City Clerk certified the results for this City Council. The results are attached as “Exhibit B” to the Resolution.

A RESOLUTION RECITING THE FACTS OF THE SPECIAL AND

GENERAL MUNICIPAL ELECTION CONSOLIDATED WITH THE
GENERAL ELECTION HELD ON NOVEMBER 5, 2024,

DECLARING THE RESULTS AND SUCH OTHER MATTERS AS

PROVIDED BY LAW

THE CITY COUNCIL RESOLVES AS FOLLOWS:

SECTION 1. For the election of Member of the City Council, District 1, the whole number of ballots cast in the precincts was 1,702; the whole number of Vote by Mail voter ballots cast was 4,365; making a total of 6,067 ballots cast in District 1 (9,629 Registered Voters; 63.0% Voter Turnout with 71.9% of those voting being Vote by Mail voters). The names of the persons voted for at the election for Member of the City Council, District 1, are as follows:

SECTION 2. For the election of Member of the City Council, District 2, the whole number of ballots cast in the precincts was 1,431; the whole number of Vote by Mail voter ballots cast was 3,271; making a total of 4,702 ballots cast in District 2 (7,859 Registered Voters; 59.8% Voter Turnout with 69.6% of those voting being Vote by Mail voters). The names of the persons voted for at the election for Member of the City Council, District 2, are as follows:

SECTION 3. For the election of Member of the City Council, District 4, the whole number of ballots cast in the precincts was 1,416; the whole number of Vote by Mail voter ballots cast was 2,770; making a total of 4,186 ballots cast in District 4 (7,650 Registered Voters; 54.7% Voter Turnout with 66.2% of those voting being Vote by Mail voters). The names of the persons voted for at the election for Member of the City Council, District 4, are as follows:

SECTION 4. For the election of Measure B, the whole number of ballots cast in the precincts was 7,929; the whole number of Vote by Mail voter ballots cast was 17,563; making a total of 25,492 ballots cast in City (42,223 Registered Voters; 60.4% Voter Turnout with 68.9% of those voting being Vote by Mail voters). Measure B [Ordinance No. 1432, attached hereto as Exhibit "A"] voted upon at the election is as follows:

Shall the Bellflower City Charter to establish Bellflower as a charter city, which would give Bellflower more authority over city affairs and local laws to make sure they are tailored to the specific needs of the City; give the City more local control in determining land use; reduce the influence of outside agencies, including the State of California; and would require all changes to the charter be approved by voters, be approved?

SECTION 5. In accordance with Election Code § 10262, the City Clerk certified the results to the City Council. These results are attached as Exhibit “B” and incorporated by reference. The number of votes given at each precinct and the number of votes given in the City to each of the persons named in Sections 1, 2, and 3 above; and for and against Measure B as referenced in Section 4 above, were as listed in Exhibit “B” attached.

SECTION 6. The City Council does declare and determine that Wendi Morse was elected as Member of the City Council, District 1, for the short term of two years; Dan Koops was elected as Member of the City Council, District 2, for the full term of four years; and Victor A. Sanchez was elected as Member of the City Council, District 4, for the full term of four years.

SECTION 7. The City Council does declare and determine that as a result of the election, a majority of the voters voting on Measure B (City Charter) voted in favor of the measure; Measure B carried; and the Measure is adopted. The Mayor is authorized to execute the Proposition.

SECTION 8. The City Clerk will enter on the records of the City Council of the City, a statement of the result of the election, showing: (1) the whole number of ballots cast in the City; (2) the names of the persons voted for; (3) the number of votes given at each precinct to each person; (4) the total number of votes given to each person; (5) t he measure voted upon; (6) the number of votes given at each precinct for and against the measure; and (7) the total number of votes given for and against the measure. -3-

SECTION 9. The City Clerk will immediately make and deliver to each of the persons so elected a Certificate of Election signed by the City Clerk and authenticated; and the City Clerk shall have the Oath of Office prescribed in the Constitution of the State of California administered to each person elected and shall have them subscribe to it and file it in the Office of the City Clerk. Each and all of the persons so elected will then be inducted into the respective office to which they were elected.

SECTION 10. Electronic Signatures. This Resolution may be executed with electronic signatures in accordance with Government Code §16.5. Such electronic signatures will be treated in all respects as having the same effect as an original signature.

