4-A

TO: Honorable Mayor and Members of the City Council

ATTENTION: Ryan Smoot, City Manager

FROM: Jim DellaLonga, Director of Economic Development

SUBJECT: Consideration and possible action to authorize the City Manager to execute an Assignment and Assumption Agreement to acquire a deed of trust, and associated note, affecting real property at 9849 Flower Street.

DATE: September 9, 2025

EXECUTIVE SUMMARY

Executing an assignment and assumption agreement with Vickie Ann Ruiter and William R. Van Setten would result in the City owning the deed of trust and associated note affecting real property located at 9849 Flower Street for $743,750. This property includes an approximately 5,532 square foot, two-story commercial building on 6,301 square feet of land.

RECOMMENDATION TO CITY COUNCIL

1) Authorize the City Manager to execute an assignment and assumption agreement, in a form approved by the City Attorney, to acquire a deed of trust, and associated note, affecting real property at 9849 Flower Street; or

2) Alternatively, discuss and take other action related to this item.

FISCAL IMPACT

The deed of trust and associated note for the real property located at 9849 Flower Street are valued at $743,750. Funding is available in the General Fund Property Acquisitions Reserve for the purchase of the deed of trust and the associated note.

DISCUSSION

In August 2025, the Van Settens, the note holders of the property at 9849 Flower Street (the “Property”), contacted the City regarding the potential acquisition of the deed of trust and associated note affecting the Property. The Property consists of one parcel containing a 5,532 square foot two-story building and parking lot (APN 7109-013-031) on a 6,301 square foot parcel.

The building is currently occupied by four tenants and the property owner.

The Director of Economic Development believes acquiring the deed of trust and associated note will provide the City with an opportunity to potentially acquire the property through a future action.

The property represents an important asset in the downtown that will contribute to this area’s economic growth. As part of this process, the City reviewed recent comparable sales in Downtown Bellflower which supports the negotiated purchase price of $743,750 for the note, agreed to by the Van Settens.
