FROM: Brian McNerney, Director of Public Safety
SUBJECT: Consideration and possible action to conduct a public hearing to consider adopting Resolution No. 26-37 – A Resolution to record a Notice of Special Assessment for Nuisance Abatement for the property located at 17440-17450 Bellflower Boulevard (APN 7161- 008-011).
DATE: September 28, 2026
EXECUTIVE SUMMARY
Pursuant to Bellflower Municipal Code (“BMC”) §§ 1.12.060 and 8.36.200, the City may recover abatement costs by recording a nuisance abatement lien upon real property.
Public nuisance on the vacant lot property located at 17 440-17450 Bellflower Boulevard has been abated by the City. As a result, the City incurred a total of $42,913.66 (which includes legal fees). The property owner has been provided with an Abatement Cost Demand and an opportunity to either remit payment to the City or formally contest the costs incurred. The City timely received from the property owner a request to appeal that demand, which will be heard by the City Council immediately prior to consideration of this Resolution.
RECOMMENDATION TO CITY COUNCIL
It is recommended that the City Council consider the following:
1) Open the public hearing; take testimonial and documentary evidence; and after considering the evidence, adopt Resolution No. 26-37 imposing a public nuisance abatement lien and special assessment on the property located 17440-17450 Bellflower Boulevard (APN 7161-008-011) to recover the City’s costs abatement; or
2) Alternatively, discuss and take other action related to this item.
FISCAL IMPACT
The City will record a public nuisance abatement lien to recover $42,913.66 in abatement costs. In addition to the lien, the amount will be added to the property tax roll as a special assessment against the property described in the Resolution.

Staff Report – Notice of Special Assessment for Nuisance Abatement at 17440–17450 Bellflower Blvd.
September 28, 2026
BACKGROUND & DISCUSSION
I. Nuisance Enforcement, Abatement and Cost Recovery, Generally.
The BMC authorizes the City to engage in nuisance abatement, or issue administrative citations, when private property owners refuse to voluntarily clean up their properties. Abatement costs include the time spent and actions performed to achieve abatement of public nuisances, whether such abatement is performed directly by the City or by the property owner as a result of the City’s enforcement efforts.
Government Code § 38773.5 and BMC § 8.36.200 allow the City to place a nuisance abatement lien upon real property to recover any unpaid enforcement/abatement costs incurred by the City. Any change in the title of the property due sale or refinancing, for example, will trigger payment to the City. Additionally, the City may impose a special assessment on a property that collected with property tax payments. If unpaid after three years, the property would be subject to non-judicial foreclosure procedures to recover the abatement costs.
II. 17440-17450 Bellflower Blvd. (APN 7161-008-011)
17440-17450 Bellflower Blvd. (the “Property”) is a commercial property consisting of two adjoining buildings adjacent to the old JC Penny property to the North and AutoZone to the South. 17440 operated as a church and 17450 housed Hard Times Billiards prior to the purchase of the property by the current owners 17450 Bellflower Blvd., LLC (the “Property Owner”) around 2021. The current owner originally purchased the Property for use as a cannabis business, but was unable to secure the necessary permits. It has remained vacant to this day.
The Property had long fallen into disrepair and blight subject to the City’s Code Enforcement efforts even before the church and Hard Times had vacated around 2021.
In 2022, Code Enforcement specifically observed that the parking lot was deteriorated, the front windows were cracked and broken, vegetation was overgrown in the rear of the Subject Property, signage appeared abandoned, and the exterior was generally dilapidated and a blight to the community.
An inspection of the interior of the Property in August 2022 revealed trespassers were occupying the property and had precariously wired into the existing electrical system presenting an immediate threat to the Property and public safety. Furthermore, the roof was in disrepair and leaking, resulting in substantial mold contamination. Subsequent inspections revealed that the entire roof was unsafe and needed replacement with structural remediation. There were also indications of fire damage in 17440, likely caused by the trespassers. All of these conditions amounted to public nuisances in violation of the BMC.

Staff Report – Notice of Special Assessment for Nuisance Abatement at 17440–17450 Bellflower Blvd.
September 28, 2026
BACKGROUND & DISCUSSION – Continued
The City attempted to gain voluntary compliance from the Property Owner to abate these conditions and secure the Property from trespassers as calls for service regarding unauthorized occupation continued. By March 2023, conditions had worsened to the point that the Building Official issued a “red tag” to the Property prohibiting any occupation and directed Southern California Edison to cut its power at the poll.
On or about March 21, 2023, the City Attorney’s Office issued a Notice of Public Nuisance and Intent to Abate with City Personnel, to which the Property Owner promptly appealed. A public nuisance administrative hearing was held on May 23, 2023, in which the hearing officer sustained the public nuisance violations alleged by the City and verbally initiated specific benchmarks of compliance with status hearings beginning on July 6, 2023.
A total of nine such administrative status hearings were held between May 23, 2023 and October 28, 2025, each with the administrative hearing officer revising his deadlines, none of which were ever met. A tenth “final” hearing was originally scheduled for January 8, 2026, but was continued to March 2026 to allow additional time for the Property Owner to comply with the hearing officer’s orders. While there were still remaining “punch list’ items required for full compliance, the City Attorney’s Office and Code Enforcement staff determined in March 2026 that the state of the Property was close enough to compliance to excuse further involvement (and associated cost) of the administrative hearing officer. Upon being advised of this, the hearing officer issued on April 15, 2026, a final order which deemed the Property to be in substantial compliance with his orders of abatement and ordered that the Property Owner remit to the City it’s costs of securing abatement of the Property in an amount to be determined.
III. Abatement Cost Demand
On or about August 19, 2026, the City Attorney’s Office and Code Enforcement staff determined that the final “punch list” items were finally in substantial compliance with the City’s overall abatement efforts and timely issued to the Property Owner a deman d for its abatement costs pursuant to BMC § 8.36.180, to which the Property Owner timely filed an notice of appeal. Further review of the hearing officer costs revealed some of the invoices were attributable to other properties and certain entries had been duplicated in that demand. On September 22, 2026, the City Attorney’s Office presented the Property Owner’s counsel with a Revised Abatement Cost Demand (the “Demand”) which updated the hearing officer costs and provided additional documentation regarding City staff time.

Staff Report – Notice of Special Assessment for Nuisance Abatement at 17440–17450 Bellflower Blvd.
September 28, 2026
BACKGROUND & DISCUSSION – Continued
The total abatement costs demanded by the City totals $42,913.66 as follows:
City Attorney1 22,744.30
City Staff 12,494.36
Hearing Officer 7,675.00
Grand Total: $42,913.66
The Property Owner timely submitted a request to appeal this Demand. That appeal hearing will immediately precede or may be combined with presentation of this Resolution. Accordingly, these costs may require adjustment depending on the City Council’s findings regarding the Property Owner’s appeal.
The Property Owner is contesting the Demand on several grounds, most notably objecting to the redaction of descriptions to the City Attorney’s individual billing entries.
These attorney billing record descriptions are protected as privileged attorney -client communications per statute and pursuant to Los Angeles County Board of Supervisors v.
Superior Court (2016) 2 Cal.5th 282, where in case like this involving active disputes and pending court actions such disclosures would reveal privileged communications and litigation strategy. That privilege can only be waived by the City Council, which it has not done.
Resolution No. 26-37 seeks reimbursement of the City’s abatement-related costs of $42,913.66 (or in another amount as determined by the City Council) by authorizing recording a nuisance abatement lien against the Property as well imposing a special assessment to recover these costs with property tax payments. A nuisance abatement lien remains an encumbrance on the Property to be paid when there is a title change recorded with the Property, such as it being sold or refinanced. If any portion of the special assessment remains unpaid after three years, the Property would be subject to non - judicial foreclosure procedures to recover any outstanding abatement costs.

Resolution No. 26-37............................................................................................... 5
1 In November 2023, the City Attorney’s Office filed a civil enforcement action against the Property after the administrative process appeared to be ineffective. That lawsuit was subsequently withdrawn based on ownership demonstrating better compliance with abatement efforts and to avoid the uncertainty of litigation. All costs attributable to that civil action have been specifically excluded from this Demand. -4-

D. On or about March 21, 2023, the City Attorney’s Office issued a Notice of Public Nuisance and Intent to Abate with City Personnel to the Property Owner for various violations of Chapter 8.36 of the Bellflower Municipal Code after repeated attempts at voluntary compliance proved ineffective. The Property Owner timely requested an appeal of the Notice of Public Nuisance;

G. While there were still remaining “punch list’ items required for full compliance, the City Attorney’s Office and Code Enforcement staff determined in March 2026 that the state of the Property was close enough to compliance to excuse further involvement (and associated cost) of the administrative hearing officer.
H. On April 15, 2026, the hearing officer issued a final order which deemed the Property to be in substantial compliance with his orders of abatement and ordered that the Property Owner remit to the City it’s costs of securing abatement of the Property in an amount to be determined.

On September 22, 2026, the City Attorney’s Office presented the Property Owner’s counsel with a Revised Abatement Cost Demand (the “Demand”) which updated the abatement costs incurred by the City totaling $42,913.66.
These costs are comprised of $22,744.30 in City Attorney fees, $12,494.36 of City Staff time, and $7,675.00 in administrative hearing officer invoices.
J. The Property Owner timely filed a notice of appeal contesting the City’s Demand for its abatement costs. That appeal hearing will immediately precede or may be combined with presentation of this Resolution. Accordingly, these costs may be adjusted according to the City Council’s findings regarding the Property Owner’s appeal; and
K. Pursuant to Government Code § 38773.5 and Bellflower Municipal Code Chapter 8.36, the City may recoup its abatement related costs by recording a lien against the Property and impose a special assessment on the Property to be collected with property tax payments.
SECTION 2. Approval. The City Council approves, confirms and adopts the Statement of Costs attached as Exhibit “A,” and incorporated by reference, and determines that each such charge is proper and correct.