SECTION 11. The Mayor, or presiding officer, is hereby authorized to affix his signature to this Resolution signifying its adoption by the City Council of the City of Bellflower, and the City Clerk, or her duly appointed deputy, is directed to attest thereto.

SECTION 12. This Resolution will become effective immediately upon adoption.

ORDINANCE NO. 1432

A PROPOSITION ADOPTING A CITY CHARTER FOR THE CITY OF
BELLFLOWER IN ACCORDANCE WITH GOVERNMENT CODE § 34458

THE PEOPLE OF THE CITY OF BELLFLOWER DO HEREBY ORDAIN AS FOLLOWS:

SECTION 1. The City Charter set forth in attached Exhibit “A,” and incorporated by reference, is approved by the voters.

SECTION 2. In accordance with Government Code § 34458.5, the City Charter would result in new city powers as follows:

A. The City Council may adopt land use regulations to maintain the City’s municipal affairs that may differ from those imposed by the state of California (Section III(C)).

B. There will be no change in the City Council’s ability to raise its own compensation in accordance with California law, i.e., it must comply with Government Code § 36516 (See Section IV(B)).

C. There will be no change in the City Council’s ability to set the compensation of other appointed officials in accordance with California law.

D. Any change to district elections must be made by ordinance adopted by a four- fifths vote of all members of the City Council (Section IV(D)).

E. The City Council may establish rules and regulations for all public works contracts that may differ from the California Public Contracts Code and may, in addition, pay a wage for public works projects that may differ from that in the California Labor Code (Section VII(A, B, and C). Notwithstanding the foregoing, the City Council must pay prevailing wage for public projects erecting, improving, painting, or repairing public buildings and project (Section VII(C)).

SECTION 3. Environmental Analysis. This Resolution is exempt from review under the California Environmental Quality Act (California Public Resources Code §§ 2100, et seq., “CEQA”) and CEQA regulations (14 California Code of Regulations §§ 15000, et seq.) because it establishes rules and procedures to implement government funding mechanisms; does not involve any commitment to a specific project which could result in a potentially significant physical impact on the environment; and constitutes an organizational or administrative activity that will not result in direct or indirect physical changes in the environment. Accordingly, this Resolution does not constitute a “project” that requires environmental review (see specifically 14 CCR § 15378(b)(4-5)).

SECTION 4. Interpretation. This Proposition must be interpreted so as to be consistent with all federal and state laws, rules, and regulations. If any section, sub- section, sentence, clause, phrase, part, or portion of this Proposition is held to be invalid or unconstitutional by a final judgment of a court of competent jurisdiction, such decision does not affect the validity of the remaining portions of this Proposition. The voters declare that this Proposition, and each section, sub-section, sentence, clause, phrase, part, or portion thereof, would have been adopted or passed irrespective of the fact that any one or more sections, sub-sections, sentences, clauses, phrases, part, or portion is found to be invalid. If any provision of this Proposition is held invalid as applied to any person or circumstance, such invalidity does not affect any application of this Proposition that can be given effect without the invalid application.

SECTION 5. Severability. If any portion of this Proposition is held by a court of competent jurisdiction to be invalid, the remainder of the Proposition and the application of such provision to other persons or circumstances will not be affected thereby. We the People indicate our strong desire that: (i) the City Council use its best efforts to sustain and reenact that portion, and (ii) the City Council implement this Proposition by taking all steps possible to cure any inadequacies or deficiencies identified by the court in a manner consistent with the express and implied intent of this Proposition, and then adopting or reenacting such portion as necessary or desirable to allow imposition of the tax.

SECTION 6. Construction. This Proposition must be broadly construed in order to achieve the purposes stated in this Proposition. It is the intent of the voters that the provisions of this Proposition be interpreted or implemented by the City and others in a manner that facilitates the purposes set forth in this Proposition.

SECTION 7. Filing and Recording. Three copies of the complete text of the approved City Charter must be certified and authenticated by the Mayor and the City Clerk, attesting to the submission of the City Charter to the voters, and their ratification of it. The City Clerk is directed to record one copy of the City Charter wi th the Los Angeles County Recorder and to file one copy in the City’s archives. The City Clerk is further directed to file a third copy of the City Charter with the California Secretary of State. The copies of the City Charter recorded with the Los Angeles County Recorder and in the City’s archive must be accompanied with the following:

A. Certified copies of all publications and notices required of the City in connection with the calling of an election to propose the City Charter.

