14-E
TO:Honorable Mayor and Members of the City Council
ATTENTION:Ryan Smoot, City Manager
FROM:Len Gorecki, Assistant City Manager/Director of Public Works Melanie Paz, Management Analyst II
SUBJECT:Consideration and possible action to adopt Resolution No. 25-26 – A Resolution authorizing the submittal of Used Oil Payment Program Applications to the Department of Resources Recycling and Recovery (“CalRecycle") for the next five fiscal years.

DATE:June 23, 2025

EXECUTIVE SUMMARY
This action would authorize the City to submit Used Oil Payment Program (“OPP”) applications to CalRecycle for the next five fiscal years.

RECOMMENDATION TO CITY COUNCIL
1) Adopt Resolution No. 25-26; or
2) Alternatively, discuss and take other action related to this item.

FISCAL IMPACT
The City’s Used OPP amount for Fiscal Year 2025-2026 will be calculated by CalRecycle in September 2025. The anticipated revenue ranges from $10,000 to $15,000 annually.

BACKGROUND
The California Oil Recycling Enhancement Act requires the State of California to provide funding to local governments for the development and operation of local used oil collection programs. Senate Bill 546 established the OPP, which provides used oil recycling funds to local governments. To be eligible for funding, the City needs to submit an OPP application to CalRecycle by June 30th each year. The attached Resolution would authorize the City to submit OPP applications to CalRecycle for the next five fiscal years.

The OPP funds will be used to educate the community about the proper recycling of used oil through the implementation of various programs. Current and previous programs include making presentations at local elementary schools, distributing used oil recycling educational materials at City events, monitoring used oil collection centers in the City, conducting used oil filter exchange events, and advertising used oil recycling through public service announcements in local newspapers.

CITY OF BELLFLOWER
RESOLUTION NO. 25-26

A RESOLUTION AUTHORIZING THE SUBMITTAL OF USED OIL

PAYMENT PROGRAM APPLICATIONS TO THE DEPARTMENT OF
RESOURCES RECYCLING AND RECOVERY (“CALRECYCLE”) FOR

THE NEXT FIVE FISCAL YEARS
THE CITY COUNCIL RESOLVES AS FOLLOWS:

SECTION 1. The City Council finds and declares as follows:

A.Pursuant to Public Resources Code § 48690, CalRecycle established the Used Oil Payment Program (“OPP”) to make payments to qualifying jurisdictions for implementation of their used oil programs; B.In furtherance of this authority, CalRecycle is required to establish procedures governing the administration of the Used Oil Payment Program; C. CalRecycle’s procedures for administering the Used Oil Payment Program require, among other things, an applicant’s governing body to declare by resolution certain authorizations related to the administration of the Used Oil Payment Program; and
D. This Resolution is adopted based upon the evidence submitted during the June 23, 2025, City Council meeting including, without limitation, all documents presented to the City Council and public testimony.

SECTION 2. The City Council of the City of Bellflower authorizes the submittal of Used Oil Payment Program applications to CalRecycle and the City Manager, or designee, as agent of the City, is authorized and empowered to execute, on behalf of the City, all documents, including, without limitation, applications, agreements, annual reports (including expenditure reports), and amendments necessary to secure said payments to support the City’s Used Oil Recycling Program.

SECTION 6.Limitations.The City Council’s analysis and evaluation of the project is based on the best information currently available. It is inevitable that in evaluating a project that absolute and perfect knowledge of all possible aspects of the project will not exist. One of the major limitations on analysis of the project is the City Council’s lack of knowledge of future events. In all instances, best efforts were made to form accurate assumptions. Somewhat related to this are the limitations on the City's ability to solve what are in effect regional, state, and national problems and issues. The City must work within the political framework within which it exists and with the limitations inherent in that framework.

SECTION 7.Reliance On Record. Each and every one of the findings and determinations in this Resolution are based on the competent and substantial evidence, both oral and written, contained in the entire record relating to the project. The findings and determinations constitute the independent findings and determinations of the City Council in all respects and are fully and completely supported by substantial evidence in the record as a whole.

SECTION 8.Summaries of Information. All summaries of information in the findings, which precede this section, are based on the substantial evidence in the record.

The absence of any particular fact from any such summary is not an indication that a particular finding is not based in part on that fact.

SECTION 9.Construction. This Resolution must be broadly construed to achieve the purposes stated in this Resolution. It is the City Council’s intent that the provisions of this Resolution be interpreted or implemented by the City and others in a manner that facilitates the purposes set forth in this Resolution.

SECTION 10.Severability. If any part of this Resolution or its Application is deemed invalid by a court of competent jurisdiction, the City Council intends that such invalidity will not affect the effectiveness of the remaining provisions or applications and, to this end, the provisions of this Resolution are severable.

SECTION 11.Electronic Signatures. This Resolution may be executed with electronic signatures in accordance with Government Code §16.5. Such electronic signatures will be treated in all respects as having the same effect as an original signature.

SECTION 12. The Mayor, or presiding officer, is authorized to affix its signature to this Resolution signifying its adoption by the City Council of the City of Bellflower, and the City Clerk, or its duly appointed deputy, is directed to attest.

SECTION 13.Effective Date. This Resolution will become effective immediately upon adoption and will remain effective unless repealed or superseded. ///
