SUBJECT: Consideration and possible action to conduct a public hearing to authorize the recording of a Notice of Special Assessment for Nuisance Abatement against the owner of 9070 Artesia Boulevard; and adopt Resolution No. 26-03 – A Resolution to record a Notice of Special Assessment for Nuisance Abatement of 9070 Artesia Boulevard (APN 7162-011-011).

DATE: January 26, 2026

EXECUTIVE SUMMARY

During the past several years, the parcel located at 9070 Artesia Boulevard, APN 7162- 011-011 (the “Property”) has consistently been in a state of vacancy and blight, among other violations of the Bellflower Municipal Code (“BMC”) amounting to public nuisances.

On October 26-29, 2024, City staff engaged in abatement of public nuisances on the Property, for which the City previously passed a resolution authorizing the recording of a special assessment lien (“January 2025 Resolution”). The City continued its enforcement efforts at the Property through 2025. These efforts culminated in the testing and remediation of toxic materials at the vacant structure located on the Property prior to its demolition.

The City Attorney accordingly recommends that the City Council adopt a Resolution authorizing the recording of a public nuisance abatement lien on the Property in order to recoup by special tax assessment the City’s costs of abating violations of the BMC.

RECOMMENDATION TO CITY COUNCIL:

1. Open the public hearing, take testimonial and documentary evidence; and after considering the evidence, adopt Resolution No. 26-03 to record a notice of special assessment for nuisance abatement on the owner of 9070 Artesia Boulevard (approved via Resolution No. 26-03, adopted January 26, 2026); or

2. Alternatively, take other actions related to this item.

FISCAL IMPACT

Adopting this Resolution is expected to result in recouping a substantial portion, if not all, of the City’s abatement costs to date related to the Property. The City will recover its abatement costs by placing a lien on the Property and by adding the costs as a direct assessment on the property tax rolls.

BACKGROUND AND ANALYSIS

On May 13, 2019, the City Council adopted Ordinance No. 1375. This ordinance created Chapter 8.40 of the BMC (“Chapter 8.40”) to specifically abate such blight with certain design and maintenance requirements for all vacant properties not in an active stage of development. Among the requirements of Chapter 8.40 is that improved vacant lots with existing on-site buildings or structures must have buildings be maintained in good condition, must maintain good conditions for all existing on-site landscaping, must be free of weeds and overgrown vegetation, have uniform ground cover, and that all portions of the perimeter along the streets include fencing and landscaping, all approved by the City Planner.

The Property is a commercial property located at 9070 Artesia Boulevard in the City of Bellflower (“City”), Accessor Parcel Number 7162-011-011. The Property has a history of being a blight in the community, as demonstrated by the accumulation of overgrown vegetation, inoperable vehicles, bee hives, graffiti, and trash, junk and debris.

The Property owner is JJR Holdings, LLC. (“Owner” or “Property Owner”). The City has also been in contact with Miguel Gonzalez, Jr., who is the owner’s designated representative with the City regarding the Property.

In 2023, Code Enforcement initiated enforcement action with the Property, due to violations of the following: BMC § 8.36.030(A)(11) – Overgrown vegetation; BMC § 8.36.030(A)(14) – Outside Storage; BMC § 8.36.030(A)(24) – Graffiti; BMC § 8.36.030(A)(2) – Unfinished Construction; BMC § 15.04.010 – Expired Building Permits; BMC § 15.04.010 – Unpermitted Construction; BMC § 8.36.030(A)(18) – Inoperable Vehicles; and BMC § 8.36.030(A)(16) – Accumulation of Trash, Junk, Debris, etc.

Enforcement efforts stalled due to the Property being transferred to the current owner at the end of 2023. On October 23, 2024, the City sought and was granted an abatement warrant by the Los Angeles County Superior Court to address these issues.

After no response from ownership, on October 24 and October 29, 2024, the City executed the abatement warrant. Abatement included removing inoperable vehicles; trimming overgrown vegetation; painting the front of the building; painting over graffiti; removing trash, junk, and debris; removing two beehives ; and securing the Property.

Enforcement efforts concerning the vacant, red-tagged structure at 9070 Artesia Boulevard, nuisances related to the bar at 9080 Artesia Boulevard, and substandard conditions with residential units at 17427 Virginia Avenue were thereafter still ongoing.

The City continued to receive multiple complaints of intrusions by homeless individuals at the Property. City Personnel confirmed that the Property was not secure from trespassers.

On February 3, 2025, the City obtained a second abatement warrant from the Honorable Judge Warren Kato to re-secure the Property after being unable to gain voluntary compliance with this nuisance. This warrant ordered City Personnel to enter onto the Property to (1) board up and otherwise secure all known and potential access poi nts to the structure; (2) fill the trench on the west side of the structure; and (3) re -key all damaged locks on the structure and make those keys available to the Property’s ownership. On February 4th, the City executed this warrant.

BACKGROUND AND ANALYSIS – Continued

After the City’s February 2025 abatement, the primary nuisance condition of the Property, and its dilapidated, vacant structure in particular, did not improve, despite ownership’s promises. On May 27, 2025, the City obtained a third abatement warrant from the Honorable Warren Kato, Judge, who ordered the demolition of the vacant structure at the Property. This warrant was designed to be executed in two phases: Phase 1 allowed City personnel to, among other things, enter the vacant structure and surrounding area to secure it, as well as conduct inspections, test for toxic materials, and conduct any required remediation for toxic materials as a precursor to demolition; Phase 2 extended the abatement warrant to demolish the vacant structure if the Property Owner did not follow through in good faith towards demolition immediately upon completion of toxic material remediation.

Due to unanticipated delays in completing the required toxic material testing and remediation, the City obtained two extensions of the original May 2025 abatement warrant on July 23, 2025, and another on October 2, 2025. By November 12, 2025, all required testing and remediation had been completed, at which time the Property Owner took over and completed demolition of the Vacant Structure leaving the pad covered with mulch and surrounded by white Kentucky-style fencing to mitigate against blight. This brought the vacant structure into compliance with the abatement warrant.

On December 17, 2025, the City Attorney’s Office sent the Owner and related parties a demand for $227,872.94 representing the City’s abatement -related costs (attached as Exhibit A to the Resolution). This included an itemization of all abatement-related costs and informed that if not paid in full by 4:00 p.m. on January 26, 2026, this Resolution would be presented to the City Council at its regularly scheduled meeting on January 26, 2026, at 7:00 p.m. if any representative of the Property wished to be he ard on it. On January 23, 2026, the City Attorney’s Office sent the Owner a revised Demand Letter, reducing the fees demanded by $29,304.07. The revised accounting, totaling $198,568.87, is attached as Exhibit B to the Resolution.

The City has not received any payment towards abatement costs as of this date or any indication whether the Property intends to challenge the cost demand .

RECOMMENDATION

It is our recommendation that the City Council move forward with adopting this Resolution authorizing the recording of this lien against the Property to be collected by special property tax assessment.

Re: REVISED DEMAND LETTER
9070 Artesia, Bellflower, CA 90706
APNs 7162-011-011

Dear Jaime Alejandre:

As you are aware, this law firm serves as the City Attorney’s Office for the City of Bellflower (“City”), and I serve as its Deputy City Attorney. I am writing here with revised notice of the City’s determination of collection by special assessment of the full cost of its abatement efforts to bring your property at 9070 Artesia Boulevard (“Property”) into compliance with the health and safety requirements of Bellflower Municipal Code (“BMC”) § 8.36 and vacant lot requirements of BMC § 8.40. Please disregard the first demand letter you were sent on December 17th as it inadvertently excluded pertinent costs.

On May 23, 2024, the City obtained an inspection warrant from the Honorable Judge Warren Kato, Judge of the Los Angeles Superior Court. The warrant ordered City personnel to enter upon the Property and, among other things, inspect all areas of both 9070 and 9080 Artesia. On June 4, 2024, the inspection warrant was executed. A locksmith was required to gain access to the properties. These costs are included in the attached Exhibit A.

Jaime Alejandre

On October 23, 2024, the City obtained the first of three abatement warrants for the Property, this one being from the Honorable Deborah Sanchez, Judge of the Los Angeles Superior Court. The warrant was executed on or about October 24 and October 29, 2024. The abatement included removing inoperable vehicles; trimming overgrown vegetation; painting the front of the building; removing trash, junk, and debris; removing one of two beehives and securing the Property. An accounting of these costs is included in the attached Exhibit A.

After receiving multiple complaints of intrusions by homeless individuals at the Property, City Personnel confirmed that the Property was not secure from trespassers.

On February 3, 2025, the City obtained a second abatement warrant from the Honorable Judge Warren Kato to re-secure the Property after being unable to gain voluntary compliance with this nuisance. This warrant ordered City Personnel to enter onto the Property to (1) board up and otherwise secure all known and potential access points to the structure; (2) fill the trench on the west side of the structure; and (3) re-key all damaged locks on the structure and make those keys available to the Property’s ownership. On February 4th, the City executed this warrant. An accounting of these costs is included in the attached Exhibit A.

After the City’s February 2025 abatement, the primary nuisance condition of the Property, and its dilapidated, vacant structure in particular, did not improve, despite ownership’s promises. On May 27, 2025, the City obtained a third abatement warrant from the Honorable Warren Kato, Judge, who ordered the demolition of the vacant structure at 9070 Artesia Blvd. (“Vacant Structure”). This warrant was presented in two phases. Phase 1 allowed City personnel to, among other things, enter the vacant structure and surrounding area to secure it, as well as conduct inspections, test for toxic materials, and conduct any required remediation for toxic materials as a precursor to demolition. Phase 2 extended the abatement warrant to demolish the Vacant Structure if you, the Property Owner, did not follow through in good faith towards demolition.