B. Certified copies of any arguments for or against the City Charter proposal that were mailed to voters pursuant to Elections Code § 9281 and § 13303.

C. A certified abstract of the vote at the election at which the City Charter proposal was approved by the voters.

SECTION 8. Effective Date. If the voters vote in favor of the City Charter, it is ratified and will take effect upon being accepted and filed by the Secretary of State pursuant to Government Code § 34460.

CHARTER FOR THE

CITY OF

BELLFLOWER

I. Preamble

We, the People of the City of Bellflower,
do not yield our sovereignty to public
officials who serve them. The need for
the People’s consent to be governed is
inherent within our democracy. It is only
the People in the City of Bellflower who
can determine the course of the City’s
destiny and vigilantly exercise all powers
not specifically granted to the City by this
Charter. In adopting this Charter,
therefore, the People delegate authority
for governance to locally elected and
appointed officials who must faithfully
serve the residents of the City of
Bellflower. By doing so, the People
assert their desire for local control over
the City’s municipal affairs; their freedom
to decide their own destiny; and their
rejection of efforts by agencies outside of
the City’s jurisdiction seeking to impose
policies upon the City’s residents without
their approval.

II. Municipal Affairs; Generally.

The City of Bellflower has the power to
make and enforce all laws respecting its
municipal affairs as described by this
Charter and established by the California
Constitution, California statute, or
judicially defined laws. This power is
limited only as set forth in this Charter
and the California Constitution. Such
powers are in addition to those granted
or prescribed by any applicable law for
municipal corporations within the state of
California. Each of the responsibilities of
governance set forth and described in
this Charter, and as established by the
Constitutional, statutory and judicially
defined law of the State of California, is
declared to be a municipal affair or
concern, the performance of which is
unique to the benefit of the residents of
the City of Bellflower. Enumeration by
this Charter of any particular power does
not constitute a limitation upon the City’s
general grant of powers under applicable
law.

III. General Laws; City Council
Authority.

A. General Laws. In addition to the
powers granted by this Charter and the
California Constitution, the City has the
power and authority to adopt, make,
exercise and enforce all legislation, laws
and regulations and to take all actions
and to exercise any and all rights,
powers, and privileges heretofore or
hereafter established, granted or
prescribed by any law of the State of
California or by any other lawful authority.

In the event of any conflict between the
provisions of this Charter and the
provisions of the general laws of the
State of California, the provisions of this
Charter control.

B. Enactment of Laws; Exercise of
Authority. Elected and appointed officials
who exercise the powers granted by this
Charter are prohibited from favoring or
unlawfully discriminating against persons
based upon a legally protected
classification; socio-economic status; or
cultural heritage. When enacting laws
pursuant to this Charter, the City Council
must include a finding that such laws will
not unduly burden a person’s ability to
pursue economic opportunities and safe
and legal residential housing.

C. Land Use. Except as otherwise
provided by City Council ordinance, the
City is governed by California law as it
applies to general law cities with respect
to the application, interpretation and
enforcement of land use matters
including, without limitation, the
requirement of consistency between the
General Plan and zoning regulations.

IV. Governance; Elections.

A. City Council. The City Council is
comprised of five persons elected in
accordance with this Charter and
applicable law. Except as otherwise
provided by applicable law, persons
currently holding office, and within six
months after holding office, are ineligible
to hold any other office or employment
with the City. Except as otherwise
provided by this Charter or the California
Constitution, the City Council is vested
with all powers of the City.

B. City Council Compensation. The
City Council is prohibited from adopting
regulations that would result in
compensating elected officials in an
amount greater than allowed by
California law regulating general law
cities. Nothing in this Charter requires the
City Council to receive any
compensation; the City Council may, by
resolution, opt to forego compensation of
any kind.

C. Officers. The City’s officers are the
five members of the City Council, the City
Manager, the City Attorney, and the City
Clerk. The City Council will appoint the
City Manager, City Attorney, and City
Clerk.

D. Districts. Any change to district
elections as it exists at the time this
Charter becomes effective must be made
by ordinance adopted by a four-fifths vote
of all members of the City Council.

