4 CONSIDERATION ITEMS
Item No. 4-A
A Consideration and possible action to authorize the City Manager to execute an assignment and assumption agreement to acquire a deed of trust, and associated note, affecting real property at 9849 Flower Street.
Assistant City Manager/Director of Public Works Gorecki introduced the item.
Director of Economic Development DellaLonga 1) provided a verbal presentation of the Staff Report; and 2) responded to Council Members' questions.
At the request of Mayor Dunton and Mayor Pro Tem Santa Ines, Director DellaLonga confirmed 1) the recommendation is to only acquire the deed of trust and associated note for the property at this time; and 2) sufficient funds are available in the General Fund Property Acquisitions Reserve for the purchase of the associated note.
In response to questions and comments provided by Council Member Koops, Director DellaLonga explained that the current property owner pays interest only payments with an interest rate of 7.5%, further confirming that if the City acquired the associated note, the interest rate would remain at 7.5%.
For the record, 1) Council Member Koops expressed support for the acquisition of the deed of trust and associated note, expressing the opinion that the interest rate of the associated note is better than the interest rate of a "regular savings"; and 2) Council Member Sanchez expressed support for the acquisition of the deed of trust and associated note, expressing the opinion that the property is an important asset in the downtown.
It was moved by Mayor Pro Tem Santa Ines, seconded by Council Member Koops, and carried by the following roll call vote, to authorize the City Manager to execute an assignment and assumption agreement, in a form approved by the City Attorney, to acquire a deed of trust, and associated note, affecting real property at 9849 Flower Street:
