B Consideration and possible action to conduct a public hearing to consider The Medicine Woman Group, LLC's appeal of the City Manager's decision to revoke Cannabis Business Permit No. CUP CU-CAN 17-12.
City Manager Smoot introduced the item.
Assistant to the City Manager Lee 1) gave a PowerPoint presentation providing an overview of the Staff Report; and 2) responded to Council Members' questions along with City Manager Smoot, Director of Finance Garan, and City Attorney Berger.
Following discussion, it was moved by Council Member Koops, seconded by Council Member Morse, and carried without objection, to open the public hearing.
Edward Pinchiff, Legal Counsel Medicine Woman Group LLC (Mr. Pinchiff), 1) provided details regarding the appeal of the revocation of The Medicine Woman Group, LLC's (TMW) cannabis business permit, including procedural concerns regarding the City's determination of an imminent threat to public welfare and substantive concerns regarding the taxation of cannabis tax amounts on non -cannabis goods; 2) requested that the appeal be granted, the permit revocation be reversed, TMW be allowed to pay its current taxes, and the tax dispute be resolved through the Superior Court while allowing the business to remain open; and 3) noted that there would not be any testimony or witnesses, as this is primarily a legal issue.
At the request of Mayor Pro Tern Sanchez, Mr. Pinchiff clarified that the disputed tax amount was approximately $57,000 and that TMW was prepared to pay its current taxes, estimated at approximately $40,000, if allowed to do so without first paying the disputed amount.
At the request of Mayor Santa Ines, Mr. Pinchiff clarified that TMW was unable to pay both the disputed and current tax amounts, and stated that TMW was willing to remain current on its undisputed taxes if the City would apply payments toward the current amount.
At the request of Mayor Pro Tem Sanchez, 1) Assistant to the City Manager Lee clarified that the undisputed amount referenced pertained to the first quarter taxes (January through March 2026); and 2) City Manager Smoot clarified that the exact amount of the undisputed first-quarter taxes could not yet be determined because TMW had not filed its report, but estimated the amount at approximately $40,000 based on previous quarters, and the disputed amount related to the audit and associated penalties was approximately $57,000.
At the request of Council Member Koops, 1) City Manager Smoot provided details regarding prior audits of cannabis operators and clarified that the City regularly conducts such audits, confirmed that the current dispute involved whether non -cannabis items sold by cannabis operators were subject to the cannabis business tax and the City Council previously considered and determined the disputed amount was due; and 2) Director Garan provided details regarding the 2023 audit of TMW, noting that the audit found unpaid tax on tax, which was subsequently paid, clarifying that the 2023 audit did not include the issue of taxes on non -cannabis items, making this a new issue with the current audit.

B Consideration and possible action to conduct a public hearing to consider The Medicine Woman Group, LLC's appeal of the City Manager's decision to revoke Cannabis Business Permit No. CUP CU-CAN 17-12 — Continued City Manager Smoot 1) clarified that the City Council upheld the Tax Administrator's determination on May 11, 2026, finding the disputed amounts immediately due; and 2) noted that, after TMW failed to respond to the City's payment notice, he determined there was an imminent threat to public welfare and revoked its cannabis business permit, which was the decision under this appeal.
At the request of Mayor Pro Tern Sanchez, City Attorney Berger clarified that 1) the City had not been served with a writ regarding the matter before the Superior Court and had only received a litigation hold; and 2) the hearing on the agenda concerns whether the City Manager's decision to revoke Medicine Woman's cannabis business permit should be upheld.
Fred Taylor, resident, 1) requested clarification regarding whether the tax rate for non -cannabis items is the same as the tax rate for cannabis items; and 2) expressed the opinion that the audio in the room was very poor and it was difficult for him to hear.
In response to comments provided by Fred Taylor, City Manager Smoot 1) provided details regarding the City's cannabis business tax, noting that it is an
8.5% tax on the gross receipts of cannabis operations and is imposed on cannabis operators for the privilege of operating in Bellflower; and 2) explained that TMW had not paid the approximately $57,000 in taxes determined to be due through the audit or its subsequent quarterly taxes, which contributed to his determination that there was an imminent threat to the public welfare and that the cannabis business permit should be revoked.
There being no one else in attendance wishing to present further testimony, it was moved by Council Member Koops, seconded by Council Member Morse, and carried without objection, to close the public hearing.
Following discussion, it was moved by Council Member Koops, seconded by Mayor Santa Ines, and unanimously carried by the following roll call vote, to uphold the City Manager's decision to revoke Cannabis Business Permit No. CUP CU-CAN 17-12 issued to The Medicine Woman Group, LLC:

At the request of Council Member Dunton, Matthew Jones 1) stated that the Artesia location, which had previously been a bank, opened in less than 75 days after the building plans were approved because the site already had a safe room and front counter space; and 2) stated that he did not want to provide an incorrect estimate about the timeframe for obtaining the state license, but could speak to the building -related timeline within his area of expertise.

At the request of Mayor Santa Ines, City Manager Smoot 1) explained how the tax guarantee would be affected by the timing of the businesses' openings and was based on the portion of the 12-month permit period during which each business would be open; and 2) stated that an operator open for a longer period would generally have a higher guaranteed amount and noted that the applicants would be responsible for explaining how they calculated their respective guarantees.

For the record, Mayor Santa Ines 1) recommended continuing the matter to the next meeting to allow the applicants time to complete the required Live Scan and fingerprinting, and provide complete applications; and 2) expressed concern regarding the incompleteness of the applications and hoped the required Live Scan and fingerprinting could be completed expeditiously.
For the record, City Manager Smoot recommended continuing both public hearings to the next City Council meeting on July 13, 2026.
Courtney Caron, Herb's Diner, 1) stated that she understood the Live Scan requirement but explained that, at the time of the application, her client had not yet identified the individual who would serve as manager; 2) stated that the individuals identified in the application had completed their Live Scans and that the newly identified manager would be required to complete one before managing the business; 3) expressed the opinion that the application was not incomplete due to the addition of a new team member; 4) requested clarification regarding Off the Charts' projected opening timeline, including the time needed for the City to approve and stamp building plans, the subsequent buildout period, and the State's licensing process; and 5) stated that the overall timeline remained unclear and should account for each of these steps.
For the record, City Manager Smoot 1) explained that, under the adopted resolution, ownership includes individuals with a 25 percent or greater interest in the business and individuals participating in the direction, control, or management of the permit; 2) stated that questions remained regarding the applicants' compliance with these requirements, supporting a continuance of the item; 3) regarding the opening timeline, explained that the City Council established the guarantee process to account for the time needed for an applicant to open; and 4) noted that if an applicant did not open, the purpose of the guarantee was to ensure the City still received the guaranteed revenue.