E. Emergency Services
Coordination. The City Council will
review the City’s local emergency
preparedness plan on a regular basis in
accordance with California law.

F. Reconsideration. Beginning in the
year 2021, when decennial census data
gathered pursuant to Article 1, Section 2
of the United State Constitution becomes
available, the City Council may hold a
public hearing to determine whether to
change the manner of district voting in
accordance with IV(D) of this Charter and
then applicable law.

V. Revenue.

The City Council is authorized to, by
ordinance or resolution, establish
standards, procedures, rules or
regulations to identify, solicit, receive, or
generate revenue for the public benefit of
any kind. In doing so, the City Council is
specifically (but without limitation)
authorized to undertake the following
actions:

A. Public Financing. The City, by
ordinance, may establish standards,
procedures, rules or regulations related
to any public financing.

B. Franchises. The City, by
ordinance, may acquire, develop, or
operate any public utility. It may also, by
ordinance, grant franchises to a public
utility that proposes to use or is using
public streets, highways or other rights-
of-way.

C. Enterprises. The City may own
and operate any enterprise the City
Council finds necessary to benefit the
public welfare.

D. Fiscal Responsibility and Stability.

The City must maintain sustainable
public finances; ensure City policies aids
economic growth; and invest appropriate
levels of public resources to support
infrastructure, recreation, and public
safety. While doing so, the City Council
must ensure that it holds at least 20% of
the City’s general fund revenue in
reserves. Upon declaring a fiscal
emergency by 4/5 vote, the City Council
may reduce this percentage to a level
that is reasonable under the
circumstances of the fiscal emergency.

VI. Intergovernmental Immunity.

A. City Revenues. All revenues
generated or collected by the City for any
public purpose cannot be involuntarily
retained, attached, withdrawn or
otherwise taken by any other
governmental entity including, without
limitation, the state of California or any of
its subdivisions.

B. Uncompensated Mandates.

Elected or appointed person acting on
the City’s behalf cannot be compelled to
perform services by any other
governmental entity including, without
limitation, the state of California or any of
its subdivisions, without adequate
compensation.

VII. Public Works Projects.

The City Council may, by ordinance,
establish standards, procedures, rules or
regulations to regulate all aspects of the
bidding, award and performance of any
public works contract, including, without
limitation, the compensation rates to be
paid for the performance of such work. In
doing so, the City Council should utilize
best practices, avoid discrimination,
encourage diversity, and may
incorporate the following concepts:

A. Projects must be competitively
bid. Contracts should be awarded to the
lowest responsible bidder as defined in
this Charter or the City should reject all
bids. The lowest responsible bidder may
be selected on the basis of the best value
to the City.

B. “Best value” means a
procurement process whereby the lowest
responsible bidder may be selected on
the basis of objective criteria for
evaluating the qualifications of bidders
with the resulting selection representing
the best combination of price and
qualifications.

C. Wages. The City Council may
establish criteria to determine whether a
project qualifies for payment of a
minimum wage different than that
ordinarily prevailing for work performed
on public works projects as defined by
California law. In lieu of paying a
minimum prevailing wage generally
required by California law for public
works projects, the City Council may
enter into a “project labor agreement”
that establishes terms and conditions of
employment for a specific construction
project or projects and is an agreement
described in 29 United States Code §
158(f). Notwithstanding any other part of
this Section, the City Council must pay
prevailing wage for public projects
erecting, improving, painting, or repairing
public buildings and projects.

VIII. Interpretation; City Council
Authority; Continuity of Existing
Laws.

A. Construction and Interpretation.

This Charter must be broadly construed
in order to achieve its purposes. It is the
intent of the voters that the provisions of
this Charter be interpreted and
implemented by the City in a manner that
liberally facilitates the City’s exercise of
powers regarding any matter that
constitutes a municipal affair.

B. The People acknowledge that
new information and future events may
demonstrate that interpretation of this
Charter is appropriate with respect to the
details of implementing this Charter. The
People desire, therefore, to retain a
certain degree of flexibility with respect to
the details of implementing those items
addressed in general terms in this
Charter. If and when, from time to time,
the City Council finds that interpretation
of this Charter is necessary, then such
interpretation may be accomplished by
written resolution adopted upon four-
fifths vote of all members of City Council.

C. City Council Authority. Except for
amendments that would frustrate the
powers and authority set forth in this
Charter, the City Council may exercise all
applicable powers set forth in the
California Government Code including,
without limitation, implementing all
aspects of this Charter by ordinance or
resolution.

D. Continuity. Nothing in this Charter
is intended to, nor does it, repeal any
provision of the Bellflower Municipal
Code as it existed on the effective date of
this Charter. Nor does the Charter affect
any penalty, forfeiture, or liability incurred
before, or preclude prosecution and
imposition of penalties for any violation
occurring before this Charter’s effective
date.

E. Severability. If any part of this
Charter or its application is deemed
invalid by a court of competent
jurisdiction, the People intend that such
invalidity will not affect the effectiveness
of the remaining provisions or
applications and, to this end, the
provisions of this Charter are severable.

F. Invalidity. If any portion of this
Charter is held by a court of competent
jurisdiction to be invalid, we the People
indicate our strong desire that: (i) the City
Council use its best efforts to sustain and
reenact that portion, and (ii) the City
Council implement this Charter by taking
all steps possible to cure any
inadequacies or deficiencies identified by
the court in a manner consistent with the
express and implied intent of this
Charter, and then adopting or reenacting
such portion as necessary or desirable to
implement this Charter.

G. Amendment. Any amendment to
this Charter must be accomplished by
then existing California law and with a
majority of voter approval.

분되어 있다.
다운스윙중 양팔을 의식적으
로 돌려가며 임팩트를 해야 한
다는 이론과 처음에는 양손을
돌리다 임팩트 순간에는 밀어내
는 기분으로 샷을 해야 한다는
두 가지 이론이다.
그러나 스윙은 기계나 반도체
의칩과같이예약된작업기능
과 기억력을 내장한 컴퓨터가
아닌 골퍼의 뇌로부터 지시받은
근육들의 순간운동이다.
탑스윙부터 임팩트 순간까지
의 시간은 0.5초, 눈 깜박할 사
이에 일어나는 행동 중에 양손
을 돌린다, 밀어낸다, 혹은 뇌로
부터 지시를 어떻게 받을 수 있
는 가이다.
또한 돌리거나 밀면서 타이밍
조절도 불가능한 것이며, 이같
이짧은시간내몸과스윙의일
치는 더욱더 불가능하다.
따라서 양손을 돌리거나 밀어
내는 골퍼들 대다수는 하체를 고

위기상황에서 볼을 밀어치거
나 돌려치는 방법도 있지만 이
렇게 샷을 만들어 치는 것은 확
고한 자신의 스윙이 있는 골퍼
에게 해당하는 것으로 욕구와는
완연히 다르다.
밥 숟가락 정도의 클럽타면과
콩알보다 더 작은 타점(sweet-
spot)에 볼을 정확히 맞춰도,
볼의 방향을 종잡을 수 없는 것
이골프샷이다.
볼을 칠 때까지 머리를 들지
말라는 의미는 여러 가지의 스
윙오류를 방지하는 목적도 있지
만 결론은 원심력을 만들기 위
함이다. 중심축(pivot axial)
이 확고하면 원심력이 살아나
클럽헤드에 힘이 모이고 그 힘
은 볼에 전달된다.
좋은 샷이란 최초의 어드레스
(set-up)상태로 어떻게 반전시
키는가에따라구질(샷)이결정
난다. 이것은 중심축을 기점으로
생겨나며축이움직이면이에따

트 은폐를 시도했다는 의혹을 규
명하기 위해 세계수영연맹에 증
인 출석을 요구했다.
당시 도핑 은폐 의혹이 제기된
중국 대표팀 선수 11명은 오는
26일 개막하는 파리올림픽에도
출전할 예정이어서 미국발 스포
츠 사정의 파장이 파리올림픽에
도 영향을 미칠지 관심을 끈다.
4일 AP 통신에 따르면 존 브렌
트 노위키 세계수영연맹 이사는
최근 미 연방수사국(FBI)으로부
터 2021년 도핑 은폐 의혹과 관련
해 증인으로 출석하라는 통보를
받았다. 선수들의 소변 샘플에서
나온 트리메타지딘은 혈류량 증
가체내산소공급을원활하게하
는 효과를 지닌 것으로 알려졌다.
당시 중국 측은 선수들이 소량
의 트리메타지딘 성분에 오염된
호텔 음식을 먹었기 때문에 발생
한 일이라고 주장했다.
세계 반 도핑기구(WADA)
는 이런 주장을 뒤집을 근거를
찾지 못했으며 선수들이 고의로
약물 성분을 복용하지 않았다고
판단, 선수 참가를 결정했다.

