SUBJECT:Consideration and possible action to conduct a public hearing to consider delinquent refuse service charges and adopt Resolution No. 26-27 – A Resolution ordering delinquent refuse service charges be assessed against the property owners and properties and such charges be transferred to the County tax rolls.

EXECUTIVE SUMMARY
This action would allow testimony to be heard for and against ordering delinquent refuse service charges to be assessed against the property owners and properties, and such charges be transferred to the County tax rolls for collection with the annual property tax assessment. This action would also approve the transfer of the list of properties with delinquent refuse service charges to the Los Angeles County Auditor-Controller (L.A. County).
RECOMMENDATION TO CITY COUNCIL
1) Open the public hearing; take testimonial and documentary evidence; after considering the evidence, adopt Resolution No. 26-27; or 2) Alternatively, discuss and take other action related to this item.
FISCAL IMPACT
As of July 1, 2026, there were 425 delinquent accounts totaling $118,167.31 owed to CR&R, Inc. (CR&R). The City retains 10% of the delinquent amount collected as an administrative fee to help offset the costs associated with processing the direct assessment.
PUBLIC NOTICE
On June 12 and July 3, 2026, a Public Hearing Notice was published in the Los Cerritos Community News; and on June 8, 2026, a Public Hearing Notice was posted at City Hall, Brakensiek Library, Bellflower Substation, Caruthers Park, Simms Park, Thompson Park and Public Works Yard.

Staff Report – Public Hearing Delinquent Refuse Service Charges July 13, 2026
BACKGROUND
Refuse service charges are delinquent if they are past due for more than 30 days.
Bellflower Municipal Code (BMC) Section 13.24.240 sets forth the procedure for the collection of delinquent refuse service charges and penalties. Each year, a list of delinquent customers is generated by CR&R for the period ending May 31st.
The process requires notification of the owners, occupants, or patrons of the property to which such delinquency applies, followed by a public hearing to consider transferring delinquent charges to L.A. County for collection with annual property tax assessments.
CR&R provided the City with a list of delinquent accounts as of June 8, 2026. The responsible parties were notified of the delinquencies via a letter mailed by CR&R on June 12, 2026, and a letter mailed by the City on June 25, 2026. The City also published and posted a Notice of Public Hearing.
As of June 8, 2026, there were 605 delinquent accounts for a total delinquent amount of $152,985.66; and as of July 1, 2026, those figures were reduced to 425 accounts for a total of $118,167.31.
CR&R will be accepting delinquent account payments until July 23, 2026. The Public Works Department will then process and submit the direct assessment to L.A. County by August 10, 2026. Responsible parties who pay their delinquent refuse service charges in full prior to the City’s transmittal to L.A. County will be removed from the lien list.

RESOLUTION NO. 26-27
A RESOLUTION ORDERING DELINQUENT REFUSE SERVICE
CHARGES BE ASSESSED AGAINST THE PROPERTY OWNERS AND
PROPERTIES AND SUCH CHARGES BE TRANSFERRED TO THE
COUNTY TAX ROLL
THE CITY COUNCIL RESOLVES AS FOLLOWS:
SECTION 1.Recitals. The City Council finds and declares as follows:
A. Charges for solid waste and recyclable material collection are set by the City Council through the provisions of the applicable franchise for solid waste and recyclable material collection.
B. The City is party to Franchise Agreement File No. 399.2 with CR&R, Incorporated (CR&R), which requires CR&R to provide solid waste services.
C. The properties listed in attached Exhibit “A,” which is incorporated by reference, are served by CR&R. The customers responsible for paying charges for such solid waste services have not paid CR&R the amounts owed.
D. The City took all actions required by Bellflower Municipal Code (BMC) § 13.24.240 to collect these outstanding amounts, including providing written notice in June 2026 to occupants and property owners with delinquent accounts regarding their past due amounts.
E. In accordance with BMC § 13.24.240, the City gave notice of a public hearing to be held on July 13, 2026, regarding all delinquent accounts.
F. The City Council held a public hearing on July 13, 2026, to determine whether the delinquent charges set forth in Exhibit A should be transferred to the Los Angeles County tax rolls in accordance with BMC § § 13.24.240(D).
G. This Resolution is adopted based upon the evidence submitted during the public hearing including, without limitation, all documents on the record and public testimony.
H. This Resolution is adopted based upon the evidence submitted during the July 13, 2026, City Council meeting including, without limitation, all documents presented to the City Council and public testimony.
SECTION 2.Approval/ Amendment/ Adoption/ Authorization & Direction. The delinquent charges in Exhibit A are valid and constitute a personal obligation of the customer and a lien against the listed properties where the customer and property owner are the same. The City Manager, or designee, is authorized to take such action as is required to collect such delinquent amounts including, without limitation, forwarding these amounts to the Los Angeles County Auditor-Controller’s Office to be included on the County tax rolls.