Due to unanticipated delays in completing the required testing and remediation, the City sought two extensions of the May 2025 abatement warrant. The Honorable Judge Kato signed one extension on July 23, 2025, and another on October 2, 2025. By November 12, 2025, all required testing and remediation had been completed, at which time your crews completed demolition of the vacant structure.

Please be advised that pursuant to BMC Chapter 8.361, the City is entitled to recover its abatement-related costs from you.

The City has determined abatement costs up to the present total to be $227,872.94. This amount is subject to increase until final payment is made as further legal fees accumulate to collect these outstanding costs.

Please be advised that you have until January 26, 2026, at 4:00 p.m. to remit to the City the total sum of $227,872.94 by cashier’s check only to avoid the City seeking and imposing a special assessment lien on the Property. Payment should be made out to “City of Bellflower,” should reference “Abatement reimbursement for 9070 Artesia Boulevard,” and should be submitted in person or mailed.

Please be further advised that pursuant to BMC § 8.36.180(D):

D. A responsible person has the right to contest a statement of abatement costs by filing a written request for contest with the City Clerk's office (located at 16600 Civic Center Drive, Bellflower, California) within 10 calendar days of service of the statement of abatement costs.

1. A written request for contest will contain the following information:
a. Name, address, telephone number, and signature of each responsible party who is contesting the statement of abatement costs;
b. Address and description of real property upon which the City abated a public nuisance;
c. Date of the statement of abatement costs being appealed; and d. Description of the specific abatement cost being contested, and a statement of the grounds for contest in sufficient detail to enable the City Council to understand the nature of the controversy.

1 The Bellflower Municipal Code may be accessed at https://ecode360.com/BE4904 .

2. Except as otherwise provided by applicable law, all filing fees applicable to this chapter will be established by City Council resolution.

Such charges will be determined by the department and be based on the actual cost incurred by the City in providing services. Such service charges will include, without limitation, charges for labor, supervision, overhead, administration and the use of any and all City equipment, and supplies.

Please be further advised that pursuant to BMC § 8.36.190(A), “[t]he City may cause a special assessment to be made upon real property upon which a public nuisance was abated pursuant to Government Code Section 38773.5 in the event a statement of abatement costs or a confirmed statement of abatement costs is not paid in a timely manner.”
Please be further advised pursuant to BMC § 8.36.190(B), I am required to provide you with the following advisal:

The property may be sold after three years by the tax collector for unpaid delinquent assessments. The tax collector’s power of sale shall not be affected by the failure of the property owner to receive notice. The assessment may be collected at the same time and in the same manner as ordinary municipal taxes are collected, and shall be subject to the same penalties and the same procedure and sale in case of delinquency as provided for ordinary municipal taxes. All laws applicable to the levy, collection and enforcement of municipal taxes shall be applicable to the special assessment. However, if any real property to which the cost of abatement relates has been transferred or conveyed to a bona fide purchaser for value, or if a lien of a bona fide encumbrance for value has been created and attaches thereon, prior to the date on which the first installment of the taxes would become delinquent, then
the cost of abatement shall not result in a lien against the real property but instead shall be transferred to the unsecured roll for collection.

Please be further advised of the following pursuant to BMC § 8.36.190:

C. The City Attorney or City Prosecutor shall establish the notice of special assessment form for use or consideration by the Tax Collector in collecting a special assessment.

Jaime Alejandre
December 17, 2025

Page 5 ends

D. The notice of special assessment shall be entitled to recordation with the Los Angeles County Recorder’s office.

E. The amount of a special assessment shall also constitute a personal obligation of the property owners of land upon which the nuisance was abated.

Please be further advised that on January 26, at 7:00 p.m., a resolution will be brought before the Bellflower City Council at its regularly scheduled council meeting to authorize a special assessment for the collection of all abatement costs pursuant to BMC § 8.36.190. You are free to attend this meeting and be heard by the City Council on this matter or otherwise challenge this resolution to record the lien against your Property. If you want to challenge the amount of this Demand, follow the procedures pursuant to BMC § 8.36.180(D), as referenced above, and that matter also will be calendared for January 26, at 7:00 p.m.

Please be further advised that this demand encompasses the City’s abatement- related costs for this Property up through the two abatement actions taken in 2024 and 2025. The first abatement only addressed certain violations at the Property that required immediate attention and that could be remedied relatively quickly. The Property remained in substantial violation of the BMC, primarily relating to unsafe structure(s) and blight, and which must still be abated. The City determined that the Vacant Structure located at 9070 Artesia Blvd. was an imminent threat to public safety and private property, and an overall blight to the community. The abatement actions taken to date and this demand to recoup those abatement costs in no way precludes the City from continuing its enforcement action with the Property for remaining violations as stated herein and in prior correspondence.

Please feel free to contact me with any questions you may have.

Sincerely,

BURKE, WILLIAMS & SORENSEN, LLP