“As Supervisor for the First District, I take great pride in representing many AAPI ethnic enclaves such as Chinatown, Little Tokyo, Historic Filipinotown, and Thai Town, but also a large swath of the San Gabriel Valley – Los Angeles Coun- ty’s fi rst Asian American suburb,” said LA County Supervisor Hilda L. Solis, First District. “The composition of the Board of Supervisors must refl ect the increased diversity of Los Angeles County’s population. To that end, I support the governance re- form proposal by Chair Lindsey Horvath and Supervisor Janice Hahn because, at a time when residents are looking for greater transparency and representation from their elected offi cials, we must allow voters to determine what they want their County government to look like. This is about determining how we can most eff ectively represent the needs of residents from every zip code, every demographic, and every income level.”
At its July 9 meeting, the Board of Supervisors approved Supervisor Horvath and Hahn’s governance and ethics reform proposal. County Counsel is now drafting an ordinance to amend the Los Angeles County Charter, which was adopted in 1912 when the population was 500,000. The ordinance will return to the Board on July 23 for fi rst reading. If approved after a second reading, the proposal will go before voters as a charter amendment ballot measure this November.

This proposed change would create distinct executive and legislative branches of the government through a directly elected County Executive. The elected County Executive would function much like a Mayor, Governor, or President with the Board of Supervisors serving as the legislative branch like a City Council, State Legislature, or Congress.

Beyond the three key pillars of the proposal, additional reforms include establishing a commission to review the County Charter every ten years; creating a Director of Budget and Management and a County Legislative Analyst; requiring departments to pres- ent their annual budget in open hearings;

Vote Centers (the polls) will be open on Election Day between the hours of 7:00 a.m. and 8:00 p.m. The number of vote centers and the number of days vote centers will be open before Election Day in the City of Bellflower are yet to be determined by the Lo s Angeles County Registrar-Recorder/County Clerk.

같은 추가 투표 조치가 유권자에게 제시될 것임을 공지합니다.

벨플라워시 헌장은 벨플라워를 헌장을 채택한 시로 설립하기 위해 시 업무와
지방 법률에 더 많은 권한을 부여하여 시의 특별 요구에 부응하고, 토지 사용을
결정하는 데 있어 시에 더 많은 지역 통제권을 부여하고, 캘리포니아 주를
포함한 외부 기관의 영향력을 줄이며, 헌장에 대한 모든 변경 사항이 유권자의
승인을 받아야 하는 것이 승인되어야 합니까?

인쇄하는데 합리적으로 필요한 시간에 근거하여, 시 서기관은 2024년 7월 22일 정상 근무시간에
찬반론을 제출할 수 있는 마감 시간으로 정했으며, 이 시간 이후에는 선거법 § 9286에 규정된 대로 시 발의안에 대한 찬반론을 인쇄하여 유권자들에게 배포하기 위해 시 서기관에게 제출될 수 없음을
이에 공지하는 바입니다. 찬반론은 필자(들)의 인쇄체로 기재한 성명 및 서명과 함께 Bellflower City Hall, 16600 Civic Center Drive, Bellflower, California, 시 서기관에게 접수되어야 하고, 특정 단체를 대표하여 제출할 경우에는 단체명과 단체의 주요 임원 중 한 명이면서 찬반론 필자인 사람 최소한 한
명의 이름을 인쇄체로 기재하고 서명하여 제출하면 됩니다. 찬반론은 시 서기관이 정한 날짜까지만
변경하거나 철회할 수 있습니다.

