15-C
TO: Honorable Mayor and Members of the City Council
ATTENTION: Ryan Smoot, City Manager
FROM: Anna Garan, Director of Finance
SUBJECT: Consideration and possible action to adopt Resolution No. 26-16 – A Resolution declaring unclaimed monies as property of the City of Bellflower and transferring it to the City’s General Fund pursuant to Government Code § 50053.
DATE: May 11, 2026
EXECUTIVE SUMMARY
Adopting the attached Resolution will transfer unclaimed money that has remained in the City’s possession for at least three years (one year for unclaimed money in an amount that is less than $15) into the City’s General Fund. Unclaimed money may be escheated to the City’s General Fund pursuant to Government Code §§ 50050 to 50055, as described in the City’s Administrative Policies and Procedures No. 8, provided that the City first publishes notice in a newspaper of general circulation once a week for two successive weeks. Unless claimed or challenged by a verified complaint, the unclaimed monies become the property of the City at least 45 days, but no more than 60 days, after the initial public notice pursuant to Government Code §§ 50050 and 50051. The Director of Finance caused notice to be published in the Los Cerritos Community Newspaper once a week for two successive weeks beginning March 6, 2026, and continuing through March 13, 2026 (the “Notice”). The Director of Finance has not received any claims or complaints concerning the unclaimed monies.
RECOMMENDATION TO CITY COUNCIL
1)Adopt Resolution No. 26-16; and
2) Approve a budget amendment authorizing the transfer of escheated substation rent checks to the General Fund Capital Projects Fund for the future Public Safety Facility; or
3) Alternatively, discuss and take other action related to this item.
FISCAL IMPACT
If Resolution No. 26-16 is adopted, then unclaimed monies totaling $55,853.23 will be transferred to the City’s General Fund.

Staff Report – Resolution No. 26-16, Unclaimed Monies
May 11, 2026
BACKGROUND
Escheat is a legal process of transferring ownership of unclaimed property to a governmental entity by operation of law. California Government Code §§ 50050 to 50055, as described in the City’s Administrative Policies and Procedures No. 8, implements a legal process for the City to escheat unclaimed monies and transfer them to the General Fund.
To escheat the unclaimed monies to the City, Government Code § 50051 requires the City to publish in a local newspaper of general circulation a public notice which states the amount of money ($15.00 or greater and at least three years old), the fund in which it is held, and that it is proposed that the monies will become the property of the City on a designated date not less than 45 days nor more than 60 days after the first publication of the notice. Unless claimed or challenged by a verified complaint by the designated due date in the public notice, unclaimed monies become the property of the City and the City Council may transfer the funds to the General Fund. Pursuant to Government Code § 50055, individual unclaimed monies less than $15.00 and at least one year old may be transferred to the General Fund by the City Council without the necessity of public notification in the local newspaper.
The required notice was published once a week for two successive weeks beginning March 6, 2026, and continuing through March 13, 2026, in the Los Cerritos Community Newspaper, and identified the escheat date as May 5, 2026. The Notice listed unclaimed monies totaling $55,853.23, of which $43,884.00 were for substation rent payments made to the “Andrea B. Calip Trust” (period from April 2022 to March 2023; net of federal and state income tax withholdings and certain other deductions). The trustee of the Andrea B.
Calip Trust has not cashed any of the rent checks from April 2022 to March 2023.
Accordingly, this is unclaimed money that has remained in City possession for at least three years.
Staff has received no claims nor written comments concerning the unclaimed monies by the due date designated in the public notice of May 5, 2026. Exhibit A to Resolution No. 26-16 contains a list of the unclaimed monies in the public notice ($15.00 or greater and at least three years old) that remain unclaimed and/or unchallenged by the escheat date. There are no unclaimed monies under $15.00 and at least one year old that are eligible to be escheated.

