SUBJECT: Consideration and possible action to authorize the City Manager to execute Amendment No. 5 to Agreement File No. 923, in a form approved by the City Attorney, with Craftwater Engineering, Inc., for additional work to complete grant applications for the Simms Park Stormwater Capture Project.

EXECUTIVE SUMMARY
This action would authorize the City Manager to execute Amendment No. 5 to Agreement File No. 923 with Craftwater Engineering Inc. (“Craftwater”), for the preparation of grant applications and coordination for additional funding for the Simms Park Stormwater Capture Project. Additionally, this amendment will realign funding in existing tasks in order to align more closely with the actual work being provided.
RECOMMENDATION TO CITY COUNCIL
1) Authorize the City Manager to execute Amendment No. 5 to Agreement File No. 923, in a form approved by the City Attorney; or
2) Alternatively, discuss and take other action related to this item.
FISCAL IMPACT
Amendment No. 5 would add $45,000 to Agreement File No. 923, for a total not to exceed amount of $1,499,972. Funding is included in the Public Works Capital Improvement Projects Budget for FY2025-26 under Account No. 320-47013-9000 (Measure W – Safe Clean Water Program Funds).
DISCUSSION
On February 14, 2022, the City entered into Agreement File No. 923 with Craftwater for the design of the Simms Park Stormwater Capture Project. Amendment No. 1 included additional funding for environmental review and CEQA documentation while Amendments 2, 3 and 4 have been simple term adjustments.

DISCUSSION – Continued
The proposed Amendment No. 5 would include an additional $45,000 for Craf twater to incorporate design changes to the project plans, develop and submit a competitive grant application for the Los Angeles County Regional Park and Open Space District – Measure A Competitive Grant and provide for a small contingency of funding for additional work if necessary. Additionally, this amendment will realign funding in existing tasks in order to align more closely with the actual work being provided.