반박하는 주장을 직접 제출하는 경우, 필자의 이름을 정자체로 기재하고 이를 제출할 수

หนังสือฉบับนี้จัดท าขึ้นเพื่อแจ้งให้ทราบว่าจะมีการเลือกตั้งพิเศษและเลือกตั้งสามัญระดับเทศบาล โดยจัดขึ้นในเมือง เบลล์ฟลาวเวอร์ ณ วันที่ 5 พฤศจิกายน 2024 ซึ่งจะมีการส่งมาตรการลงคะแนนเสียงเพิ่มเติมต่อไปนี้ให้แก่ผู้ลงคะแนน:

Pursuant to Assembly Bill No. 1416 dated September 29, 2022 amended Sections 303, 9050, 9051, 9053, 13282 and added 9170.

“정말 걱정이다. 중국에서 어떻게 아이를
키워야 할지 모르겠다.”
18일 중국 광둥성 선전시에서 벌어진 일
본인초등생흉기피습사건에대한한일
본인 남성의 반응이다. 10살짜리 피해 학
생은 병원에서 치료를 받다가 하루 만에
숨졌다. 등굣길을 함께 하던 부모도 참극
을막지못했다.
중국에서4년째거주중인그는“나에게
비슷한 일이 일어나지 않으리라는 보장이
없다”면서 “외국인의 안전을 지켜주겠다
는 중국 정부의 말을 믿을 수밖에 달리 어
쩔 도리가 없는 상황”이라고 수화기 건너
에서 걱정스럽게 말했다. 이제 막 4살이 된
그의 아이는 자택에서 도보 5분 거리에 있
는 유치원에 다닌다.
붙잡힌 피의자는 44세 중국인 남성이다.
범행 동기는 아직 공개적으로 드러나지 않
았다.중국당국은사건을추가조사중이
라고 했다. 그러나 사건 날짜를 두고 묘한
해석이 나온다. 93년 전 일제가 일으킨 만
주사변이 시작된 날이기 때문이다. 그동안
중국은 이날을 국치일로 지정하고 주요 도
시에서 추도식을 열어왔다. 반일감정이 이
번 범행의 기폭제가 됐을 거란 목소리가
나오는 이유다.
중국 내 일본인을 향한 공격은 꾸준히 이
어져 왔다. 지난 6월엔 장쑤성 쑤저우시에
서 중국인 남성이 일본인 모자에게 흉기를
휘둘렀다. 하교 중인 일본인 학교 스쿨버스
가 습격당했다. 이 남성을 막으려던 중국인
여성 안내원이 결국 숨졌다. 일본인 모자도
상처를 입었다. 지난해 8월엔 산둥성 칭다
오시 일본인 학교에 돌이 날아들었다.
비단 일본뿐 아니다. 곳곳에서 외국인을
대상으로 한 범죄가 이어졌다. 지난 6월 지
린성에서 미국인 대학 강사 4명이 흉기에
찔려 쓰러졌고, 지난 3월엔 쓰촨성에서 시
위 현장을 취재하던 네덜란드 기자들이 폭
행당했다. 그럴 때마다 중국 당국은 ‘우발
적 범죄’라는 점만 강조했다.
이러한 외국인 대상 범죄의 근간엔 ‘중
국식 애국주의’가 있다. 외국인을 배척하
고 맞서야 할 ‘적’으로 보는 인식이다. 외
국 기업 불매운동이 대표적이다. 결국 강
력 사건까지 벌어졌다. 관영 매체들은 그
제야 비판의 목소리를 내고 있다.
중국에 촘촘히 뿌려진 ‘혐오의 씨앗’은
싹을 틔우고 꽃을 피우고 있다. 어떤 열매
를맺을것인지불보듯뻔하다.이를방조
해왔다는 눈초리를 받는 중국 당국도 책임
에서 벗어날 수 없다. “효과적인 조치를 취
해 모든 외국인의 안전을 실질적으로 보호
하겠다”는 말이 공염불에 그치지 않길 바
란다.

한인회가어떤일을하는단체죠?이런
질문에선뜻답을내놓을수있는사람
은 많지가 않다. 한인이 사는 곳이면 어
디든 있을 정도로 한인회라는 조직은 많
지만 역할에 대한 명확한 규정은 어렵다.
그래서 한인회라는 명칭은 친숙하면서
도낯설다.
수많은 한인회 가운데 대표를 꼽으라면
아마 LA 한인회일 것이다. 규모나 역량 면
에서 그렇다는 의미다. 이런 LA 한인회를
들여다보면 한인회의 존재 이유도 어느 정
도알수있지않을까싶다.