CITY OF BELLFLOWER
RESOLUTION NO. 26-16
A RESOLUTION DECLARING UNCLAIMED MONIES AS PROPERTY OF
THE CITY OF BELLFLOWER AND TRANSFERRING IT TO THE CITY’S GENERAL FUND PURSUANT TO GOVERNMENT CODE § 50053
THE CITY COUNCIL RESOLVES AS FOLLOWS:
SECTION 1. Recitals. The City Council finds and declares as follows:
A. This resolution escheats $55,853.23 in unclaimed money to the City.
B. Government Code §§ 50050, et. seq., establishes a legal process for the City to escheat unclaimed monies and transfer them to the General Fund.
C. A public notice was duly published once a week for two successive weeks beginning March 6, 2026, and continuing through March 13, 2026, in the Los Cerritos Community Newspaper, and identified the escheat date as May 5, 2026.
D. The City did not receive any claims or written comments concerning the unclaimed monies on or before May 5, 2026.
E. The City reviewed this Resolution’s environmental impacts under the California Environmental Quality Act (Public Resources Code §§ 21000, et seq., “CEQA”), the regulations promulgated thereunder (14 Cal. Code of Regulations §§15000, et set., the “CEQA” Guidelines”), and the City’s Environmental Guidelines.
F. The findings in this Resolution are made based on the entire administrative record including testimony and evidence presented to the City Council at its May 11, 2026, regular meeting including, without limitation, the staff report submitted by the Finance Director.
SECTION 2. Environmental Assessment. The City reviewed the environmental impacts of the Project under the California Environmental Quality Act (Public Resources Code §§ 21000, et seq. “CEQA”) and the regulations promulgated thereunder (14 Cal.
Code of Regs. §§ 15000, et seq., the “CEQA Guidelines”). CEQA Guidelines §§ 15060(c)(2), 15061(b)(3), and 15378 exempt activities that will not result in a direct or reasonably foreseeable indirect physical change in the environment, activities where there is possibility that it may have a significant effect on the environment, and activities that do not constitute a “project” as defined, respectively. This Resolution is for general policies and procedure-making. Any subsequent expenditures will be evaluated separately under the CEQA Guidelines. Accordingly, this Resolution is exempt from further review.

City of Bellflower
Resolution No. 26-16
SECTION 3. Action. Pursuant to Government Code § 50053, the City Council:
A. Declares the unclaimed monies on the attached Exhibit “A,” which is incorporated by reference, in the total amount of $55,853.23 escheated to the City; and B. Authorizes and directs the City Manager, or designee, to transfer the escheated funds totaling $55,853.23 to the City’s General Fund’s cash account.
SECTION 4. Limitations. The City Council’s analysis and evaluation of the project is based on the best information currently available. It is inevitable that in evaluating a project that absolute and perfect knowledge of all possible aspects of the project will not exist. One of the major limitations on analysis of the project is the City Council’s lack of knowledge of future events. In all instances, best efforts were made to form accurate assumptions. Somewhat related to this are the limitations on the City's ability to solve what are in effect regional, state, and national problems and issues. The City must work within the political framework within which it exists and with the limitations inherent in that framework.
SECTION 5. Summaries of Information. All summaries of information in the findings, which precede this section, are based on the substantial evidence in the record.
The absence of any particular fact from any such summary is not an indication that a particular finding is not based in part on that fact.
SECTION 6. Construction. This Resolution must be broadly construed to achieve the purposes stated in this Resolution. It is the City Council’s intent that the provisions of this Resolution be interpreted or implemented by the City and others in a manner that facilitates the purposes set forth in this Resolution.
SECTION 7. Severability. If any part of this Resolution or its Application is deemed invalid by a court of competent jurisdiction, the City Council intends that such invalidity will not affect the effectiveness of the remaining provisions or applications and, to this end, the provisions of this Resolution are severable.
SECTION 8. Electronic Signatures. This Resolution may be executed with electronic signatures in accordance with Government Code §16.5. Such electronic signatures will be treated in all respects as having the same effect as an original signature.
SECTION 9. The Mayor, or presiding officer, is authorized to affix its signature to this Resolution signifying its adoption by the City Council of the City of Bellflower, and the City Clerk, or its duly appointed deputy, is directed to attest.
SECTION 10. Effective Date. This Resolution will become effective immediately upon adoption and will remain effective unless repealed or superseded. ///
