15-J
TO:Honorable Mayor and Members of the City Council
ATTENTION:Ryan Smoot, City Manager
FROM:Len Gorecki, Assistant City Manager/Director of Public Works Kimberly Gonzalez, Public Works Coordinator
SUBJECT:Consideration and possible action to adopt Resolution No. 26-19 – A Resolution of the City of Bellflower electing to withdraw from the Uniform Public Construction Cost Accounting Act and repealing Resolution No. 20-59.

DATE:May 26, 2026

EXECUTIVE SUMMARY
The proposed Resolution would declare the City’s intent to withdraw from the Uniform Public Construction Cost Accounting Act (“UPCCAA”) and repeal Resolution No. 20-59 in its entirety.

RECOMMENDATION TO CITY COUNCIL
1) Adopt Resolution No. 26-19; or
2) Alternatively, discuss and take other action related to this item.

FISCAL IMPACT
The City should not experience any fiscal impacts based on its election to withdraw from UPCCAA as the City has previously established purchasing procedures that govern public works projects under Bellflower Municipal Code (BMC) Chapter 3.30.

DISCUSSION
On August 24, 2020, the City adopted Resolution No. 20-59 electing to participate in UPCCAA and adopted Ordinance No. 1400 adding BMC Chapter 3.30 increasing the thresholds for the City Manager’s spending authority and ability to use informal bidding procedures on public works projects as defined in Public Contract Code § 22002 (c).

On November 5, 2024, the voters approved Measure B which adopted the City Charter for the City of Bellflower. BMC Chapter 3.30 was amended to implement the City’s Charter and removed all references to UPCCAA. To withdraw from the UPCCAA, Public Contract Code § 22030 allows the City to adopt a resolution during a public meeting stating its intent to withdraw and then filing an approved copy with the State Controller’s Office. The Public Works Director recommends that the City Council adopt Resolution No. 26-19 to formally withdraw from UPCCAA.