LA 한인회 웹사이트에 소개된 설립
목적을보면한인사회공익대변과한인
단체의 구심점 역할, 한·미 양국의 각종
정보 제공, 한인 사회 위상 제고로 되어
있다.
주요 업무 내용은 더 다양하다. 주류 사
회와 한인 사회 연결,한인들의 권리와 공
익 보호, 소비자 문제 상담, 문제 해결 중
재, 각종 정보 제공 및 확인, 통역 및 서류
작업 지원, 고용 추천 서비스, 법률,복지제
도 상담, 세미나 워크숍, 사회복지 혜택 상
담, 차세대 지도자 육성, 이민자 지원 서비
스 등 12가지나 된다. 모두 필요한 일들이
긴 하지만 지금 역량으로 가능할까?라는
생각이 들 정도다.

LA 한인회는 비영리 봉사단체고, 회장
자리는 명예직이다. 역대 회장 대부분이 본
업은 따로 있고 한인 사회를 위해 봉사하
겠다며 나선 분들이었다. 물론 회장 역량
에 따라 성과에서 차이를 보였지만 전체적
으로는 큰 틀을 벗어나지 못했다. 한인회
라는 조직의 태생적 한계 때문이다. 예산
이 부족하면 회장이나 이사장이 주머닛돈
으로 메우는 경우도 많았다. 이런 상황이
다 보니 한인회에 분발을 촉구하기도 모호
한 구석이 있었다.

LA 한인회가 주목받을 때도 있었다. 회
장 선거 시즌이 그때다. 특히 2000년대로
접어들면서 LA 한인회장 선거는 과열 양
상을 보였다. 한동안은 선거 때마다 분란
이 생겼을 정도다. 갈등의 골이 깊어져 법
원에 호소하기도 하고, 2명의 회장이 선출
되는 해프닝도 있었다. 이런 볼썽사나운 모
습에 한인회 무용론 주장이 불거지기도
했다. 당시의 분란 원인을 복기해 보면 대
부분이 주먹구구식 업무 처리와 불투명한
운영이 발단이었다.
그러던 LA 한인회에 변화가 생기기 시
작한 것은 코로나 19 펜데믹 시기였다. 당
시 정부의 다양한 지원 프로그램들이 쏟
아졌지만 한인들이 도움을 받을 만한 곳
은 없었다. 이때 발 벗고 나선 곳이 LA
한인회다. 펜데믹 기간에도 사무실 문을
열고 상담을 하고 신청을 도왔다. 자연히
한인회를 바라는 한인들의 시각에도 변화
가 생겼다. 있느나 마나한 단체에서 필
요한 단체라고 생각하는 사람이 많아진
것이다.
펜데믹이후한인사회도전환의시기
를 맞고 있다. 가장 근본적인 것이 인구 구
성의 변화다. 한인 1세들의 은퇴는 늘고
있지만, 신규 이민자는 줄고 있다. 그 격
차를1.5세와2세들이일부메우는상황이
다. 이처럼 한인 사회가 달라지고 있다면
한인회도 변해야 한다.
지금의 한인회라는 틀은 수십 년 전 이
민 1세들이 만든 것이다. 그때와 지금의
상황은 너무나 차이가 있다. 과거에 만들
었던 틀은 이제 제 역할을 다했다고 볼 수
있다. 달라진 환경에 맞는 새로운 한인회
로의 체질 개선이 필요하다.
조만간 차기 LA 한인회장 선거가 있다
고 한다. 벌써 자천타천으로 몇몇 후보가
하마평에 오르는 모양이다. 한인 사회를
위해 활동하겠다는 의욕을 보이는 사람들
이 있다니 반갑다. 다만 LA 한인회장 선
거에 나서려는 후보들이 염두에 둬야 할
것이 있다. 그것은 LA 한인회도 전환기를
맞고 있다는 사실이다. 과거처럼 단순히
명예직으로 생각하고 회장에 나설 일이 아
니라는 의미다.
한인 사회의 변화에 맞게 한인회 조직
과 역할에 새로운 청사진을 제시할 수 있
는 인물이 차기 회장이 되는 것이 바람직
하다. LA 한인회가 새로운 길을 개척해
야 수많은 한인회의 생존도 가능하다.