SECTION 3.Preservation. This Resolution does not affect any penalty, forfeiture, or liability incurred before, or preclude prosecution and imposition of penalties for any violation occurring before, this Resolution’s effective date. Any such amended part will remain in full force and effect for sustaining action or prosecuting violations occurring before the effective date of this Resolution.
SECTION 4.Limitations.The City Council’s analysis and evaluation of the project is based on the best information currently available. It is inevitable that in evaluating a project that absolute and perfect knowledge of all possible aspects of the project will not exist. One of the major limitations on analysis of the project is the City Council’s lack of knowledge of future events. In all instances, best efforts were made to form accurate assumptions. Somewhat related to this are the limitations on the City's ability to solve what are in effect regional, state, and national problems and issues. The City must work within the political framework within which it exists and with the limitations inherent in that framework.
SECTION 5.Reliance On Record. Each and every one of the findings and determinations in this Resolution are based on the competent and substantial evidence, both oral and written, contained in the entire record relating to the project. The findings and determinations constitute the independent findings and determinations of the City Council in all respects and are fully and completely supported by substantial evidence in the record as a whole.
SECTION 6.Summaries of Information.All summaries of information in the findings, which precede this section, are based on the substantial evidence in the record.
The absence of any particular fact from any such summary is not an indication that a particular finding is not based in part on that fact.
SECTION 7.Construction. This Resolution must be broadly construed to achieve the purposes stated in this Resolution. It is the City Council’s intent that the provisions of this Resolution be interpreted or implemented by the City and others in a manner that facilitates the purposes set forth in this Resolution.
SECTION 8.Severability. If any part of this Resolution or its Application is deemed invalid by a court of competent jurisdiction, the City Council intends that such invalidity will not affect the effectiveness of the remaining provisions or applications and, to this end, the provisions of this Resolution are severable.
SECTION 9.Electronic Signatures. This Resolution may be executed with electronic signatures in accordance with Government Code §16.5. Such electronic signatures will be treated in all respects as having the same effect as an original signature.
SECTION 10. The Mayor, or presiding officer, is authorized to affix its signature to this Resolution signifying its adoption by the City Council of the City of Bellflower, and the City Clerk, or its duly appointed deputy, is directed to attest. -4-

SECTION 11.Effective Date. This Resolution will become effective immediately upon adoption and will remain effective unless repealed or superseded.

NOTICE OF PUBLIC HEARING TO CONSIDER DIRECTING SUBMITTAL
OF DELINQUENT SOLID WASTE BILLINGS TO THE COUNTY OF LOS
ANGELES FOR COLLECTION WITH THE ANNUAL PROPERTY TAX
ASSESSMENT
NOTICE IS HEREBY GIVEN that a Public Hearing will be held by the Bellflower City Council to consider directing submittal of all solid waste billings delinquent for 30 days or more to the County of Los Angeles for collection with the annual property tax assessment. The Public Hearing will be held on Monday, July 13, 2026, at 7 p.m., in the City Hall Council Chambers, 16600 Civic Center Drive, Bellflower, California.
Testimony will be heard for and against directing submittal of delinquent solid waste billings to the County of Los Angeles for collection with the annual property tax assessment. Also, any person interested may make written protest or objection. Such written protest or objection shall be signed by the person protesting or objecting and delivered to the City Clerk before the end of the subject public hearing. Timely received written testimony will be submitted as evidence for the Public Hearing. Oral testimony may be presented at the appropriate time during the Public Hearing.
Copies of the staff report, the proposed resolution, and attachments may be inspected by the public in the Public Works Department, City Maintenance Yard, 9944 Flora Vista Street, Bellflower, California. Questions should be addressed to Melanie Paz, Management Analyst II, at (562) 804-1424, ext. 2283 .
If you wish to challenge this matter in court, then you may be limited to raising only those issues you or someone else raised at the Public Hearing described in this notice, or in written correspondence timely delivered to the City Clerk for submission at the Public Hearing.
