SUBJECT: Consideration and possible action to authorize the City Manager to execute Amendment No. 7 to Agreement File No. 923, in a form approved by the City Attorney, with Craftwater Engineering, Inc., for additional work required for the Simms Park Stormwater Capture Project.

EXECUTIVE SUMMARY
This action would authorize the City Manager to execute Amendment No. 7 to Agreement File No. 923 with Craftwater Engineering Inc. (Craftwater), for the additional work required to update the design and plans to conform with the 2025 California Building Code requirements and well as provide for additional project management for the Simms Park Stormwater Capture Project.
RECOMMENDATION TO CITY COUNCIL
1) Authorize the City Manager to execute Amendment No. 7 to Agreement File No. 923, in a form approved by the City Attorney; or
2) Alternatively, discuss and take other action related to this item.
FISCAL IMPACT
Amendment No. 7 would add $124,001 to Agreement File No. 923, for a total not to exceed amount of $1,637,058. Funding is included in the Public Works Capital Improvement Projects Budget for FY2025-26 under Account No. 320-47013-9000-106 (Measure W – Safe Clean Water Program Funds).
DISCUSSION
On February 14, 2022, the City entered into Agreement File No. 923 with Craftwater for the design of the Simms Park Stormwater Capture Project. Amendment No. 1 included additional funding for environmental review and CEQA documentation while Amendments 2, 3 and 4 have been simple term adjustments. Amendment No. 5 included additional funding for grant application and coordination for additional funding request from the Safe Clean Water Program.

DISCUSSION – Continued
Amendment No. 6 extended the term of the contract and included an additional $13,085 for Craftwater to complete additional structural design services. The proposed Amendment No. 7 includes an additional $124,001 to provide additional design services to update the structural design and plans to conform to the 2025 California Building Code as well as provide additional project management services to complete these updates.
This work is required to complete the final plans for the project. -2-
